GUIDELINES FOR IMPLEMENTING POINTS đ, h, i, k CLAUSE 1 ARTICLE 12a DECREE NO. 05/2011/NĐ-CP OF JANUARY 14, 2011 OF THE GOVERNMENT ON ETHNIC AFFAIRS AMENDED AND COMPLEMENTED BY DECREE NO. 127/2024/NĐ-CP OF OCTOBER 10, 2024 OF THE GOVERNMENT

GENERAL PROVISIONS

This Circular guides the implementation of points đ, h, i, k Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CPdated October 10, 2024 of the Government.

2. Applicability

This Circular guides the implementation of points đ, h, i, k Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP1. Agencies, organizations, and individuals specified in points đ, h, i, k Clause 1 of Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP

Chapter II

GUIDELINES FOR IMPLEMENTING POINTS Đ, H, I, K CLAUSE 1 ARTICLE 12A DECREE NO. 05/2011/NĐ-CP OF JANUARY 14, 2011 OF THE GOVERNMENT ON ETHNIC AFFAIRS AMENDED AND COMPLEMENTED BY DECREE NO. 127/2024/NĐ-CP OF OCTOBER 10, 2024 OF THE GOVERNMENT

This Circular guides the implementation of points đ, h, i, k Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP3. 1. Party cell secretaries, village chiefs, outstanding farmers, religious officials who are ethnic minorities making contributions to the economic and social development of ethnic minority regions include the following contributions:

a) Assets, labor, or specific solutions to improve production efficiency, business operations, job creation, and increase income for local residents;

b) Voluntary activities to help poor people, those in difficult circumstances, vulnerable groups, community building; environmental protection, health care for the community; raising public awareness;

c) Activities to preserve and promote positive traditional cultural values; build civilized lifestyles and enhance the spiritual life of the people;

d) Activities to implement democracy at the grassroots level; propaganda and mobilization of the people to implement Party policies, state laws, and local regulations contributing to the construction and maintenance of security, order, and social safety in the locality.

2. The People's Committee of the commune confirms in writing the contributions of the subjects specified in Clause 1 of this Article.

Guidelines for Implementation Point h Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP dated October 10, 2024 of the Government

1. Ethnic minority individuals and households in ethnic minority areas affected by natural disasters, epidemics, fires, including:

a) Loss of life: Households with deceased members;

b) Health loss: Individuals or households with severely injured members;

c) Property loss: Individuals or households with houses completely collapsed, severely damaged, or urgently relocated due to landslide, flood risks, or other property losses significantly affecting their livelihoods requiring support to stabilize their lives;

d) Individuals or households with members confirmed by healthcare facilities to be in Group A or Group B according to the announcement of the competent authority as stipulated in Decision No. 02/2016/QĐ-TTg dated January 28, 2016 of the Prime Minister regarding conditions for declaring and ending infectious disease outbreaks.

2. Ethnic minority individuals and households in ethnic minority areas facing sudden difficulties not covered under Clause 1 of this Article, including:

a) Having a family member who was the main breadwinner and died;

b) Individuals or the main breadwinner in the household suffering severe health or property losses significantly affecting their livelihoods requiring support to stabilize their lives;

c) Individuals or the main breadwinner in the household diagnosed with a serious illness by a healthcare facility.

3. The People's Committee of the commune confirms in writing the losses of the subjects as specified in Points a, b, c Clause 1 and Points a, b Clause 2 of this Article.

Guidelines for Implementation Point i Clause 1 of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP dated October 10, 2024 of the Government

1. Agencies and units with achievements in ethnic affairs and the cause of building the great national unity bloc, constructing, and defending the country as specified in Point i Clause 1 of Article 12a include one of the following achievements in ethnic affairs work:

a) Building, directing, and organizing the implementation of the Party's guidelines and policies, state laws on ethnic affairs, beliefs, and religions;

b) Propaganda and mobilization of the people to build the great national unity bloc, construct, and defend the country;

c) Education, training, and development of ethnic minority human resources, human resources for ethnic minority regions, and employment for ethnic minorities;

d) Healthcare for ethnic minorities.

2. The agencies and units specified in Point i, Clause 1 of this Article shall report in writing on their achievements and contributions when they are visited, congratulated, or presented with gifts by the Party leadership, State leadership, the Ministry of Ethnic Affairs and Religion.

Guidance for Implementation Point k, Clause 1 of Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Work, as amended and supplemented by Decree No. 127/2024/NĐ-CP dated October 10, 2024 of the Government

1. The People's Committee of the province shall establish a delegation of ethnic minority representatives to visit and work with the Party and State leadership according to the current regulations of competent authorities. Documents and files shall be submitted to the competent authorities and simultaneously sent to the Ministry of Ethnic Affairs and Religion for information.

2. The People's Committee of the province shall establish a delegation of ethnic minority representatives to visit and work with the leadership of the Ministry of Ethnic Affairs and Religion; the establishment document shall clearly specify the number, composition of the delegation, the proposed program of work, and the content of the work. In cases where the provincial People's Committee delegates the authority to establish the delegation to the specialized agency on ethnic affairs and religion at the provincial level, the dossier submitted to the Ministry of Ethnic Affairs and Religion shall include: the task assignment document of the provincial People's Committee, the establishment document clearly specifying the number, composition of the delegation, the proposed program of work, and the content of the work.

3. The document stipulated in Clause 2 of this Article shall be sent to the Ministry of Ethnic Affairs and Religion 15 days before the delegation visits and works with the leadership of the Ministry of Ethnic Affairs and Religion.

Chapter III

IMPLEMENTING PROVISIONS

This Circular guides the implementation of points đ, h, i, k Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP7. Effective Date

1. This Circular takes effect from February 15, 2026.

2. In cases where the cited documents in this Circular are amended, supplemented, or replaced by other documents, the provisions of the amended, supplemented, or replacing documents shall apply.

This Circular guides the implementation of points đ, h, i, k Clause 1 Article 12a of Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on Ethnic Affairs amended and supplemented by Decree No. 127/2024/NĐ-CP8. Implementation

1. The Ministry of Ethnic Affairs and Religion

a) Visiting, congratulating, presenting gifts, encouraging, meeting with agencies, organizations, individuals, and working with delegations of representatives as prescribed in Articles 3, 4, 5, and 6 of this Circular;

b) Directing and guiding local authorities at all levels (provincial and communal), agencies, organizations, and individuals related to implement the provisions of this Circular;

c) Directing the departments and units under the Ministry to proactively monitor the situation, provide advice, and propose the leadership of the Ministry to visit, congratulate, present gifts, encourage, meet with agencies, organizations, and individuals, and work with delegations of representatives as prescribed in this Circular.

2. The People's Committee of the province

Directing the specialized agency on ethnic affairs and religion at the provincial level to take the lead and coordinate with relevant departments and sectors to monitor the situation, promptly compile, provide advice, and propose to the competent authority to visit, congratulate, present gifts, encourage, meet with agencies, organizations, and individuals, and work with delegations of representatives as prescribed in Articles 3, 4, 5, and 6 of this Circular.

3. The People's Committee of the commune

Promptly compiling, proposing, and confirming according to the requirements of the Ministry of Ethnic Affairs and Religion and the directives of the provincial People's Committee to enable the competent authority to visit, congratulate, present gifts, encourage, meet with agencies, organizations, and individuals as prescribed in Articles 3, 4, and 5 of this Circular.

During the implementation process, if there are difficulties, please reflect them to the Ministry of Ethnic Affairs and Religion for guidance or amendment and supplementation as appropriate./.
