Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Clause 2, Article 4 of Decree No. 42/2023/NĐ-CP dated June 29, 2023 of the Government adjusting pensions, social insurance allowances, and monthly allowances;

At the proposal of the Director of the Salary Department;

The Minister of Home Affairs issues this Circular guiding the implementation of adjustments to the monthly allowance for retired village, ward, and town cadres who are elderly.

Article 1. Scope of application

Retired village, ward, and town cadres who are elderly currently receiving monthly allowances under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers supplementing policies and preferential treatment for village cadres and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers amending and supplementing certain policies and benefits for village and ward cadres (hereinafter referred to as retired village cadres who are elderly).

Article 2. Adjustment of Monthly Subsidies

As of July 1, 2023, adjustments to the monthly allowance for retired village cadres who are elderly shall be implemented according to the provisions of Article 2 of Decree No. 42/2023/NĐ-CP dated June 29, 2023 of the Government adjusting pensions, social insurance allowances, and monthly allowances as follows:

1. Increase the monthly allowance by 12.5% over the amount received in June 2023 for the subjects specified in Article 1 of this Circular.

In which: The monthly allowance received in June 2023 is the allowance prescribed in Clause 3, Article 2 of Circular No. 02/2022/TT-BNV dated January 29, 2022 of the Minister of Home Affairs guiding the implementation of adjustments to the monthly allowance from January 1, 2022 for retired village, ward, and town cadres under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

2. As of July 1, 2023, after adjusting the monthly allowance for retired village cadres who are elderly according to the provisions of Clause 1 of this Article, if the amount received is lower than 3,000,000 VND/month, it shall be adjusted as follows:

a) Increase by 300,000 VND/person/month for those whose monthly allowance is below 2,700,000 VND/person/month;

b) Increase to 3,000,000 VND/person/month for those whose monthly allowance is from 2,700,000 VND/person/month to less than 3,000,000 VND/person/month.

3. According to the provisions of Clauses 1 and 2 of this Article, retired village cadres who are elderly shall receive the monthly allowance from July 1, 2023 (rounded off) as follows:

a) For former Secretaries of the Party Committee, Chairmen of the People's Committee, Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Council, Village Militia Chiefs, and Chiefs of Public Security Stations: 3,000,000 VND/month;

b) For other positions: 2,817,000 VND/month.

Article 3. Implementation Organization

1. Provincial People's Committees and municipal people's committees directly under the central government shall organize the payment of monthly allowances from July 1, 2023, according to the guidelines set out in this Circular for the subjects within their jurisdiction.

2. The source of funds for implementing adjustments to the monthly allowance for retired village cadres who are elderly according to the provisions of Clause 1, Article 3 of Decree No. 42/2023/NĐ-CP dated June 29, 2023 of the Government adjusting pensions, social insurance allowances, and monthly allowances.

Article 4. Effective date

1. This Circular takes effect from September 15, 2023.

2. The regulations stipulated in this Circular shall be implemented from July 1, 2023.

3. This Circular replaces Circular No. 02/2022/TT-BNV dated January 29, 2022 of the Minister of Home Affairs guiding the implementation of adjustments to the monthly allowance from January 1, 2022 for retired village, ward, and town cadres under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are any difficulties, please report them to the Ministry of Home Affairs for study and resolution./.
