DIRECTIVE

Regarding the implementation of the Amnesty Law

The Amnesty Law was passed by the National Assembly, Session XII on November 21, 2007, and took effect from March 1, 2008. To ensure strict and consistent enforcement of the Amnesty Law, creating positive changes in encouraging convicted persons to repent, reform, actively study and work to be eligible for State amnesty, the Prime Minister requests that all Ministries, agencies at the ministerial level, and People's Committees of provinces and centrally governed cities immediately carry out the following tasks:

1. Ministry of Public Security

a) Take the lead and coordinate with the Ministry of Justice, the Ministry of Defense, and relevant ministries and sectors to urgently draft and submit to the Government for promulgation a Decree detailing certain provisions of the Amnesty Law and other regulatory legal documents as prescribed by the Amnesty Law;

b) Take the lead and coordinate with the Ministry of Justice and the Ministry of Defense to compile publicity materials, disseminate, and provide guidance on the implementation of the Amnesty Law to the public, ensuring clarity, ease of understanding, and consistency;

c) Urgently organize specialized training on the Amnesty Law for police officers, focusing on leadership cadres at various levels of the police force and staff involved in managing and enforcing prison sentences in detention centers and prisons;

d) Directly instruct police units at all levels to allocate sufficient capable and virtuous personnel for amnesty work; ensure that amnesty activities are timely, transparent, and conducted according to standards, procedures, and formalities; promptly address complaints regarding the compilation of lists of individuals proposed for amnesty and reports of violations during the amnesty process as stipulated by law; resolutely and strictly handle any police officers who violate laws related to amnesty;

đ) Coordinate with the Supreme People's Court and the Supreme People's Procuracy to implement activities related to amnesty;

Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force

a) Compile materials and organize specialized training on the Amnesty Law for military personnel involved in managing and enforcing prison sentences. Coordinate with the Ministry of Public Security to draft a draft Decree detailing certain provisions of the Amnesty Law and other regulatory legal documents as prescribed by the Amnesty Law; allocate sufficient capable and virtuous personnel for amnesty work; promptly address complaints regarding the compilation of lists of individuals proposed for amnesty and reports of violations during the amnesty process as stipulated by law; resolutely and strictly handle any personnel who violate laws related to amnesty;

b) Coordinate with the Supreme People's Court and the Supreme People's Procuracy in implementing activities related to amnesty;

3. The Ministry of Foreign Affairs

Coordinate with the Ministry of Public Security to draft a draft Decree detailing certain provisions of the Amnesty Law and other regulatory legal documents as prescribed by the Amnesty Law, focusing on guidelines for the implementation of amnesty for foreign nationals. Adopt appropriate forms of international propaganda to clarify the humanitarian policies of the Party and the State towards convicted persons;

4. Ministry of Information and Communications

Coordinate with the Ministry of Public Security, the Ministry of Defense, the Ministry of Justice, the Ministry of Foreign Affairs, and the Government's Inter-Ministerial Coordination Committee for Legal Education and Propaganda to direct and guide central and local media outlets to disseminate and educate about the Amnesty Law and guiding documents;

5. The Ministry of Finance

Take the lead and coordinate with the Ministry of Public Security, the Ministry of Defense, relevant ministries and agencies, and People's Committees of provinces and centrally governed cities to prepare a budget for implementing the Amnesty Law in 2008, and submit it to the Prime Minister for consideration and decision to supplement funding for the Ministry of Defense and the Ministry of Public Security;

6. All Ministries, agencies at the ministerial level, and People's Committees of provinces and centrally governed cities:

a) Within their respective duties and authorities, organize the dissemination and education of the Amnesty Law, the President's Decision on amnesty, and guiding documents issued by competent state agencies;

b) Direct the provision of information and documents related to individuals proposed for amnesty; issue certificates and confirmations regarding compliance with policies and laws or family circumstances or other necessary documents of individuals proposed for amnesty;

c) Receive and create conditions to assist individuals released through amnesty to reintegrate into their families and communities, providing employment opportunities and stabilizing their lives;

7. The Minister of Public Security shall be responsible for monitoring, urging, inspecting, and reporting to the Prime Minister on the implementation of this Directive;

Ministers, heads of agencies at the ministerial level, heads of agencies under the Government, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Directive./.
