CIRCULAR

Regulations on standards and conditions for promotion examination

of professional titles Registration of security measures

 

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants; Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 98/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the National Registration Center for Property Transactions;

The Minister of Justice issues this Circular stipulating the standards and conditions for promotion examination for the profession of registration of security measures.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the standards and conditions for promotion examination for the profession of registration of security measures (hereinafter referred to as the profession).

Article 2. This Circular applies to civil servants performing registration work, providing information on security measures, registering assets, and other transactions as prescribed by law at the Property Transaction Registration Centers under the National Registration Center for Property Transactions, Ministry of Justice (hereinafter referred to as the Registration Centers); and other relevant agencies, organizations, and individuals.

Article 2. Principles for Promotion Examination

Clause 1. The organization and examination for promotion of the profession must be based on the profession's qualification standards for civil servants registering security measures; job positions, staffing structures, and the number of civil servants registered according to the profession and the needs of the Registration Centers in accordance with the approved Job Position Plan by the competent authority.

Clause 2. Civil servants registering security measures who are eligible for promotion examination must meet the standards and conditions stipulated in this Circular and other relevant laws.

Clause 3. Equality, transparency, fairness, and objectivity in determining standards and conditions and in conducting promotion examinations for candidates.

Chapter II

STANDARDS AND CONDITIONS FOR PROMOTION EXAMINATION

Article 3. General Standards and Conditions for Promotion Examination for Civil Servants Registering Security Measures

Clause 1. Meeting the ethical standards and educational qualifications stipulated in Articles 3 and 4 of Circular No. 10/2024/TT-BTP dated September 24, 2024 of the Minister of Justice on the code, standards, and qualifications for the profession of registration of security measures (hereinafter referred to as Circular No. 10/2024/TT-BTP).

Clause 2. Meeting the standards and conditions set by the Registration Centers regarding participation in the promotion examination when the number of civil servants at the Registration Centers who meet the profession's qualifications exceeds the number or structure of civil servants specified in the approved Job Position Plan of the Registration Centers, and in cases where the examination is conducted based on the needs of the Registration Centers.

Clause 3. Meeting other general standards and conditions stipulated by relevant laws on recruitment, utilization, and management of civil servants.

Article 4. Criteria and conditions for promotion examination from Registration Guarantee Officer Level III to Level II

1. Currently holding the position of Registration Guarantee Officer Level III - code: V.00.01.03 (hereinafter referred to as Registration Guarantee Officer Level III) at the time of submitting the application for promotion examination.

2. Meeting the criteria for professional competence for Registration Guarantee Officer Level II - code: V.00.01.02 as stipulated in Clause 2, Article 6 of Circular No. 10/2024/TT-BTP.

3. Having held the position of Registration Guarantee Officer Level III for at least nine years.

In cases where the period of holding the position of Registration Guarantee Officer Level III has not reached nine years but the person applying for promotion has held an equivalent position, they may be eligible for promotion if the total period of holding both positions has reached nine years or more, with a minimum of one year (12 months) spent in the position of Registration Guarantee Officer Level III.

The period of holding the position specified in this clause does not include the probationary period or trial period.

4. Having performed at least one of the tasks specified in point c, Clause 1, Article 6 of Circular No. 10/2024/TT-BTP and having a decision or confirmation regarding the performance of the task from the competent authority.

Article 5. Criteria and conditions for promotion examination from Registration Guarantee Officer Level II to Level I

1. Currently holding the position of Registration Guarantee Officer Level II - code: V.00.01.02 (hereinafter referred to as Registration Guarantee Officer Level II) at the time of submitting the application for promotion examination.

2. Meeting the criteria for professional competence for Registration Guarantee Officer Level I - code: V.00.01.01 as stipulated in Clause 2, Article 7 of Circular No. 10/2024/TT-BTP.

3. Having held the position of Registration Guarantee Officer Level II for at least six years.

In cases where the period of holding the position of Registration Guarantee Officer Level II has not reached six years but the person applying for promotion has held an equivalent position, they may be eligible for promotion if the total period of holding both positions has reached six years or more, with a minimum of one year (12 months) spent in the position of Registration Guarantee Officer Level II.

4. Having performed at least one of the tasks specified in point d, Clause 1, Article 7 of Circular No. 10/2024/TT-BTP and having a decision or confirmation regarding the performance of the task from the competent authority.

Chapter III

IMPLEMENTING PROVISIONS

Article 6. Effectiveness and Responsibility for Implementation

1. This circular takes effect from November 8, 2024.

2. The Director of the Registration Center for Transactions and Assets under the National Registry of Security Interests Transaction is responsible for coordinating with the Trade Union Organization at the Center to establish the criteria and conditions stipulated in Clause 2, Article 3 of this circular.

3. In cases where laws on civil servants or normative legal documents cited in this circular are amended, supplemented, or replaced, implementation shall follow the new provisions in the amended, supplemented, or replacing normative legal documents.

4. The Director of the National Registry of Security Interests Transaction, the Head of the Cadre and Civil Servant Organization Department, the Directors of the Registration Centers for Transactions and Assets under the National Registry of Security Interests Transaction, and related organizations and individuals are responsible for implementing this circular.

5. During the implementation process, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should report to the Ministry of Justice for consideration and resolution./.
