Issuing Technical Regulations and Economic-Tech Standards for Water Resources Planning and Basic Investigation

Pursuant to the Law on Irrigation dated June 19, 2017;

Pursuant to the Law Amending and Supplementing Some Articles of 37 Related Laws on Planning dated November 20, 2018;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 53/2019/NĐ-CP dated June 17, 2019 detailing the procedures for preparing, reviewing, approving, and amending water resources plans; dike systems; flood prevention along river courses with dikes approve and adjust the water resources planning; dyke and flood control planning for river courses with dikes;

At the proposal of the Director General of the Department of Water Resources;

The Minister of Agriculture and Rural Development hereby issues this Circular on Technical Regulations and Economic-Tech Standards for Water Resources Planning and Basic Investigation.

Article 1. Scope of Regulation

This Circular sets forth technical regulations and economic-tech standards for water resources planning and basic investigation activities, including the following contents:

1. Water Resources Planning

a) Preparing and reviewing, adjusting inter-provincial river basin water resources plans;

b) Preparing and reviewing, adjusting water resources plans for interconnected water works systems involving two or more provinces.

2. Basic Investigation for Water Resources

a) Investigating the current quantity, quality, and service capacity of water works; demand for water products and services;

b) Investigating the current organizational structure and policy mechanisms in water resources operations;

c) Assessing the impact of water works on the environment and people's livelihoods;

d) Collecting monitoring and surveillance information on the quantity, quality of water, droughts, water shortages, salinity intrusion, desertification, floods, inundations, waterlogging, erosion of water works, riverbanks, and coastlines to support water resources operations.

Article 2. Applicability

This Circular applies to state management agencies, public institutions, organizations, and individuals involved in water resources planning and basic investigation activities.

Article 3. Technical Regulations and Economic-Tech Standards for Water Resources Planning Activities

Technical regulations and economic-tech standards for water resources planning activities are stipulated in Appendix I attached hereto.

Article 4. Technical Regulations and Economic-Tech Standards for Basic Investigation Activities in Water Resources

Technical regulations and economic-tech standards for basic investigation activities in water resources are stipulated in Appendix II attached hereto.

Article 5. Effective Date

This Circular takes effect from December 15, 2020.

Article 6. Implementation Organization

1. Heads of units under the Ministry of Agriculture and Rural Development and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. During implementation, if there are difficulties or obstacles, they should be promptly reported to the Ministry of Agriculture and Rural Development for study, amendment, and supplementation as appropriate./.
