THÔNG TƯ

Căn cứ Luật Ban hành văn bản quy phạm pháp luật số 64/2025/QH15 được sửa đổi, bổ sung bởi Luật số 87/2025/QH15;

Căn cứ Nghị quyết số 197/2025/QH15 ngày 17 tháng 5 năm 2025 của Quốc hội về một số cơ chế, chính sách đặc biệt tạo đột phá trong xây dựng và tổ chức thi hành pháp luật;

Căn cứ Nghị định số 289/2025/NĐ-CP ngày 6 tháng 11 năm 2025 của Chính phủ hướng dẫn thi hành Nghị quyết số 197/2025/QH15 về một số cơ chế, chính sách đặc biệt tạo đột phá trong xây dựng và tổ chức thi hành pháp luật;

Căn cứ Nghị định số 25/2025/NĐ-CP ngày 21 tháng 2 năm 2025 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn của Bộ Nội vụ;

Theo đề nghị của Vụ trưởng Vụ Kế hoạch - Tài chính;

Bộ trưởng Bộ Nội vụ ban hành Thông tư hướng dẫn một số nội dung tại Nghị định số 289/2025/NĐ-CP ngày 6 tháng 11 năm 2025 của Chính phủ hướng dẫn thi hành Nghị quyết số 197/2025/QH15 ngày 17 tháng 5 năm 2025 của Quốc hội về một số cơ chế, chính sách đặc biệt tạo đột phá trong xây dựng và tổ chức thi hành pháp luật thuộc thẩm quyền của Bộ Nội vụ.

Điều 1. Phạm vi điều chỉnh

Thông tư này hướng dẫn một số nội dung tại Nghị định số 289/2025/NĐ-CP ngày 6 tháng 11 năm 2025 của Chính phủ hướng dẫn thi hành Nghị quyết số 197/2025/QH15 ngày 17 tháng 5 năm 2025 của Quốc hội về một số cơ chế, chính sách đặc biệt tạo đột phá trong xây dựng và tổ chức thi hành pháp luật thuộc thẩm quyền của Bộ Nội vụ, bao gồm:

1. Danh mục nhiệm vụ, hoạt động và định mức khoán chi cho từng nhiệm vụ, hoạt động trong xây dựng Thông tư thuộc thẩm quyền ban hành của Bộ trưởng Bộ Nội vụ và trong xây dựng Thông tư liên tịch do Bộ Nội vụ chủ trì xây dựng.

2. Lập, phê duyệt, điều chỉnh dự toán kinh phí ngân sách nhà nước bảo đảm cho công tác xây dựng pháp luật và tổ chức thi hành pháp luật.

3. Phân bổ và thanh, quyết toán kinh phí ngân sách nhà nước bảo đảm cho công tác xây dựng pháp luật và tổ chức thi hành pháp luật.

4. Sử dụng chuyên gia, tổ chức tư vấn trong công tác xây dựng pháp luật và một số nhiệm vụ, hoạt động tổ chức thi hành pháp luật hỗ trợ trực tiếp cho xây dựng pháp luật.

Điều 2. Đối tượng áp dụng

1. Các cơ quan, đơn vị thuộc Bộ Nội vụ thực hiện nhiệm vụ, hoạt động theo chức năng hoặc theo phân công của Bộ trưởng Bộ Nội vụ về xây dựng chính sách, soạn thảo, thẩm định văn bản quy phạm pháp luật.

2. Các cơ quan, đơn vị, tổ chức, cá nhân có liên quan đến lập dự toán, quản lý, sử dụng, quyết toán kinh phí ngân sách nhà nước cho nhiệm vụ, hoạt động xây dựng văn bản quy phạm pháp luật.

3. Cơ quan, tổ chức, cá nhân khác có liên quan trong thực hiện nhiệm vụ, hoạt động của các đơn vị quy định tại khoản 1 và khoản 2 Điều này.

Điều 3. Nguyên tắc thực hiện

Bảo đảm tuân thủ đúng, đầy đủ nguyên tắc áp dụng chế độ, chính sách đặc biệt quy định tại Điều 3 Nghị quyết số 197/2025/QH15 và Điều 2 Nghị định số 289/2025/NĐ-CP.

Điều 4. Danh mục nhiệm vụ, hoạt động và định mức khoán chi cho từng nhiệm vụ, hoạt động

1. Danh mục nhiệm vụ, hoạt động và định mức khoán chi cho từng nhiệm vụ, hoạt động xây dựng Thông tư của Bộ trưởng Bộ Nội vụ và Thông tư liên tịch do Bộ Nội vụ chủ trì soạn thảo quy định tại Phụ lục ban hành kèm theo Thông tư này.

2. Trường hợp xây dựng Thông tư sửa đổi, bổ sung của Bộ trưởng Bộ Nội vụ hoặc Thông tư liên tịch sửa đổi, bổ sung do Bộ Nội vụ chủ trì soạn thảo thì áp dụng định mức khoán chi như sau:

a) Thông tư sửa đổi, bổ sung hoặc Thông tư liên tịch sửa đổi, bổ sung của 02 Thông tư/Thông tư liên tịch trở lên thì áp dụng bằng tổng mức chi trong xây dựng 01 Thông tư tương ứng tại Phụ lục kèm theo Thông tư này; bằng định mức khoán chi cho từng nhiệm vụ, hoạt động tương ứng tại Phụ lục kèm theo Thông tư này.

b) Thông tư sửa đổi, bổ sung hoặc Thông tư liên tịch sửa đổi, bổ sung của 01 Thông tư/Thông tư liên tịch thì áp dụng bằng 60% tổng mức chi trong xây dựng 01 Thông tư tương ứng tại Phụ lục kèm theo Thông tư này; bằng 60% định mức khoán chi cho từng nhiệm vụ, hoạt động tương ứng tại Phụ lục kèm theo Thông tư này.

3. Thông tư hoặc Thông tư liên tịch bãi bỏ một phần hoặc bãi bỏ toàn bộ thì áp dụng tổng mức chi bằng 30% tổng mức chi trong xây dựng 01 văn bản thông tư tại Phụ lục kèm theo Thông tư này; bằng 30% định mức khoán chi cho từng nhiệm vụ, hoạt động tương ứng tại Phụ lục kèm theo Thông tư này.

4. Trường hợp xây dựng Thông tư, Thông tư liên tịch có kết hợp nhiều hình thức xử lý trong cùng một văn bản (ví dụ: vừa sửa đổi, bổ sung, vừa bãi bỏ) thì áp dụng định mức khoán chi của hình thức xử lý có tỷ lệ phân bổ ngân sách cao nhất để bảo đảm không vượt tổng mức chi theo khung quy định.

Article 5. Establishment, Approval, and Adjustment of Budgetary Expenditure Projections for National Budget Funds Ensuring Legislative Work and Organizational Implementation of Law

1. Based on the program or work plan (regular, thematic, or ad hoc) in legislative work assigned by a superior document or approved and agreed upon by the Minister, the unit directly implements tasks and activities with responsibility to prepare detailed budgetary expenditure projections for each task and activity.

2. The authority to approve and adjust the budgetary expenditure projection for each task and activity is carried out according to the financial management delegation rules of the Ministry of Interior.

3. In cases where the budgetary expenditure projection has been allocated and approved at the beginning of the year, the unit implements based on the assigned budgetary expenditure projection. In case there are ad hoc tasks or changes in the scope of expenditure, the unit shall follow the procedures for approving and adjusting detailed budgetary expenditure projections during the process of drafting documents according to the authority specified in Clause 2 of this Article.

4. The adjustment of expenditure content and level must ensure that it does not exceed the total approved budget; does not exceed the total expenditure limit for tasks and activities as stated in the annexes to Decree No. 289/2025/NĐ-CP and this Circular; and does not exceed the highest expenditure standard specified in each task and activity in the annexes to Decree No. 289/2025/NĐ-CP and this Circular.

5. Based on the document requesting the establishment or supplementation of budgetary projections as per the national budget laws, the relevant Bureaus and equivalent organizations are responsible for submitting the budgetary projection to the Planning-Finance Bureau; the Departments and Offices of the Ministry are responsible for submitting the budgetary projection to the Office of the Ministry for consolidation into the annual budget of the Ministry.

The budgetary projection file includes: the program or work plan (regular, thematic, or ad hoc) in legislative work and organizational implementation of law assigned by a superior document or approved and agreed upon by the Minister; detailed expenditure projections as per Clause 1 of this Article.

Article 6. Allocation and Settlement of National Budget Funds Ensuring Legislative Work and Organizational Implementation of Law

1. Based on the national budgetary expenditure projection assigned by an authorized body, the Planning-Finance Bureau reports to the Minister for allocation and distribution of the national budgetary expenditure to the relevant Bureaus and equivalent organizations, the Office of the Ministry, and sends it to the National Treasury for execution.

2. The head of the unit assigned is responsible for drafting normative legal documents based on the importance and complexity of the task or activity, proposing expenditure content and level within the allocated budgetary expenditure, in accordance with the expenditure standards specified in Decree No. 289/2025/NĐ-CP and this Circular.

Settlement, Finalization of Expenditure for Drafting Normative Legal Documents

a) The settlement and finalization of expenditure for drafting normative legal documents are carried out according to the provisions in Clauses 3 and 4 of Article 7 of Decree No. 289/2025/NĐ-CP. For tasks and activities involving the preparation of Circulars or Joint Circulars led by the Ministry of Interior, they shall be implemented according to the provisions stated in the annex issued with this Circular.

b) The unit assigned to draft normative legal documents is responsible for submitting the documents specified at point a of this clause to the unit assigned to settle and finalize expenditure for drafting normative legal documents as per regulations.

c) The unit assigned to settle and finalize expenditure for drafting normative legal documents is responsible for settling the expenditure with each unit based on each product of the task or activity and the standards specified in Decree No. 289/2025/NĐ-CP and this Circular.

Article 7. Use of Experts and Consulting Organizations in Legislative Work and Some Tasks and Activities Supporting Legislative Work

1. The unit proposing policy initiatives, the unit drafting legislation, the unit reviewing legislation, the unit consulting on policies, and the unit performing other tasks and activities as provided for in Paragraph 2 of Resolution No. 197/2025/QH15 may engage experts to support, enhance the quality of policy formulation, consultation, drafting, and review of normative legal documents; and perform some tasks and activities supporting legislative work.

2. The head of the unit directly performing a task or activity with the following responsibilities:

a) Establish criteria for identifying domestic experts and consulting organizations in the field of management to be submitted to the Leadership of the Ministry for issuance or issued according to authority (for units assigned staffing, operational funding, having their own seal and account).

b) Select experts and consulting organizations participating in task or activity implementation based on actual costs in the market or the type of service or work at the time of task or activity execution, as well as the criteria for identifying experts and consulting organizations specified in Clause 2, Point a hereof.

c) Determine the manner of cooperation and enter into contracts in accordance with legal provisions.

d) Evaluate and be responsible for the results of evaluation and acceptance of completed tasks; products of each activity under the task.

3. Payment of remuneration, costs to experts and consulting organizations shall comply with Paragraph 2 of Article 8, Paragraph 2 of Article 26, and Appendix VIII attached to Decree No. 289/2025/NĐ-CP.

Article 8. Responsibilities of Units under the Ministry

1. The unit directly performing a task or activity has the following responsibilities:

a) Ensure timely and quality completion of each task or activity; be responsible for the content and accuracy of documents and records during the execution of tasks or activities.

b) Use and manage funds in accordance with regulations, for the intended purpose, ensuring transparency, accountability, and efficiency.

c) Perform final accounts according to the specified cost allocation limits as provided in Decree No. 289/2025/NĐ-CP and this Circular.

For Departments under the Ministry: Provide complete records, vouchers, and products as required to the Departmental Office of the Ministry. The Departmental Office is the lead unit responsible for directly performing final accounts for the construction of normative legal documents for departments under the Ministry.

d) Provide all necessary documentation for inspection, audit, and inspection activities.

2. Planning and Finance Department:

Be responsible for guiding the preparation of budget plans; compile and report to competent authorities the budget estimates, allocation schemes, and provide full and timely national budget allocations for legislative work within the Ministry's jurisdiction.

3. Units under the Ministry shall report to the Leadership of the Ministry in charge on the implementation status of tasks and activities related to legislative work and organization of law enforcement.

4. The head of the unit responsible for drafting and implementing normative legal documents is fully responsible before the Minister, the Leadership of the Ministry, and under the law for applying special provisions as provided in Decree No. 289/2025/NĐ-CP and this Circular.

5. Heads of units under the Ministry are responsible to the Minister for the implementation of tasks assigned by this Circular; promptly address or recommend resolution of any difficulties or obstacles that arise during execution.

Article 9. Enforceability

1. This Circular shall take effect from June 1, 2026.

2. Regulatory documents assigned prior to July 1, 2025, as per the approved plan, will commence their implementation on July 1, 2025. Regulatory documents implemented before July 1, 2025, and issued from July 1, 2025, shall be settled and accounted for in accordance with the expenditure ceiling specified in Decree No. 289/2025/NĐ-CP and this Circular.

3. In case any documents, names, functions, tasks, or organizational structure referred to in this Circular are replaced or modified, such implementation shall be carried out in accordance with the substituted or amended document.

4. Should any difficulties arise during implementation, it is recommended that relevant agencies, units, organizations, and individuals promptly report to the Ministry of Home Affairs for research and guidance./.

In the case of two or more joint agencies, the allocation standard for expenditure shall be evenly distributed among the agencies.
