Pursuant to the proposal of the Ministry of National Defense at Circular No. 2801/BQP dated May 9, 2004, Social Insurance at Circular No. 2019/BHXH-CĐCS dated June 15, 2004, and some localities regarding the guidance on supplementing the List of Leadership Positions in the Military, Police, and Cryptographic Sector to serve as the basis for adjusting pensions as stipulated in Point b Clause 2 Article 1 of Government Decree No. 31/2004/NĐ-CP dated January 19, 2004. After receiving opinions from the Ministry of Finance and the Ministry of National Defense, the Ministry of Labor, Invalids, and Social Affairs guides the application of the List of Leadership Positions in Appendix No. 01 issued together with Circular No. 03/2004 of the Joint Ministry of Labor, Invalids, and Social Affairs - Finance - National Defense as follows:

 

I. SUPPLEMENTATION OF THE LIST OF LEADERSHIP POSITIONS IN THE MILITARY AND POLICE TO SERVE AS THE BASIS FOR ADJUSTING PENSIONS

POLICE FOR THE PURPOSE OF DETERMINING PENSION AMOUNTS IN ACCORDANCE WITH REGULATIONS

1. Leadership positions in the Military:

Those who receive salary based on rank, hold leadership positions when retiring have been defined in Group A of the Appendix attached to Joint Circular No. 03/2004/TTLT-BLDTBXH-BTC-BQP dated March 4, 2004, including those holding leadership positions in military command, political, staff, or specialized and professional functions (Political Commissar, Deputy Political Commissar, Director, Deputy Director, Commander, Deputy Commander, Chief of Command, Deputy Chief of Command, Chief of Staff, Deputy Chief of Staff, Chief of Political Affairs, Deputy Chief of Political Affairs, Principal, Deputy Principal, Head, Deputy Head, or equivalent positions) from battalion level upwards, recorded in retirement files.

2. Leadership positions in the Police sector.

Those who receive salary based on rank, hold leadership positions when retiring are defined in Group B of the Appendix attached to Joint Circular No. 03/2004/TTLT-BLDTBXH-BTC-BQP dated March 4, 2004, including those holding leadership positions from the level of Chief, Deputy Chief of Police Station or equivalent upwards, recorded in retirement files.

II. IMPLEMENTATION

Due to historical development, changes in organizational structure, and variations in the number and titles of leadership positions across different periods, it is not possible to list all such positions comprehensively in the Appendix accompanying this guiding circular. Additionally, during the establishment of retirement files, some units failed to fully record the leadership positions that were officially appointed by competent authorities in the retirement files. During implementation, if there are any difficulties, the social insurance agencies of provinces and cities should compile lists attached to the files and send them to the Vietnam Social Security. The Vietnam Social Security will review the files and guide local social insurance agencies to resolve issues in accordance with current regulations. If any difficulties arise during implementation, please report to the Ministry of Labor, Invalids, and Social Affairs for research and resolution.
