DECISION
Announcing the maritime area of Ha Tinh coastal ports within the jurisdiction of Ha Tinh Province
and the management area of Ha Tinh Maritime Port Office

Pursuant to the Vietnam Navigation Law dated June 14, 2005;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port and shipping channel management;
Based on the opinions of the People's Committee of Ha Tinh Province at Official Document No. 2102/UBND-CN1 dated September 29, 2006;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.
DECISION:
Article 1.
1. Now announcing the maritime areas of the ports located within the jurisdiction of Ha Tinh Province, including:
a) The maritime area before the port wharf and berths of Vung Ang Port and Xuan Hai, Xuan Pho Berths;
b) The maritime area of the port channels, branch channels, pilot reception zones, quarantine zones, anchorage areas, transshipment areas, and typhoon shelters of the ports specified in point a of this clause.
2. Other maritime areas before the port wharfs, berths, anchorage areas, transshipment areas, and typhoon shelters shall be announced in accordance with the provisions of the law.
12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe scope of the maritime areas of the ports located within the jurisdiction of Ha Tinh Province is measured according to the highest tidal level and defined as follows:
1. The Vung Ang Port Area:
a) The boundary towards the sea: delimited by straight lines connecting points A1, A2, A3, A4, and A5 with the following coordinates:
A1: 18°06'30"N, 106°22'30"E;
A2: 18°08'30"N, 106°22'30"E;
A3: 18°08'30"N, 106°27'30"E;
A4: 18°05'00"N, 106°27'30"E;
A5: 18°05'00"N, 106°22'24"E.
b) The boundary towards the land: from point A1 running along the shoreline to point A5.
2. The Xuan Hai, Xuan Pho Berth Area on the Lam River includes:
a) The common maritime area with the Ben Thuy Port Berth: the maritime area defined in the Decision of the Minister of Transport regarding the maritime area of the ports located within the jurisdiction of Nghe An Province and the management area of the Nghe An Maritime Port Office;
b) The Xuan Hai, Xuan Pho Berth Maritime Area: the maritime area on the Lam River limited by two straight lines intersecting the river at points 2,000 meters upstream from the edge of the Xuan Hai Port Wharf and 1,000 meters downstream from the edge of the Xuan Pho Port Wharf.
Article 3.
The pilot reception zone, quarantine zone, anchorage area, transshipment area, and typhoon shelter for vessels entering the ports located within the jurisdiction of Ha Tinh Province are defined as follows:
1. Pilot Reception Zone and Quarantine Zone:
a) The Vung Ang Port Area: the maritime area limited by a circle with a radius of 01 nautical mile, with its center located at the following coordinates:
18°08'00"N; 106°23'30"E.
b) The Xuan Hai, Xuan Pho Berth Area: the maritime area limited by a circle with a radius of 01 nautical mile, with its center located at the following coordinates:
18°47'12"N; 105°47'00"E.
2. Anchorage Area, Transshipment Area, and Typhoon Shelter:
a) For Vung Ang Port: designated by the Director of the Ha Tinh Maritime Port Office based on actual weather conditions, wave and wind conditions, and tidal levels in the area;
b) For Xuan Hai, Xuan Pho Berths: near Hon Nu Island within the common maritime area with the Ben Thuy Port Berth.
Article 4.
1. The Ha Tinh Maritime Port Office is responsible for:
a) Performing its duties and powers as prescribed by the Vietnam Navigation Law and related laws concerning maritime activities in the maritime area of Vung Ang Port and Xuan Hai, Xuan Pho Berths;
b) Based on actual weather conditions, wave and wind conditions, draft, and vessel tonnage, designating specific positions for vessels to anchor, transship, and avoid typhoons in the maritime areas defined in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.
2. As for the common maritime area with the Ben Thuy Port Berth, the coordination and management between the Ha Tinh Maritime Port Office and the Nghe An Maritime Port Office shall be carried out according to the following principles:
a) The Ha Tinh Maritime Port Office is responsible for coordinating with the Nghe An Maritime Port Office to manage the maintenance of order and safety in the common maritime area with the Ben Thuy Port Berth. Any incidents involving vessels entering or leaving which berth shall be primarily handled by the maritime port office managing that area in accordance with the law;
b) In cases where vessels enter or leave the Xuan Hai, Xuan Pho Berths but must wait, transship, or avoid typhoons in the Hon Nu Island area, the Ha Tinh Maritime Port Office must notify the Nghe An Maritime Port Office at least three hours in advance of the relevant information for joint management in accordance with the law;
c) In cases where vessels arrive at the Xuan Hai, Xuan Pho Berths but then proceed to the Ben Thuy Port Berth or Cu Loi Port, or vice versa, the maritime port office where the vessel first arrives is responsible for handling procedures and collecting entry fees; the maritime port office where the vessel subsequently arrives handles departure procedures and collects departure fees in accordance with the law;
d) For other activities related to order and safety, as well as vessel operations in the common maritime area with the Ben Thuy Port Berth, except for those activities specified in points a and b of Clause 2 of this Article, they shall be managed by the Nghe An Maritime Port Office in accordance with the law.
Article 5.Outside the maritime areas defined in Articles 2 and 3 of this Decision, the Ha Tinh Maritime Port Office also has the responsibility for state management of maritime safety and security in the sea area within the jurisdiction of Ha Tinh Province.
Article 6.This Decision takes effect 15 days after its publication in the Official Gazette and revokes Decision No. 2437/2002/QĐ-BGTVT dated August 7, 2002 of the Minister of Transport regarding the maritime areas of the ports located within the jurisdiction of Ha Tinh Province and the responsibility area of the Ha Tinh Maritime Port Office.
Article 7. The Heads of the Ministry’s Office, the Inspectorate, the Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Directors of the Ha Tinh Provincial Department of Transport, the Nghe An Provincial Department of Transport, the Ha Tinh Maritime Port Office, the Nghe An Maritime Port Office, and the heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
