JOINT CIRCULAR
Guidelines for quarterly health check-ups for workers at business establishments prone to being exploited for prostitution activities

Pursuant to Article 11 and Article 27 of Decree No. 178/2004/NĐ-CP dated October 15, 2004 of the Government detailing implementation of certain provisions of the Ordinance on Prevention and Control of Prostitution;
After reaching an agreement with the Ministry of Labor, Invalids and Social Affairs through Circular No. 1915/LĐTBXH-PCTNXH dated June 7, 2006, the Ministry of Health and the Ministry of Finance issue guidelines for quarterly health check-ups for workers at business establishments prone to being exploited for prostitution activities (hereinafter referred to as business establishments) as follows:
I. SCOPE OF REGULATION AND APPLICABLE OBJECTS

This Circular guides the operation of healthcare facilities under the health sector and the responsibility of employers regarding quarterly health check-ups for workers employed at business establishments.

a) General hospitals at the district level and above (hereinafter referred to as hospitals) must have sufficient doctors and necessary technical equipment to conduct health check-ups according to the specialties specified in the Quarterly Health Check-Up Booklet for Workers (hereinafter referred to as the Health Check-Up Booklet) - Appendix No. 1 attached hereto.
b) Business establishments shall operate within the scope of activities listed in the catalog of workplaces and jobs as stipulated in Joint Circular No. 21/2004/TTLT-BLĐTBXH-BYT dated December 9, 2004 of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health guiding and specifying the catalog of workplaces and jobs that do not employ workers under 18 years old in business establishments prone to being exploited for prostitution activities.
c) Workers such as waitresses, service staff, dancers... (hereinafter collectively referred to as workers) working at business establishments as specified in point b, Clause 2 of this Article.
II. ORGANIZATION OF HEALTH CHECK-UPS
1. For Hospitals
a) General Principles:
- Hospitals shall carry out quarterly health check-ups for workers upon request from business establishments.
- The periodic health check-up for workers according to the contents in the Health Check-Up Booklet as prescribed in Appendix No. 1 attached hereto.
- Hospitals organizing health check-ups must be responsible for treating workers suffering from diseases specified in Appendix No. 2 attached hereto and collect hospital fees according to current regulations of the State; if beyond their professional capacity or at the request of the worker or employer, the hospital must arrange for transfer of the patient according to current regulations.
- Statistical work, reporting, and archiving results of periodic health check-ups for workers according to professional regulations of the health sector and included in the general professional activity plan of the hospital.
b) Organization of Health Check-Ups:
- Doctors specializing in dermatology, infectious diseases, internal medicine, gynecology, laboratory tests, diagnostic imaging, and other relevant specialties.
- The director or deputy director in charge of professional matters of the hospital shall be responsible for concluding on the health status.
c) The hospital conducting health check-ups has the following responsibilities:
- Completing administrative procedures for health check-ups and issuing appointment cards for result delivery.
- Conducting clinical examinations and performing ancillary clinical tests according to the contents in the Health Check-Up Booklet.
- Conducting additional examinations and tests as required by specialties.
- Based on the conclusions of doctors from various specialties, the director or deputy director in charge of professional matters of the hospital shall conclude on the health status of the worker, sign, stamp the hospital seal, and affix the position seal.
- Within seven days after conducting health check-ups for workers, the hospital shall return the Health Check-Up Booklet and ancillary clinical test results to the employer of the business establishment.
- In case the worker suffers from one or more diseases specified in Appendix No. 2 attached hereto, the hospital director shall notify the employer of the business establishment about the health condition of the worker; simultaneously, notify in writing to the provincial or municipal labor department and the district, county, city, or town-level labor department where the business establishment's main office is located for monitoring and management.
- The Provincial/Municipal Department of Veterans Affairs and Social Affairs and the District/Urban District/Rural City/Township Department of Veterans Affairs and Social Affairs of the locality where the main office of the business service provider is located shall monitor and manage.
2. For Business Establishments
a) Organize for workers to undergo quarterly health check-ups every three months, as stipulated in this Circular.
If a worker has already undergone a quarterly health check-up coinciding with the regular health check-up for workers at business establishments, the employer shall organize supplementary health check-ups for the worker according to the contents in Appendix No. 1 attached hereto.
b) Contact and enter into contracts with hospitals to organize health check-ups for workers.
c) Pay examination fees and ancillary clinical test costs to the hospital according to the law.
d) Notify each worker individually about the results of their health check-up.
e) Based on the health conclusion of the worker in the Health Check-Up Booklet, if the worker suffers from one or more diseases specified in Appendix No. 2 attached hereto, the employer of the business establishment must arrange for the worker to receive treatment at healthcare facilities and be responsible for monitoring and supervising the treatment process; in cases where the disease does not improve, they must arrange alternative work outside the workplace and job as specified in point b, Clause 2, Section I of this Circular.
III. FEES FOR HEALTH CHECK-UPS AND ANCILLARY CLINICAL TEST COSTS
1. Fee levels for health check-ups and ancillary clinical test costs: According to the current hospital fee system.
2. For Hospitals:
Fees for health check-ups and ancillary clinical test costs are hospital revenue sources, to be used and managed in accordance with the State's regulations on hospital fees.
3. For business establishments providing services with employees undergoing health examinations: The costs of health examinations and clinical laboratory tests shall be included in the service expenses.
4. Medical treatment costs for employees shall be implemented according to current regulations on medical insurance benefits or employees shall pay hospital fees according to the current payment system.
IV. IMPLEMENTATION
1. Provincial People's Committees shall direct the Health Departments to coordinate with Labor, Invalids, and Social Affairs Departments and relevant agencies to disseminate this Circular to hospitals and business establishments providing services; develop programs and plans for regular and spot inspections and audits of the implementation of this Circular; ensure quarterly health check-ups for employees and take measures to manage employees at business establishments suffering from diseases specified in Appendix No. 2 issued together with this Circular.
2. The Ministry of Health and Health Departments of provinces and centrally-administered cities shall be responsible for guiding and directing hospitals under their management to implement quarterly health check-ups for employees working at business establishments providing services.
Labor, Invalids, and Social Affairs Departments of provinces and centrally-administered cities shall be responsible for directing and guiding labor, invalids, and social affairs agencies at all levels and organizations to manage employees through the signing of labor contracts and the results of quarterly health check-ups of employees at business establishments in accordance with this Circular and related laws and regulations on labor and employment.
3. Hospitals conducting quarterly health check-ups for employees shall be responsible for organizing research on the content of quarterly health check-ups for employees as stipulated in this Circular and related health sector regulations; prepare health examination records for business establishments providing services.
4. Business establishments providing services shall organize quarterly health check-ups for employees in accordance with the provisions; store and keep confidential health examination records, report to competent authorities when required. In cases where employees are not working at the establishment, the owner of the business establishment providing services shall hand over the quarterly health examination record to the employee for management.
V. IMPLEMENTATION PROVISIONS
This Circular shall take effect fifteen days from the date of publication in the Official Gazette. Previous regulations contrary to this Circular shall be abolished. During implementation, if there are difficulties or obstacles, they should be reported to the relevant ministries for study and resolution./.
