DECREE

On the functions, tasks, powers, and organizational structure of the Committee for Ethnic Minorities and Mountainous Areas

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Considering the proposal of the Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas and the Minister and Director of the Civil Service Committee of the Government;

 

DECREE:

Article 1. The Committee for Ethnic Minorities and Mountainous Areas is an agency of the Government, having the function of state management over ethnic minority and mountainous areas affairs throughout the country, and concurrently serving as an advisory body to the Party Central Committee and the Government on general policies and specific policies for mountainous areas with ethnic minorities.

Article 2. The Committee for Ethnic Minorities and Mountainous Areas has the following tasks and powers:

1. To draft and submit to the Government for issuance, or for the Government to submit to the Party Central Committee, the National Assembly, the Standing Committee of the National Assembly for issuance, regarding guidelines, policies, laws on socio-economic development in mountainous areas and ethnic minorities.

To coordinate with the State Planning Commission and Ministries, agencies at the ministerial level, agencies under the Government, relevant organizations, provincial People's Committees, municipal People's Committees directly under the central government in the formulation of strategic plans, five-year plans, annual plans, specific policies on ethnic minorities and socio-economic development in mountainous areas, to be submitted to the Government, and to cooperate with sectors and localities in implementing these plans and policies.

2. To monitor, urge, and inspect Ministries, agencies at the ministerial level, agencies under the Government, local People's Committees in implementing ethnic minority policies of the Party, laws, and regulations of the State on ethnic minorities and mountainous areas; economic and social development projects and programs in mountainous areas and regions inhabited by ethnic minorities.

3. To submit to the Government for approval and organization of implementation of programs and projects on mountainous areas and ethnic minorities directly managed by the Committee.

To directly organize the implementation of settlement programs for ethnic minority populations.

4. To participate with related agencies under the Government in the construction and management of state budget funds and government and non-governmental aid funds invested in socio-economic development programs and projects in mountainous areas and regions inhabited by ethnic minorities, in accordance with Government regulations; to guide the inspection of the use of humanitarian aid funds from non-governmental organizations assisting mountainous populations and ethnic minorities according to their designated purposes.

5. To receive, resolve, or coordinate with other agencies to resolve legitimate requests and aspirations of ethnic minority populations in accordance with established policies, regulations, and laws.

Article 3. The Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas is the head and overall leader of the Committee's activities.

Deputy Chairmen of the Committee assist the Minister and Chairman in directing certain aspects of work and are responsible to the Minister and Chairman.

Article 4. The organizational structure of the Committee for Ethnic Minorities and Mountainous Areas includes:

1. Office

2. General Department

3. Department of Ethnic Minority and Mountainous Area Policies

4. Organization and Cadre Department

5. International Cooperation Department

6. Settlement Bureau (organized based on the resettlement bureau transferred from the Ministry of Forestry).

Article 5. The organizational structure for ethnic minority and mountainous area work at the local level shall be established by the Minister and Director of the Civil Service Committee of the Government upon submission to the Prime Minister for decision based on the proposal of the Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas.

Article 6. This Decree takes effect from the date of issuance. Decision No. 147-CT dated May 11, 1990 of the Council of Ministers Chairman on the establishment of the Office of Ethnic Minorities and Mountainous Areas is hereby repealed.

Article 7. The Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas, Ministers, Heads of agencies at the ministerial level, agencies under the Government, Chairmen of provincial People's Committees, municipal People's Committees directly under the central government are responsible for enforcing this Decree./.
