Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;

Pursuant to Decree No. 38/2001/PL-UBTVQH dated August 28, 2001 on fees and charges;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to the proposal of the Ministry of Transport in Circular No. 4283/GTVT-TCKT dated November 13, 2002, and the recommendation of the Director of the Enterprise Finance Department,

DECISION:

Article 1. This Decision promulgates the Fee Schedule for Technical Safety and Quality Inspection of Inland Waterway Vessels, including:

1. The fee for reviewing the design of inland waterway vessels.

2. The fee for technical safety and quality inspection of newly built inland waterway vessels.

3. The fee for technical safety and quality inspection of inland waterway vessels in operation.

4. The fee for technical safety and quality inspection during repair and conversion of inland waterway vessels.

5. The fee for technical safety and quality inspection of the water displacement volume certification of inland waterway vessels.

Article 2. The fees in this schedule include value-added tax but exclude the license fee for issuing certificates of technical safety and quality of inland waterway vessels and travel, accommodation, and communication costs for inspection work more than 100 kilometers from the office.

Article 3. The price for designing, building, manufacturing, repairing, and converting inland waterway vessels (including materials and equipment provided by the customer) serving as the basis for calculating inspection fees in this fee schedule is the price excluding value-added tax.

Article 4. For inspection tasks not specified in this fee schedule, the inspection fee will be calculated based on the time spent inspecting, with a rate of VND 100,000 per hour. The minimum charge for one inspection session is VND 100,000 per session.

Article 5. The entities subject to payment under this Decision are organizations and individuals whose inland waterway vessels are inspected for technical safety and quality by the Vietnam Inspection Authority during design, construction, repair, conversion, and operation.

Article 6. Some concepts in this fee schedule are understood as follows:

- Inland waterway vessel: Includes boats, ships (with or without engines), and other floating structures used for transportation or business services on inland waterways.

- Gross tonnage: Is the weight in tons of cargo, passengers, fresh water, ballast water, provisions, fuel oil, lubricating oil corresponding to the dry side as stipulated by current technical regulations and standards.

Article 7. This Decision takes effect from February 1, 2003, and replaces the inspection service fee schedule for inland waterway vessels established in Decision No. 129/1999/QD-BVGCP dated December 16, 1999, issued by the Government Price Board on inland waterway vessel inspection service fees and related guiding documents.

Article 8. Organizations and individuals subject to payment, inspection agencies, and relevant agencies are responsible for implementing this Decision./.
