CIRCULAR

Regulations on awarding the Commemorative Medal "National Security Protection"

Pursuant to the Law on Encouragement, Reward and Honor dated November 26, 2003;i Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Encouragement, Reward and Honor dated November 16, 2013;i Pursuant to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Encouragement, Reward and Honor;June 2024;At the proposal of the Director of the Party Work and Political Affairs Department, and the Director of the Department for Building Mass Movements for National Security Protection;

The Minister of Public Security promulgates this Circular on awarding the Commemorative Medal "National Security Protection".No. 2. The Commemorative Medal shall not be awarded to individuals who have been awarded the Medal "Distinguished Soldier," the Medal "For National Security," or the Order of National Security Defense for their contributions in the People's Public Security Force.

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

3. The Commemorative Medal shall not be awarded to individuals whose titles of People's Public Security Force member have been revoked; who have been criminally indicted; who have been placed in compulsory educational facilities; or individuals who cooperated with the People's Public Security Force but were excluded due to betrayal or violation of unit management regulations.

4. Individuals currently undergoing disciplinary action, under consideration for disciplinary action, or involved in complaints, accusations, inspections, and audits without a conclusion from the competent authority shall not be considered for the Commemorative Medal.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

2. The Commendation Medal shall not be awarded to individuals who have been awarded the Medal "Distinguished Soldier," the Medal "For National Security," or Orders for their contributions in the People's Public Security Force.

3. The Commendation Medal shall not be awarded to individuals whose titles of People's Public Security members have been revoked; who are under criminal investigation; who are placed in compulsory educational facilities; or individuals collaborating with the People's Public Security Force but were dismissed due to betrayal or violations of unit management regulations.

4. Individuals currently under disciplinary review or having complaints, accusations, inspections, or investigations without final conclusions from competent authorities, or involved in corruption or negative issues reported by the media that require verification, shall not be considered for the Commendation Medal until such issues are resolved. If they meet the criteria after receiving a conclusion from the competent authority, they may be proposed for the Commendation Medal. For individuals disciplined, upon completion of their disciplinary period, the time for assessing achievements for the Commendation Medal will start from the end of the disciplinary period.

5. The examination, presentation, and use of the Commemorative Medal for individuals cooperating with the People's Public Security Force must ensure absolute confidentiality according to operational requirements. Local public security units organize the presentation of the Commemorative Medal but keep the decision, certificate, and insignia in the personnel files managed by the unit.

SUBJECTS, CRITERIA, FILES, AND PROCEDURES FOR PROPOSAL

AWARDS OF THE COMMENDATION MEDAL

Article 3. Awarding the Commemorative Medal to officers, non-commissioned officers, and soldiers in the People's Public Security Force

Chapter II

1. Subjects and criteria

Officers, non-commissioned officers, soldiers, and workers of the People's Public Security Force who have worked in the People's Public Security Force for at least five years but do not meet the criteria for the Medal "Distinguished Soldier" Bronze Class, when retiring or transferring to another profession, may be considered for the Commemorative Medal.

a) A report from the head of the local public security unit;

b) A brief list of individuals proposed for the Commemorative Medal (confirmed by the head of the unit).

3. Procedures

2. The dossier for granting Commemorative Medals includes:

Local public security units prepare the file proposing the award of the Commemorative Medal to be submitted to the Minister of Public Security (through the Party Work and Political Affairs Department) for examination and decision.

Article 4. Awarding the Commemorative Medal in the mass movement for national security protection

a) Individuals who are leaders of the Party and State; leaders and members of central agencies, ministries, sectors, and social organizations; who have made achievements in leading and directing national security and social order work and in the mass movement for national security protection;

b) Individuals who are leaders, members, and officials of various levels of government, social organizations, political-social organizations; leaders of schools and educational institutions with legal personality; leaders of state-owned enterprises, economic groups, and state-owned corporations who have held these positions for at least five years (as of the date of proposal); who have made achievements in the mass movement for national security protection and have been honored at least once by the provincial-level People's Committee or higher public security organs for their contributions to national security; the units and places under their responsibility have no serious incidents related to national security and social order;

c) Individuals who are auxiliary police officers (part-time specialized force), People's Security Guards, and security guards of state-owned enterprises who have worked for at least fifteen years for men and ten years for women;

b) A brief list of individuals proposed for the Commemorative Medal (confirmed by the head of the unit).

d) Foreigners and overseas Vietnamese who have made positive contributions to building, consolidating, and developing friendly relations and cooperation between Vietnam and other countries; between foreign organizations and international organizations and the Ministry of Public Security in the cause of national security protection; other cases with outstanding achievements in the cause of national security protection.

b) A brief list of individuals proposed for the Commemorative Medal confirmed by the head of the local public security unit and the workplace;

c) The file proposing the award of the Commemorative Medal to foreigners and overseas Vietnamese must include the agreement of the Foreign Relations Department.

a) Cases under points a and d of Clause 1 shall submit the file proposing the award of the Commemorative Medal to the Minister of Public Security (through the Party Work and Political Affairs Department) for examination and decision;

2. The dossier for granting Commemorative Medals includes:

c) The dossier proposing to confer the Commendation Medal for foreigners and overseas Vietnamese must include the agreement of the Foreign Affairs Department.

a) Individuals who are leaders of the Party and State; leaders and members of central agencies, ministries, sectors, and social organizations; who have made achievements in leading and directing national security and social order work and in the mass movement for national security protection;

a) Cases under points a and d of Clause 1 shall submit the dossier proposing to confer the Commendation Medal to the Minister of Public Security (through the Department of Party Work and Political Affairs) for examination and decision;

b) Cases under points b and c of Clause 1 shall submit the dossier proposing to confer the Commendation Medal to the Minister of Public Security (through the Department for Mass Mobilization for National Security Protection) for examination and decision.

Article 5. Granting Commemorative Medals to individuals collaborating with the People's Public Security Forces

b) A brief list of individuals proposed for the Commemorative Medal (confirmed by the head of the unit).

a) Individuals who have achieved many merits in collaboration with public security agencies in combating crime; who have not violated work principles or regulations; and who have collaborated for at least 15 years for males and 10 years for females shall be considered for the granting of Commemorative Medals;

b) Individuals who, although not having sufficient collaboration time, have achieved outstanding merits; sacrificed or been injured while on duty, and are no longer able to continue collaborating shall also be considered for the granting of Commemorative Medals.

2. Documentation, procedures, and submission process

a) Based on the achievements of individuals, comparing them with the established criteria, the head of the public security unit or locality signs a report requesting approval from the competent leader of the Ministry of Public Security regarding the achievements and list of individuals proposed for the granting of Commemorative Medals;

b) After receiving approval from the leadership of the Ministry of Public Security to grant Commemorative Medals, the head of the public security unit or locality submits a proposal to the Minister of Public Security (through the Party Work and Political Affairs Department). The proposal only states the number of individuals agreed upon by the Ministry's leadership (accompanied by a copy of the document with the leadership's approval opinion), without sending the list and achievement reports of the individuals proposed for the Commemorative Medal;

c) The Party Work and Political Affairs Department reports to the leadership of the Ministry of Public Security to sign a decision granting Commemorative Medals (the Decision only states the number of individuals receiving Commemorative Medals) and hands over the physical medals to the public security units or localities for presentation and file retention.

3. Individuals collaborating with the People's Public Security Forces who fail to comply with confidentiality requirements as stipulated will have their decisions revoked and their certificates and badges withdrawn.

Article 6. Presentation of Commemorative Medals

1. Commemorative Medals are presented on the occasion of the Traditional Day of the People's Public Security, the National Day for the Protection of Homeland Security (August 19 each year) or when requested by the leadership of the Ministry of Public Security.

2. Individuals meeting the criteria are presented with a decision accompanied by a certificate and badge (without monetary reward).

3. In cases where the decision, certificate, or badge is damaged or lost, the public security unit or locality shall submit a request to the Party Work and Political Affairs Department to report to the leadership of the Ministry of Public Security for replacement or issuance of new ones.

Chapter III

IMPLEMENTING PROVISIONS

Article 7. Effective Date

1. This Circular takes effect from March 15, 2021.

2. Abolish Decision No. 838/2006/QĐ-BCA(X15) dated July 13, 2006, issued by the Minister of Public Security on the Commemorative Medal "National Security Protector" and Regulations on awarding Commemorative Medals to individuals with outstanding achievements in protecting national security; Decision No. 839/2006/QĐ-BCA(X15) dated July 13, 2006, issued by the Minister of Public Security on the Commemorative Medal "National Security Protector" and Regulations on awarding Commemorative Medals to individuals with a history of collaboration with the People's Public Security Forces from the date this Circular takes effect.

Article 8. Responsibility for Implementation

1. The head of the public security unit or locality is responsible for organizing the implementation of this Circular.

2. The Party Work and Political Affairs Department and the Mass Mobilization Department for National Security Protection are responsible for inspecting and urging the implementation of this Circular.

3. The Planning and Finance Department is responsible for ensuring funding for printing certificates, manufacturing badges, boxes, frames, and organizing ceremonies for presenting Commemorative Medals.

During the implementation process, if there are difficulties or obstacles, public security units or localities, organizations, or individuals concerned should report to the Ministry of Public Security (through the Party Work and Political Affairs Department and the Mass Mobilization Department for National Security Protection) for timely guidance./.
