PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Government Decree No. 38/CP dated June 4, 1993 on the functions, tasks, powers, and organization of the Ministry of Justice;

To enhance the dissemination and popularization of laws widely among cadres and the people, creating conditions for compliance with and supervision of the enforcement of laws, policies, and systems of the State;

At the proposal of the Minister of Justice,

DECISION:

Article 1. Approve the Project on Construction and Management of Legal Bookshelves at Communes, Wards, and Towns with the following contents:

I. OBJECTIVES OF THE PROJECT

1. General Objective: Implement the construction and management of legal bookshelves at all communes, wards, and towns nationwide according to Decision No. 69/1998/QĐ-TTg dated March 31, 1998 of the Government Prime Minister, with appropriate steps and measures suitable to practical conditions and the specific characteristics of each region; thereby serving as a basis for maintaining and developing legal bookshelves at communes, wards, and towns in subsequent years.

2. Immediate Objective: Within three years, from 1999 to 2001, basically construct legal bookshelves at all communes, wards, and towns nationwide based on a model consisting of at least four parts of books, newspapers, and legal documents as follows:

- A part comprising regulatory legal documents including: the official gazette; collections of regulatory legal documents issued by localities; some specialized books systematizing regulatory legal documents directly related to the people and local authorities;

- A part comprising general legal books including: question-and-answer books, commentaries, and explanations of laws regarding citizens' rights and obligations; pamphlets for disseminating and popularizing laws;

- A part comprising books guiding administrative and judicial work at the grassroots level;

- A part comprising central and local legal newspapers.

II. GUIDING PRINCIPLES

1. Legal bookshelves must be constructed according to unified models for each type of locality based on selectively absorbing and developing good experiences while considering trends in information technology development during industrialization and modernization.

2. The construction and management of legal bookshelves must be integrated into overall measures to strengthen legal education and promote democracy at the grassroots level, contributing to enhancing citizens' understanding of laws and their capacity to exercise democratic rights.

3. Carry out the construction of legal bookshelves on a wide scale combined with pilot guidance to draw lessons and improve the implementation of this task.

III. TASKS OF THE PROJECT

1. Construct and manage legal bookshelves at communes, wards, and towns suitable for each type of locality.

The Ministry of Justice shall be responsible for constructing and guiding the common model of legal bookshelves at communes, wards, and towns, taking into account the specific characteristics of each type of locality nationwide; act as the focal point, compile a list of legal documents and books to be printed within six months or one year to supply to localities; compile materials guiding administrative and judicial work at the grassroots level; coordinate with relevant agencies to study and publish special legal newspapers to serve state management and judicial work at the grassroots level.

2. Collect, systematize, print, and distribute quarterly or monthly regulatory legal documents of various levels of local authorities.

The Ministry of Justice shall coordinate with the Government Office to guide provincial Departments of Justice to assist People's Committees of provinces and cities in implementing this task.

3. Guide the operation and management of legal bookshelves for specialized judicial staff at communes, wards, and towns.

The Ministry of Justice shall coordinate with the Ministry of Culture and Information to compile materials and organize training sessions for staff of provincial Departments of Justice.

4. The Ministry of Justice shall coordinate with relevant ministries and sectors to organize pilot guidance with the aim of promptly evaluating and focusing on models of legal bookshelves in each type of locality, thereby drawing lessons to continue guiding this work.

IV. IMPLEMENTATION PLAN AND BUDGET FOR THE PROJECT

1. Implementation Plan: The project will be implemented over three years from 1999 to 2001 and divided into the following phases:

a) In 1999, conduct pilot construction of legal bookshelves while simultaneously initiating the construction of legal bookshelves nationwide;

Compile and publish some general legal books and books guiding administrative and judicial work at the grassroots level;

Train and enhance library skills for specialized judicial staff at communes, wards, and towns.

b) From 2000 to 2001: Maintain, consolidate, and develop legal bookshelves constructed in 1999;

Continue to train and enhance library skills for specialized judicial staff at communes, wards, and towns.

2. Budget for Implementation:

Estimated total budget (projected): 52 billion VND over three years (from 1999 to 2001);

Where:

- From commune, ward, and town budgets: 51 billion VND (average 4.6 million VND per commune over three years);

- From central budget: 1 billion VND over three years.

Article 2. Implementation

1. The Ministry of Justice shall be responsible for leading and coordinating with relevant ministries and sectors to implement the project in accordance with their respective functions and tasks;

The Ministry of Justice shall coordinate with the Ministry of Finance to prepare annual budget plans to implement this project;

The Ministry of Finance shall guide People's Committees of communes, wards, and towns to prepare annual budget estimates and balance commune budgets for constructing and maintaining legal bookshelves in accordance with the provisions of the State Budget Law.

2. People's Committees of provinces and centrally-administered cities shall have plans to organize and implement the construction and maintenance of legal bookshelves at communes, wards, and towns.

Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city authorities are responsible for implementing this Decision./.
