Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Directive No. 01/2004/CT-TTg dated January 2, 2004 of the Prime Minister on Rectifying Inter-Provincial Passenger Transport by Motor Vehicles;

Considering the proposals of the Heads of the Transport Department, the Vietnam Highway Administration, and the Director of the Computing Center,

DECISION:

Article 1. This Decision hereby promulgates the Regulation on Management, Operation, and Use of Information Systems to Serve the Work of Managing Inter-Provincial Passenger Transport by Motor Vehicles.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Ministry's Office, the Legal Affairs Department, the Transport Department, the Vietnam Highway Administration, the Directors of the Departments of Transportation, the Departments of Transportation and Public Works, the Director of the Computing Center under the Ministry of Transportation, and the Heads of related agencies and units shall be responsible for implementing this Decision.

REGULATIONS

Management, Operation, and Use of Information Systems to Serve the Work of Managing Inter-Provincial Passenger Transport by Motor Vehicles

PART I

GENERAL PROVISIONS

Article 1. Information System for Managing Inter-Provincial Passenger Transport Activities and Plan to Rectify Inter-Provincial Passenger Transport by Motor Vehicles.

1. The information system for managing inter-provincial passenger transport activities and the plan to rectify inter-provincial passenger transport by motor vehicles is established to provide timely information about management work and the implementation of the plan to rectify inter-provincial passenger transport by motor vehicles in localities, meeting the objectives and solutions set out in Plan No. 652/GTVT-VT dated February 18, 2004, and Plan No. 1558/GTVT-VT dated April 6, 2004 of the Steering Committee for Implementing Directive No. 01/2004/CT-TTg dated January 2, 2004 of the Prime Minister; it also serves as a wide-ranging source of information for agencies, organizations, and individuals regarding transportation management and the situation of rectifying inter-provincial passenger transport by motor vehicles nationwide.

2. The information system is built with a web interface integrated into the website of the Vietnam Highway Administration, accessible at (IMPLEMENTATION OF DIRECTIVE 01). Data of the system is stored and processed on servers of the Vietnam Highway Administration.

Article 2. Updating Information into the System.

1. The Vietnam Highway Administration, Departments of Transportation, and Departments of Transportation and Public Works assign technical staff to update information into the system and are responsible for the authenticity of the information.

2. Information provided into the system includes high-time-sensitive information serving management and rectification of inter-provincial passenger transport by motor vehicles, including: management documents, news, events, and data on bus stations, inter-provincial routes, enterprises participating in inter-provincial passenger transport, signposting stops on national highways, registered restaurants, sample routes related to the rectification of inter-provincial passenger transport by motor vehicles, especially information on violating motor vehicles and "illegal bus stations".

Chapter II

RESPONSIBILITIES FOR MANAGEMENT, OPERATION, AND USE

Article 3. Responsibilities of Local Steering Committees.

Direct the Departments of Transportation and Departments of Transportation and Public Works:

1. To utilize the information system to promptly report to the local steering committee on regulations and operational directives issued by the central steering committee.

2. To promptly update information on violating motor vehicles, information on handling "illegal bus stations," and other required information from the system at the local level.

Article 4. Responsibilities of the Transport Department.

1. Organize coordination with relevant agencies to exploit and use the information system effectively for managing inter-provincial passenger transport by road; initially serving the work of rectifying inter-provincial passenger transport activities according to Directive No. 01/2004/CT-TTg.

2. Regularly report to the Ministry of Transport's leadership on the results of exploiting and using the system; study and propose supplements, improvements, and expansions of the system at each specific stage to serve comprehensive management of the national transport system.

Article 5. Responsibilities of the Vietnam Highway Administration.

1. It is the agency authorized by the Steering Committee and the Ministry of Transport to manage, operate, and use the information system.

2. Ensure material and technical infrastructure for the information system during its exploitation and use.

3. Timely update documents serving management and rectification of inter-provincial passenger transport by road, including management documents, news, events, and data on bus stations, inter-provincial bus routes, participating passenger transport enterprises, stop signs on national highways, registered restaurants, and sample routes related to the rectification of inter-provincial passenger transport by road into the System.

4. Aggregate information from the System to serve the requirements of the Steering Committee and the Ministry of Transport.

Article 6. Responsibilities of Provincial Departments of Transport and Provincial Departments of Transport and Public Works.

1. The Provincial Departments of Transport and Provincial Departments of Transport and Public Works are responsible for organizing the collection of information on transport management work and the implementation of rectification of inter-provincial passenger transport by road according to the objectives and solutions in Plan No. 652/GTVT-VT dated February 18, 2004, and Plan No. 1558/GTVT-VT dated April 6, 2004 of the Steering Committee implementing Directive No. 01/2004/CT-TTg dated January 2, 2004 of the Prime Minister within their respective localities.

2. Exploit information on the system to implement, handle promptly, or report to the local Steering Committee for guidance on directives or documents from the competent management authority.

Article 7. Responsibilities of the Information Technology Center of the Ministry of Transport.

1. Maintain the information system throughout its exploitation and use to meet information requirements.

2. Organize training and guidance on use for local officials to ensure that localities can effectively utilize the information system.

Chapter III

IMPLEMENTATION

Article 8. Implementation Organization.

1. Local Steering Committees, the Transport Department, the Vietnam Highway Administration, the Information Technology Center of the Ministry of Transport, Provincial Departments of Transport, and Provincial Departments of Transport and Public Works are responsible for organizing the implementation of this Regulation. During the implementation process, these agencies need to closely coordinate to achieve the highest efficiency in exploiting the System.

2. Any issues arising during the implementation process should be reported to the Steering Committee and the Ministry of Transport for resolution./.
