Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Considering the proposals of the Directors of the National Center for Scientific and Technological Information and the Director of the Department of Personnel and Organization;
DECISION:
Article 1. This Decision promulgates the Charter on Organization and Operation of the National Center for Scientific and Technological Information under the Ministry of Science and Technology.
Article 2. This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 247/QĐ-TCCB dated May 4, 1994 of the Minister of Science, Technology, and Environment (now the Ministry of Science and Technology) regarding the issuance of the Charter on Organization and Operation of the National Center for Scientific and Technological Information and Documentation.
Article 3. The Heads of the Office, the Director of the Department of Personnel and Organization, the Director of the National Center for Scientific and Technological Information, and the Heads of related units are responsible for implementing this Decision./.
CHARTER
ORGANIZATION AND OPERATION OF
NATIONAL CENTER FOR SCIENTIFIC AND TECHNOLOGICAL INFORMATION
(Issued together with Decision No. 11/2004/QĐ-BKHCN dated May 13, 2004 of the Minister of Science and Technology)
PART I
FUNCTIONS, TASKS, AND POWERS
Article 1. The National Center for Scientific and Technological Information (hereinafter referred to as the Center) is a public service unit under the Ministry of Science and Technology, organizing and leading the system of scientific and technological information organizations, performing the function of central information and library services for the country in the fields of science and technology.
The English name of the Center is "National Centre for Scientific and Technological Information" (abbreviated as NACESTI).
The Center may use its traditional name "Central Library for Science and Technology" (English name: Central Library for Science and Technology) in external relations with the library community and the publishing industry.
The Center has legal personality, its own seal, and domestic and foreign currency accounts at the State Treasury and banks for its operations and transactions in accordance with the law.
The Center's headquarters is located at 24-26 Ly Thai Kieu Street, Hanoi.
Article 2Tasks and Powers
The Center has the following tasks and powers:
1. Participating in the development and implementation of policies, strategies, regulations, plans, and normative legal documents on scientific and technological information activities; developing national scientific and technological information resources;
2. Collecting, selecting, processing, storing, and developing domestic and international scientific and technological information sources, particularly information on basic research materials, doctoral dissertations, conference and seminar papers, ongoing scientific and technological tasks;
3. Organizing and implementing the registration and preservation of scientific research results and technological development outcomes;
4. Performing the function of the central library for the country in the fields of science and technology; building a national electronic library on science and technology;
5. Organizing and implementing the provision of information to serve leadership, management, scientific research, technological development, education, training, production, and business;
6. Publishing "Vietnam Science and Technology Books"; journal "Information & Documentation"; information publications; announcing the list of ongoing domestic scientific and technological tasks and the results of these tasks;
7. Developing the Vietnam Scientific and Technological Information Network (VISTA); Virtual Market for Technology and Equipment;
8. Organizing and implementing scientific and technological information dissemination work, bringing scientific knowledge to everyone, especially information on scientific and technological activities serving rural economic and social development, mountainous areas, and small and medium-sized enterprises;
9. Conducting scientific research and technological development, applying standards in the field of scientific and technological information and libraries;
10. Coordinating the organization of training and upgrading the professional skills of scientific and technological information personnel;
11. Cooperating in the implementation of international cooperation tasks in the field of scientific and technological information;
12. Implementing information services in the field of scientific and technological information according to the provisions of the law;
13. Performing other tasks assigned by the Minister of Science and Technology;
14. Managing the organization, staff, assets, and files of the Center according to the delegation and regulations of the Ministry.

ORGANIZATIONAL STRUCTURE
Article 3The organizational structure of the Center includes:

The Center operates under a directorate system headed by the Director and assisted by several Deputy Directors.
The Director of the Center is appointed and relieved of duty by the Minister of Science and Technology; he/she is responsible to the Minister of Science and Technology for all work of the Center.
The Director of the Center specifies the specific tasks and powers of subordinate units; arranges and assigns staff members suitable to the functions and tasks of the Center.
The Deputy Directors are proposed by the Director and appointed or relieved of duty by the Minister of Science and Technology; they are responsible for assisting the Director in general leadership work of the Center, accountable to the Director for the assigned responsibilities, and have the authority to decide issues within their delegated scope of duties.
In the absence of the Director, one Deputy Director will act on behalf of the Director to manage and resolve the Center's affairs according to the Director's authorization.
Article 4. The human resources of the Center include:
1) Staff within the establishment;
2) Staff working under labor contracts including:
a) Fixed-term contracts of one year or more and indefinite-term contracts;
b) Contracts based on specific tasks with a term of less than one year.
The Director of the Center signs labor contracts with workers in accordance with the Labor Code, suitable for the volume of work and the financial capacity of the Center.
Article 5. The Center implements labor management systems and pays salaries, wages, and other income sources, implements social insurance and health insurance systems for civil servants within the state budget and contractual employees from the Center's funds in accordance with current State regulations and those of the Ministry of Science and Technology.
CHAPTER III
WORK RELATIONSHIPS
Article 6The Director of the Center manages all activities of the Center based on the Charter of Organization and Operation of the Center and the working regulations of the Ministry of Science and Technology.
Article 7. The Center collaborates with subordinate units of the Ministry of Science and Technology to effectively perform assigned functions and tasks.
PART IV
FINANCIAL MANAGEMENT
Article 8. The Center applies financial management mechanisms for revenue-generating public service units.
1. The financial resources of the Center include the following sources:
a) Resources from the State budget;
b) Revenue from public services of the Center;
c) Other revenues as prescribed by law: grants, loans, gifts, etc.
2. Expenditures include:
a) Regular operational expenses according to the functions and tasks assigned by competent authorities;
b) Expenditure on service supply activities;
c) Labor hire costs;
d) Other expenditures as prescribed.
Article 9The Director of the Center is responsible for managing and using the Center's financial resources effectively; fulfilling obligations to the State; establishing development funds for public services, income stabilization reserves, welfare and rewards, and implementing accounting systems according to current State regulations.
CHAPTER V
IMPLEMENTING PROVISIONS
Article 10. The Director of the Center collaborates with the Head of the Personnel Department to implement this Charter.
Article 11Any amendments or supplements to this Charter shall be proposed by the Director of the Center in collaboration with the Head of the Personnel Department to the Minister of Science and Technology for consideration and decision./.
