Regulations on functions, tasks, powers, and organizational structure

of the Vietnam Academy of Social Sciences society Vietnam

WHEREAS the Law on the Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on the Organization of the Government and the Law on the Organization of Local Authorities dated November 22, 2019;

WHEREAS Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government stipulates about agencies under the Government;

WHEREAS Decree No. 47/2019/NĐ-CP dated June 5, 2019 of the Government amends and supplements certain provisions of Decree No. 10/2016/NĐ-CP dated February 1, 2016 stipulating about agencies under the Government;

Pursuant to the proposal of the Minister of Science and Technology;

The Government promulgates this Decree to stipulate the functions, tasks, powers, and organizational structure of the Vietnam Academy of Social Sciences.

Article 1. Position and Functions

1. The Vietnam Academy of Social Sciences is an agency under the Government, performing the function of researching fundamental issues in social sciences; providing scientific grounds for the Party and State in formulating policies, strategies, plans, and development plans to serve rapid and sustainable development of the country in accordance with socialist orientation; advising on policies for development in the field of social sciences; training high-level human resources in social sciences in accordance with the law.

Article 2. The Vietnam Academy of Social Sciences has the international trade name in English as: Vietnam Academy of Social Sciences, abbreviated as VASS.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. On strategy, programs, and plans

a) Submitting to the Government and the Prime Minister the strategy, long-term, five-year, and annual programs and plans, important projects and proposals of the Vietnam Academy of Social Sciences and organizing their implementation after approval.

b) Participating in scientific assessment of important projects and proposals in the field of social sciences at the request of the Government and the Prime Minister.

Point c. Deciding on investment projects within the authority of the Vietnam Academy of Social Sciences according to the provisions of the law.

2. Researching theoretical and practical issues in social sciences

a) Reforming and perfecting the political system; enhancing the leadership capacity of the Communist Party of Vietnam; the effectiveness of state management, gradually perfecting the legal system of Vietnam.

b) The development of a socialist-oriented market economy, a socialist rule-of-law state, and socialist democracy in Vietnam.

c) Fundamental issues regarding comprehensive human development and excellent cultural values of the nation, absorbing the finest elements of world culture and civilization.

d) Fundamental and urgent issues concerning ethnicity, religion, history, culture, literature, language, psychology aimed at mobilizing the strength of the entire nation in the cause of building and defending the country.

đ) Fundamental, comprehensive, systematic issues regarding the theory of development in Vietnam under the influence of globalization and international integration.

e) Aspects of social sciences related to the knowledge-based economy in the context of globalization and responding to climate change and assessing their impact on the process of economic and social development in Vietnam.

g) Experiences in development worldwide, forecasting major trends in regional and global development, evaluating the multi-faceted impacts of globalization and international integration on global, regional, and Vietnamese development.

3. Conducting basic and interdisciplinary surveys in social sciences, analyzing and forecasting socio-economic trends to serve national development needs, focusing on key socio-economic areas, major economic regions, and inter-regional linkages.

4. Organizing the compilation of outstanding scientific works, large sets of books, reflecting the finest of Vietnamese and world intellect serving research and dissemination of knowledge in social sciences.

Clause 5. Organizing activities such as investigation, excavation, research, collection, preservation, museum work, and promotion of cultural heritage values of the Vietnamese ethnic groups.

6. On implementing public services

a) Organizing the implementation of public services assigned by the Government in accordance with the law.

Point b. Inspecting the organization and implementation of public services by subordinate units according to the provisions of the law.

7. Deciding and directing the implementation of the administrative reform program according to the goals and contents of the State administrative reform program approved by the Prime Minister.

8. Training master's and doctoral degrees; participating in training high-level human resources in the field of social sciences in accordance with the law.

9. Advising on strategies, plans, policies, programs, and projects for important socio-economic development within the scope of functions assigned by the Government and the Prime Minister.

10. On international cooperation

a) Organizing research cooperation and educational linkage in social sciences with international organizations, foreign institutes, and universities in accordance with the law.

Point b. Organizing international conferences, seminars, cooperation programs, and plans according to the provisions of the law.

11. On information and reporting systems

a) Organizing information work, propaganda, and dissemination of political tasks, policies, regulations, and laws of the State in the assigned sector and field.

b) Building a database of scientific information on research results of the Vietnam Academy of Social Sciences. Implementing information and reporting systems to the Government, the Prime Minister, and the Minister of Science and Technology on the activities of the agency in accordance with the law.

12. On organizational structure

a) Cooperating with the Ministry of Science and Technology to submit to the Government decisions on establishing new, reorganizing, dissolving, or renaming subordinate organizations and units of the Vietnam Academy of Social Sciences in accordance with the law.

b) Managing organizational structure, number of civil servants and employees, job positions, and civil servant structure by profession; deciding on rotation, transfer, appointment, dismissal, resignation, removal, assignment, training, commendation, discipline, termination of employment, retirement, salary, and incentive policies for civil servants and employees managed by the Vietnam Academy of Social Sciences in accordance with the law.

Point c. Implementing the autonomy mechanism according to the provisions of the law.

13. On financial and asset management

a) Preparing annual budget estimates and three-year state financial and budget plans for submission to competent authorities for approval in accordance with the law.

b) Manage the finance and assets assigned to the Vietnam Academy of Social Sciences in accordance with the law.

14. Perform other tasks and powers delegated by the Government and the Prime Minister and as prescribed by law.

The units specified from Clause 1 to Clause 5 of this Article are specialized units assisting the President of the Vietnam Academy of Social Sciences. The Office shall be organized into ten departments.

The units specified from Clause 6 to Clause 34 of this Article are public scientific and technological organizations.

The units specified from Clause 35 to Clause 38 of this Article are other public service units.

The President of the Vietnam Academy of Social Sciences shall stipulate the functions, tasks, powers, and organizational structure of the affiliated units.

Article 4. Leadership of the Academy

1. The Vietnam Academy of Social Sciences has a President and not more than four Vice Presidents.

2. The President of the Vietnam Academy of Social Sciences shall be appointed and relieved of duty by the Prime Minister, and shall be responsible before the Government, the Prime Minister, and the law for all activities of the Vietnam Academy of Social Sciences.

3. The Vice Presidents of the Vietnam Academy of Social Sciences shall be appointed and relieved of duty by the Prime Minister on the basis of the proposal of the President of the Vietnam Academy of Social Sciences; they shall have the responsibility to assist the President in directing and resolving certain areas of work and shall be responsible before the President and the law for the tasks assigned to them.

Article 5. Transitional Provisions

The President of the Vietnam Academy of Social Sciences shall be responsible for directing the development and implementation of restructuring and reorganization plans for the affiliated units of the Academy in accordance with the regulations, specifically as follows:

1. The Center for Analysis and Forecasting, Institute of Economics shall operate until the end of 2023, after which it shall be merged into the Institute of Economics according to Clause 8, Article 3 of this Decree.

2. The Institute of Indian and Southwest Asian Studies, Institute of African and Middle Eastern Studies shall operate until the end of 2023, after which they shall be consolidated into the Institute of South Asia, West Asia and Africa Studies according to Clause 30, Article 3 of this Decree.

3. The Institute of Capital City Studies, Institute of Archaeology shall operate until the end of 2024, after which the Institute of Capital City Studies shall be merged into the Institute of Archaeology according to Clause 18, Article 3 of this Decree.

4. The Institute of Dictionary and Encyclopedia Studies, Institute of Linguistics shall operate until the end of 2024, after which the Institute of Dictionary and Encyclopedia Studies shall be merged into the Institute of Linguistics according to Clause 15, Article 3 of this Decree.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decree shall take effect from January 1, 2023.

This Decree replaces Decree No. 99/2017/NĐ-CP dated August 18, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Academy of Social Sciences.

2. The President of the Vietnam Academy of Social Sciences, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the central government shall be responsible for implementing this Decree./.
