AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 36/2018/TT-BNNPTNT OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULAR NO. 26/2016/TT-BNNPTNT OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT ON ANIMAL INSPECTION AND ANIMAL PRODUCTS FROM AQUATIC SOURCES
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Animal Health No. 79/2015/QH13 dated June 19, 2015;
At the proposal of the Director of the Department of Animal Health, the General Director of the General Department of Fisheries,
The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain articles of Circular No. 36/2018/TT-BNNPTNT dated December 25, 2018 on amending and supplementing certain provisions of Circular No. 26/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural Development on animal inspection and aquatic animal products (hereinafter referred to as Circular No. 36/2018/TT-BNNPTNT).
Article 1. Amend and supplement
Point g Clause 2 Article 1 of Circular No. 36/2018/TT-BNNPTNT"g) In cases where aquatic animal products are imported indirectly from foreign fishing vessels transshipped at foreign ports and brought back to Vietnam, in addition to the documents specified in points a, c, d and e of this clause, enterprises shall supplement the Declaration Form for Transshipment Information (self-declared by the enterprise) according to the form attached hereto or a copy of the Confirmation Certificate issued by the competent authority of the country where the transshipment port is located (with confirmation by the enterprise)". The contents of the Confirmation Certificate shall include the following information: name; registration number, flag state of the fishing vessel and the transport vessel; type of aquatic product, quantity, loading time, loading place, storage conditions of the product, the aquatic product remains in its original condition without undergoing any other process except for loading activities."
Article 2. Effective Date
This Circular takes effect from December 6, 2019.
Article 3. Responsibility for Implementation
1. The Director of the Department of Animal Health, the General Director of the General Department of Fisheries and the Heads of relevant units, organizations, and individuals are responsible for implementing this Circular.
2. During the implementation process, if there are difficulties or obstacles, it is recommended that agencies, organizations, and individuals report them to the Ministry of Agriculture and Rural Development for review, amendment, and supplementation./.
