CIRCULAR

Guidelines for financial measures to prevent, control brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in southern provinces (from Da Nang southward)

Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister on policies to support prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in southern provinces (from Da Nang southward);

The Ministry of Finance hereby provides guidance as follows.

I- GENERAL PROVISIONS

1. The subjects eligible for state budget funding for the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice include:

a) Households of farmers with winter-spring rice crop 2006-2007 areas affected by brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease who must spray plant protection chemicals and destroy their crops according to regulations of the Ministry of Agriculture and Rural Development.

b) Forces participating in the prevention and control of outbreaks and monitoring the destruction of infected rice areas.

2. The period during which the state budget will provide support to the subjects mentioned in Clause 1, Part I of this Circular shall be from October 1, 2006 until the competent state authority announces the end of the outbreak.

II- SPECIFIC PROVISIONS

1. Content and level of support for work related to the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice as stipulated in Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister include:

a) Funding for purchasing plant protection chemicals provided by the state budget or drawn from the National Reserve Fund to support households of farmers according to point a, Clause 1, Article 1 of Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister.

b) Allowance for those directly involved in preventing and controlling diseases and supervising the destruction of infected rice areas at a rate of VND 50,000 per person per working day and VND 100,000 per person per non-working day. Based on local circumstances, the Chairman of the People's Committee of the province or centrally governed city decides on specific expenditure levels for these participants.

c) Training costs for those assigned to participate in the prevention and control of outbreaks according to training and instruction regulations and expenditure systems issued by the provincial or centrally governed city People's Committee pursuant to Circular No. 118/2004/TT-BTC dated December 18, 2004 of the Ministry of Finance regarding travel expenses and conference expenditure systems for administrative agencies and public service units nationwide.

d) Costs for propaganda and organizing the implementation of prevention and control of outbreaks: Based on local conditions and current expenditure standards, the Chairman of the People's Committee of the province or centrally governed city decides on specific recipients and expenditure levels and is responsible for such decisions.

2. Direct support to households of farmers with winter-spring rice crop 2006-2007 areas affected by rice yellow dwarf disease and rice stripe disease that must be destroyed according to guidelines of the Ministry of Agriculture and Rural Development at a rate of VND 2 million per hectare of destroyed rice.

The area of destroyed rice must be confirmed by the local commune authorities, the local state management agency for plant protection, and relevant units as the basis for payment of support. Based on guidelines of the Ministry of Agriculture and Rural Development and local conditions, the Chairman of the People's Committee of the province or centrally governed city specifies the responsibilities of entities participating in the destruction of infected rice areas.

3. Provide 12 kilograms of rice per person per month to alleviate hunger for households of farmers suffering losses due to brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease; the maximum support period is six months. Based on local conditions, the Chairman of the People's Committee of the province or centrally governed city decides on specific recipients and support periods for households of farmers.

4. Sources of funds to ensure the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice:

a) The central budget supplements the local budget to support 100% of the cost of purchasing plant protection chemicals for the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice; direct support costs for households of farmers with destroyed rice areas as specified in point a, Clause 1 and Clause 2, Part II of this Circular.

b) Local budgets ensure:

- Funding for organizing and directing implementation, propaganda, and training for those assigned to participate in the prevention and control of outbreaks and supervision of the destruction of infected rice areas, allowances for those directly involved in preventing and controlling diseases as specified in point b, c, and d, Clause 1, Part II of this Circular.

- Funding for purchasing rice to alleviate hunger for households of farmers suffering losses due to brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease as specified in Clause 3, Part II of this Circular. In cases where local budgets face difficulties, the Chairman of the People's Committee of the province or centrally governed city reports to the Ministry of Finance for consolidation and submission to the Prime Minister for consideration and decision to draw rice from the National Reserve to support localities in alleviating hunger for households of farmers.

c) Ho Chi Minh City uses its local budget to ensure the implementation of tasks specified in Clause 1, 2, and 3, Part II of this Circular.

5- The establishment, determination, allocation, and settlement of budgets to ensure the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice shall be carried out in accordance with the State Budget Law and guiding documents.

6- Reporting system:

Monthly and at the end of each outbreak period, the Chairman of the Provincial People's Committee directs relevant agencies to compile and report on the situation and results of prevention and control of outbreaks; the amount of funds spent to ensure the prevention and control of brown planthopper outbreaks, rice yellow dwarf disease, and rice stripe disease in rice (details according to sources, expenditure levels, and specific expenditure items attached in the form), report to the Ministry of Finance and the Ministry of Agriculture and Rural Development to determine the level of support from the central budget for each province and centrally governed city and to consolidate and report to the Prime Minister on the results of implementation.

III- IMPLEMENTATION ORGANIZATION

1. The People's Committees of provinces and centrally governed cities shall be responsible for:

a) Directing the Department of Finance to coordinate with the Department of Agriculture and Rural Development and relevant agencies to determine the financial needs to ensure the work of preventing and controlling brown planthopper outbreaks, rice yellow dwarf disease, and rice stunt disease, and to develop financial plans to implement them. At the same time, they shall report to the People's Committee of the province or centrally governed city to proactively utilize local budget funds, central government support funds, and other lawful financial sources to promptly meet the financial requirements for preventing and controlling brown planthopper outbreaks, rice yellow dwarf disease, and rice stunt disease in accordance with this Circular.

b) Directing departments, branches, and People's Committees at all levels to effectively carry out the work of preventing and controlling brown planthopper outbreaks, rice yellow dwarf disease, and rice stunt disease; to use the financial resources serving the prevention and control of diseases efficiently, for their intended purposes, and for the appropriate beneficiaries; directing People's Committees at all levels, especially those at the commune level, to cooperate with relevant agencies in the locality to publicly disclose state support policies; the quantity of plant protection chemicals used in the commune; the level of support provided to households of farmers whose rice areas were destroyed before and after the decision on support was made by the competent authority through mass media, in the commune, in villages, and posted at the offices of the People's Committee of the commune and in villages in accordance with Circular No. 54/2006/TT-BTC dated June 19, 2006, issued by the Ministry of Finance guiding the implementation of regulations on publicizing direct support from the budget for individuals and residents.

2. This Circular shall take effect fifteen days from the date of publication in the Official Gazette. During the implementation process, if there are difficulties, they are requested to be reported to the Ministry of Finance for consideration and appropriate amendments./.
