Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Housing Law dated November 27, 2023;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Law on Management and Use of State Assets dated June 21, 2017;

Pursuant to the Security Guard Law dated June 20, 2017;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15 dated June 29, 2024;

At the proposal of the Minister of Construction;

The Prime Minister issues this Decision on the standards for area and quotas for interior equipment of official housing.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Decision stipulates the standards for area and quotas for interior equipment of official housing.

a) Ministries, sectors, central agencies, provincial People's Committees, centrally governed cities, agencies managing official housing, units managing and operating official housing;

b) Subjects renting official housing as prescribed in Clause 1, Article 45 of the Housing Law;

c) Organizations and individuals related to the allocation and rental of official housing.

Article 2. Principles for allocating rentals and equipping interior furnishings of official housing

1. Principles for allocating rentals of official housing

a) Allocation of rentals of official housing must ensure the correct subjects and meet the conditions as prescribed in Article 45 of the Housing Law;

b) For official housing owned by the Communist Party of Vietnam (managed by the Central Party Office), implementation shall be carried out according to the laws and regulations of the competent authority of the Party;

c) In cases where a person concurrently holds multiple positions eligible for allocation of rentals of official housing, allocation of rentals of official housing shall be made according to the highest position held;

d) In cases where there is not enough official housing to allocate rentals according to the standard, based on the existing official housing fund, the representative owner agency shall consider and decide on the allocation of rentals accordingly;

đ) For the subject prescribed in point g, Clause 1, Article 45 of the Housing Law,

e) The term of rental of official housing shall be based on the duration of holding the position for which the tenant is transferred, rotated, seconded, appointed, or extended in tenure, ensuring that they belong to the rental subject and meet the conditions for renting official housing as prescribed by the law on housing.

2. Principles for equipping interior furnishings of official housing

a) Funding for the construction of official housing and interior furnishings of official housing using state budget funds including the central budget and local budget;

b) Interior furnishings attached to official housing included in the cost of constructing official housing or purchasing commercial housing for official housing purposes include: air conditioning system; integrated kitchen cabinet (including kitchen cabinets, sink, faucet, stove, exhaust hood); hot water heater; integrated bathroom fixtures;

c) Interior furnishings not attached to official housing include: living room: 01 set of sofa and 01 TV stand; dining room: 01 set of dining table and chairs, 01 refrigerator; bedroom: 01 wardrobe, 01 bed, 01 mattress; 01 desk and chair set; 01 washing machine;

d) Interior furnishings for official villas, adjacent houses, and apartments as prescribed in point a, b, and c, Clause 1, Article 3 of this Decision shall be implemented according to the provisions of points b and c of this clause;

đ) For interior furnishings for official housing as prescribed in point d, Clause 1, Article 3 of this Decision, it includes: 01 set of sofa, 01 refrigerator, 01 wardrobe, 01 fan, 01 bed, 01 mattress;

e) Selection of interior furnishings must be appropriate to the function, area, and space of each room in official housing, ensuring economy and efficiency as prescribed; for official housing purchased with interior furnishings already installed, replacement is not allowed, only supplementary furnishings missing or not yet synchronized according to the design as prescribed in points b, c, and đ of this clause may be provided;

g) For official housing previously constructed but not fully equipped with interior furnishings, the official housing management agency shall report to the competent authority for consideration and supplementation of interior furnishings according to the regulations;

h) The provision of interior furnishings for official housing must establish a budget and procurement plan to ensure economy and efficiency, and implement payment and settlement according to current laws;

i) In cases where official housing is allocated for rental and the interior furnishings previously installed have been used but have not yet reached their depreciation period or have reached their depreciation period but are still usable, such furnishings shall continue to be used;

3. Principles for planning procurement to replace interior furnishings

In cases where the interior furnishings of official housing have reached their depreciation period and cannot be continued to be used, the planning for procurement to replace interior furnishings shall be carried out as follows:

a) For the procurement of interior furnishings of official housing by central agencies (excluding the Ministry of National Defense and the Ministry of Public Security): The Ministry of Construction shall prepare the procurement plan, coordinate with the Ministry of Finance to report;

b) For the procurement of interior furnishings of official housing by the Ministry of National Defense and the Ministry of Public Security: The Ministry of National Defense and the Ministry of Public Security shall prepare the procurement plan, coordinate with the Ministry of Construction and the Ministry of Finance to report;

c) For the procurement of interior furnishings of official housing by localities, the Department of Construction shall prepare the procurement plan, coordinate with the Department of Finance to report to the Provincial People's Committee for consideration and decision.

Article 3. Principles for the design and construction of public service housing and warranty, maintenance, management operations

1. Public service housing shall be constructed in tandem with infrastructure projects, ensuring criteria for building density, land use coefficient, and other criteria as stipulated in the planning regulations, standards, and construction norms, including:

a) Detached houses not exceeding 04 floors, with a construction land area from 300 to 500 square meters (except as provided for in Clause 1, Article 4 of this Decision), having a garden, fence, and separate entrance and exit, ensuring security and protection systems as prescribed; t s2 up to 500 t s2 (except as provided for in Clause 1 of Article 4 of this Decision), with a courtyard, garden, fence, and separate access, ensuring security and protection systems as prescribed;

b) Attached houses not exceeding 04 floors, with construction land area from 60 t s2 to 250 t s2, designed in the style of attached houses with courtyards or townhouses, built adjacent to each other, sharing common technical infrastructure systems;

c) Apartment units with usable area from 45 t s2 to 160 t s2, designed as enclosed living spaces, including one or more different functional spaces such as: Living room, bedrooms, dining room, kitchen, bathroom, balcony or loggia;

d) Level IV attached houses with usable area from 24 t s2 to 60 t s2, constructed in the style of single-story houses with multiple adjacent units, each unit having enclosed ancillary facilities. The minimum usable area per house is 24 t s2.

2. Warranty, maintenance, and management operations for public service housing and interior equipment shall be carried out in accordance with laws on construction, housing, and other relevant laws.

Chapter II

SPECIFIC PROVISIONS

Article 4. Standards for the area and quota for interior equipment of public service housing for central agencies (excluding the Ministry of National Defense and the Ministry of Public Security)

1. For the positions of General Secretary, President, Prime Minister, Chairman of the National Assembly, rental public service housing shall be arranged to meet usage needs, working conditions, and security and protection requirements as prescribed. 

2. The Standing Deputy Secretary of the Party Central Committee, Politburo members, Secretariat members shall be allocated rental public service detached houses meeting the requirements as specified in point a, Clause 1, Article 3 of this Decision, including:

a) Construction land area from 450 square meters; t s2 up to 500 t s2;

b) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 350 million VND.

3. Chairperson of the Vietnam Fatherland Front Central Committee, Chief Justice of the Supreme People's Court, Procurator-General of the Supreme People's Procuracy, Vice President, Vice Chairman of the National Assembly, Vice Prime Minister shall be allocated rental public service detached houses meeting the requirements as specified in point a, Clause 1, Article 3 of this Decision, including:a) Construction land area from 350 to under 450 square meters;

a) Construction land area from 350 t s2 to less than 450 t s2;

b) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 300 million VND.

4. Members of the Central Committee of the Communist Party, Heads of central Party organs, Chairpersons of National Assembly Committees, Ministers, Heads of central political-social organizations at the equivalent level and above shall be allocated rental one of two types of public service housing, including:

a) Adjacent houses with a land area from 200 square meters, meeting the requirements as specified in point b, Clause 1, Article 3 of this Decision; t s2 to 250 t s2 meeting the requirements stipulated in Point b of Clause 1 of Article 3 of this Decision;

b) Apartment units with a usable area from 145 square meters, meeting the requirements as specified in point c, Clause 1, Article 3 of this Decision; t s2 to 160 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

5. Deputy Heads of central Party organs, Deputy Chairperson of the Vietnam Fatherland Front Central Committee, Deputy Chairpersons of National Assembly Committees, Deputy Ministers, Heads of government agencies under the Prime Minister (excluding positions managed by the Politburo), scientists assigned to head national-level key science and technology tasks according to the Law on Science and Technology, talents recognized by competent authorities for their significant contributions to the country at the equivalent level and above shall be allocated rental apartment units meeting the requirements as specified in point c, Clause 1, Article 3 of this Decision, including:

a) Usable area from 100 to under 145 square meters;

a) Usable area from 100 m2 to less than 145 t s2;

b) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 200 million VND.

6. Deputy Heads of government agencies, General Directors of General Departments and equivalent positions and above shall be allocated rental apartment units meeting the requirements as specified in point c, Clause 1, Article 3 of this Decision, including:

a) Usable area from 65 to under 100 square meters; t s2 to less than 100 t s2;

b) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 180 million VND.

Article 5. Standards for area and maximum budget for interior equipment of official housing for localities

1. Members of the Central Party Committee and Secretaries of Provincial Party Committees shall be allocated to rent one of two types of official housing as prescribed in Clause 4, Article 4 of this Decision.

2. Deputy Secretaries of Provincial Party Committees, Chairpersons of People's Committees of provinces directly under the Central Government, scientists assigned to lead national-level scientific and technological tasks of special importance as stipulated by the Law on Science and Technology, and talents recognized by competent authorities as having made significant contributions to the country at the equivalent level or higher shall be allocated to rent one of two types of official housing, including:

a) Detached houses with land area from 120 t s2 to 150 t s2 meeting the requirements stipulated in Point b of Clause 1 of Article 3 of this Decision;

b) Apartment units with usable area from 100 t s2 to less than 145 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

c) The maximum budget for interior equipment not attached to official housing prescribed in this clause is 200 million VND.

3. Secretaries of County Party Committees, Deputy Secretaries of County Party Committees, Chairpersons of People's Committees at the county level, Directors of Departments and equivalent positions or higher shall be allocated to rent one of two types of official housing, including:

a) Detached houses with land area from 80 t s2 to 100 t s2 meeting the requirements stipulated in Point b of Clause 1 of Article 3 of this Decision;

b) Apartment units with usable area from 80 t s2 to less than 100 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

c) The maximum budget for interior equipment not attached to official housing prescribed in this clause is 180 million VND.

4. Deputy Chairpersons of People's Committees at the county level, Deputy Directors of Departments and equivalent positions or higher shall be allocated to rent one of two types of official housing, including:

a) Detached houses with land area from 60 t s2 to less than 80 t s2 meeting the requirements stipulated in Point b of Clause 1 of Article 3 of this Decision;

b) Apartment units with usable area from 60 t s2 to less than 80 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

c) The maximum budget for interior equipment not attached to official housing prescribed in this clause is 150 million VND.

5. Cadres, civil servants, public officials, teachers, doctors, and health workers transferred or rotated to work in communes in remote areas, extremely difficult economic and social conditions, border regions, and islands shall be allocated to rent a house meeting the requirements as prescribed in Point d, Clause 1, Article 3 of this Decision, including:

a) Usable area from 24 t s2 to 48 t s2;

b) The maximum budget for interior equipment for official housing prescribed in this clause is 60 million VND.

Article 6. Standards for area and maximum budget for interior equipment of official housing for the Ministry of National Defense

1. Members of the Politburo, members of the Secretariat, Ministers of the Ministry of National Defense, Directors of the General Political Department, officers holding positions with the rank of General shall be allocated to rent villa-type official housing meeting the requirements as prescribed in Clause 2, Article 4 of this Decision.

2. Chief of the General Staff shall be allocated to rent villa-type official housing meeting the requirements as prescribed in Point a, Clause 1, Article 3 of this Decision, including:

a) Land area for construction from 300 t s2 to less than 350 t s2;

b) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 300 million VND.

3. Members of the Central Party Committee, Deputy Ministers of the Ministry of National Defense, Directors, Political Commissars of the National Defense Academy, Admirals of the Navy and equivalent positions; officers holding positions with the highest military rank of Lieutenant General shall be allocated to rent official housing as prescribed in Clause 4, Article 4 of this Decision.

4. Directors, Political Commissars of General Departments; Commanders, Political Commissars of Military Regions, Military Services, Border Guard Forces; Vice Admirals, Rear Admirals of the Navy and equivalent positions; officers holding positions with the military rank of Lieutenant General, Major General shall be allocated to rent official housing as prescribed in Clause 2, Article 5 of this Decision.

5. Division Commanders, Political Commissars of Divisions; Commanders, Political Commissars of Provincial Military Commands, Border Guard Forces; officers holding positions or titles with the highest military rank of Colonel, Senior Colonel shall be allocated to rent official housing as prescribed in Clause 3, Article 5 of this Decision.

6. Battalion Commanders, Political Commissars of Battalions and equivalent positions; officers holding positions or titles with the highest military rank of Colonel shall be allocated to rent official housing as prescribed in Clause 4, Article 5 of this Decision.

7. Company Commanders, Political Commissars of Companies and equivalent positions; officers holding positions or titles with the highest military rank of Lieutenant Colonel, Junior Officer; professional soldiers shall be allocated to rent one of two types of official housing as follows:

a) Apartment units with usable area from 45 t s2 to less than 60 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

b) Houses with usable area from 48 t s2 to less than 60 t s2 meeting the requirements as prescribed in Point d, Clause 1, Article 3 of this Decision;

c) The maximum budget for interior equipment for official housing prescribed in this clause is 120 million VND.

8. Civil servants, workers, and public officials of the Ministry of National Defense engaged in confidential work, other personnel working in confidential organizations funded by the state budget who are transferred, rotated, or detailed to work in communes in remote areas, extremely difficult economic and social conditions, border regions, and islands shall be allocated to rent a house as prescribed in Clause 5, Article 5 of this Decision.

Article 7. Standards for area and equipment quotas for residential premises of the Ministry of Public Security

1. Members of the Politburo, members of the Secretariat, Ministers of the Ministry of Public Security, officers holding positions with the rank of General shall be allocated to rent official villas, ensuring requirements according to the standards prescribed in Clause 2, Article 4 of this Decision.

2. Central Committee members, Deputy Ministers of the Ministry of Public Security, officers holding positions with the highest rank of Lieutenant General shall be allocated to rent residential premises for official use as prescribed in Clause 4, Article 4 of this Decision.

3. Commanders of the Guard Corps, Commanders of the Mobile Police Corps, Directors of the Ministry's Office, Directors of the Ministry's Inspectorate, Bureau Chiefs (officers holding the rank of Major General), Directors of the Political Academy of the People's Public Security, Directors of the National Security Academy, Directors of the Police Academy, Directors of the Public Security of Hanoi City, Directors of the Public Security of Ho Chi Minh City and equivalent positions; officers holding positions with the highest rank of Major General, shall be allocated to rent residential premises for official use as prescribed in Clause 2, Article 5 of this Decision.

4. Bureau Chiefs, Directors of Public Security of provinces and centrally-administered cities, Directors of Public Security Academies, Principals of Public Security Schools, Directors of Public Security Hospitals and equivalent positions; officers holding positions with the rank of Major General, shall be allocated to rent one of the two types of residential premises for official use as follows:

a) Detached houses with land area from 100 t s2 to less than 120 t s2 meeting the requirements stipulated in Point b of Clause 1 of Article 3 of this Decision;

b) Apartment units with usable area from 100 t s2 to less than 120 t s2 c) The maximum budget quota for non-fixed interior equipment within public service housing as stipulated herein is 250 million VND.

c) The maximum budget for interior equipment not attached to official housing prescribed in this clause is 200 million VND.

5. Deputy Commanders of the Guard Corps, Deputy Commanders of the Mobile Police Corps, Deputy Directors of the Ministry's Office, Deputy Directors of the Ministry's Inspectorate, Deputy Bureau Chiefs, Deputy Directors of Public Security of provinces and centrally-administered cities, Deputy Directors of Public Security Academies, Deputy Principals of Public Security Schools, Deputy Directors of Public Security Hospitals and equivalent positions; officers holding positions with the rank of Senior Colonel, shall be allocated to rent residential premises for official use as prescribed in Clause 3, Article 5 of this Decision.

6. Heads of Departments, Deputy Heads of Departments and equivalent positions; officers holding positions with the rank of Senior Colonel, shall be allocated to rent residential premises for official use as prescribed in Clause 4, Article 5 of this Decision.

7. Team Leaders, Deputy Team Leaders, Chiefs of Public Security of communes, Deputy Chiefs of Public Security of communes, Battalion Commanders, Deputy Battalion Commanders, Company Commanders, Deputy Company Commanders and equivalent positions; officers not holding positions, non-commissioned officers, shall be allocated to rent residential premises for official use as prescribed in Clause 7, Article 6 of this Decision.

8. Public Security workers, personnel engaged in confidential work, other personnel working in confidential organizations receiving state budget salaries who are assigned, transferred, or seconded to work in remote, mountainous, and extremely difficult socio-economic areas, border regions, islands, shall be allocated to rent residential premises as prescribed in Clause 5, Article 5 of this Decision.

Chapter III

IMPLEMENTATION

Article 8. Implementation organization

1. Responsibilities of the Ministry of Construction

a) Guide, inspect, audit, and urge ministries, sectors, and localities throughout the country to implement this Decision;

b) Develop plans and budgets for purchasing interior furnishings for residential premises for official use in accordance with laws on housing, laws on management and use of public assets, laws on the state budget, and related laws.

2. Responsibilities of the Ministry of Defense, the Ministry of Public Security

a) Direct the management and allocation for renting residential premises for official use under their management as prescribed in this Decision and relevant laws;

b) Organize audits and inspections of the application of standards and quotas for residential premises for official use in investment construction and management and use of such premises under their management.

3. Central agencies (excluding the Ministry of Defense and the Ministry of Public Security) currently managing funds for residential premises for official use shall be responsible for organizing implementation in accordance with this Decision.

4. Responsibilities of Provincial People's Committees and Municipal People's Committees directly under the Central Government

a) Allocate capital from the local budget to invest in construction and purchase interior furnishings for residential premises for official use as prescribed;

b) Direct the management and development of residential premises for official use within their jurisdiction in accordance with laws on housing;

c) Organize audits and inspections of the application of standards and quotas for residential premises for official use in investment construction and management and use of such premises within their jurisdiction.

Article 9. Provisions on Transition

1. For housing projects for official residence that have been approved before the effective date of this Decision, the standards and norms set forth in Decision No. 03/2022/QĐ-TTg dated February 18, 2022 shall be applied.

2. In cases where housing for official residence has already been leased according to the standards and norms of Decision No. 03/2022/QĐ-TTg dated February 18, 2022 and the standards for housing for official residence of the Ministry of National Defense and the Ministry of Public Security, such leasing shall continue under the lease contracts for housing for official residence. After the expiration of these lease contracts, leasing shall be carried out in accordance with the provisions of this Decision.

3. In cases where plans and budgets for purchasing interior furnishings for housing for official residence have been submitted to the competent authority but have not yet been approved, or have been approved before the effective date of this Decision but have been modified after the effective date of this Decision, implementation shall be in accordance with the provisions of this Decision.

Article 10. Provisions on implementation

1. This Decision takes effect from August 1, 2024 and replaces Decision No. 03/2022/QĐ-TTg dated February 18, 2022 of the Prime Minister regarding standards and norms for housing for official residence.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, Heads of relevant agencies and organizations, and tenants of housing for official residence are responsible for implementing this Decision./.
