Is the time spent working in occupations before the issuance of this Circular considered as time spent working in heavy, hazardous, and dangerous occupations?
Yes, the time workers spend working in occupations stipulated in the accompanying Decisions and Circulars that have been abolished will still be counted as time spent working in heavy, hazardous, and dangerous occupations or particularly heavy, hazardous, and dangerous occupations until the effective date of this Circular (Article 3.3).

CIRCULAR
Issuing the List of Occupations and Jobs that are Heavy, Hazardous, and Dangerous, and Particularly Heavy, Hazardous, and Dangerous

Pursuant to the Labor Safety Law dated June 25, 2015;
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
At the proposal of the Director of the Occupational Safety and Health Inspectorate;
The Minister of Labor - Invalids and Social Affairs issues this Circular on issuing the List of Occupations and Jobs that are Heavy, Hazardous, and Dangerous, and Particularly Heavy, Hazardous, and Dangerous.
Article 1. The List of Occupations and Jobs that are Heavy, Hazardous, and Dangerous, and Particularly Heavy, Hazardous, and Dangerous
Attached hereto is the List of Occupations and Jobs that are Heavy, Hazardous, and Dangerous, and Particularly Heavy, Hazardous, and Dangerous.
Article 2. Implementation
Annually, ministries managing sectors and fields, and employers shall proactively review and assess the List of Occupations and Jobs that are Heavy, Hazardous, and Dangerous, and Particularly Heavy, Hazardous, and Dangerous according to the method prescribed by the Minister of Labor - Invalids and Social Affairs to propose amendments and supplements to the List in accordance with economic and social development, scientific and technological progress, and management requirements at each period.
Article 3. Effectiveness
1. This Circular takes effect from March 1, 2021.
2. From the date this Circular takes effect, the following Decisions and Circulars cease to be effective:
a) Decision No. 1453/LDTBXH-QĐ dated October 13, 1995 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs and Heavy, Hazardous, and Dangerous Occupations and Jobs;
b) Decision No. 915/LDTBXH-QĐ dated July 30, 1996 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs and Heavy, Hazardous, and Dangerous Occupations and Jobs;
c) Decision No. 1629/LDTBXH-QĐ dated December 26, 1996 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs;
d) Decision No. 190/1999/QĐ-BLDTBXH dated March 3, 1999 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs;
đ) Decision No. 1580/2000/QĐ-BLDTBXH dated December 26, 2000 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs;
e) Decision No. 1152/2003/QĐ-BLDTBXH dated September 18, 2003 of the Minister of Labor - Invalids and Social Affairs on temporarily issuing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs;
g) Circular No. 36/2012/TT-BLDTBXH dated December 28, 2012 of the Minister of Labor - Invalids and Social Affairs on supplementing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs;
h) Circular No. 15/2016/TT-BLDTBXH dated June 28, 2016 of the Minister of Labor - Invalids and Social Affairs on issuing the List of Heavy, Hazardous, and Dangerous Occupations and Jobs and Particularly Heavy, Hazardous, and Dangerous Occupations and Jobs.
3. The time workers spend in occupations and jobs issued in the Decisions and Circulars abolished pursuant to Clause 2 of this Article shall still be counted as time spent in heavy, hazardous, and dangerous occupations and jobs or particularly heavy, hazardous, and dangerous occupations and jobs until the date this Circular takes effect.
4. In the course of implementation, if there are difficulties, please report to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
