On the List of State Secrets of Confidential Level in the Social Insurance Sector

THE MINISTER OF PUBLIC SECURITY

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protecting State Secrets;

Pursuant to Decree No. 136/2003/ND-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

After reaching agreement with the General Director of the Vietnam Social Security,

DECISION:

Article 1. The List of State Secrets of Confidential Level in the Social Insurance Sector includes information within the following scope:

1. Strategies for the development of the Social Insurance Sector in Vietnam, short-term and long-term social insurance development orientation data, and unannounced solutions;

2. Documents and data submitted to the National Assembly, Government, Ministries, sectors, and political-social organizations to serve the formulation and amendment of social insurance policies that have not been announced;

3. Data on the balance of the Social Insurance Fund (including Health Insurance) and investment activities aimed at increasing the fund;

4. Annual plan allocation figures; quarterly and annual financial settlement reports, minutes of the audit of annual financial settlement reports of provincial-level Social Insurances, Ministry of Public Security Social Insurance, Ministry of Defense Social Insurance, State Cryptographic Department under the Government Office, and the Vietnam Social Security Agency that have not been announced or will not be announced;

5. Investment construction project files for material infrastructure in the Social Insurance Sector; information technology project documents, research project documents both domestically and internationally related to Vietnam Social Insurance data that have not been announced;

6. Petitions, reports to the Government, Ministries, and sectors of the Vietnam Social Security regarding issues related to social insurance that affect national security and social stability that have not been announced;

7. Files, documents, and results of inspections and audits of social insurance activities that have not been announced;

8. Inspection, audit, and verification documents of complaints and denunciations against officials and civil servants in the Social Insurance Sector that have not been announced;

9. Information and documents about cadre planning, appointment, dismissal, rotation, and disciplinary actions of cadres under the management of the Party Cadre Affairs Committee of the Government and the Party Cadre Affairs Committee of the Vietnam Social Security that have not been announced;

10. Personnel files of leaders at the department level and above in the Vietnam Social Security;

11. Design documents, technical specifications, and regulations and conventions ensuring internal computer network security of the Vietnam Social Security;

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The competent agencies of the Vietnam Social Security and the Ministry of Public Security are responsible for supervising the implementation of this Decision.

Article 3. Ministries; agencies equivalent to ministries; government agencies, and organizations mentioned in Article 2 of the Law on Protection of State Secrets dated December 28, 2000, and People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
