Regarding the regime and policies for the families of non-commissioned officers and soldiers on active duty

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Military Service Law dated December 30, 1981; the Law Amending and Supplementing Certain Articles of the Military Service Law dated December 21, 1990; the Law Amending and Supplementing Certain Articles of the Military Service Law dated June 22, 1994; the Law Amending and Supplementing Certain Articles of the Military Service Law dated June 14, 2005;
Based on the Education Law dated June 14, 2005;
Considering the proposal of the Minister of National Defense.
DECREE:
Article 1. Applicability
This Decree stipulates the regime and policies for the families of non-commissioned officers and soldiers during their period of active service, including: father, mother; wife or husband; legitimate children, adopted children of non-commissioned officers and soldiers serving on active duty.
Article 2. Rights of the families of non-commissioned officers and soldiers on active duty
1. Students who are children (legitimate children, legally adopted children) of non-commissioned officers and soldiers on active duty are exempt from tuition fees when studying at state-run preschools and general education schools.
2. The families of non-commissioned officers and soldiers on active duty shall be entitled to emergency hardship allowances, specifically as follows:
a) Emergency hardship allowance in cases where the family of non-commissioned officers and soldiers on active duty suffer accidents, fires, natural disasters; father, mother; wife or husband; legitimate children, legally adopted children are sick for one month or more, or hospitalized for 15 days or more, shall receive an allowance of VND 300,000 per person per occurrence; not exceeding two occurrences in a year;
b) Emergency hardship allowance in cases where father, mother; wife or husband; legitimate children, legally adopted children die; the allowance amount is VND 600,000.
3. Relatives of non-commissioned officers and soldiers on active duty, including: father, mother; wife or husband; legitimate children, legally adopted children shall implement the health insurance regime according to current regulations. The monthly health insurance contribution rate for one person is 3% of the national minimum wage as prescribed by the Government at the time of purchasing the health insurance card; the general health insurance card is valid for two years.
Article 3. 1. The funding for determining the degree of disability and issuing the Disability Confirmation Certificate is allocated in the annual budget estimate of the commune in accordance with the State Budget Law and guiding documents.
The financial resources to implement the regimes stipulated in this Decree shall be guaranteed by the State budget in accordance with the provisions of the State Budget Law.
Article 4. Implementation Provisions
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Finance, the Ministry of Health, and relevant ministries and sectors to guide the implementation of this Decree; prepare budgets and pay emergency hardship allowances, purchase and issue health insurance cards for relatives of non-commissioned officers and soldiers on active duty as prescribed in this Decree.
2. The Ministry of Finance shall be responsible for coordinating with the Ministry of National Defense in the work of preparing and implementing the State budget according to the provisions of the State Budget Law to ensure the implementation of the regimes and policies stipulated in this Decree.
3. The Chairman of the People's Committee of provinces and centrally-administered cities shall be responsible for directing and organizing the implementation of the tuition fee exemption regime prescribed in this Decree within their respective jurisdictions.
4. Persons belonging to the category specified in Article 1 of this Decree shall cease to enjoy the regimes and policies when non-commissioned officers and soldiers cease to serve on active duty, die, or are stripped of their military rank due to disciplinary violations.
5. Those who engage in acts that distort or forge documents shall be subject to disciplinary action or criminal prosecution and must compensate for any losses (if any) in accordance with the law.
Article 5. Effectiveness
This Decree shall take effect fifteen days after its publication in the Official Gazette.
Article 6. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
