Amending Point c, Clause 2, Article 1 of Circular No. 40/2011/TT-BTC dated March 22, 2011 of the Ministry of Finance amending and supplementing certain provisions
of Circular No. 108/2007/TT-BTCdated September 7, 2007 of the Ministry of Finance guiding the financial management mechanism
for official development assistance (ODA) programs and projects

- Law on Public Debt Management;
- Decree No. 79/2010/NĐ-CP dated July 14, 2010 of the Government on public debt management operations;
- Decree No. 131/2006/NĐ-CP dated November 9, 2006 of the Government promulgating the Regulation on the management and use of official development assistance (ODA) sources;
- Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;
- Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
- The guidance opinion of the Prime Minister in Official Letter No. 3497/VPCP-QHQT dated May 30, 2011 of the Government Office regarding the amendment of the content of Circular No. 40/2011/TT-BTC of the Ministry of Finance guiding the financial management mechanism for ODA programs and projects;
The Ministry of Finance amends Point c, Clause 2, Article 1 of Circular No. 40/2011/TT-BTC dated March 22, 2011 of the Ministry of Finance amending and supplementing a point of Circular No. 108/2007/TT-BTC dated September 7, 2007 of the Ministry of Finance guiding the financial management mechanism for official development assistance (ODA) programs and projects as follows:
Article 1. Amends Point c, Clause 2, Article 1 of Circular No. 40/2011/TT-BTC as follows:
"c) Selection of banks to serve:
- Based on the list of banks meeting the criteria to be serving banks published by the State Bank of Vietnam in coordination with the Ministry of Finance, and the proposal of commercial banks and the agency in charge of negotiating specific international treaties on ODA, such agencies shall consider and approve the selection of serving banks for ODA projects and notify the negotiating partners accordingly.
- In cases where multiple commercial banks meet the conditions and propose to serve the same ODA project, priority shall be given to the following banks: banks with experience in serving ODA projects; state-owned commercial banks; joint-stock commercial banks in which the state holds a controlling stake."
Article 2. Implementation:
1. This Circular takes effect from September 1, 2011.
2. During the process of implementation, if there are any difficulties, agencies are requested to promptly report to the Ministry of Finance for guidance and coordination in resolving them./.
