THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

The Government issues this Decree on mechanisms and policies to encourage forest protection, encirclement and regeneration of forests, afforestation, development of non-timber forest products, and increased income in connection with policies to quickly reduce poverty, sustainably and to support ethnic minority groups during the period 2015-2020.

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Considering the proposal of the Director of the Forest Protection Department,

DECISION:

Article 1. Amending and supplementing some provisions of the Management and Stamping Regulations for Timber and Forest Inspection issued together with Decision No. 44/2006/QĐ-BNN dated June 1, 2006 of the Minister of Agriculture and Rural Development, as follows:

1. Supplementing the provision on "other special marks" in Article 7, Clause 2, Point a of Decision No. 44/2006/QĐ-BNN and amending it as follows:

"Imported round timber is considered lawful if it does not bear a forest inspection stamp or other special marks of the exporting country.

Other special marks of the exporting country referred to in this Decision include cases where labels made of different materials (plastic, alloy, paper) are affixed to the ends of imported round timber, indicating the serial number and dimensions of the log that correspond to the log list in the import documentation."

In the case of a consignment of imported round timber subject to forest inspection stamping, which includes logs of various diameters (including those smaller than 25 cm), if the importer requests that all logs be stamped, then the Forest Protection Department will stamp the entire consignment according to the importer's request."

2. Supplementing the end of Article 7, Clause 2, Point b of Decision No. 44/2006/QĐ-BNN as follows:

"Timber that is evidence of a violation of the law and has been decided upon by a competent state agency in accordance with the law."

3. Amending the provision on the location for stamping forest inspection stamps for imported round timber in Article 9, Clause 2, Point c of Decision No. 44/2006/QĐ-BNN as follows:

"c) Location for stamping forest inspection stamps for imported round timber

For imported round timber transported by road: the location for stamping forest inspection stamps is the legal processing facility or wood storage of the importer after completing customs procedures on Vietnamese territory at the first place where the timber is unloaded. The importer must notify the Forest Protection Sub-department at the entry point and the Forest Protection Sub-department at the location of the legal processing facility or wood storage (if the entry point and the legal processing facility or wood storage are not located within the same province or centrally governed city) about the first unloading site. The Forest Protection Sub-department at the location of the legal processing facility or wood storage shall organize the stamping of forest inspection stamps.

For imported timber transported by water: if the timber is transported separately, the location for stamping forest inspection stamps is the first port where the timber is unloaded onto land after completing customs procedures. The importer must notify the Forest Protection Sub-department at the port of unloading to organize the stamping of forest inspection stamps. If imported round timber is contained in containers and transported further to the legal processing facility or wood storage after completing customs procedures, the importer must notify the Forest Protection Sub-department at the port of timber importation and the Forest Protection Sub-department at the location of the legal processing facility or wood storage (if the port of timber importation and the legal processing facility or wood storage are not located within the same province or centrally governed city). The Forest Protection Sub-department at the location of the legal processing facility or wood storage shall organize the stamping of forest inspection stamps.

In areas without a Forest Protection Department, the importer must notify the Regional Forest Protection Department to organize the stamping of forest inspection stamps."

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Head of the Ministry’s Office, Heads of Departments, Directorates, Institutes, Schools related to this matter; Directors of Regional Forest Protection Departments; Directors of Provincial Departments of Agriculture and Rural Development, Forest Protection Sub-departments of provinces and centrally governed cities; organizations and individuals concerned are responsible for implementing this Decision.
