on approving the planning of defense land managed by border guard forces

throughout the country

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Land Law dated July 14, 1993;

Pursuant to Decree No. 09/CP dated February 12, 1996 of the Government on the regime for managing and using defense and security land;

Considering the proposal of the Ministry of National Defense (Proposal No. 2925/QP dated September 18, 1998) and the General Department of Land Administration (Proposal No. 1975 TC/TCDC dated November 6, 1998),

DECISION:

Article 1.

1. Approves the defense land managed and used by the Border Guard Forces at 1,296 locations with an area of 2,874.24 hectares for the following purposes:

a) Land for units stationed: 1,144 locations with an area of 2,271.44 hectares.

b) Land for naval bases and other military bases: 6 locations with an area of 11.61 hectares.

c) Land for defensive works: 29 locations with an area of 81.42 hectares.

d) Land for military ports: 7 locations with an area of 10.58 hectares.

đ) Land for industrial, scientific, and technological facilities serving national defense and economic integration: 7 locations with an area of 17.51 hectares.

e) Land for warehouses of armed forces: 14 locations with an area of 61.37 hectares.

g) Land for shooting ranges and training grounds: 42 locations with an area of 213.18 hectares.

h) Land for building schools, hospitals, and rest homes for armed forces: 37 locations with an area of 108.34 hectares.

i) Land for other national defense construction projects: 10 locations with an area of 98.77 hectares.

The area and location of defense land managed by the Border Guard Forces are distributed across provinces and centrally-administered cities as follows:

The specific details of each location and area within each province are determined by the Ministry of National Defense, the General Department of Land Administration, and the People's Committees of the provinces and centrally-administered cities.

2. The Ministry of National Defense is responsible for directing the Border Guard Forces to transfer management of 42 family areas with an area of 27.14 hectares in various provinces and centrally-administered cities to the provincial and municipal authorities:

The specific details of each family area within each province are determined by the Ministry of National Defense, the General Department of Land Administration, and the People's Committees of the provinces and centrally-administered cities.

3. The Ministry of National Defense directs the Border Guard Command to transfer 23 locations with an area of 372.68 hectares, which were identified as surplus through the review of the planning, including:

The specific details of each location within each province and centrally-administered city are determined by the Ministry of National Defense, the General Department of Land Administration, and the People's Committees of the provinces and centrally-administered cities.

4. During the process of managing and using defense land, the Ministry of National Defense and the People's Committees of the provinces and centrally-administered cities may negotiate adjustments to the location and area of defense land to align with national defense tasks and socio-economic development needs of each locality, subject to approval by the Prime Minister.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentBased on Article 1 of this Decision, the Ministry of National Defense and the People's Committees of the provinces and centrally-administered cities shall be responsible for:

1. For the Ministry of National Defense:

- Jointly with the People's Committees of the provinces and centrally-administered cities to resolve outstanding issues and clearly define the boundaries of land managed by the Border Guard Forces;

- Surveying and determining the area of each location;

- Managing and using land according to its approved purpose and boundaries.

- Transferring family areas mentioned in Clause 2, Article 1 of this Decision to local management and transferring surplus defense land identified through planning review mentioned in Clause 3, Article 1 of this Decision to the Government.

- When there is a need to request the State to allocate land for national defense purposes, it must comply with the provisions of the Land Law.

2. For the People's Committee of provinces and cities where Border Guard units are stationed, they are responsible for:

- Implementing state management over land that has been designated for national defense purposes within their local administrative areas;

- Issuing land use right certificates to the Border Guard based on the Prime Minister's approval of the national defense land planning and the Ministry of National Defense's Decision on the location of military units or construction sites.

Article 3. The Minister of National Defense, the Director of the General Department of Land Administration, the Chairpersons of the People's Committees of centrally governed cities and provinces, the Commanders of Border Guard Commands, and the Heads of relevant agencies shall be responsible for implementing this Decision.
