 CIRCULAR

Guidelines for Amending and Supplementing Certain Contents of Circular No.

06/1999/TT-BKH dated November 24, 1999 of the Ministry of Planning and Investment on the Content of Total Investment Amount, Project Appraisal Documents, and Investment Report

Implementing the provisions of Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain articles of the Investment Management Regulations issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999; in response to the requirements of ministries and localities to simplify procedures for small projects, the Ministry of Planning and Investment issues guidelines for amending and supplementing the Investment Report section at Section III of Circular No. 06/1999/TT-BKH dated November 24, 1999 as follows:

III/ Investment Report:

3.1/ The Investment Report shall apply to projects with investment capital under one billion dong, repair and maintenance projects using public funds, and projects in sectors that have standard designs and technical standards approved by the sector management agency based on compliance with sector planning, regional planning, or medium- and long-term plans.

3.2/ Contents of the Investment Report:

1/ Legal basis and necessity for investment:

+ Clearly state the legal bases such as superior decisions, approved plans...

+ Provide a brief explanation of the reasons for the need to invest in the project.

2/ Project name and investment form.

(The investment form must clearly indicate whether it is new construction, renovation, expansion, or maintenance).

3/ Investor (clearly state the name of the agency, unit, or individual acting as the investor).

4/ Location and land area:

Clearly state the name of the commune (or ward) within the district.

For projects with architectural construction such as schools, health stations, cultural houses..., clearly state the permitted land area.

5/ Work volume: The work volume of the investment is recorded in appropriate units and calculated based on the unit price norms issued by the People's Committee of the province or centrally governed city.

6/ Investment capital and sources of capital:

- Total investment capital:

+ State budget, including:

. Central government budget (if there is foreign aid, this should also be clearly stated).

- Sources of capital:

. Local government budget.

+ State development investment credit

+ Other sources of capital.

7/ Commencement and completion time:

For production and business projects, in addition to the above contents, the following should be supplemented:

- Products (services) and capacity scale.

- Equipment (clearly state the value and source of supply).

- Raw material supply sources.

- Debt repayment capability (if it is borrowed capital) and payback period.

- Environmental protection measures (if the project has a negative impact on the environment).

For projects with investment capital under 100 million dong, depending on the project requirements, it is not necessarily required to detail all the items mentioned above.

This Circular takes effect fifteen days from the date of issuance.
