GUIDELINES FOR IMPLEMENTING CERTAIN ARTICLES OF THE DECREE NO. 41/2014/QD-TTg OF JULY 21, 2014 OF THE GOVERNMENT ON THE REGIME OF PRIVILEGES FOR STUDENTS IN TRADITIONAL AND SPECIAL ARTS PROGRAMS AT CULTURAL AND ART SCHOOLS

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 41/2014/QD-TTg dated July 21, 2014 of the Government on the regime of privileges for students in traditional and special arts programs at cultural and art schools;

The Ministers of Culture, Sports and Tourism, Finance, Education and Training, and Labor, Invalids and Social Affairs issue this Joint Circular guiding the implementation of certain Articles of Decree No. 41/2014/QD-TTg dated July 21, 2014 of the Government on the regime of privileges for students in traditional and special arts programs at cultural and art schools.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Joint Circular guides the implementation of certain Articles of Decree No. 41/2014/QD-TTg dated July 21, 2014 of the Government regarding the regime of privileges for students in traditional and special arts programs at cultural and art schools (hereinafter referred to as training institutions).

Article 2. Applicability

1. This Joint Circular applies to public and private cultural and art training institutions within the national education system.

2. This Joint Circular applies to students enrolled in regular programs of secondary vocational, college, and university levels in traditional and special arts fields, including: Traditional folk music performers, Hue traditional music performers, Southern traditional music performers, stage drama and opera performers, folk song performance arts, Ca Tru performance arts, Bai Choi performance arts, traditional musical instrument performance arts.

Chapter II

SPECIFIC PROVISIONS

Article 3. Tuition Fee Reduction

1. Students studying at public cultural and art training institutions as specified in Article 2 of this Joint Circular shall have their tuition fees reduced by 70%. The tuition fee level shall be implemented according to the maximum tuition fee level for general programs of public educational institutions that have not yet self-financed recurrent and investment expenditures as stipulated in Decree No. 86/2015/NĐ-CP dated October 2, 2015 of the Government on the mechanism for collecting, managing tuition fees for educational institutions under the national education system and policies on exemption, reduction of tuition fees, and support for learning expenses from the academic year 2015-2016 to the academic year 2020-2021.

For the academic year 2014-2015, it shall be implemented according to the maximum tuition fee level for general programs as stipulated in Decree No. 49/2010/NĐ-CP dated May 14, 2010 of the Government on exemption, reduction of tuition fees, support for learning expenses, and the mechanism for collecting and using tuition fees for educational institutions under the national education system from the academic year 2010-2011 to the academic year 2014-2015.

2. Students studying at private cultural and art training institutions as specified in Article 2 of this Joint Circular shall have their tuition fees reduced to a level not exceeding the maximum level prescribed for corresponding general programs in public cultural and art training institutions.

Article 4. Vocational Allowance System

1. Students studying at public cultural-artistic training institutions shall be entitled to a vocational allowance equivalent to forty percent (40%) of the good scholarship level under the scholarship encouragement program. The amount of the good scholarship level under the scholarship encouragement program shall be implemented according to the provisions of Decision No. 44/2007/QĐ-BGD&ĐT dated August 15, 2007 of the Minister of Education and Training on scholarships for students in specialized schools, talent schools, higher education institutions, and vocational colleges within the national education system. For training programs that do not charge tuition fees, the scholarship encouragement amount shall be determined based on the maximum tuition fee ceiling of the training program group of the institution.

2. Students studying at private cultural-artistic training institutions shall be entitled to a vocational allowance not exceeding the level prescribed for corresponding training programs at public cultural-artistic training institutions.

Article 5. Study Equipment System

Students studying at public cultural-artistic training institutions shall be provided with study uniforms once a year, specifically as follows:

1. Two (2) sets of exercise clothes.

2. Four (4) pairs of canvas shoes.

3. Seven (7) pairs of socks.

Article 6. Procedures, Formalities, and Application Documents for Implementing Tuition Reduction and Vocational Allowance Systems

1. Procedures, Formalities, and Application Documents

a) Within thirty (30) days from the start of the academic year, the training institution shall notify and guide eligible students to complete and submit one set of application documents (including the Request for Support of Preferential Benefits Form attached as Appendix I or II of this Joint Circular).

b) Students eligible for preferential benefits (tuition reduction, vocational allowance) only need to prepare and submit their application documents once for the entire duration of their studies at the training institution.

2. Responsibilities for Reviewing and Verifying Application Documents

a) For Public Cultural-Artistic Training Institutions

The heads of the training institutions shall be responsible for organizing the process of reviewing and verifying application documents to decide on the implementation of preferential benefits for students; simultaneously preparing a budget estimate for implementing preferential benefits according to the form specified in Appendix III and reporting it to the direct management authority (Ministries, central agencies; Provincial People's Committees). The superior management authority shall review and prepare a budget estimate according to the form specified in Appendix IV, send it to the Ministry of Finance for consolidation, and submit it to the competent authority for allocation in the annual state budget according to current laws on state budget.

b) For Private Cultural-Artistic Training Institutions

Within ten (10) days from receiving the application documents (Request for Support of Preferential Benefits) from students, the training institution shall be responsible for confirming the Request of the students and guiding them or their parents (legal guardians) to submit the application documents to the Department of Labor, Invalids, and Social Affairs where the students have permanent residence.

The Department of Labor, Invalids, and Social Affairs shall be responsible for organizing the process of reviewing and verifying application documents, approving the list of beneficiaries, and preparing a budget estimate for implementing preferential benefits for students, which shall be submitted to the financial department at the same level for approval according to current laws on state budget. In cases where the application documents are not valid, the Department of Labor, Invalids, and Social Affairs shall be responsible for checking and immediately informing the applicant (students; parents or legal guardians of students) upon receipt of the application documents to resubmit the documents according to regulations.

The head of the training institution shall be responsible for the contents confirmed on the Request of the students.

Article 7. Methods of implementation and standards, principles for managing and using educational equipment

1. Principles for providing educational equipment to students and trainees who are beneficiaries

a) The educational uniforms specified in Article 5 of this Circular have a usage period of 12 months, including summer break, and are provided once a year.

b) Time of provision: within one month from the start of the academic year.

2. Provisions on providing educational equipment

a) Based on the actual operation situation of the training institution and the requirements and nature of the field of study, the head of the public cultural-artistic training institution decides on the design and type of necessary uniforms for each field of study; decides on the procurement of educational equipment for students and trainees to ensure uniformity with approved designs, quality of educational equipment, and cost savings. Provision of educational equipment must be accurate to the target group, requirements, regulations, and time.

b) Procurement of educational equipment for students and trainees shall be carried out in accordance with the laws on the use of state capital for procurement to maintain the regular operation of state agencies, units under the people's armed forces, public non-profit organizations, political organizations, political-social organizations, political-social-professional organizations, social organizations, and social-professional organizations.

3. Principles for managing and using educational equipment

a) Students and trainees who are provided with educational equipment must manage and use such equipment for its intended purpose.

b) Students and trainees must purchase their own educational equipment according to the prescribed design when they damage or lose the provided educational equipment.

c) Students and trainees will be provided with supplementary educational equipment if the provided equipment is damaged due to objective reasons (poor quality leading to damage...). The training institution is responsible for using the operational funds according to current laws to procure supplementary educational equipment without additional funding from the state budget.

Article 8. Provisions on financial resources for implementing preferential benefits

Financial resources for implementing preferential benefits for students and trainees who are beneficiaries shall be implemented as follows:

1. For public cultural-artistic training institutions

a) Financial resources for implementing preferential benefits (reduced tuition fees, vocational allowances, educational equipment) for students and trainees at public cultural-artistic training institutions are annually allocated from the state budget through the annual budget allocation process. The allocation of the budget for implementing preferential benefits is carried out simultaneously with the annual state budget allocation. When allocating budgets to training institutions, the supervising authority must clearly specify the budget for implementing preferential benefits for students and trainees who are supported and currently studying at public cultural-artistic training institutions.

b) When withdrawing the budget for compensating reduced tuition fees and implementing vocational allowances, public cultural-artistic training institutions must submit to the State Treasury office where the unit conducts transactions a consolidated request for compensation for these two items (including the following contents: name of the student eligible for preferential benefits currently studying at the institution; tuition fee level of the institution; amount of tuition reduction; vocational allowance level and total financial needs requested for implementing preferential benefits).

c) The financial resources allocated from the state budget to compensate for free tuition fees for public cultural-artistic training institutions can be autonomously used according to the current regulations on financial autonomy of public non-profit organizations.

d) Public cultural-artistic training institutions pay vocational allowances to students and trainees for the months they are studying and pay it at the beginning of the month. In cases where beneficiaries have not received the preferential benefits within the stipulated time, they may claim them in the next payment period.

đ) Financial resources for providing educational equipment are implemented in accordance with the laws on state budget.

2. For private cultural-artistic training institutions

a) The Department of Labor, Invalids, and Social Affairs where the students and trainees have permanent residence is responsible for managing and organizing the direct cash payment of preferential benefits (reduced tuition fees, vocational allowances) to students and trainees or to their parents (legal guardians).

b) The provision of financial support for preferential benefits is carried out twice a year during the academic year: the first time for five months in October or November each year; the second time for five months in March or April of the following year. In cases where students and trainees have not received the benefits within the stipulated time, they may claim them in the next payment period.

3. The agency responsible for paying financial support for preferential benefits to students and trainees shall publicly announce the procedures and timing for paying financial support for preferential benefits to facilitate students and trainees or their parents (legal guardians) receiving the benefits in accordance with the regulations.

Article 9. Provisions on Ceasing Allocation of Funds for Implementing Preferential Benefits

1. Students who withdraw from school or are disciplined with compulsory withdrawal shall not be entitled to receive funds supporting educational expenses from the time the disciplinary decision becomes effective. In cases where students have already received preferential support funds but then withdraw from school or are disciplined with compulsory withdrawal, public training institutions and the Department of Labor - Invalids and Social Affairs shall cease allocating preferential support funds for the next academic period.

2. Students who are suspended from studies (temporary cessation of studies with a specified duration) or who stop studying due to illness, accidents, repeating courses, retention, or supplementary studies shall not be entitled to receive preferential support funds during the period of cessation of studies.

If students who have already received preferential support funds stop studying, public training institutions and the Department of Labor - Invalids and Social Affairs shall deduct the corresponding amount of money for the period of cessation of studies from the next academic period after the student resumes studies.

3. Private training institutions that have students falling under the provisions of Clause 1 and Clause 2 of this Article shall be responsible for sending written notifications to the Department of Labor - Invalids and Social Affairs at the place of permanent residence of the students when they stop studying to cease allocation of preferential support funds, and when they resume studying to be eligible for allocation of preferential support funds.

Article 10. Sources of Funds

The sources of funds for implementing preferential benefits as stipulated in this Circular shall be allocated within the annual budget for educational and training services of localities, ministries, and central agencies according to the following principles:

1. The central government budget will support local budgets to implement preferential support policies for individuals studying at private cultural and artistic training institutions and those managed by localities according to the principle: full support for localities that cannot yet balance their budgets independently and the province of Quang Ngai, 50% support for localities with a central budget adjustment ratio below 50%, and the remaining localities must ensure their own funding.

2. The central government budget will guarantee funds for implementing preferential benefits for students studying at cultural and artistic training institutions managed by ministries, sectors, and central agencies.

3. Provincial People's Committees shall allocate local budgets together with central government support to implement reduced tuition fees, vocational training allowances, and study equipment support for students in traditional and special arts programs in cultural and artistic schools as prescribed.

4. For the academic years 2014-2015 and 2015-2016, ministries, sectors, and localities shall submit comprehensive reports on preferential benefit funds for students studying in traditional and special arts programs in cultural and artistic schools as prescribed in this Circular to the Ministry of Finance for consolidation and submission to competent authorities for consideration and supplementation of the budget estimate to implement these measures.

Article 11. Budget Preparation, Allocation, and Settlement of Accounts

Annually, based on the socio-economic development plan and the state budget estimate for the planning year; guidance documents from the Ministry of Finance on building the state budget estimate for the planning year; and the number of beneficiaries of preferential support, provincial People's Committees, ministries, and central agencies shall prepare the budget estimate for the total amount of funds required to support preferential benefits, which will be included in the local and ministry budget estimates sent to the Ministry of Finance along with the state budget estimate report for the planning year. Specifically, as follows:

1. Public cultural and artistic training institutions shall base their list of beneficiaries (accompanied by confirmation documents for beneficiaries as stipulated in Article 2 of this Circular) on the level of support and the number of beneficiaries to prepare the budget estimate, which will be submitted to the supervising authority for review and consolidation before submission to the financial authority for approval.

2. County-level Departments of Labor - Invalids and Social Affairs shall base their list of beneficiaries (accompanied by confirmation documents for beneficiaries as stipulated in Article 2 of this Circular) on the level of support and the number of beneficiaries to prepare the budget estimate, which will be submitted to the same-level financial authority for review and consolidation before submission to the approving authority for approval.

3. Agencies and units responsible for managing the implementation of preferential benefits for beneficiaries as stipulated in Article 2 of this Circular shall prepare, consolidate, and manage the budget estimate for implementing these policies and submit it to the same-level financial authority before July 20 each year to be included in the local and ministry budget estimates sent to the Ministry of Finance.

4. Based on the decision on allocating the state budget estimate issued by

a) Provincial People's Committees shall submit to the People's Council at the same level for approval of the allocation of funds for implementing preferential benefits for students at public cultural and artistic training institutions directly under their jurisdiction and at private cultural and artistic training institutions within the local education and training service budget estimate according to regulations;

b) Ministries, sectors, and central agencies shall decide on the allocation of funds for preferential benefits for public cultural and artistic training institutions directly under their jurisdiction according to regulations.

5. Management, Use, and Settlement of Accounts The management, use, and settlement of accounts for funds supporting preferential benefits shall be carried out in accordance with current laws on the State Budget, guiding documents, and the current State Budget Manual.

Chapter III

IMPLEMENTING PROVISIONS

Article 12. Effective Date

1. This Circular takes effect from February 1, 2016.

2. The date of implementation of preferential benefits for students as stipulated in this Circular shall be calculated from September 9, 2014.

Article 13. Implementation Organization

1. At the same time, beneficiaries of preferential benefits as stipulated in this Circular and other supportive policies with similar nature prescribed in other documents may only enjoy the highest preferential benefit.

2. In case the regulatory legal documents mentioned in this Joint Circular are amended, supplemented, or replaced by new documents, they shall be implemented according to the new documents.

3. During the implementation process, if there are any difficulties, please reflect them to the Ministry of Culture, Sports and Tourism for coordination with the Ministry of Finance, the Ministry of Education and Training, and the Ministry of Labor, Invalids and Social Affairs to study and resolve.
