JOINT CIRCULAR

Guidelines on the transfer and classification of salary grades for technical medical staff

Pursuant to Decree No. 116/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of officials and civil servants in state-owned public service units, and Decree No. 121/2006/NĐ-CP dated October 26, 2006 of the Government amending and supplementing certain articles of Decree No. 116/2003/NĐ-CP;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for officials, civil servants, and technical staff, and Decree No. 76/2009/NĐ-CP dated September 15, 2009 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for officials, civil servants, and technical staff;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Home Affairs;

Pursuant to Circular No. 09/2009/TT-BNV dated October 15, 2009 of the Ministry of Home Affairs promulgating job titles and code numbers for technical medical staff positions;

Pursuant to Circular No. 23/2009/TT-BYT dated December 1, 2009 of the Ministry of Health promulgating professional standards for technical medical staff positions;

The Ministry of Health and the Ministry of Home Affairs hereby issue guidelines on the transfer and classification of salary grades for technical medical staff as follows:

Article 1. Scope of Regulation and Applicability

1. These joint circulars provide guidance on the transfer and classification of salary grades for technical medical staff as specified in Circular No. 09/2009/TT-BNV dated October 15, 2009 of the Ministry of Home Affairs promulgating job titles and code numbers for technical medical staff positions (referred to as Circular No. 09/2009/TT-BNV) and Circular No. 23/2009/TT-BYT dated December 1, 2009 of the Ministry of Health promulgating professional standards for technical medical staff positions (referred to as Circular No. 23/2009/TT-BYT).

2. These joint circulars apply to technical medical staff working at public health service units.

Article 2. Principles for Transfer of Positions

1. The transfer of positions must be based on the responsibilities, job positions, and professional qualifications assigned to the staff member.

2. Staff members who are transferred to positions must meet the professional standards for technical medical staff positions as stipulated in Circular No. 23/2009/TT-BYT.

3. When transferring from the current position to a technical medical staff position, there shall be no combination with promotion of salary grade, promotion of position, or change in type of staff member.

Article 3. Method of Transfer from Current Position to Technical Medical Staff Position

1. Transfer to the technical medical assistant position (position code 16.285) for staff members currently engaged in technical medical work and holding senior technical assistant positions that meet the conditions and standards stipulated in Circular No. 23/2009/TT-BYT.

2. Transfer to the mid-level technical medical assistant position (position code 16.287) for staff members currently engaged in technical medical work and holding chief technical medical assistant positions that meet the conditions and standards stipulated in Circular No. 23/2009/TT-BYT.

3. Transfer to the junior technical medical assistant position (position code 16.288) for staff members currently engaged in technical medical work and holding technical medical assistant positions that meet the conditions and standards stipulated in Circular No. 23/2009/TT-BYT.

Article 4. Salary Grading Method

The classification of salary grades for staff members transferred to technical medical staff positions according to Article 3 of these joint circulars shall be implemented in accordance with Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the classification of salary grades when promoting positions, transferring positions, or changing types of staff members.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Heads of public service units directly managing and utilizing staff members have the responsibility to:

a) Review job positions within their unit, develop plans for transferring positions and classifying salary grades for staff members under their management, submit them to higher-level supervisory agencies for consolidation and submission to competent authorities for approval.

b) Decide on transferring positions and classifying salary grades for staff members under their management to positions within their authority or according to delegated authority after the plan for transferring staff positions has been approved by competent authorities.

2. Ministries, agencies equivalent to ministries, provincial people's committees, and municipal people's committees directly under the central government have the responsibility to:

a) Direct subordinate units to implement the transfer and classification of positions and salary grades for technical medical staff.

b) Approve plans for transferring positions and classifying salary grades for staff members of subordinate units; resolve issues within their authority during the process of transferring staff positions.

c) Decide on transferring positions and classifying salary grades for staff members under their management within their authority.

d) Report the results of transferring positions for technical medical staff under their management to the Ministry of Health and the Ministry of Home Affairs.

Article 6. Effectiveness

These joint circulars take effect from April 15, 2011.

During implementation, if any difficulties arise, ministries, sectors, and localities should report to the Ministry of Health and the Ministry of Home Affairs for consideration and resolution./.
