 Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decision No. 56/2003/QĐ-BGD&ĐT dated December 10, 2003 of the Minister of Education and Training promulgating the Charter of Colleges;

Considering the proposal of the Rector of the College of Mechanical Engineering and Metallurgy (Document No. 979/CV-CKLK/TC dated December 14, 2004);

At the suggestion of the Director of the Department of Organization and Cadres,

 DECISION:

Clause 4 of Article 6Approves the Charter on Organization and Operation of the College of Mechanical Engineering and Metallurgy attached to this Decision.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

The Heads of the Ministry's Office, Inspectorate, Departments, Bureaus, Heads of units under the Ministry, and the Rector of the College of Mechanical Engineering and Metallurgy are responsible for implementing this Decision./.

CHARTER

 

Organization and Operation of the College of Mechanical Engineering and Metallurgy

(Annexed to Decision No. 11/2005/QĐ-BCN dated March 15, 2005)

of the Minister of Industry)

 

PART I

GENERAL PROVISIONS

Article 1. The College of Mechanical Engineering and Metallurgy (hereinafter referred to as the College) is an educational institution directly under the Ministry of Industry, with the function of training and upgrading human resources at the level of technical and economic college education and lower levels in fields such as mechanical engineering, metallurgy, electricity, electronics, informatics, automation according to the framework structure of the national education system and the system of educational and training certificates as stipulated in the Education Law dated December 2, 1998; it serves as a research and technology development organization to support management, production, and business operations in the industry sector and socio-economic development.

Full name in Vietnamese: College of Mechanical Engineering and Metallurgy.

International trade name: THE COLLEGE OF MECHANICS AND METALLURGY;

Abbreviation: CMM.

Main office: Lang Son Commune, Thai Nguyen City, Thai Nguyen Province.

Branch office: Tan Thanh Ward, Thai Nguyen City, Thai Nguyen Province.

Article 2. The College is subject to comprehensive and direct leadership and management by the Ministry of Industry; state management by the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and related ministries and sectors; administrative management within its territorial jurisdiction by the People's Committee of Thai Nguyen Province where the College is located; and enjoys policies and systems applicable to universities, colleges, vocational high schools, and vocational training institutions as provided by the State.

Article 3. The College is a public service training entity with revenue, having legal personality, operating on public funds allocated from the State budget and certain research, consulting, and service activities generating income as prescribed by the State, maintaining accounts at the State Treasury and banks, and using seals (including embossed and reduced-size seals) for its operations and transactions in accordance with the law.

Article 4. Establishing Party organizations and mass organizations.

1. The College has a grassroots Communist Party organization operating within the framework of the Constitution, laws, and the Party Charter, leading the College to implement the Party's guidelines, policies, and State laws, mobilizing Party members and the masses to unite and fulfill the College's political tasks.

2. Mass organizations and social organizations within the College operate in accordance with the law, responsible for achieving their objectives educational principles as prescribed by the Education Law and consistent with the mission, purpose, functions, and responsibilities of these organizations.

 

Chapter II

TASKS AND POWERS OF THE COLLEGE

Article 5. The College shall perform the following tasks.

1. Train human resources with good political qualities, ethics, and technical and economic college-level qualifications and lower levels in fields such as mechanical engineering, metallurgy, electricity, electronics, informatics, and automation according to the framework structure of the national education system and the system of educational and training certificates as prescribed by the Education Law.

2. Retrain and upgrade cadres and technical and economic managers in specialized fields, senior skilled workers meeting the standards set by the State and the requirements of agencies and enterprises both within and outside the industry sector.

3. Develop curricula, textbooks, teaching plans, and learning programs for the fields authorized by the College according to the framework curriculum issued by the Ministry of Education and Training.

4. Organize and implement student recruitment, student management, training activities, graduation certification, and issuance of graduation certificates in accordance with the Education Law.

5. Build and train a faculty team ensuring sufficient numbers and balanced structures in terms of qualification levels as prescribed by the Ministry of Education and Training.

6. Organize and carry out scientific and technological research projects; integrate training with scientific research and production work to enhance training quality in line with industrial development needs and socio-economic progress.

7. Conduct scientific and technical services, technology transfer, experimental production, production and business activities suitable to the training fields; provide career counseling and job placement services for students and graduates, and for units with demand as prescribed by current regulations.

8. Organize information dissemination activities through various forms such as specialized conferences, scientific seminars, surveys, study tours, printing, and publishing materials and textbooks to serve training and scientific research activities in accordance with State regulations.

9. Implement international cooperation and collaboration in training and upgrading human resources, research, and technology development with domestic and foreign organizations and individuals in accordance with the law.

10. Manage and utilize land, facilities, assets, and assigned capital sources for their intended purposes effectively.

11. Manage organizational structure and staffing in accordance with State regulations and the Ministry of Industry's delegated management authority.

12. Protect property, maintain political security, social order, and safety, safeguard national secrets, and establish and enforce labor protection rules and measures within the College.

13. Submit regular and ad hoc reports as required by the State reporting system and the Ministry of Industry.

14. Perform other tasks as prescribed by law.

Article 6. Rights of the College

1. Develop and implement planning, development programs, curricula, and training plans for the College in line with the State's education development strategy and the network of colleges.

2. Is authorized to cooperate in joint ventures, receive sponsorships, and accept capital contributions from organizations and individuals both within and outside the country for the purpose of training high-level human resources to serve the development of the School and the industry in accordance with state regulations.

3. Is permitted to mobilize funds from faculty members, staff, and employees to serve the training objectives, scientific research, technological development, production, business operations, and services in accordance with the law.

4. Is granted land by the State, allowed to lease land, and borrow funds; is exempted from taxes in accordance with current regulations.

5. Is authorized to issue internal management regulations and rules in compliance with the relevant state administrative agencies' regulations.

6. Decides on the establishment of subordinate organizations according to the organizational structure approved by the Ministry of Industry, appoints and dismisses positions such as Heads and Deputy Heads of departments, faculties, subjects, centers, production workshops, stores, and decides on issues concerning personnel from lecturer, specialist, and employee ranks.

7. To decide on the recruitment, rotation, salary increase, retirement, rewards and disciplinary actions, sending for study and work assignments both domestically and internationally, according to the hierarchical management of personnel by the Ministry of Industry.

8. Provides career counseling and job placement services.

9. Other authorities as prescribed by law.

Article 7. Civil Liability of the School

The School bears civil liability in accordance with the law; shall not allow organizations or individuals to exploit the School's name and facilities to conduct activities contrary to the law and this Charter.

 

Chapter III

ORGANIZATION AND STAFFING

Article 8. Organizational Structure of the School includes:

1. Leadership:

a) Principal;

b) Deputy Directors.

2. The Scientific Training Council and other advisory councils.

3. Business units:

a) Training Department;

b) Planning, Material Supply, and Technical Services Department;

c) Finance and Accounting Department;

d) Organization, Administrative Management, and Governance Department;

đ) Student and Pupil Affairs Department;

e) Security Office.

4. Specialized units:

a) Mechanical Engineering Faculty;

b) Metallurgy Faculty;

c) Electrical, Electronics, and Computer Science Faculty;

d) Basic Sciences and Fundamental Engineering Faculty;

d) Political Education Subject Group;

e) Research and Development Organizations.

5. Service and Training Support Units.

Article 9. Principal

The Rector is the legal representative of the School, directly responsible for managing and directing the School's activities in accordance with the law. The Rector is appointed and dismissed by the Minister of Industry for terms and standards set by the Ministry of Education and Training. The Rector has the following duties and powers:

1. Submits to the Minister of Industry for approval the Charter of the Organization and Activities of the College of Mechanical Engineering and Metallurgy based on the provisions of the College Charter issued together with Decision No. 56/2003/QĐ-BG&ĐT dated December 10, 2003 of the Minister of Education and Training; the Vocational School Charter issued together with Decision No. 775/2001/QĐ-BLĐTBXH dated August 9, 2001 of the Minister of Labor, Invalids, and Social Affairs, and implements after approval.

Within the scope of delegated authority, issues internal management regulations in compliance with current state regulations to ensure the School's activities are properly organized.

2. Submits to the Minister of Industry for approval the School's development planning, long-term plans, five-year plans, and annual plans; the School's financial budget and final accounts, and implements after approval.

3. Exploits, manages, and uses resources effectively to achieve training goals, develop the School, and ensure the quality and effectiveness of training, scientific research, production, and business operations.

4. Implements the tasks, powers, and responsibilities of the School as stipulated in Articles 6 and 7 of this Charter.

5. Decides on the establishment, division, merger, dissolution of internal organizations within the School's organizational structure approved by the Ministry, appoints positions such as Heads and Deputy Heads of Departments, Faculties, Subject Groups, and service units according to the Ministry of Industry's management hierarchy.

6. Manages and uses physical assets, property, and assigned funds from the State for their intended purposes effectively, including:

a) Performs the function of the main account holder; is responsible under the law for managing the School's physical assets, finances, and property in accordance with Articles 22, 23, 24, 25, and 26 of this Charter;

b) To manage and use funds for training, scientific research, production and business operations, and basic construction of the School in accordance with current state regulations;

c) Implements state regulations regarding labor, wages, scholarships, social allowances, and state policies and systems for lecturers, staff, and students of the School;

7. Determines the management costs and operational expenses in the financial budget based on the results of the School's training, scientific research, technical services, production, and business operations.

8. Organizes scientific and technological activities, experimental production, production and business operations, technical services, technology transfer; receives foreign sponsorship in accordance with the law.

9. Implements certain investment projects using budget funds according to the decision of the Ministry of Industry; for self-funded investment projects, follows current regulations.

10. Ensures the leadership of the Communist Party of Vietnam's grassroots organization and builds close relationships with mass organizations within the School.

11. When absent, the Rector delegates a Deputy Rector to manage and resolve work matters but remains accountable under the law and to the Minister of Industry for the delegation.

12. Ensures order, security, and safety within the School.

13. Implements other tasks as prescribed by law.

Article 10. Deputy Rector

The Deputy Rector assists the Rector and is assigned responsibility for one or more areas of work at the School by the Rector. The Deputy Rector resolves work matters and is accountable to the Rector for the results of the assigned work.

The appointment and removal of Deputy Directors are proposed by the Director and decided by the Minister of Industry according to the term and criteria set forth by the Ministry of Education and Training.

Article 11. Scientific and Training Council

1. The Scientific and Training Council advises the Director on:

a) Objectives, programs, long-term plans, annual plans regarding education and training, and science and technology of the School;

b) Training and developing the faculty and staff.

2. The Scientific and Training Council of the School consists of: the Rector, Deputy Rectors, Heads of Faculties, Center Directors, some Department and Subject Group Heads, lecturers, scientific and technological researchers, scientists, and representatives of economic and social organizations outside the School.

3. The Rector decides on the establishment of the Scientific and Training Council; the Chairman of the Council is elected by the Council members by majority vote, in case of equal votes, the decision is made according to the side with the Rector's vote. The Rector decides on the appointment of the Chairman of the Scientific and Training Council of the School.

4. The Scientific and Training Council of the School shall convene at least once every six months, convened by the Chairperson of the Council.

5. The Chairperson of the Scientific and Training Council of the School shall be responsible for drafting and submitting to the Rector for approval the Operational Regulations of the Council.

Article 12. Other advisory councils

Advisory councils (including councils on salary; staffing and recruitment of lecturers, officers, and staff; competition; commendation; discipline...) shall be established by the Rector with their own operational regulations; their composition shall comply with current State and Ministry of Industry regulations.

Article 13. Business units.

The School may organize business departments (offices) to assist the Rector in organizational matters, personnel, training, administration, planning, finance, international relations, student management, and shall have the following main tasks:

1. Implement assigned functions and responsibilities according to granted authority.

2. Proposing projects, initiatives, policies, and draft management decisions within their authority for the Director's consideration and decision.

3. Implementing the Director's decisions and handling regular tasks within their assigned functions and responsibilities.

4. Managing staff according to the division of authority by the Director.

The head of each department (office) shall be appointed and relieved from office by the Rector upon recommendation of the Director of the Organization - Administration - Management Department. Deputy heads of departments (offices) shall assist the head, and their appointments and reliefs shall be proposed by the head and approved by the Rector.

Article 14. Professional units.

1. Based on the number of fields and scale of training, the Rector shall decide to establish departments and subject groups under the school structure approved by the Ministry of Industry. Departments and subject groups under the School shall have the following main tasks:

a) Organizing and implementing the training process, teaching plans, study plans, and other educational activities according to the general teaching plan and schedule of the School;

b) Organize scientific research and technological development; implement the integration of training with scientific research, production-business, and social life;

c) Organize the compilation of curricula, textbooks, teaching materials, and improve teaching and learning methods; propose plans for supplementing and maintaining teaching equipment, practical training, and experimental facilities;

d) Developing and implementing plans for training and enhancing professional skills for lecturers, staff, and employees under the department;

đ) Managing lecturers, staff, and employees under the department according to the division of authority by the Director.

Each department shall have a Head and one or two Deputy Heads. The Head shall be appointed and relieved from office by the Rector upon recommendation of the Director of the Organization - Administration - Management Department. The Deputy Head shall be appointed and relieved from office by the Rector upon recommendation of the Head. The term of office and standards for the Head and Deputy Head shall comply with the regulations of the Ministry of Education and Training.

2. The Rector shall specify the specific tasks of subject groups under the School.

Article 15. Subject groups under the Department.

1. Subject groups under the department are basic training units, engaging in scientific and technological activities. Subject groups shall have the following main tasks:

a) Be responsible for the content, quality, and progress of teaching and learning of certain subjects within the department's and School's general teaching program and plan;

b) Organizing the development, improvement of content, programs, textbook compilation, and teaching materials related to the specialized fields and vocational training programs assigned by the faculty and the school.

c) Implementing teaching and learning plans, scientific and technological activities, and managing facilities and equipment as assigned by the faculty and the school.

2. The head of the subject group shall be appointed and relieved from office by the Rector upon recommendation of the Department Head. The term of office and standards for the Head of the subject group shall comply with the regulations of the Ministry of Education and Training.

Article 16. Research and Development Organizations

1. Research and technology transfer organizations shall be established in the form of centers or science and technology enterprises; their main tasks include conducting scientific research, experimental production, production-business, and technology transfer to enhance training quality and serve economic and social development needs.

2. Research and development organizations shall operate in accordance with the Science and Technology Law dated June 9, 2000, established by the Rector; for research organizations with legal personality, bank accounts, and seals, the Rector shall develop proposals for the Ministry of Industry to consider and decide.

Article 17. Service and Training Facilities

The School may organize service and training facilities, including:

1. Service facilities include: laboratories; practical and internship rooms; libraries, tradition rooms, clubs, sports and cultural houses, dormitories.

2. Service and technology transfer facilities include: language centers, computer centers, part-time education centers, experimental production, production-business, driving schools, career counseling, job placement services, and student life services.

The Rector shall decide on the establishment of service and training facilities, define their functions, tasks, authorities, and appoint management positions. For facilities with legal personality, bank accounts, and seals for operation, the Rector shall develop proposals for the Ministry of Industry to consider and decide.

 

Chapter IV

TEACHERS, OFFICERS, AND STAFF

Article 18. Lecturer

Teachers include those within the School's staffing who engage in teaching work, and technical-economic officers and managerial staff working inside and outside the School who participate in teaching on a part-time basis, having university-level qualifications or higher, pedagogical competence, meeting the professional standards set by the Ministry of Education and Training, and capable of teaching theoretical and practical courses at college level and below.

1. Teachers have the following tasks:

a) Strictly adhere to the Party's policies and guidelines; state policies and laws; implement the regulations, rules, provisions, and internal regulations of the Ministry of Education and Training, Ministry of Industry, and the School;

b) Teach according to the prescribed content and curriculum by the Ministry of Education and Training and the School; write textbooks and develop teaching materials as assigned by the School, Department, and Subject Group;

c) Being subject to supervision by the school regarding the content, quality, and methods of teaching and scientific research;

d) Lead research projects or participate in scientific research and technology application and transfer as assigned by the School, Department, and Subject Group;

đ) Completing other tasks assigned by the school, faculty, and department;

e) Continuously improving professional skills and teaching methods to enhance teaching quality;

g) Maintain personal integrity, reputation, and honor; respect human dignity, protect the legitimate rights and interests of students; guide students in study, research, scientific and technological implementation, ideological, moral, style, and lifestyle cultivation.

2. Teachers have the following authorities:

a) Be assigned teaching duties according to their field of expertise; determine the content of teaching materials consistent with the general regulations of the Ministry of Education and Training;

b) Selecting teaching methods and tools to maximize individual capabilities and ensure teaching quality and effectiveness;

c) Participate in scientific research and technological implementation; receive training and professional enhancement; take examinations for promotion and transfer of rank according to the law on cadres and civil servants;

d) Enjoying material and spiritual benefits according to state policies for educators;

đ) Signing teaching and scientific research contracts with agencies, units, and enterprises in accordance with the Labor Code and the Visiting Lecturer Regulations issued by the Ministry of Education and Training;

e) Participating in democratic regulations within the school;

g) Being considered for national awards such as People's Teacher, Outstanding Teacher, Commendation Medal for the Education Cause, and other commendations.

Article 19. Officers and Staff

Officers and staff of the School include leadership and management officers, functional units, professional units, service units; technical workers employed in units within the School's organizational structure and have the following tasks and authorities:

1. To be assigned clear tasks and be responsible for completing the assigned work.

2. To strictly comply with regulations and decisions of the Rector and current laws.

3. To use work equipment as required by their job and have the obligation to maintain and preserve the common property of the School.

4. Participate in discussions and provide opinions on the program, plans, mid-term reviews, and final evaluations of the working unit and the School. Propose measures to improve organizational management, working conditions, material and spiritual life, environmental hygiene, and staff training and development to meet the requirements of the School.

5. To participate in discussions and build regulations on organizational management, rights, and obligations of staff members within the School.

6. To be proposed by the Rector to arrange and utilize according to the State’s policies and systems for staff members as stipulated in the Labor Code.

The positions, tasks, and authorities, working systems of staff members (excluding Party and mass organization staff) shall be decided by the Rector according to the cadre management classification of the Ministry of Industry.

 

Chapter V

STUDENTS

Article 20. Candidates for admission to the School

Vietnamese citizens, overseas Vietnamese, and foreigners who meet the conditions stipulated in the Admissions Regulations for universities and colleges issued by the Ministry of Education and Training may register for admission to the School.

Article 21. Duties and rights of students

1. Tasks of students:

a) Strictly comply with state laws, the charter, regulations, provisions, and internal rules of the School, and current regulations on education and student rules for both resident and non-resident students.

b) To complete all study contents, scientific research, and training activities as stipulated in the School's training program and plan;

c) To respect lecturers, staff members, and employees of the School;

d) Fulfill the obligation to pay tuition fees according to the current regulations of the State.

đ) To participate in class activities, mass organizations, public welfare labor, and social service activities;

e) To maintain and preserve the School's property;

Students enrolled under the quota system must comply with the dispatching of competent state authorities responsible for sending them to study; if they fail to comply, they must reimburse scholarships and training costs as prescribed by law.

2. Rights of students:

a) To be respected and treated equally by the School and to be provided with timely and comprehensive information about their studies;

b) Be guaranteed educational systems as prescribed by the Ministry of Education and Training;

c) To participate in mass organizations and social organizations according to the law;

d) To use the School's equipment and facilities for learning, scientific research, physical education, and sports according to the School's regulations;

đ) To directly or through the organizations and mass organizations they belong to, make suggestions to the School regarding solutions to contribute to building the School and protecting their legitimate rights and interests;

e) Enjoy social policies as prescribed by the State and benefits according to the law regarding scientific research achievements and production labor;

g) To receive a degree upon graduation.

Chapter VI

ASSETS AND FINANCES

Article 22. The School's assets, which are assigned by the State and the Ministry of Industry, include:

The main campus located in Luong Son commune, Thai Nguyen city, Thai Nguyen province, and the second campus located in Tan Thanh ward, Thai Nguyen city, Thai Nguyen province, including land, office buildings, laboratories, science and technology consulting and service centers, experimental production workshops, equipment and machinery invested by the State and self-provided by the School, architectural structures, and all infrastructure within the planned area approved by the Ministry of Industry based on economic and technical justifications. The School is responsible for:

1. Properly preserving and using physical facilities and assets in accordance with their intended purposes and effectively in the various fields of activity of the School.

2. Conducting an annual inventory and revaluation of the School's assets.

3. All assets must be fully recorded and documented in accordance with the State's regulations.

Article 23. The liquidation, transfer, and reallocation of the School's assets must comply with the State's regulations.

Article 24. Financial resources ensuring the operation of the School:

1. State funding for vocational training activities includes: salaries, administrative expenses, repair and upgrade costs for equipment, construction projects for physical facilities, national-level research topics, ministry-level and grassroots-level research topics, and training quotas assigned by the State.

2. Tuition fees and service charges as prescribed by the State.

3. Revenue from cooperative training, scientific and technological experimentation, experimental production, production and business operations, and services as prescribed by current regulations.

4. Other revenues as prescribed by law, including: sponsorships, aid, donations, gifts, capital contributions from organizations, businesses, and individuals both domestically and internationally for expanding and developing the School.

5. Borrowed credit and capital mobilization from faculty members, staff, and employees in accordance with the provisions of the law.

6. Supplementary capital from the School's operations after fulfilling its obligations to the State.

Article 25. Contents of expenditures of the School.

1. Regular operational expenditures according to functions and tasks assigned by authorized bodies as follows:

a) Expenditures for employees, including: salaries, wages, allowances, social insurance and health insurance contributions, training and development programs for lecturers, staff, and employees, and union activity funds as prescribed by current regulations;

b) Administrative management expenditures, including: office supplies, administrative services, communication, travel expenses, conference fees.

c) Professional and vocational teaching, learning, and scientific research expenditures for lecturers, staff, employees, and students.

d) Expenditure on purchasing assets and regular maintenance of fixed assets and material facilities.

2. Production and service provision operational expenditures and fulfillment of budgetary obligations to the State regarding tax payments and depreciation of fixed assets.

3. Expenditure on implementing research topics at the School level, ministry level, and state level; expenditure on counterpart funds for implementing projects with foreign capital in accordance with the regulations.

4. Expenditure on streamlining staffing in accordance with the State's regulations.

5. Development investment expenditure, including: construction of material facilities, purchase of fixed assets and equipment, implementation of other investment projects in accordance with State regulations.

6. Expenditure on urgent tasks assigned by the competent authority.

7. Repayment of loans and capital contributions.

8. Other expenditures.

Article 26. Financial Management

The institution shall manage its finances in accordance with the State's regulations on financial systems applicable to training units with income as follows:

1. Manage the financial resources assigned by the State and implement the current financial expenditure system.

2. Manage credit loans, bank loans, development support funds, and other funds to expand and enhance the quality of training, scientific research, production organization, service provision activities, and bear responsibility for repaying loan principal.

3. Establish and proactively utilize reserve funds for income stabilization, rewards, welfare, and the development of vocational training activities as prescribed by the State.

4. Subordinate units that operate with revenue, have legal personality, seals, and separate accounts must report financial statements regularly to the School in accordance with the law. Subordinate units without legal personality must manage finances through the School's Finance and Accounting Department.

5. Open accounts at the State Treasury to reflect budgetary funds and revenue from vocational activities, and open deposit accounts at banks to reflect revenue from production and service provision activities of the School; fulfill tax obligations to the State and enjoy tax exemption and reduction benefits for production and service provision activities with revenue.

6. Prepare annual financial revenue and expenditure budgets and report to the Ministry of Industry, the State Treasury where the School has accounts. For budgetary revenues and expenditures, they must be reflected in the account at the State Treasury according to current regulations. Funds from the State budget for regular operations and vocational revenue not spent in the year can be carried over to the next year for continued use.

7. Organize accounting, statistics, financial reporting, and publicly disclose financial information in accordance with the law.

8. Implement auditing systems to evaluate the effectiveness of capital and asset management; accept supervision and inspection by the Ministry of Industry and relevant state management agencies.

 

Chapter VII

RELATIONSHIP OF THE INSTITUTION WITH STATE AGENCIES AND LOCAL AUTHORITIES

AND LOCAL AUTHORITIES

Article 27. The School is subject to inspection and supervision by the Ministry of Industry and relevant state management agencies in accordance with the functions prescribed by law, as follows:

1. Adhere to laws, implement State and Ministry of Industry regulations related to the institution's areas of operation.

2. Adhere to financial, credit, tax, profit distribution, accounting, and statistical systems as prescribed by law.

3. Comply with the State and Ministry of Industry's regulations on organizational and personnel work, including: establishment, division, merger, restructuring, dissolution; approval, amendment, and supplementation of the School Charter; appointment, dismissal, transfer, commendation, and disciplinary action for the Principal and Deputy Principals.

4. Implement State regulations on external relations.

5. Fulfill rights and obligations towards lecturers, staff, and workers in the institution in accordance with the law.

Article 28. The School may establish cooperative relationships and coordinate with functional departments, specialized management agencies under the Ministry, scientific research institutions, information media, training schools, enterprises, and other organizations in all fields to fulfill its mission.

The institution is allowed to establish cooperative relationships and exchange professional experience in training and cadre development with domestic and international organizations in accordance with the law.

Article 29. Relationship between the President and Party organization and mass organizations:

1. The relationship with the Party Committee of the School shall be carried out in accordance with Regulation No. 97/QD-TW dated March 22, 2004 of the Central Committee of the Communist Party of Vietnam.

2. The relationship with the Trade Union Committee to coordinate and resolve issues related to the performance of the functions, duties, responsibilities, powers of the Trade Union; obligations and rights of members under the Trade Union Law of 1990.

3. The Rector shall create favorable working conditions and provide necessary information for the Ho Chi Minh Communist Youth Union to perform its functions, tasks, powers, obligations, and rights as stipulated in the Charter of the Union.

4. The Rector shall facilitate and assist social organizations within the School in their activities according to their objectives, purposes, functions, and tasks, contributing positively to the implementation of educational principles of the Party and State within the School.

Article 30. The School is subject to administrative territorial management by the People's Committee where the School is located.

 

Chapter VIII

IMPLEMENTING PROVISIONS

Article 31. Subordinate units, lecturers, staff, and employees within the School have the responsibility to implement this Charter.

Article 32. Based on the Charter, the Rector of the School has the responsibility to establish and promulgate internal regulations regarding the functions, tasks, and powers of each department within the organizational structure of the School.

Article 33. Upon the proposal of the Rector, the Ministry of Industry shall consider and decide to amend, supplement, adjust, or abolish the Charter of the School./.
