JOINT CIRCULAR

GUIDELINES FOR IMPLEMENTING THE GOVERNMENT DECREE NO. 35/2001/NĐ-CP OF JULY 9, 2001 ON POLICIES FOR TEACHERS AND EDUCATIONAL MANAGEMENT STAFF WORKING IN SPECIALIZED SCHOOLS AND IN AREAS WITH EXTREMELY DIFFICULT ECONOMIC AND SOCIAL CONDITIONS

Implementing Government Decree No. 35/2001/NĐ-CP dated July 9, 2001 on policies for teachers and educational management staff working in specialized schools and in areas with extremely difficult economic and social conditions, the Ministry of Education and Training, the Organization and Staff Department of the Government, the Ministry of Finance, and the Ministry of Labor, Invalids and Social Affairs provide guidelines for implementing policies for teachers and educational management staff working in specialized schools and in areas with extremely difficult economic and social conditions as follows:

A. GENERAL PROVISIONS

I. APPLICABLE OBJECTS

1. Teachers and educational management staff within the establishment quota, those in their probationary period, or currently under contract within the establishment quota and receiving salary from the state budget (teachers and educational management staff receiving salary from the state budget) who are currently working at specialized schools and in areas with extremely difficult economic and social conditions.

2. Teachers and educational management staff not within the state establishment quota, those in their probationary period, or under contract and receiving salary from legitimate sources other than the state budget (teachers and educational management staff not receiving salary from the state budget) who are currently working at specialized schools and in areas with extremely difficult economic and social conditions.

3. Educational management staff as specified in Points 1 and 2 above include:

a) Principals, Deputy Principals, Directors, and Deputy Directors of centers and educational institutions;

b) Staff members originally teachers, Principals, Deputy Principals, Directors, and Deputy Directors of educational institutions assigned to work in specialized departments and units of educational institutions;

c) Staff members originally teachers, Principals, Deputy Principals, Directors, and Deputy Directors of educational institutions transferred to work at the Department of Education and Training located in areas with extremely difficult economic and social conditions.

II. SCOPE OF APPLICATION

1. Specialized schools include:

a) Boarding schools for ethnic minorities;

b) Boarding schools for ethnic minorities part-time;

c) Pre-university schools;

d) Specialized high schools;

đ) Reformatory schools;

e) Schools and classes for disabled persons;

g) Talent development schools in arts, physical education, and sports established to develop students' talents in these fields and operating according to the provisions of the Education Law.

2. Areas with extremely difficult economic and social conditions include: ethnic minority regions, mountainous regions, islands, and other difficult regions. The list of these areas is issued together with Decision No. 1232/QĐ-TTg dated December 24, 1999, Decision No. 647/QĐ-TTg dated July 12, 2000, Decision No. 42/QĐ-TTg dated March 26, 2001, and other supplementary decisions of the Prime Minister approving the list of particularly difficult communes and border, island communes within the scope of the special economic and social development program for mountainous, remote, and far-flung communes.

3. Educational institutions include: kindergartens, groups of kindergartens, kindergarten classes, primary schools, secondary schools, vocational training, technical and vocational colleges, junior colleges, universities; centers for comprehensive technical training, vocational training, continuing education, and care for disabled children.

III. PRINCIPLES OF APPLICATION

1. In addition to enjoying policies like civil servants working in the education sector, teachers and educational management staff also enjoy additional allowances, subsidies, and benefits as stipulated in this Circular.

2. Teachers and educational management staff who retire or leave their positions will not enjoy the allowances, subsidies, and benefits stipulated in this Circular.

The allowances, subsidies, and benefits stipulated in this Circular shall not be used to calculate other allowances, social insurance, health insurance, and severance pay.

However, the attraction allowance, responsibility allowance, and mobility allowance can be used to deduct 2% of union funds.

3. Teachers and educational management staff working at specialized schools not located in areas with extremely difficult economic and social conditions shall only enjoy allowances, subsidies, and benefits prescribed for specialized schools as detailed in Sections I, II, and III of Part B of this Circular;

- Teachers and educational management staff working at specialized schools located in areas with extremely difficult economic and social conditions shall enjoy all allowances, subsidies, and benefits prescribed from Section I to Section XI of Part B of this Circular;

- Teachers and educational management staff working at educational institutions located in areas with extremely difficult economic and social conditions shall only enjoy allowances, subsidies, and benefits prescribed for areas with extremely difficult economic and social conditions from Section I to Section XI (excluding Section III) of Part B of this Circular.

4. Teachers and educational management staff receiving salary from the state budget shall enjoy allowances, subsidies, and benefits stipulated in this Circular paid from state budget funds;

Central government budget shall cover teachers and educational management staff working at specialized schools and educational institutions managed by central ministries and agencies. Local government budgets shall cover teachers and educational management staff working at specialized schools and educational institutions managed by local authorities;

Teachers and educational management staff not receiving salary from the state budget shall implement allowances, subsidies, and benefits stipulated in this Circular from legitimate income sources of their institutions.

B. BENEFITS TO BE ENJOYED

I. SUBSIDY FOR TOURISM, STUDY, AND PROFESSIONAL DEVELOPMENT

1. Teachers and educational management staff falling under the application scope of Section I of Part A of this Circular who are currently working at specialized schools and in areas with extremely difficult economic and social conditions:

- When assigned to attend training courses on professional skills, vocational training, or foreign languages by the competent educational management authority, they shall be provided with funding for purchasing study materials (excluding reference materials), tuition fees, and reimbursement for train or bus tickets, accommodation rental costs, and travel allowances during the training period according to the current travel allowance regulations.

- Upon successfully completing their annual tasks (receiving outstanding laborer, excellent teacher, model worker awards, or certificates for creative labor), they shall be organized by their units to visit and learn from other domestic units at least once a year, with all expenses including train or bus tickets, accommodation rental costs, travel allowances according to the current travel allowance regulations, and other expenses for organizing practical visits being covered if such expenses are supported by valid receipts and within the approved budget.

2. At the beginning of each academic year, specialized schools and educational and training institutions located in areas with particularly difficult socio-economic conditions shall base their plans for teachers and educational managers to attend professional training and skill development courses, as well as plans to organize visits and exchanges for teachers and educational managers with outstanding achievements, on the staffing plan for that academic year, and submit these plans along with the budget estimates to the directly supervising educational management and training authorities for approval.

- Specialized schools and educational and training institutions managing teachers and educational managers shall settle accounts for the purchase of study materials and tuition fees based on financial invoices and receipt vouchers issued by the training institutions. Expenses for train or bus tickets, accommodation rental costs, and travel allowances during the training period shall be settled according to the current regulations.

- The costs for purchasing study materials, tuition fees, train or bus tickets, accommodation rental costs, travel allowances, and expenses for organizing visits, learning, training, and experience exchanges shall be recorded under appropriate sub-items of the corresponding chapters, types, and sections in the State Budget Manual.

II. SPECIAL ALLOWANCE

1. Eligible Recipients.

Teachers and educational managers who fall under the application scope of Part A, Section I of this Circular and are currently working at specialized schools in areas with particularly difficult socio-economic conditions.

The periods not counted towards the eligibility for special allowances include:

- Long-term study trips lasting over three months, personal leave exceeding one month (consecutive);

- Maternity leave exceeding the standard stipulated in the Labor Code and sick leave as prescribed in the Social Insurance Regulations;

- Periods during which disciplinary measures are being enforced starting from a warning level or higher.

2. Allowance Rates.

2.1. Allowance Rates:

2.1.1. An allowance rate of 70% of the current salary grade and leadership position allowance (if applicable) applies to teachers and educational managers working at:

a) Educational and training institutions located in areas with particularly difficult socio-economic conditions;

b) Specialized schools including:

- Specialized secondary schools;

- Boarding schools for ethnic minorities;

- Schools and classes for disabled persons;

For teachers and educational managers working at correctional schools who meet the criteria for special allowances under this Circular but whose current defense and security allowances and seniority allowances are lower than 70% of their current salary grade and leadership position allowance (if applicable), they shall receive additional percentage points to reach the 70% rate.

2.1.2. An allowance rate of 50% of the current salary grade and leadership position allowance (if applicable) applies to teachers and educational managers working at specialized schools not located in areas with particularly difficult socio-economic conditions, including:

- Boarding schools for ethnic minorities;

- Pre-university schools;

- Artistic, physical education, and sports talent schools.

2.1.3. Calculation Method:

The monthly special allowance = Minimum wage x (current salary coefficient + leadership position allowance coefficient (if applicable) x 70% or 50%).

Example 1: A primary school principal working in an area with particularly difficult socio-economic conditions, with a salary coefficient of 2.59 and a leadership position allowance of 0.25, receives a special allowance rate of 70%. The calculation for this case's monthly special allowance is as follows:

Monthly special allowance = 210,000 VND x (2.59 + 0.25) x 70% = 417,480 VND.

Example 2: Teacher Nguyen Van A, currently working at a correctional school, with the rank of Major, has a salary coefficient of 4.15 and a seniority allowance of 20%.

The additional special allowance rate for Teacher Nguyen Van A is calculated as follows:

Additional special allowance rate = 70% (as per regulation) - 20% (seniority allowance) = 50%.

Monthly special allowance = 210,000 VND x 4.15 x 50% = 435,750 VND.

3. Payment Method.

3.1. This allowance is paid together with the monthly salary (including summer vacation).

3.2. Teachers and educational managers who have received special allowances according to this Circular shall not receive special allowances as prescribed in Joint Circular No. 147/1998/TTLT-BTCCBCP-BTC-BLDTBXH-BGDĐT dated March 5, 1998, of the Joint Office of the Government Organizational and Cadre Affairs Council - Ministry of Finance - Ministry of Labor, Invalids and Social Affairs - Ministry of Education and Training guiding the implementation of Decision No. 973/1997/QD-TTg dated November 17, 1997, of the Prime Minister regarding the special allowance system for teachers directly teaching in state-owned public schools.

3.3. This allowance amount shall be recorded under Item 102 Sub-item 08 of the corresponding chapters, types, and sections in the State Budget Manual.

III. RESPONSIBILITY ALLOWANCE

1. Teachers and educational managers who fall under the application scope of Part A, Section I of this Circular and work at specialized schools shall receive a responsibility allowance of 0.3 times the minimum wage and shall not receive a responsibility allowance as prescribed in Circular No. 17/BLDTBXH-TT dated June 2, 1993, of the Ministry of Labor, Invalids and Social Affairs guiding the implementation of the responsibility allowance system.

2. Calculation Method:

The amount of duty allowance received in one month = Minimum wage x 0.3.

3. Payment method:

3.1. Duty allowance is calculated and paid together with monthly salary.

3.2. This allowance is recorded under Item 102 sub-item 03 of the corresponding chapter, type, and item according to the State Budget Chart.

IV. ATTRACTIVE ALLOWANCE

1. Recipients

Teachers and educational management staff, including those who have just graduated and been recruited and assigned to work by the competent authority (including both local and non-local personnel) and are transferred by the competent educational management authority from areas not classified as particularly difficult economic and social conditions to work at educational and training institutions located in areas classified as particularly difficult economic and social conditions.

2. Level of Attractive Allowance and Duration of Enjoyment:

- The level of attractive allowance equals 70% of the current rank-based salary and leadership position allowance (if applicable).

- The attractive allowance is paid for the actual working time of teachers and educational management staff at educational and training institutions located in areas classified as particularly difficult economic and social conditions, but not exceeding five years from the date of receiving the decision on job transfer.

3. Calculation Method for Attractive Allowance:

3.1. The amount of attractive allowance received in one month = Minimum wage x (current salary coefficient + leadership position allowance (if applicable)) x 70%.

3.2. For those transferred before July 25, 2001, the period for calculating the attractive allowance starts from July 25, 2001 onwards. In these cases, the attractive allowance is also paid based on the actual continued working time at educational and training institutions located in areas classified as particularly difficult economic and social conditions, but not exceeding five years from the effective date of the job transfer decision. For those transferred from July 25, 2001 onwards, the calculation period starts from the date of receiving the job transfer decision until the completion of the job transfer term.

Example 1: Mr. Nguyen Van A, a graduate of a teacher training high school, was transferred to work at a primary school in an area classified as particularly difficult economic and social conditions on December 31, 1996 by the Department of Education and Training. On December 31, 2002, he received a decision to be transferred to an area without particularly difficult economic and social conditions. From July 25, 2001 to December 31, 2002, Mr. Nguyen Van A enjoyed an attractive allowance of 70% (a total of one year and five months from the date of receiving the job transfer decision).

Example 2: Ms. Principal Nguyen Thi B works at a primary school with a rank code 15114, grade 7, coefficient 2.59, and enjoys a leadership position allowance of 0.35. She received a decision on July 15, 2001 from the District Education and Training Office to be transferred to work at a primary school in an area classified as particularly difficult economic and social conditions for three years until August 15, 2004, and she enjoys an attractive allowance of 70%.

The amount of attractive allowance received in one month for this case = 210,000 VND x (2.59 + 0.35) x 70% = 432,180 VND and is paid over a period of three years (36 months).

After three years, Ms. Nguyen Thi B continues to work at an educational institution in an area classified as particularly difficult economic and social conditions according to the decision of the competent authority for another three years and continues to enjoy the attractive allowance for two more years.

4. Payment Method:

4.1. This allowance is calculated and paid together with monthly salary (including summer vacation periods);

4.2. This allowance is only paid during the actual working time in areas classified as particularly difficult economic and social conditions.

4.3. This allowance is recorded under Item 102, sub-item 02 of the corresponding chapter, type, and item according to the State Budget Chart.

V. ROTATION PERIOD FOR TEACHERS AND REGIONAL TRANSFER ALLOWANCE

1. Recipients.

1.1. Teachers receiving state budget salaries who are decided by the competent educational management-training authority to be rotated from areas not classified as particularly difficult economic and social conditions to work at educational and training institutions located in areas classified as particularly difficult economic and social conditions starting from July 25, 2001;

1.2. New graduates recruited and assigned to work at educational and training institutions located in areas classified as particularly difficult economic and social conditions starting from July 25, 2001.

2. Rotation Period for Teachers and Benefits Received.

2.1. The rotation period for teachers working in areas classified as particularly difficult economic and social conditions is five years for males and three years for females.

During the working period stipulated by the rotation regulations, if teachers are disciplined (reprimanded; warned; demoted in rank; demoted in grade), they will not be eligible for rotation. Only after the disciplinary measures cease to be effective can the teachers be rotated, and the time spent under discipline does not count towards the service period within the rotation term.

2.2. After completing the aforementioned service period, the competent educational management-training authority will arrange for the rotation of teachers to work in areas not classified as particularly difficult economic and social conditions according to the following principles:

a) For teachers transferred to work at educational and training institutions located in areas classified as particularly difficult economic and social conditions, they will be rotated back to their last place of residence and work before being transferred to such areas.

b) For those who have just graduated from training institutions and are newly recruited by competent authorities to be assigned to work at educational and training facilities in areas with particularly difficult socio-economic conditions for a rotation period (excluding cases where they were admitted to study at training institutions already having permanent residence registration in areas with particularly difficult socio-economic conditions), competent educational and training management authorities shall arrange and assign them to work at educational and training facilities not located in areas with particularly difficult socio-economic conditions;

c) Teachers who wish to transfer their work to another place shall be facilitated by competent educational and training management authorities to contact for job transfer and resolve the transfer according to their wishes;

d) Once a decision on rotation to a new locality has been made, teachers must comply with the work assignment of the educational management authority in the new locality; if they fail to comply with the work assignment, they will be subject to disciplinary action depending on the severity of the violation as stipulated by current regulations;

2.3. Teachers who do not fall within the category entitled to the rotation period allowance and those who took up work in areas with particularly difficult socio-economic conditions before July 24, 2001 shall not be eligible for rotation according to the aforementioned period;

2.5. Upon completion of the service period in areas with particularly difficult socio-economic conditions, if teachers voluntarily choose to remain and continue working and settling down permanently, they may be granted land for housing and farming by the People's Committee of the district based on specific conditions of the district, and they can borrow funds for housing and farming at preferential interest rates repayable over ten years;

2.6. When implementing the rotation decision (including cases of transferring to and from areas with particularly difficult socio-economic conditions), if teachers have family members (parents; spouse; children) accompanying them, they shall be compensated for travel expenses (according to ticket prices and financial invoices) for accompanying members and shall also receive a relocation allowance of VND 5,000,000 (five million dong) per household (including the entire family);

3. Method of paying the relocation allowance;

3.1. The relocation allowance and travel expenses for teachers and accompanying members shall be paid once by the educational and training facility in areas with particularly difficult socio-economic conditions (where teachers are rotated out from and received to);

3.2. The expenditure for travel expenses and relocation allowances shall be recorded under Item 105 Sub-item 99 of the corresponding chapter, type, and item according to the State Budget Manual;

VI. INITIAL ALLOWANCE

1. Eligibility and Conditions for Entitlement

Teachers, including newly graduated individuals recruited and assigned by competent authorities, who are transferred to work at educational and training facilities located in areas with particularly difficult socio-economic conditions starting from July 25, 2001 onwards, shall be eligible;

2. Amount of Allowance and Housing Arrangements

- Teachers meeting the above criteria shall be entitled to an initial allowance of VND 3,000,000 (three million dong) per person to support the purchase of necessary items to stabilize their personal and family life early on;

- Teachers transferred to work at educational and training facilities shall have their housing arrangements resolved by the People's Committee of the district receiving them. Based on the number of teachers working at the educational and training facilities requiring housing and the actual situation of the locality, the district People's Committee shall direct relevant agencies within the district to build collective housing (public service housing) for teachers or add rooms in existing teacher collective housing areas to suit local conditions;

3. Payment Method

3.1. This allowance shall be paid by the educational and training facility receiving the teacher after the teacher has commenced work;

3.2. This allowance shall be recorded under Item 105 Sub-item 99 of the corresponding chapter, type, and item according to the State Budget Manual;

VII. ALLOWANCE FOR PURCHASE AND TRANSPORTATION OF CLEAN WATER

1. Eligibility and Conditions for Entitlement

Teachers and educational management officials falling within the scope of application of Section I Part A of this Circular who are working and living in areas with particularly difficult socio-economic conditions where there is a genuine seasonal shortage of clean water;

2. Determination of Water Shortage Areas, Duration, and Allowance Level

Seasonal water shortage areas are regions where natural conditions do not provide water or where available water cannot be used for daily living for one month or more consecutively in a year;

The Provincial People's Committee shall determine the water shortage areas, duration, and allowance level for purchasing and transporting clean water based on the specific conditions of areas with particularly difficult socio-economic conditions under its jurisdiction;

3. Calculation Method

3.1. The heads of educational and training facilities shall calculate the allowance for purchasing and transporting clean water according to the following guidelines:

- The basis for calculating the actual cost per person includes:

+ Standard quota: 6 cubic meters/person/month (a);

+ Actual number of months without clean water in a year (b);

+ Cost of purchasing and transporting 1 cubic meter of clean water to the residence and workplace of teachers and educational management officials as specified by the Provincial People's Committee (c);

+ Water consumption costs already included in salary: VND 600/cubic meter;

- The allowance for purchasing clean water is the difference between the actual cost and the amount already included in salary (VND 600/cubic meter x 6 cubic meters = VND 3,600);

The allowance for one month = (a) x (c) - VND 3,600;

3.2. Teachers and educational management officials who work at centrally-managed schools located in areas with particularly difficult socio-economic conditions and are entitled to the allowance for purchasing and transporting clean water shall receive it according to the local level where the school is located;

4. Payment Method:

- The allowance for purchasing and transporting clean water shall be paid in cash along with monthly salaries.

- The allowance for purchasing and transporting fresh and clean water shall be recorded under Item 105 sub-item 99 of the corresponding chapter, type, and clause according to the State Budget Manual.

VIII. MOBILITY ALLOWANCE

1. Recipients and Conditions for Entitlement:

Teachers and educational administrators who fall within the scope of application as stipulated in Section I Part A of this Circular working in areas with extremely difficult socio-economic conditions and engaged in full-time illiteracy eradication and universal education programs, spending at least 15 days in villages, hamlets, phums, or socs in a month.

2. Rate of Allowance and Method of Payment:

- The rate of allowance is 0.2 times the minimum wage level.

- The method of payment for the allowance shall be implemented in accordance with the guidelines set forth in Section IV of Circular No. 19/LDTBXH-TT dated June 2, 1993 issued by the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of the mobility allowance system.

- This allowance shall be recorded under Item 102 sub-item 06 of the corresponding chapter, type, and clause according to the State Budget Manual.

IX. ALLOWANCE FOR TEACHING IN THE LANGUAGE AND WRITING OF ETHNIC MINORITIES

1. Eligibility and Conditions for Entitlement

Teachers and educational administrators who fall within the scope of application as stipulated in Section I Part A of this Circular currently working in areas with extremely difficult socio-economic conditions, assigned responsibilities by the head of the unit or educational institution, and directly teaching in the language and writing of ethnic minorities according to the curriculum and teaching materials issued by the Department of Education and Training, regardless of whether it is a single-language or bilingual (ethnic minority language - Vietnamese) program.

2. Duration of Entitlement

2.1. If teachers and educational administrators directly teach in the language and writing of ethnic minorities for two semesters in a school year, they will receive the allowance for nine months in that school year;

2.2. If teachers and educational administrators directly teach in the language and writing of ethnic minorities for one semester in a school year, they will receive the allowance for four and a half months in that school year;

2.3. If teaching does not last a full semester in a school year, the allowance will be paid for each month taught.

3. Rate of Allowance and Calculation Method

The allowance for teaching in the language and writing of ethnic minorities is equal to 50% of the current salary grade and position allowance (if applicable).

The amount of allowance received in one month = Minimum wage x (current salary coefficient + position allowance for leadership roles (if applicable)) x 50%.

4. Payment Method:

4.1. This allowance is calculated and paid together with the monthly salary.

4.2. This allowance is only paid during the period when teachers and educational administrators work in areas with extremely difficult socio-economic conditions and directly teach in the language and writing of ethnic minorities.

4.3. This allowance shall be recorded under Item 102 sub-item 99 of the corresponding chapter, type, and clause according to the State Budget Manual.

X. SUPPORT FOR SELF-STUDY OF THE LANGUAGE OF ETHNIC MINORITIES TO SERVE WORK

(as provided for in Clause 2 Article 14 of Decree No. 35/2001/NĐ-CP).

1. Eligibility and Conditions for Entitlement

Teachers and educational administrators who fall within the scope of application as stipulated in Section I Part A of this Circular currently working (including self-study and use of other ethnic minority languages) in areas inhabited by ethnic minorities in regions with extremely difficult socio-economic conditions must genuinely study and master the writing and spoken language of the local ethnic minority for use in teaching and educating students, confirmed by the competent educational management authority to meet the specified standards.

2. Entitlements:

2.1. They are entitled to reimbursement for the purchase of learning materials for self-study (excluding reference materials) in the language and writing of ethnic minorities (if any) based on financial invoices.

2.2. They are entitled to a subsidy for self-study in the language and writing of ethnic minorities. The specific amount is determined by the Provincial People's Committee upon the proposal of the Department of Education and Training but shall not exceed five million dong per person.

3. Payment Method

3.1. The cost of purchasing learning materials (excluding the cost of purchasing reference materials) is provided once a year based on actual purchases and can be reimbursed over a maximum of three years.

3.2. The self-study subsidy is provided once when teachers and educational administrators have successfully mastered the language and writing of ethnic minorities for use in teaching and educating students and this is confirmed by the competent educational management authority.

3.3. The costs for purchasing learning materials and self-study subsidies shall be recorded under appropriate sub-items of Item 119 of the corresponding chapter, type, and clause according to the State Budget Manual.

XI. RECOGNITION AND AWARDS

Teachers and educational administrators working in specialized schools or in areas with extremely difficult socio-economic conditions are eligible for time conversion to be considered for the title of National Teacher, Outstanding Teacher, and for the awarding of medals for the education cause and other state recognition policies.

C. IMPLEMENTATION

1. The budget estimate for paying allowances and preferential benefits as guided in this Circular for teachers and educational administrators working in educational institutions and training centers (according to Table 1, Table 3, and Table 2b attached)* shall be prepared concurrently with the regular budget estimate at each level and unit for submission to the competent authority for approval and implementation.

2. Heads of public educational institutions and training centers are responsible for reviewing and preparing the annual budget estimate for payments to those receiving salaries from the state budget (including detailed analysis of payments for allowances and subsidies for teachers and educational administrators in their units) to be submitted to the superior supervisory agency before April 30, 2002, following the format attached to this Circular.

3. Central Ministries and Departments are responsible for compiling information on schools and institutions under their management (according to Tables 3, 4a, 4b, and 5 attached)* and submitting reports to the Joint Ministry (Ministry of Education and Training, Government Organizational and Cadre Management Board, Ministry of Finance, Ministry of Labor, Invalids, and Social Affairs) before May 31, 2002, as the basis for allocating funds.

The Department of Finance and Prices shall be responsible for compiling reports from schools and facilities under local management (as per Tables 3, 4a, 4b, and 5 attached) regarding the budget estimates for implementing the allowances and subsidies set forth in this Circular to report to the People's Committees of provinces and cities for their decision. The People's Committees of provinces and cities shall compile and report to the Ministry of Education and Training, the Government Organizational and Cadre Affairs Board, the Ministry of Finance, and the Ministry of Labor, Invalids, and Social Affairs before May 31, 2002, on the implementation situation at the local level.

From 2003 onwards, the examination and approval of additional subjects eligible for allowances and subsidies pursuant to Decree No. 35/2001/NĐ-CP mentioned above shall be decided by the People's Committees of provinces and cities, which will delegate and decentralize the responsibility to subordinate functional units for resolution.

This Circular takes effect from July 25, 2001. During its implementation, if there are any difficulties, units should promptly reflect them to the Ministry for consideration and supplementation to ensure appropriateness.
