Regulations on service fees for preparing vehicle records for motor vehicles exempted from initial inspection and for reprinting Inspection Certificates and Inspection Stickers for motor vehicles

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Prices dated June 20, 2012;

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices and Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013;

Pursuant to Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of motor vehicle inspection services and Decree No. 30/2023/NĐ-CP dated June 8, 2023 of the Government amending and supplementing certain provisions of Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of motor vehicle inspection services;

Pursuant to Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating the functions, powers, and organizational structure of the Ministry of Transport;

On the proposal of the Director of the Department of Finance and the Director of the Vietnam Motor Vehicle Registration Agency,

Minister of The Ministry of Transport issues this Circular regulating service fees for preparing vehicle records for motor vehicles exempted from initial inspection and for reprinting Inspection Certificates and Inspection Stickers for motor vehicles.

Article 1. Scope of Regulation

This Circular regulates the service fee levels for preparing vehicle records for motor vehicles exempted from initial inspection and for reprinting Inspection Certificates and Inspection Stickers for motor vehicles.

Article 2. Applicability

1. Organizations and individuals subject to the vehicle registration units to prepare vehicle records for motor vehicles exempted from initial inspection and to reprint Inspection Certificates and Inspection Stickers for motor vehicles.

2. Vehicle registration units currently in operation.

3. Other organizations and individuals related to the preparation of vehicle records for motor vehicles exempted from initial inspection and the service of reprinting Inspection Certificates and Inspection Stickers for motor vehicles.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Motor vehicles exempted from initial inspection are motor vehicles (including passenger cars; trailers and semi-trailers towed by passenger cars) falling under the category exempted from initial inspection as prescribed in Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport on technical safety inspection and environmental protection of road motor vehicles (amended and supplemented by Circular No. 02/2023/TT-BGTVT dated March 21, 2023, and Circular No. 08/2023/TT-BGTVT dated June 2, 2023).

2. Preparing vehicle records for motor vehicles exempted from initial inspection is the process where the vehicle registration unit examines and evaluates the vehicle record to prepare the vehicle record, issue the Inspection Certificate, and Inspection Sticker for motor vehicles exempted from initial inspection as prescribed in Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport on technical safety inspection and environmental protection of road motor vehicles (amended and supplemented by Circular No. 02/2023/TT-BGTVT dated March 21, 2023, and Circular No. 08/2023/TT-BGTVT dated June 2, 2023).

3. Reprinting Inspection Certificates and Inspection Stickers for motor vehicles is the process where the vehicle registration unit reprints the Inspection Certificate and Inspection Sticker for the owner of the motor vehicle or the person bringing the vehicle for inspection as prescribed in Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport on technical safety inspection and environmental protection of road motor vehicles (amended and supplemented by Circular No. 02/2023/TT-BGTVT dated March 21, 2023, and Circular No. 08/2023/TT-BGTVT dated June 2, 2023).

Article 4. Regulations on the level of service fees for preparing vehicle registration files for motor vehicles exempted from initial inspection and reprinting the Inspection Certificate and Inspection Label for motor vehicles, and the responsibilities of related organizations and individuals.

1. The fee for preparing vehicle registration files for motor vehicles exempted from initial inspection is: 46,000 VND per vehicle; the fee for reprinting the Inspection Certificate and Inspection Label for motor vehicles is: 23,000 VND per time per vehicle.

The service fee specified in this clause includes the cost of organizing the collection of the Registration Fee for the Safety Technical Inspection and Environmental Protection Certificate for motor vehicles but does not include Value Added Tax as prescribed by law.

2. The inspection unit shall use invoices for service provision in accordance with Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government on invoices and documents; Circular No. 78/2021/TT-BTC dated September 17, 2021 of the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Administration dated June 13, 2019, and Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government on invoices and documents.

3. The inspection unit has the obligation to publicly disclose information and post service prices in accordance with laws on pricing, implement tax policies, and pay taxes in accordance with current tax laws and tax administration regulations.

4. Organizations and individuals receiving services for preparing vehicle registration files for motor vehicles exempted from initial inspection and reprinting the Inspection Certificate and Inspection Label for motor vehicles from the inspection unit are responsible for paying the service fee to the inspection unit according to the rates stipulated in this Circular.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. This Circular takes effect from June 15, 2024.

2. In cases where referenced documents in this Circular are newly issued or amended, they will be applied according to the new document or the amended document.

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Vehicle Inspection Agency, Directors of Provincial Departments of Transport under central cities and provinces, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
