Regulations on the List of State Secrets of Confidential Level

in the Education and Training Sector

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." tate secrets;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

After reaching consensus with the Minister of Education and Training, the Minister of Public Security promulgates this Circular stipulating the List of State Secrets of Confidential Level in the Education and Training Sector.

Article 1. The List of State Secrets of Confidential Level in the Education and Training Sector includes information and documents within the following scope:

1. Information and documents about foreign delegations, negotiations, contents of agreements signed with foreign countries and international organizations regarding education and training that have not been disclosed.

2. Strategies, programs, orientations for medium-term and long-term cooperation with foreign countries and international organizations in the field of education and training that have not been disclosed.

3. Information and documents from foreign individuals and organizations transferred to the Education and Training Sector where both parties agree not to disclose.

4. Information and documents related to bidding and tendering activities for projects managed and implemented by units under the Ministry of Education and Training during the review process before disclosure.

5. Arrangement plans for examinees in examination rooms, code numbers of answer sheets and related documents for the National High School Examination, selection exams for outstanding students at various levels, international Olympic team selection exams, graduation exams, admission exams, and final exams at different educational levels, fields, and training degrees that have not been disclosed.

6. Files related to training institutions under the Ministry of National Defense and the Ministry of Public Security; files related to sending public security and defense officials to study at non-military schools; files of university graduates recruited annually for reserve officer training according to the Prime Minister's Decision.

7. Information, documents, and comments from leaders of the Ministry; documents, proposals, recommendations, and suggestions from unit heads at the department level and above in the Education and Training Sector that have not been disclosed or will not be disclosed.

8. Personnel files of civil servants and public officials in the Education and Training Sector that have not been disclosed or will not be disclosed; files of the Party Cadre Management Board of the Ministry of Education and Training that have not been disclosed or will not be disclosed; personnel files of management officials at the department level and above in the Education and Training Sector that have not been disclosed or will not be disclosed.

9. Information, documents, reports on inspection, verification, and investigation of complaints and denunciations; reports on the results of inspections, verification of complaint contents, and investigation of denunciation contents; draft conclusions on denunciation contents; other information and documents in the activities of inspection, reception of citizens' petitions, resolution of complaints and denunciations, and anti-corruption in the Education and Training Sector that have not been disclosed or will not be disclosed.

10. Documents on the design of computer systems of the Ministry of Education and Training; regulations and conventions on ensuring computer network security of the Ministry of Education and Training.

11. Files and documents on candidates applying for overseas scholarships organized by the Ministry of Education and Training; lists and files of candidates sent for negotiation of foreign scholarships and personal information of overseas students that have not been disclosed or will not be disclosed.

12. Programs, projects, research documents, plans, directives in the field of education and training serving national defense, ensuring national security, protecting border and maritime sovereignty that have not been disclosed or will not be disclosed.

13. Information on independent reviewers and independent evaluators of doctoral dissertations when doctoral candidates have not yet received their degrees; research topics, papers, theses, projects, and scientific tasks managed by the Ministry of Education and Training containing state secrets that have not been disclosed or will not be disclosed.

14. Documents using information and documents included in the List of State Secrets of Confidential Level of other agencies and organizations.

Article 2. Effective Date

This Circular takes effect from May 2, 2017 and replaces Decision No. 160/2005/QĐ-BCA(A11) dated February 23, 2005 of the Minister of Public Security stipulating the List of State Secrets of Confidential Level in the Education and Training Sector.

Article 3. Responsibility for Implementation

1. The Ministry of Education and Training and the Ministry of Public Security shall be responsible for guiding and supervising the implementation of this Circular.

2. Ministries, ministerial-level agencies, government agencies; People's Committees of provinces and centrally governed cities shall be responsible for implementing this Circular./.
