RESOLUTION

On the legislative program for Laws and Ordinances in 1998

OF THE NATIONAL ASSEMBLY

SOCIALIST REPUBLIC OF VIET NAM

Pursuant to Article 84 of the Constitution of the Socialist Republic of Vietnam 1992, Articles 62 and 63 of the Law on the Organization of the National Assembly, and Article 22 of the Law on Enacting Legal Normative Documents;

After hearing Report No. 16/UBTVQH10 of the Standing Committee of the National Assembly regarding the proposed Legislative Program for Laws and Ordinances in 1998 and the opinions of the National Assembly deputies;

RESOLVES

I- APPROVE THE LEGISLATIVE PROGRAM FOR LAWS IN 1998, AS FOLLOWS:

1- At the third session (April 1998)

a) Approve the following draft laws:

1. Law on Export Tax, Import Tax (Amendment);

2. Law on Special Consumption Tax (Amendment);

3. Law Amending and Supplementing Certain Provisions of the State Budget Law;

4. Law Amending and Supplementing Certain Provisions of the Law on Foreign Investment in Vietnam;

5. Law Amending and Supplementing Certain Provisions of the Law on Encouraging Domestic Investment;

6. Law on Complaints and Petitions;

7. Law on Citizenship (Amendment);

8. Law on Water Resources.

b) Give opinions on the following draft laws:

1. Penal Code (Amendment);

2. Law on Marriage and Family (Amendment).

2- At the fourth session (October 1998)

a) Approve the following draft laws:

1. Law on the Organization of People's Councils and People's Committees (Amendment);

2. Law on Elections of Deputies to People's Councils (Amendment);

3. Education Law;

4. Penal Code (Amendment).

b) Give opinions on the following draft laws:

1. Criminal Procedure Code (Amendment);

2. Land Law (Amendment);

3. Science and Technology Law.

II. ASSIGN THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY TO REVIEW AND APPROVE IN 1998 THE FOLLOWING DRAFT ORDINANCES AND RESOLUTIONS (CONTAINING LEGAL NORMATIVE PROVISIONS):

1. Ordinance on Combating Corruption;

2. Ordinance on Thrift and Anti-Waste;

3. Ordinance on Cadres and Civil Servants;

4. Resolution on Issuing Regulations on Grassroots Democracy;

5. Resolution on Civil Transactions Regarding Private Houses Established Before July 1, 1991;

6. Ordinance on the Vietnam Coast Guard Force;

7. Ordinance on Resource Tax (Amendment);

8. Ordinance on the Organization and Operation of Grassroots Mediation Organizations;

9. Ordinance on the Organization of People's Supervision;

III. APPROVE THE LIST OF DRAFTS THAT NEED TO CONTINUE TO BE PREPARED IN 1998 FOR SUBMISSION TO THE NATIONAL ASSEMBLY AND THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY FOR REVIEW IN 1999 AND SUBSEQUENT YEARS, INCLUDING THE FOLLOWING DRAFTS:

A- Draft Laws

1. Law on the Oversight Activities of the National Assembly;

2. Civil Procedure Code;

3. Law on the Organization of the National Assembly (Amendment);

4. Law on the Organization of the Government (Amendment);

5. Law on the Organization of the People's Courts (Amendment);

IV- ON IMPLEMENTATION:

1. Assign the Standing Committee of the National Assembly to strictly direct the implementation of the Legislative Program for Laws and Ordinances in 1998.

2. Assign the Government and relevant agencies within their respective functions and powers, and according to the division of labor by the Standing Committee of the National Assembly, to develop specific plans, coordinate to prepare the legislative projects according to the schedule set out, and effectively implement the laws and ordinances that have been enacted.

3. Assign the National Ethnic Council and the Committees of the National Assembly to cooperate with relevant agencies in preparing legislative projects under the Legislative Program for Laws and Ordinances in 1998 within their respective areas of responsibility; study ways to improve the quality of review work, contributing to enabling the National Assembly and the Standing Committee of the National Assembly to quickly and efficiently examine and approve legislative projects.

4. Assign the Standing Committee of the National Assembly to research and prepare the proposed Legislative Program for Laws and Ordinances for the tenth term to be submitted to the National Assembly for decision at the third session (April 1998).

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, tenth term, second session, on December 12, 1997./.
