CIRCULAR
Regarding the guidance on implementing Document No. 192/CP-KTTH dated February 29, 2000 of the Government concerning the management of rice exports and fertilizer imports
On the management of rice exports and fertilizer imports for the year 2000; on February 29, 2000, the Prime Minister issued Document No. 192/CP-KTTH to direct certain issues in the management work;
 
Following Decision No. 237/1999/QĐ-TTg dated December 24, 1999 on the management of rice exports and fertilizer imports for the year 2000; on February 29, 2000, the Prime Minister issued Document No. 192/CP-KTTH to direct certain issues in the management work;
The Ministry of Trade provides specific guidance on Points 3 and 4 of the aforementioned Document No. 192/CP-KTTH as follows:
 
I. ON RICE EXPORTS:
1. Adjusting and supplementing the export rice agencies:
a/ Enterprises meeting all the following conditions will be considered for permission to act as export rice agencies:
Having a business registration certificate for foodstuffs and having had a history of trading in foodstuffs for three years or more.
Having registered for enterprise code at the Customs authority.
Having sound financial status.
Having the ability to mobilize capital for exporting a minimum of 5,000 tons of rice per shipment.
Having rice milling and processing facilities that meet export standards.
b/ Enterprises meeting the above conditions shall submit the following documents to the Ministry of Trade requesting to become export rice agencies:
A proposal letter from the People's Committee of the province, Ministry, or managing agency of the enterprise (confirmed by the Chairman of the People's Committee of the province or city; the leadership of the Ministry or managing agency that the enterprise meets the conditions to act as an export rice agency as stipulated in this document).
The enterprise's request letter.
Business registration (a certified copy).
Certificate of enterprise code registration for import and export (a certified copy).
Audited settlement report for the years 1998-1999 confirmed by an independent professional auditing organization in accordance with current state regulations on independent auditing.
Report on the system of rice milling and processing facilities for export of the enterprise (confirmed by the managing agency).
c. Enterprises not meeting the conditions to continue acting as export rice agencies:
Unable to find export markets;
Unprofitable operations;
Failure to comply with regulations on budget payments and other financial regulations.
Based on the above criteria, the Ministry of Trade will decide specifically on adjusting or supplementing enterprises acting as export rice agencies when requested by the People's Committees of provinces or cities, Ministries, or managing agencies of the enterprises.
3. Reporting System:
Export enterprises must implement the reporting system as stipulated in Decision No. 0248/1999/QĐ-BTM dated March 11, 1999 (guidance on implementing Decision No. 20/1999/QĐ-TTg dated February 13, 1999 of the Prime Minister). The Standing Management Team is responsible for compiling reports from enterprises to report to the Ministry of Trade and the Ministry of Agriculture and Rural Development.
II. ON FERTILIZER IMPORTS:
1. To help the Steering Committee take timely measures in case of fluctuations in supply and demand in the world and domestic markets, it is required that export agencies strictly adhere to the monthly reporting system. Reports must be submitted to the Ministry of Trade, the Ministry of Agriculture and Rural Development, and the Standing Management Team before the 5th of each month. The report format is attached as Appendix (Form No. 1).
2. Enterprises meeting the following conditions will be considered for permission to participate in fertilizer imports:
Business registration including the import of fertilizers or agricultural production materials
The company has registered for enterprise code at the Customs authority as prescribed.
Having a distribution network for fertilizers established in accordance with the law
The company's financial situation is sound; having the ability to mobilize capital and pay for imported goods a minimum of 50,000 tons of fertilizer per year.
Enterprises meeting the above conditions and wishing to import fertilizers shall submit the following documents to the Ministry of Trade:
A proposal letter from the People's Committee of the province (signed and stamped by the Chairman or Deputy Chairman of the province or city; signed by the leadership of the Ministry).
A proposal letter from the company (attached Form No. 2).
Audited settlement report for the year 1999 confirmed by an independent professional auditing organization in accordance with current state regulations on independent auditing.
Report on the domestic distribution system for fertilizers (confirmed by the managing agency).
Business registration (a certified copy).
Certificate of enterprise code registration for import and export (a certified copy).
3. Based on the conditions stated in Section 2 above, the Ministry of Trade will make specific decisions on adjusting or supplementing, or removing from the list of main import fertilizer agencies when requested by the People's Committees of provinces or cities, Ministries, or managing agencies of the enterprises.
4. For special fertilizers (bio-fertilizers, foliar fertilizers, etc.) not produced domestically but permitted for use in Vietnam, enterprises with appropriate business registration may import according to their production and business needs.
For chemical raw materials used in the production of compound fertilizers, enterprises already registered for production, quality certification, and product labeling in accordance with current regulations may directly import according to their production needs.
The Ministry of Trade requests the People's Committees of centrally governed municipalities, Ministries, agencies equivalent to Ministries, and central agencies of mass organizations to notify and instruct subordinate enterprises to implement accordingly./.
