RESOLUTION

GUIDELINES FOR DETERMINING THE PROJECTED STRUCTURE, COMPOSITION, AND ALLOCATION OF THE NUMBER OF PERSONS TO BE NOMINATED

 FOR CANDIDATES FOR MEMBERS OF PEOPLE'S COUNCILS AT ALL LEVELS FOR THE 2026-2031 TERM

IN ORDER TO ENSURE THE SELECTION OF CANDIDATES FOR MEMBERS OF PEOPLE'S COUNCILS AT ALL LEVELS FOR THE 2026-2031 TERM

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;

Pursuant to the Law on Election of Deputies to the National Assembly and Members of People's Councils No. 85/2015/QH13, as amended and supplemented by Law No. 83/2025/QH15;

Pursuant to Resolution No. 199/2025/QH15 dated May 21, 2025 of the National Assembly on shortening the term of the 15th National Assembly and People's Councils at all levels for the 2021-2026 term; the date of election of deputies to the 16th National Assembly and members of People's Councils at all levels for the 2026-2031 term;

RESOLUTION:

Article 1. The number of members of People's Councils at all levels for the 2026-2031 term

1. The determination of the number of members of People's Councils to be elected in each administrative unit shall be based on the provisions of the Law on Organization of Local Administration and the following bases:

a) The population of each administrative unit serving as the basis for determining the number of members of People's Councils to be elected shall be determined according to the population statistics in the National Population Database as of August 31, 2025;

b) The identification of communes in mountainous and island areas as the basis for determining the number of members of People's Councils at commune level to be elected shall be based on the documents and decisions of competent state agencies. The Ministry of Ethnic Affairs and Religion is responsible for identifying communes in mountainous areas; the Ministry of Home Affairs is responsible for identifying communes in island areas for the election of members of People's Councils at all levels for the 2026-2031 term.

The Ministry of Ethnic Affairs and Religion and the Ministry of Home Affairs shall announce the identification of communes in mountainous and island areas on the website of the National Election Committee no later than November 1, 2025.

2. The number of Vice Chairpersons of People's Councils, Deputy Heads of People's Councils at provincial and commune levels, and the allocation of full-time members of People's Councils at provincial and commune levels for the 2026-2031 term shall be implemented in accordance with the provisions of Resolution No. 106/2025/UBTVQH15 dated October 16, 2025 of the National Assembly Standing Committee on the number of Vice Chairpersons of People's Councils, Deputy Heads of People's Councils at provincial and commune levels, and the allocation of full-time members of People's Councils at provincial and commune levels.

Article 2. Structure, composition, and allocation of the number of persons to be nominated as candidates for members of People's Councils at all levels for the 2026-2031 term

1. Based on the number of members of People's Councils to be elected, the principle of ensuring a surplus when compiling the list of candidates for members of People's Councils as stipulated in Clause 3, Article 58 of the Law on Election of Deputies to the National Assembly and Members of People's Councils, the Standing Body of the People's Council at provincial level, after reaching consensus with the Standing Body of the Vietnam Fatherland Front and the People's Committee at the same level, shall specifically project the structure, composition, and allocation of the number of persons from political organizations, political-social organizations, social organizations, military units, state agencies at their own level, lower-level administrative units, and public institutions, economic organizations on the territory to be nominated as candidates for members of the People's Council at provincial level.

2. Based on the number of members of People's Councils to be elected, the principle of ensuring a surplus when compiling the list of candidates for members of People's Councils as stipulated in Clause 3, Article 58 of the Law on Election of Deputies to the National Assembly and Members of People's Councils, the Standing Body of the People's Council at commune level, after reaching consensus with the Standing Body of the Vietnam Fatherland Front and the People's Committee at the same level, shall specifically project the structure, composition, and allocation of the number of persons from political organizations, political-social organizations, social organizations, military units, state agencies at their own level, villages, hamlets, ấp, bản, phum, sóc (hereinafter referred to collectively as village), residential wards, neighborhoods, khóm (hereinafter referred to collectively as residential ward), and public institutions, economic organizations on the territory to be nominated as candidates for members of the People's Council at commune level.

3. The projection of the structure, composition, and allocation of the number of persons to be nominated as candidates for members of People's Councils in each administrative unit must ensure democracy, fairness, objectivity, transparency; focus on quality, selecting candidates who are outstanding in character, morality, reputation, intelligence; while ensuring a reasonable structure regarding the number of members working in political organizations, political-social organizations, social organizations, military units, state agencies at their own level and lower-level administrative units (for provincial level), villages, residential wards (for commune level), and public institutions, economic organizations on the territory; increase the number of full-time members; have a reasonable proportion of representatives from religions, ethnic groups, genders, ages, scientists, intellectuals, artists, candidates originating from workers, farmers, entrepreneurs, and associations, trade unions in production and business, and meet the following requirements:

a) Ensuring a reasonable proportion of candidates from ethnic minorities in the official list of candidates for members of People's Councils that is consistent with the characteristics, ethnic structure, and specific situation of each locality and striving to achieve the expected election rate;

b) Female candidates, ensuring a minimum ratio of 35% in the official list of candidates for members of People's Councils at each level; striving to achieve an election rate of about 30% of the total number of members of People's Councils at each level;

c) Candidates outside the Party, striving to achieve a minimum ratio of 10% in the official list of candidates for members of People's Councils at each level;

d) Young candidates (under 40 years old), striving to achieve a minimum ratio of 15% in the official list of candidates for members of People's Councils at each level;

e) Members of People's Councils for the 2021-2026 term re-elected, striving to achieve a minimum ratio of 30% at each level.

Article 3. Implementation Provisions

1. This resolution takes effect from the date of its adoption.

2. The Government, the Central Committee of the Vietnam Fatherland Front, People's Councils, People's Committees, the Standing Committee of the Vietnam Fatherland Front at provincial and commune levels, and related agencies and organizations shall be responsible for implementing this Resolution.

3. The National Ethnic Committee, the Committees of the National Assembly, the Delegations of the National Assembly of the provinces and cities, and the Members of the National Assembly, within their respective duties and authorities, shall supervise the implementation of this Resolution.

This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, Session 50, on October 16, 2025.
