Regulations on certain allowances for those participating in the prevention and control of the A(H1N1) influenza pandemic

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;
Considering the proposal of the Minister of Health and the Minister of Finance,
DECISION:
Article 1. Scope and Applicability
1. Allowances for anti-pandemic duty and 24/24-hour standby duty against the A(H1N1) influenza for:
a. Civil servants, public officials, employees, and workers under labor contracts at public health facilities and medical personnel in the armed forces.
b. Civil servants, public officials, and employees of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza in Humans.
2. Allowances for volunteers participating in the prevention and control of the A(H1N1) influenza.
3. Training and simulation exercises for preventing and controlling the A(H1N1) influenza.
4. Regulations applicable to individuals suspected of having A(H1N1) influenza and patients with A(H1N1) influenza.
Civil servants, public officials, employees, and workers under labor contracts from relevant agencies participating in the prevention and control of the A(H1N1) influenza at international border gates such as Customs, Security, and Border Guard shall be subject to the allowances stipulated in Clause 1 and Clause 2 of this Article.
Article 2. Duration of allowance application for those participating in the prevention and control of the A(H1N1) influenza
1. The period before the outbreak of the disease in Vietnam is calculated from April 25, 2009, when the World Health Organization announced the A(H1N1) influenza pandemic, until May 30, 2009, and the period after Vietnam declared the end of the A(H1N1) influenza pandemic but the disease was still present in some countries around the world.
2. The period during which the disease occurred in Vietnam is calculated from May 31, 2009, when the first case was reported, until the announcement of the end of the A(H1N1) influenza pandemic.
Article 3. Levels of anti-pandemic allowances and 24/24-hour standby duty allowances and levels of allowances for participation in the prevention and control of the A(H1N1) influenza as stipulated in Clause 1 of Article 2 of this Decision.
1. Apply an anti-pandemic allowance of VND 60,000/person/day for civil servants, public officials, employees, and workers under labor contracts at public health facilities and medical personnel in the armed forces who are mobilized to international border gates to directly monitor incoming persons from infected areas, monitor suspected cases of A(H1N1) influenza; directly collect samples or come into contact with samples; directly test samples to serve diagnostic and treatment follow-up work; directly transport samples or suspected cases of A(H1N1) influenza.
2. Apply a 24/24-hour standby duty allowance of VND 40,000/person/session for civil servants, public officials, employees, and workers under labor contracts at public preventive healthcare facilities, preventive healthcare units of district health centers (where there are not yet sufficient conditions to separate hospitals); medical personnel at preventive healthcare facilities in the armed forces; civil servants, public officials, and employees of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza in Humans assigned by the Steering Committee to stand by for 24/24 hours against the A(H1N1) influenza.
Volunteers participating in the prevention and control of the A(H1N1) influenza:
a. Apply an allowance of VND 50,000/day/person for volunteers directly or collaboratively participating in anti-pandemic activities as stipulated in Clause 1 of this Article.
b. Apply an allowance of VND 30,000/day/person for volunteers directly involved in disseminating information, distributing leaflets, and mobilizing the public to participate in the prevention and control of the A(H1N1) influenza.
c. The Head of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza decides the number of volunteers needed based on the specific development of the epidemic and the workload required.
4. The duration of entitlement to allowances is calculated based on the actual number of days participating in anti-pandemic activities or standing by for 24/24 hours.
5. The Heads of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza in Humans and the Heads of health facilities tasked with implementing anti-pandemic activities for the A(H1N1) influenza are responsible for confirming the specific number of beneficiaries and the duration of entitlement to the allowances and subsidies mentioned above.
Article 4. The level of allowance for epidemic prevention work, 24/24 hours on-duty allowance for epidemic prevention work, and the level of compensation for epidemic prevention against influenza A(H1N1) as stipulated in Clause 2, Article 2 of this Decision
1. Officials, civil servants, public employees, and workers under labor contracts at public health facilities and medical personnel directly performing tasks such as diagnosis, treatment, care, and monitoring of patients with influenza A(H1N1) or suspected cases thereof; directly supervising people entering from epidemic areas at international border gates; directly supervising suspected cases; directly collecting samples or coming into contact with samples; directly testing samples to serve diagnostic and monitoring purposes; directly performing disinfection and decontamination tasks at epidemic sites and healthcare facilities with influenza A(H1N1) patients; directly handling sample transportation and patient transport for those with influenza A(H1N1) or suspected cases thereof; the Anti-Epidemic Steering Committees at all levels going to direct epidemic prevention work at epidemic sites shall enjoy the following epidemic prevention allowance levels:
a. For working days during the week: the allowance received is VND 185,000/person/day.
b. For weekend days (Saturday, Sunday): the allowance received is VND 240,000/person/day.
c. For holidays and Tet: the allowance received is VND 330,000/person/day.
2. Officials, civil servants, public employees, and workers under labor contracts at preventive healthcare facilities, preventive healthcare departments of district health centers (where there are not yet sufficient conditions to separate hospitals); medical personnel at preventive healthcare facilities under military forces and officials, civil servants, and public employees under the Anti-Pandemic Steering Committees at all levels assigned to perform 24/24 hours on-duty epidemic prevention work against influenza A(H1N1) shall enjoy the following 24/24 hours on-duty epidemic prevention allowance against influenza A(H1N1):
a. For working days during the week: the allowance received is VND 124,000/person/session.
b. For weekend days (Saturday, Sunday): the allowance received is VND 160,000/person/session.
c. For holidays and Tet: the allowance received is VND 220,000/person/session.
3. Collaborators and volunteers participating in epidemic prevention work against influenza A(H1N1) during the epidemic period shall enjoy the following compensation levels:
a. Apply an allowance compensation level of VND 100,000/day/person for collaborators and volunteers directly or collaboratively participating in epidemic prevention activities against influenza A(H1N1) as stipulated in Clause 1 of this Article.
b. Apply an allowance compensation level of VND 60,000/day/person for collaborators and volunteers directly involved in propaganda, distributing leaflets, and mobilizing the public to participate in preventing and controlling influenza A(H1N1).
c. The Head of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza decides the number of volunteers needed based on the specific development of the epidemic and the workload required.
4. The duration of entitlement to allowances is calculated based on the actual number of days participating in anti-pandemic activities or standing by for 24/24 hours.
5. The Heads of the Central and local-level Steering Committees for Preventing and Controlling Pandemic Influenza in Humans and the Heads of health facilities tasked with implementing anti-pandemic activities for the A(H1N1) influenza are responsible for confirming the specific number of beneficiaries and the duration of entitlement to the allowances and subsidies mentioned above.
Article 5. Regulations on training and simulation exercises for epidemic prevention against influenza A(H1N1)
1. To be applied according to the current regulations on travel expenses, domestic conference fees, and training and capacity building costs for state officials and civil servants to organize specialized training courses on prevention and control of influenza A(H1N1).
2. Participants in simulation exercises shall enjoy a simulation exercise allowance of VND 70,000/day/person (including water and light meals).
3. Participants in simulation exercises and training during the epidemic period who must go to the field in epidemic areas, epidemic sites, or healthcare facilities with influenza A(H1N1) patients, in addition to the travel expenses, domestic conference fees, and training and capacity building costs for state officials, civil servants, and public employees as stipulated, shall also enjoy the epidemic prevention allowance specified in Clause 1 of Article 4 of this Decision for the number of days spent in the field.
Article 6. Regulations on the treatment regime for individuals suspected of having A(H1N1) influenza and patients with A(H1N1) influenza
1. Patients with A(H1N1) influenza shall be exempted from hospital fees in accordance with Clause 2 of Article 48 of the Law on Prevention and Control of Infectious Diseases.
2. Hospital fees and related expenses (including food and transportation costs) shall be exempted for individuals suspected of having A(H1N1) influenza and required to undergo medical examination according to professional medical standards for monitoring and isolation.
3. Funeral expenses shall be supported in cases of death due to A(H1N1) influenza in accordance with professional medical procedures.
Article 7. Sources of funds for implementing certain benefits for individuals participating in the fight against A(H1N1) influenza as stipulated in this Decision
1. Ministries, sectors, and localities shall allocate within their 2009 budget estimates, local budget reserve funds, and additional local government revenue in 2009 (if any).
2. Financial reserve funds, sources of fundraising from organizations and individuals in accordance with the law, and legitimate income of units.
3. In cases where ministries, sectors, and localities cannot balance sufficient sources, they must submit a written report to the Ministry of Finance for consolidation and submission to the Prime Minister for decision.
4. Customs, Security, and Border Guard agencies shall be responsible for allocating within their operational budgets to pay for the subjects specified in Point 5 of Article 1 of this Decision.
Article 8. Effective Date
This Decision takes effect from the date of issuance and shall be applied from April 25, 2009.
Article 9. Responsibility for implementation
Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the central city, and Heads of relevant agencies are responsible for implementing this Decision./.
