On the basis of Law on Government Organization dated June 19, 2015;

On the basis of Law on State Budget Management dated June 25, 2015;

On the basis of Law on Fees and Charges dated November 25, 2015;

Decree No. Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government stipulating the self-management and self-responsibility regime regarding staffing and administrative management expenses for state agencies;

Decree No. Decree No. 117/2013/NĐ-CP dated October 7, 2013 of the Government amending and supplementing certain articles of Decree No. Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government stipulating the self-management and self-responsibility regime regarding staffing and administrative management expenses for state agencies;

At the proposal of the Minister of Finance;

The Prime Minister issues this Decision on the financial management regime applicable to the Insurance Management and Supervision Department - Ministry of Finance.

Article 1. Scope of Regulation

This Decision stipulates the financial management regime for the Insurance Management and Supervision Department - Ministry of Finance.

Article 2. Applicability

1. Officials and civil servants at the Insurance Management and Supervision Department.

1. Rooftop solar power is electricity produced from photovoltaic panels according to the principle of converting solar energy into electrical energy, through architectural structures designed to install on the roof of construction projects, connected to electrical equipment and serving directly for power generation.

Article 4. Contents of Expenditure

1. Expenditure under the self-management regime:

a) Average salary expenditure with a maximum salary coefficient not exceeding two times the state-prescribed salary level (grade, rank, and all types of allowances except night shift and overtime pay);

b) Administrative expenditure according to prescribed standards;

c) Purchase expenditure for assets serving management and supervision activities as prescribed;

d) Expenditure for enhanced management, supervision, inspection, and auditing activities including: travel expense for inspection and audit teams; information technology application expenditure; training, education, and seminar organization expenditure; conference, seminar, and insurance market information dissemination expenditure. Expenditure levels as prescribed by law;

đ) Special activity expenditure: expenditure for hiring domestic and foreign experts (including insurance actuarial experts) as prescribed;

e) Expenditure for joint work commendation for collectives and individuals (outside the Insurance Management and Supervision Department) who have made direct contributions to insurance management and supervision activities. Total expenditure not exceeding one month's salary and wages of the Insurance Management and Supervision Department in a year.

2. Expenditure not under the self-management regime: To be implemented according to current laws.

Article 4. Funding for task expenditures

1. The source of funding for task expenditures for the Insurance Management and Supervision Department's operations as stipulated in Article 3 of this Decision shall be allocated from the revenue derived from insurance management and supervision fees as prescribed by law on fees and charges.

2. If there is any surplus in the self-management budget, the Insurance Management and Supervision Department may allocate it for purposes as prescribed in Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government stipulating the self-management and self-responsibility regime regarding staffing and administrative management expenses for state agencies; Decree No. 117/2013/NĐ-CP dated October 7, 2013 of the Government amending and supplementing certain articles of Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government stipulating the self-management and self-responsibility regime regarding staffing and administrative management expenses for state agencies and related legal provisions; among which, additional income for officials and civil servants shall not exceed one time the state-prescribed salary level.

Article 5. Effective Date

1. This Decision takes effect from May 15, 2020.

2. The regimes stipulated in this Decision shall apply for the 2020 fiscal year.

Article 6. Responsibility for Implementation

Ministers: Finance, Home Affairs, Labor, Invalids and Social Affairs, Director of the Insurance Management and Supervision Department, and heads of relevant agencies are responsible for implementing this Decision./.
