Guidelines for managing and using administrative expenses to implement policies supporting poor households with housing

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 67/2010/QĐ-TTg dated October 29, 2010 of the Prime Minister on amending and supplementing certain provisions of Decision No. 167/2008/QĐ-TTG of the Prime Minister on housing support policies for poor households;

The Ministry of Finance hereby issues guidelines for managing and using administrative expenses to implement Decision No. 67/2010/QĐ-TTg dated October 29, 2010 of the Prime Minister as follows:

- Relending agency: Vietnam Development Bank (VDB).

These Circulars provide guidance on the management and use of administrative expenses to implement housing support policies for poor households pursuant to Decision No. 67/2010/QĐ-TTg dated October 29, 2010 of the Prime Minister on amending and supplementing certain provisions of Decision No. 167/2008/QĐ-TTG of the Prime Minister on housing support policies for poor households.

Article 4. Scope of Application:

These Circulars apply to agencies and organizations involved in activities related to the management and implementation of housing support policies for poor households under Decision No. 167/2008/QĐ-TTG and Decision No. 67/2010/QĐ-TTG of The Prime Minister.

Article 3. Principles of Management:

1. Administrative expenses for implementing housing support policies for poor households must be strictly managed by organizations and agencies, expended according to regulations, for their intended purposes, ensuring efficiency and thrift in state budget expenditures.

2. Administrative expenses for implementing housing support policies for poor households shall be implemented from the date Decision No. 67/2010/QĐ-TTg takes effect (December 25, 2010).

Article 4. Contents of Administrative Expenses for Implementing Housing Support Policies for Poor Households:

1. Expenses for publicizing housing support policies for poor households: The amount of expenditure is determined according to current regulations on publicity and dissemination of laws.

2. Expenses for office supplies; printing forms, lists of poor households eligible for housing support; purchasing books, materials serving management work: The amount of expenditure is reimbursed based on actual costs within the approved budget.

3. Expenses for surveys, reviews, and statistics of data on target groups: The content and amount of survey and investigation expenses are carried out in accordance with Circular No. 58/2011/TT-BTC dated May 11, 2011 of the Ministry of Finance on managing, using, and settling accounts for expenses for conducting surveys and statistics.

4. Expenses for supporting the application of information technology to serve the management of files and target groups: The content and amount of expenditure are determined according to current regulations on managing and using funds for the application of information technology in state agency operations.

5. Expenses for training, professional development, mid-term and final evaluations: The content and amount of expenditure are determined according to current regulations on training and professional development for civil servants and the system of expenses for organizing meetings and training sessions for state agencies and public service units.

6. Expenses for reviewing applications for housing support for poor households: Based on actual circumstances and within the budget estimate for managing the housing support program for poor households, the People's Committees of provinces and centrally-administered cities shall decide on specific amounts that are appropriate.

7. Expenses for purchasing, repairing assets, equipment, and means of transportation to serve the management of target groups: Such expenses are carried out according to current regulations on tendering and procurement of assets to maintain the regular operation of state agencies with state funds.

8. Expenses for fuel and communication: The amount of expenditure is based on valid invoices and receipts.

9. Other rental expenses to serve payment and management activities: The amount of expenditure is carried out according to contracts, receipt notes, or invoices (in cases of service rentals).

10. Other expenses related to policy implementation activities.

Article 5. On sources and levels of funding for implementation:

The People's Committees of provinces and centrally governed cities shall proactively allocate local budgets to manage and implement housing support policies for poor households with a maximum level not exceeding 0.5% of the total state budget support costs and policy bank loans as prescribed for policy implementation.

Article 6. Preparation, execution of budget estimates and settlement of funds:

The preparation, execution of budget estimates, and settlement of accounts for funds shall be carried out according to current regulations, this Circular provides detailed guidance as follows:

1. Allocation and assignment of budget estimates:

a) Based on the management funds allocated from the local budget for implementing housing support policies for poor households, the People's Committee of the province or centrally governed city shall decide to approve the allocation plan for management funds and assign them to the Department of Finance to notify the management funds to relevant agencies and organizations at the provincial level and supplement targeted funds to the district budget. Based on the management funds assigned by the provincial People's Committee, the district People's Committee shall decide on the allocation of management funds and assign them to the Planning and Finance Office to notify the management funds to relevant agencies and organizations and each commune within its jurisdiction.

b) Based on the assigned funds, the People's Committee of the commune and units using the funds shall prepare budget estimates according to current expenditure standards and regulations stipulated in this Circular, categorizing the budget estimates by expense items and submitting them to financial authorities and State Treasury for coordinated expenditure as prescribed. The commune People's Committee shall open a separate account for managing and settling these funds with the district budget, without including them in the commune budget.

2. Execution of budget estimates and settlement of funds:

a) When a unit using management funds incurs budget expenditures, it must prepare vouchers in accordance with regulations and submit them to the State Treasury at the same level to execute the withdrawal of budget estimates.

b) The State Treasury has the responsibility to verify the legality and validity of vouchers and payment orders issued by the head of the unit using the funds, ensuring timely and correct payments to the units using the funds.

c) Agencies and units allocated management funds for implementation shall settle the funds they have used with financial authorities in accordance with current regulations.

Article 7. Implementation organization:

1. This Circular takes effect from August 28, 2011.

2. During implementation, if there are difficulties or obstacles, the provinces and centrally governed cities are requested to report to the Ministry of Finance for consideration and resolution./.
