CIRCULAR
Issued Domestic air passenger transport service on regular basic economy classlist of light jobs that can employ persons under 15 years old
to work
Pursuant to the Labor Code on June 18, 2012;
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
At the proposal of the Director of the Occupational Safety and Health Inspectorate;
The Minister of Labor, Invalids and Social Affairs issues this Circular stipulating the list of light jobs that can employ persons under 15 years old to work.
Article 1.
1. This Circular promulgates the list of light jobs that can employ persons under 15 years old to work.
2. This Circular applies to all enterprises, agencies, organizations, cooperatives, households, and individuals who hire or use laborers under labor contracts (hereinafter referred to as employers).
Article 2.
1. Employers shall be responsible for:
a) Review the jobs currently employing persons under 15 years old; only employ persons under 15 years old for jobs listed in the light job list issued together with this Circular;
b) When recruiting persons under 15 years old to work, must have a health certificate from a medical facility authorized to confirm suitability for the job; organize regular health checks at least once every six months;
c) Comply with the provisions on using persons under 15 years old stipulated in Clause 2 Article 162; Clause 2, Clause 5 Article 163; Clause 2 Article 164 of the Labor Code;
d) The workplace must ensure environmental hygiene factors meet current legal standards;
đ) When initially recruiting persons under 15 years old to work, must notify in writing the Department of Labor, Invalids and Social Affairs of the province/city directly under the Central Government (hereinafter referred to as the Provincial Department of Labor, Invalids and Social Affairs) where the main office is located within 30 days from the date of recruitment;
e) Annually report on the employment of persons under 15 years old along with occupational safety and health reports to the Provincial Department of Labor, Invalids and Social Affairs.
2. The Provincial Department of Labor, Invalids and Social Affairs shall be responsible for:
a) Cooperating with the Health Department and the local Trade Union to regularly publicize, inspect, and supervise the implementation of this Circular;
b) Strengthening inspections and promptly handling violations of laws on the employment of persons under 15 years old;
c) Annually compiling and reporting to the Ministry of Labor, Invalids and Social Affairs on the implementation of this Circular along with occupational safety and health reports in their jurisdiction.
Article 3.
1. This Circular takes effect from August 1, 2013.
2. Repeal Circular No. 21/1999/TT-BLDTBXH dated September 11, 1999 of the Ministry of Labor, Invalids and Social Affairs stipulating the list of occupations and jobs and conditions for accepting children under 15 years old to work from the date this Circular takes effect.
3. During implementation, if there are difficulties or obstacles, please reflect them to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
