DECREE
Detailed implementation of certain provisions of the Minerals Law
Decree No. 158/2016/NĐ-CP dated November 29, 2016 of the Government detailing the implementation of certain provisions of the Minerals Law, effective from January 15, 2016, has been amended and supplemented by:
1. Decree No. 67/2019/NĐ-CP dated July 31, 2019 of the Government stipulating the method of calculation and level of payment for granting the right to exploit minerals, effective from September 15, 2019.
2. Decree No. 22/2023/NĐ-CP dated May 12, 2023 of the Government amending and supplementing certain provisions of related decrees concerning business activities in the natural resources and environment sector, effective from May 12, 2023.
Pursuant to the Law on Government Organization dated June 19, 2015;
Based on the Minerals Law dated November 17, 2010;
At the proposal of the Minister of Natural Resources and Environment;
The Government promulgates this Decree detailing the implementation of certain provisions of the Minerals Law1.
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Decree details the implementation of certain contents of the Minerals Law No. 60/2010/QH12 regarding the reimbursement of costs for basic geological surveys of minerals, mineral exploration costs; periodic reports on mineral activities; mine general manager; confirmation of capital ownership; mineral planning; basic geological surveys of minerals; protection of local interests and people's rights where minerals are exploited, protection of unexploited minerals; mineral areas and regulations on mineral activities; procedures for granting permits for mineral activities, approval of mineral reserves and closure of mineral mines.
2. This Decree amends and supplements Clause 2 Article 3, Clause 1 Article 6, Point b Clause 2 Article 16; supplements Clause 4 Article 15 of Decree No. 22/2012/NĐ-CP dated March 26, 2012 of the Government on auctioning the right to exploit minerals; amends and supplements Clause 2 Article 3, Article 4, Article 5, Clause 3 Article 6, Article 7 of Decree No. 203/2013/NĐ-CP dated November 28, 2013 of the Government on the method of calculation and level of payment for granting the right to exploit minerals.
Article 2. Interpretation of Terms
2. Self-generated and self-consumed electricity is electricity produced and consumed by an organization or individual to serve their own needs.
1. Hazardous minerals are types of minerals containing one of the elements Mercury, Arsenic, Uranium, Thorium, asbestos group, which when mined and used release radioactive or harmful substances exceeding the levels specified in Vietnam technical standards.
2. Associated minerals are other types of minerals located within the mining area, recoverable during the exploitation of the main minerals already determined in the Mineral Exploitation Permit, including other minerals at the tailings of operating mines that at that time it is determined that the exploitation and utilization of these minerals are economically viable.
3. Raw minerals are mineral resource products that have been mined but are not yet in their natural state and have not undergone crushing, screening, classification, or other activities to enhance the value of the minerals after mining.
4. Mine construction works are those defined in the investment project and mine design, including: Construction of facilities (houses, warehouses, wharfs, etc.) serving mining; construction of transportation routes connecting the mining site with the surrounding transportation system; initial land leveling for mining.
5. Mine General Manager is a person with qualifications and capabilities meeting the requirements stipulated in Clause 2 Article 62 of the Minerals Law appointed by the organization or individual permitted to exploit minerals, or directly assumed by the individual permitted to exploit or the head of the organization permitted to exploit.
62. Reserve for payment for the right to exploit minerals is the reserve of minerals allowed to be included in the mining design, determined in the investment project or economic and technical report and specified in the Mineral Exploitation Permit.
7. Area of basic geological survey of minerals is the area determined in the basic geological survey project of minerals approved by the competent authority. Within the area of basic geological survey of minerals, one or more mineral zones may be discovered and evaluated.
8. Geological heritage is a part of geological resources with outstanding scientific, educational, aesthetic, and economic values.
9. Force majeure in mineral activities is an unforeseeable objective event; an incident where organizations and individuals have applied all measures but cannot avoid or overcome, leading to inability to perform or perform incompletely the obligations of organizations and individuals engaged in mineral activities.
Article 3. Repayment of basic geological investigation costs for mineral resources and exploration costs for minerals
1. The information on basic geological investigations for mineral resources that organizations and individuals must repay costs for when using is information assessing the potential of mineral resources.
2. The repayment of costs for assessing the potential of mineral resources and exploring mineral resources shall be carried out according to the following principles:
a) In cases where the information on assessing the potential of mineral resources and exploring mineral resources belongs to the State, organizations and individuals using such information for exploration, exploitation of mineral resources or other business purposes must repay to the State the investment costs. The costs to be repaid for information on assessing the potential of mineral resources are determined based on the volume of works already constructed within the proposed area for mineral resource exploration including drilling, trenches, shafts, wells, karotage of drill holes, and samples determining the quality of mineral resources in these works. The costs to be repaid for information on mineral resource exploration are all items of work already constructed within the proposed area for mineral resource exploitation. The repayment unit price is calculated based on the current unit price at the time of calculation;
b) In cases where areas are being exploited under permits issued by competent state authorities, the costs to be repaid are determined based on the current status of natural resources and remaining reserves at the time of calculation, while also basing it on the average cost calculated per unit of natural resources (when assessing the potential of mineral resources) or per unit of reserves (when exploring mineral resources), as determined according to the principle stipulated in point a of this clause;
c) Organizations and individuals conducting mineral resource exploration with capital from the state budget may not provide or transfer information about the results of mineral resource exploration to other organizations or individuals, except in cases of providing such information to competent authorities as prescribed by the Ministry of Natural Resources and Environment;
d) In cases where the information on assessing the potential of mineral resources and exploring mineral resources is invested by organizations or individuals, the repayment of the investment costs shall be carried out according to the principle of mutual agreement in writing between the investing organization or individual and the organization or individual using the information, and must fulfill financial obligations as prescribed;
In cases where the information on assessing the potential of mineral resources and exploring mineral resources, which is invested by organizations or individuals in areas where mining activities have been suspended due to permit revocation, permit return, or expiration of priority rights to apply for mining permits, and the parties cannot agree on the costs to be repaid, the competent state authority issuing permits as stipulated in Clause 1 and Clause 2, Article 82 of the Law on Mineral Resources (hereinafter referred to as the competent state authority issuing permits) shall decide on the investment costs to be repaid according to the principle stipulated in point a of this clause;
e) In cases where organizations or individuals have already repaid the state budget the amount invested in assessing the potential of mineral resources and exploring mineral resources, the repayment of costs shall be carried out according to the provisions of point d of this clause;
3. The repayment of costs for basic geological investigations for mineral resources and exploration costs for minerals as stipulated in point a of Clause 2 of this Article must be completed before organizations or individuals submit applications for mining permits;
4. The Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Finance to submit to the Prime Minister for issuance of regulations on methods for determining costs for assessing the potential of mineral resources and exploration costs for minerals to be repaid, repayment methods; regulations on collection, management, and use of costs for assessing the potential of mineral resources and exploring mineral resources that have been invested by the State.
Article 4. Utilization of Information on Mineral Potential Assessment, Exploration, and Mining
1. Organizations and individuals have the right to utilize information on mineral exploration that they have invested in or information on mineral potential assessment, exploration, and mining owned by the State for which costs have been reimbursed according to Article 3 of this Decree and have the right to transfer or inherit such information in accordance with the provisions of the law. 2. After six months from the date the mineral reserves are approved by the competent authority and the term of the Mineral Exploration Permit has expired, if the organization or individual permitted to explore does not submit an application for a Mineral Exploitation Permit, the competent state agency may provide information about minerals in that area to other organizations and individuals for use, except in cases of force majeure. Organizations and individuals utilizing the mineral exploration information specified in
point d, Clause 2, Article 3 of this Decree shall be responsible for reimbursing the exploration costs to the organization or individual who conducted the exploration previously. Article 5. State Investment for Mineral Exploration and Mining
1. The State invests in exploring and mining certain important types of minerals to serve economic and social development, national defense, and security objectives as stipulated in Clause 5, Article 3 of the Law on Minerals.
2. Based on the approved mineral planning, taking into account the requirements for serving economic and social development, national defense, and security objectives, the Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and related ministries and sectors to appraise and submit to the Prime Minister for approval projects for mineral exploration and mining implemented with capital from the state budget.
Article 6. Responsibilities for Managing Hazardous Minerals
1. The Ministry of Natural Resources and Environment shall be responsible for investigating, assessing, determining the degree of impact, and identifying affected areas due to hazardous minerals; proposing preventive measures against the adverse effects of hazardous minerals on the local environment and residents; notifying and transferring relevant documents to the People's Committee of the province where hazardous minerals are located.
2. The People's Committee of the province where hazardous minerals are located shall be responsible for implementing preventive measures against the negative impacts of hazardous minerals on the local environment and residents; organizing management and protection of unexploited hazardous minerals within the local area in accordance with regulations.
Article 7. Reporting on Mineral Activities; Reporting on State Management of Minerals
1. Reporting on the results of mineral activities includes:
a) Report on the results of mineral exploration activities;
b) Report on the results of mineral exploitation activities.
2. Reporting on the situation of state management of minerals includes:
a) Report on the situation of state management of minerals within the scope of provinces and centrally-administered cities;
b) Report on the situation of state management of minerals nationwide.
3. The reporting system is regulated as follows:
a) Periodic reports as stipulated in Clauses 1 and 2 of this Article shall be conducted once a year. The reporting period runs from January 1 to December 31 of the reporting year;
b) In addition to the reporting system mentioned in point a of this clause, when requested by the state management agency for minerals, organizations and individuals permitted to engage in mineral activities must report promptly on their mineral activity situations.
4. The responsibility for submitting reports is regulated as follows:
a) Before February 1 each year, organizations and individuals permitted to engage in mineral activities must submit the previous year's report as stipulated in Clause 1 of this Article to the Department of Natural Resources and Environment where the mineral activities are carried out. For organizations and individuals engaging in mineral activities under permits issued by the Ministry of Natural Resources and Environment, they must also submit the report to the Vietnam General Directorate of Geology and Minerals;
b) Before February 15 each year, the Department of Natural Resources and Environment must complete the previous year's report as stipulated in point a, Clause 2 of this Article and submit it to the People's Committee of the province for submission to the Ministry of Natural Resources and Environment and send a copy of the report to the Department of Industry and Trade and the Department of Construction for coordinated management;
c) Before March 15 each year, the Vietnam General Directorate of Geology and Minerals must prepare the previous year's report as stipulated in point b, Clause 2 of this Article and submit it to the Ministry of Natural Resources and Environment for reporting to the Prime Minister and send a copy of the report to the Ministry of Industry and Trade, the Ministry of Construction, and the Ministry of Planning and Investment for coordinated management.
5. The Ministry of Natural Resources and Environment shall specify the formats of the various reports as stipulated in Clauses 1 and 2 of this Article.

Article 8. Mine Manager
1. The Mine Manager is responsible for managing mining activities according to the Mineral Extraction Permit; implementing approved investment projects and mine designs in accordance with laws on minerals; and ensuring labor safety and environmental protection regulations during mineral extraction.
2. Immediately upon appointing the Mine Manager, the organization or individual conducting mineral extraction shall notify the authority specified in Clause 4 of this Article in writing. The notification letter shall include: Information about the appointment decision (except in cases where the individual conducting mineral extraction or the head of the organization permitted to conduct mineral extraction concurrently serves as the Mine Manager); the Mine Manager's curriculum vitae, accompanied by the original Appointment Decision and Curriculum Vitae; copies of relevant professional certificates of the Mine Manager.
3. The educational qualifications of the Mine Manager stipulated at point d and e, Clause 2, Article 62 of the Minerals Law include:
a) A bachelor’s degree or equivalent in mining engineering or mine construction for underground mines;
b) A bachelor’s degree or equivalent in mining engineering, mine construction, or geological engineering for open-pit mines;
c) An associate degree, secondary vocational school diploma, or equivalent in mining engineering or geological engineering for open-pit non-metallic mineral mines that do not use industrial explosives; common building material mineral mines extracted manually.
4. Organizations or individuals conducting mineral extraction shall notify the Mine Manager as prescribed in Clause 2 of this Article to the Vietnam General Department of Geology and Minerals for Mineral Extraction Permits issued by the Ministry of Natural Resources and Environment; and the Provincial Department of Natural Resources and Environment for Mineral Extraction Permits issued by the People's Committee of the province.
Article 9. Capital of organizations and individuals engaged in mineral activities
1. For newly established enterprises, one of the following documents shall be submitted:
a) Shareholders' contribution minutes for joint-stock companies or founders' contribution minutes for limited liability companies with two or more members; company charter for joint-stock companies, member registration book for limited liability companies with two or more members;
b) Capital allocation decision by the owner for a single-member limited liability company where the owner is an organization.
2. For operating enterprises, the following applies:
a) For enterprises established within one year from the date of submitting the application for a Mineral Exploration Permit or a Mineral Extraction Permit: Submit a copy of the Enterprise Registration Certificate;
b) For enterprises established over one year from the date of submitting the application for a Mineral Exploration Permit or a Mineral Extraction Permit: Submit a copy of the most recent Financial Report.
3. For Cooperatives and Cooperative Federations, one of the following documents shall be submitted:
a) The registered capital of the cooperative or cooperative federation is the total amount of capital contributed or committed to be contributed by the cooperative members or member cooperatives within a certain period and recorded in the cooperative or cooperative federation charter in accordance with the Law on Cooperatives;
b) The operational capital of the cooperative or cooperative federation includes the contributions of members and member cooperatives, raised funds, accumulated funds, various funds of the cooperative or cooperative federation; state subsidies, support from domestic and foreign organizations and individuals; gifts and other lawful sources of income as prescribed.
Chapter II. MINERAL PLANNING AND BASIC GEOLOGICAL INVESTIGATION ON MINERALS
Article 10. Establishment and submission for approval of mineral planning
1. Responsibilities for establishing and submitting to the Prime Minister for approval of mineral planning as stipulated in Clause 3, Article 10 of the Mineral Law are specified as follows:
a) The Ministry of Natural Resources and Environment shall take the lead in establishing basic geological investigation planning for minerals;
b) The Ministry of Industry and Trade shall take the lead in establishing exploration, exploitation, processing, and utilization planning for various types of minerals (excluding construction materials);
c) The Ministry of Construction shall take the lead in establishing exploration, exploitation, processing, and utilization planning for construction materials;
2. Mineral planning as stipulated in Clause 1 of this Article shall be established in accordance with the approved mineral strategy.
3. During the process of establishing mineral planning, the Ministry of Industry and Trade and the Ministry of Construction, according to their authority as stipulated in Points b and c of Clause 1 of this Article, shall coordinate to implement the provisions of Point d, Clause 1 of Article 13 of the Mineral Law.
Article 11. Exploration, Exploitation, and Utilization Planning for Minerals at Provincial and Central City Levels
1. Exploration, exploitation, and utilization planning for minerals at provincial and central city levels as stipulated in Point d, Clause 1 of Article 10 of the Mineral Law shall be established for the following types of minerals:
a) Ordinary construction materials, mud coal;
b) Minerals in areas with scattered and small deposits that have been delineated and announced by the Ministry of Natural Resources and Environment;
c) Minerals in tailing areas where mines have been officially closed.
2. The establishment of exploration, exploitation, and utilization planning for minerals at provincial and central city levels must ensure the following principles:
a) Consistency with the mineral strategy and mineral planning as stipulated in Point a, Point b, and Point c of Clause 1 of this Decree;
b) Consistency with the overall socio-economic development planning at the provincial level; land use planning and plans already reviewed and approved by competent authorities; ensuring security and defense on the territory;
c) Ensuring rational, economical, and efficient exploitation and utilization of minerals to meet current needs while considering scientific and technological progress and future mineral demands;
d) Protecting the environment, natural scenery, historical and cultural relics, scenic spots, and other natural resources.
3. The basis for establishing exploration, exploitation, and utilization planning for minerals at provincial and central city levels includes:
a) Overall socio-economic development planning of the province and regional planning;
b) Mineral strategy; mineral planning as stipulated in Point a, Point b, and Point c of Clause 1 of this Decree;
c) Demand for minerals during the planning period;
d) Progress in science and technology in mineral exploration and exploitation;
đ) Results of implementing the previous planning period.
4. Exploration, exploitation, and utilization planning for minerals at provincial and central city levels must include the following main contents:
a) Investigation, research, synthesis, and evaluation of natural conditions, socio-economic conditions, and the current status of mineral exploration, exploitation, processing, and utilization activities in the local area;
b) Evaluation of the results of the previous planning period;
c) Determination of directions and goals for mineral exploration, exploitation, and utilization during the planning period;
d) Indication of areas prohibited from mineral activities and temporarily prohibited areas that have been approved;
đ) Delineation of detailed mining areas, types of minerals requiring exploration and exploitation investment, and schedules for exploration and exploitation. The exploration and exploitation areas are limited by straight lines connecting vertices shown on national coordinate system topographic maps at appropriate scales;
e) Determination of scale, capacity of exploitation, and requirements for exploitation technology;
g) Solutions and schedules for organizing the implementation of the planning.
Article 12. Soliciting Opinions and Announcing Mineral Resource Planning
1. The solicitation of opinions on mineral resource planning shall be carried out as follows:
a) Prior to submitting for approval by the Prime Minister, the leading agency responsible for drafting the planning shall solicit opinions from agencies specified in Clause 1, Article 10 of this Decree; ; opinions from the Ministries of Planning and Investment, Finance, Public Security, National Defense, Transport, Agriculture and Rural Development, Culture, Sports and Tourism; and opinions from the People's Committees of provinces and centrally-run cities where the mineral deposits included in the planning are located; publicly posting the explanatory content of the planning on the electronic information website of the leading agency responsible for drafting the planning at least 45 days before submitting for approval of the planning;b) Prior to submitting for approval by the People's Councils at the same level, the provincial People's Committee shall solicit opinions from the Ministries of Natural Resources and Environment, Industry and Trade, Construction. In cases where the mineral resources included in the planning have an area distributed across two or more bordering provinces or centrally-run cities, the provincial People's Committee must submit the file for soliciting opinions from the People's Committees of the bordering provinces or centrally-run cities.
2. Within 45 days from the date of receipt of the opinion solicitation document from the leading agency responsible for drafting the planning, the agencies specified in Clause 1 of this Article shall respond in writing regarding the planning dossier. If the agency solicited for opinions fails to respond in writing within the above time limit, the leading agency responsible for drafting the planning will submit for consideration and approval or passage of the planning by the Prime Minister or the People's Councils at the same level.
3. The dossier for soliciting opinions on mineral resource planning includes:
a) A request for opinions;
b) An explanatory draft of the planning;
c) Planning drawings and other related documents (if any).
4. Within no more than 30 days from the date of approval of the mineral resource planning, the leading agency responsible for drafting the planning must announce the planning through the following methods:
a) Publicly posting the content of the planning on the Government's electronic information website and the electronic information website of the leading agency responsible for drafting the planning;
b) Organizing a press conference to publicly announce the planning at the headquarters of the leading agency responsible for drafting the planning.
Article 13. Investment in Basic Geological Survey of Mineral Resources with Capital from Organizations and Individuals
1. Encouragement is given to organizations and individuals participating in investment in basic geological survey of mineral resources, except for basic geological survey of uranium and thorium mineral resources.
In cases where the basic geological survey of mineral resources falls within the national border zone, the Ministry of Natural Resources and Environment shall report to the Prime Minister for consideration prior to making a decision.
2. Based on the approved basic geological survey of mineral resources planning and the provisions of Clause 1 of this Article, the Ministry of Natural Resources and Environment shall establish a supplementary list of projects for basic geological survey of mineral resources that encourage participation in investment with capital from organizations and individuals, to be submitted for approval by the Prime Minister.
3. Organizations and individuals participating in investment in basic geological survey of mineral resources must meet the following requirements:
a) Meeting the conditions stipulated in Clause 1, Article 34 and Clause 1, Article 51 of the Law on Minerals;
b) Ensuring sufficient funds to implement the entire project for basic geological survey of mineral resources.
a) Delimiting and announcing the type of mineral resources, location, coordinates, and area belonging to the project for basic geological survey of mineral resources that encourages participation in investment with capital from organizations and individuals on the Ministry's electronic information website according to the approved basic geological survey of mineral resources planning;
4. The Ministry of Natural Resources and Environment has the responsibility:
b) Reviewing and approving projects for basic geological survey and evaluation of mineral resources that encourage investment;
c) Issuing regulations supervising the implementation process of the project for basic geological survey of mineral resources;
d) Leading and coordinating with the Ministries of Planning and Investment, Finance to guide procedures for capital contribution and management of capital for investment participation by organizations and individuals;
đ) Supervising the implementation process of the project for basic geological survey of mineral resources conducted by organizations and individuals participating in investment.
d) Supervise the implementation process of the basic geological survey project on minerals by organizations and individuals participating in investment.
Article 14. Investigation and assessment of geological heritage, geological parks, and funding for basic geological investigation on minerals
1. Basic geological investigation on minerals must be linked to the investigation and assessment of geological heritage and geological parks. The Ministry of Natural Resources and Environment shall stipulate the contents of the work on investigating and assessing geological heritage and geological parks.
2. Funding for basic geological investigation on minerals shall be implemented according to the provisions of Clause 1, Article 21 of the Minerals Law and supplemented from the money refunded for basic geological investigation on minerals, exploration costs for minerals, fees for mineral exploitation rights, and investment funds of organizations and individuals as prescribed in Article 13 of this Decree.
3. Annually, based on the revenue specified in Clause 2 of this Article, the Ministry of Finance shall take the lead and coordinate with the Ministry of Natural Resources and Environment to balance the level of supplementary funding for basic geological investigation on minerals.
Chapter III. RIGHTS OF LOCAL AUTHORITIES AND CITIZENS WHERE MINERALS ARE EXPLOITED; PROTECTION OF UNEXPLOITED MINERALS
Article 15. Rights of local authorities where minerals are exploited
1. Based on the actual annual revenue from mineral exploitation activities, the People's Committee of the province shall submit to the People's Council at the same level for approval the budget estimate for financial support to upgrade and renovate infrastructure projects for the locality where minerals are exploited as prescribed in Clause 2 of this Article.
2. Infrastructure projects supported for upgrading and renovation must meet the following conditions and criteria:
a) They are district and commune-level roads directly affected by the transportation of waste rock and extracted minerals;
b) They are welfare facilities located within the districts and communes where minerals are exploited, including schools, medical facilities, cultural houses, clean water supply systems, and environmental treatment facilities.
Article 16. Rights of citizens where minerals are exploited
1. The support for localities and citizens where minerals are exploited as prescribed in Clause 2, Article 5 of the Minerals Law shall be carried out by the organizations and individuals directly exploiting minerals.
2. Organizations and individuals exploiting minerals shall notify the content and volume; plans and programs for implementing tasks and projects supporting the locality and citizens to the People's Committee of the commune; publicly announce to the residential wards/villages/hamlets so that citizens can elect representatives to participate in supervising the implementation process.
3. The cost of supporting localities and citizens where minerals are exploited by organizations and individuals exploiting minerals shall be recorded as production expenses.
Article 17. Responsibilities for protecting unexploited minerals of People's Committees at all levels
1. Within the scope of their duties and powers, the People's Committee of the province shall have the responsibility:
a) To direct the People's Committee of the district to propose plans; assign the Department of Natural Resources and Environment to aggregate, prepare, and submit to the People's Committee of the province for approval the Plan for Protecting Unexploited Minerals in the locality according to the budget expenditure guidelines issued by the Ministry of Finance;
b) To direct the People's Committee of the district and commune; specialized agencies; and cooperate with defense and police forces to prevent and stop unauthorized mineral exploitation activities (hereinafter referred to as illegal mineral exploitation activities) within the territory;
c) To summarize and assess the protection of unexploited minerals within the territory and include it in the annual report on state management of minerals;
d) The Chairman of the People's Committee of the province shall bear responsibility before the Prime Minister when illegal mineral exploitation occurs in the locality without being addressed or not thoroughly resolved, leading to prolonged occurrences.
2. The People's Committee of the district, town, city under provincial jurisdiction (hereinafter collectively referred to as the People's Committee of the district) shall have the responsibility:
a) To lead the dissemination and implementation of the Plan for Protecting Unexploited Minerals within the territory;
b) To direct the People's Committee of the commune, ward, town (hereinafter collectively referred to as the People's Committee of the commune) to implement measures to protect unexploited minerals;
c) To immediately carry out clearance and prevention of illegal mineral exploitation activities upon discovery or receipt of information about such activities occurring within the territory. Timely report to the People's Committee of the province for guidance on handling if the activity cannot be stopped;
d) Before December 15 each year, send a report to the People's Committee of the province on the situation of protecting unexploited minerals in the locality;
đ) The Chairman of the People's Committee of the district shall bear responsibility before the Chairman of the People's Committee of the province when illegal mineral exploitation occurs in the territory without being addressed or prolonged.
3. The People's Committee of the commune shall be responsible for:
a) To disseminate, popularize, and educate the law on minerals to villages/communities; mobilize local residents not to exploit, purchase, store, or transport minerals illegally, to detect and report organizations and individuals engaging in illegal mineral exploitation; to implement the Plan for Protecting Unexploited Minerals within the territory;
b) To detect and implement measures to prevent illegal mineral exploitation activities immediately upon discovery; in cases exceeding authority, promptly report to the People's Committee of the district for guidance on clearance operations;
c) To periodically report every six months on the situation of protecting unexploited minerals in the locality to the People's Committee of the district.
Article 18. Main contents of the plan for protecting unexploited mineral resources
The plan for protecting unexploited mineral resources prescribed in point a, Clause 1, Article 17 of this Decree includes the following main contents: point a, Clause 1, Article 17 of this Decree includes the following main contents:
1. The current status of state management over mineral resources and mining activities, including efforts to protect unexploited mineral resources in the locality at the time of drafting the Plan; existing problems, limitations, and their causes.
2. Statistics on the quantity, area, coordinates of exploration and exploitation zones of mineral resources currently in operation for organizations and individuals granted permits by competent state authorities in the locality; zones where mining has ended and mines have been closed for protection; tailing areas of mines that have been officially closed.
Boundaries and areas with minerals that have been and are being investigated and evaluated; national mineral reserves requiring protection; zones prohibited from mining activities, temporarily prohibited zones from mining activities that have been approved; scattered and small-scale mineral areas that have been delineated and announced.
3. Updated information on the planning for exploration, exploitation, and utilization of mineral resources of the province/city that have been adjusted and supplemented; information on the national mineral resource planning that has been approved up to the time of drafting the Plan.
4. Responsibilities of Departments: Natural Resources and Environment, Industry and Trade, Construction, Agriculture and Rural Development, Transportation, Culture, Sports and Tourism; police and military forces in protecting unexploited mineral resources; local media agencies in disseminating state management information on mineral resources and illegal mining.
5. Responsibilities of the People's Committee at the district and commune levels; forms of handling collective and individual entities who are heads of district and commune governments when illegal mining occurs, illegal buying, selling, and transporting of mineral resources in the locality without complete resolution, leading to recurrence and prolongation; responsibilities of village/hamlet chiefs in promptly informing the commune and district authorities upon discovering illegal mining activities in the locality.
6. Responsibilities for coordination between relevant departments and sectors of the locality; district and commune-level authorities in providing, processing information, and resolving illegal mining activities; responsibilities of the agency and person receiving information; mechanisms for processing received information.
7. Implementation plans and solutions; budget estimates for implementation costs.
Article 19. Soliciting opinions from state management agencies on mineral resources before submitting for approval of socio-economic development planning
The process of soliciting written opinions from state management agencies on mineral resources before submitting for approval as stipulated in Clause 3, Article 17 of the Mineral Law shall be carried out as follows:
1. The agency or organization drafting the plan sends to the Ministry of Natural Resources and Environment a document soliciting opinions, along with the Detailed Description of the Plan and the overall map of the planned area.
2. Within no more than 20 working days from the date of receipt of the opinion solicitation document from the agency or organization as specified in Clause 1 of this Article, the Ministry of Natural Resources and Environment shall take the lead and coordinate with the People's Committee of the province where the plan is located and related agencies to review and respond in writing regarding the extent of investigation and evaluation of mineral resources; whether there are mineral resources; issues concerning the planning for exploration, exploitation, and utilization of mineral resources that have been approved by competent authorities within the planned area.
Article 20. Responsibility for Protecting Unexploited Mineral Resources of Organizations and Individuals Authorized to Engage in Mineral Activities
1. To protect unexploited mineral resources and to conduct exploration and exploitation of minerals within the permitted area, organizations and individuals must mark the corners of the exploration and exploitation areas according to the coordinates recorded in the Exploration Permit for Minerals or the Exploitation Permit for Minerals.
2. The specifications for marking the corners of the mineral activity areas are as follows:
a) In accordance with the specifications for boundary markers of administrative units at the commune level for solid mineral exploration and exploitation;
b) For cases involving the exploitation of riverbed sand and gravel, estuary sand and gravel, or beach sand and gravel, the marking shall be carried out in accordance with the regulations on inland waterways or maritime laws. If it is not possible to comply with the aforementioned regulations, the markers shall be placed along the riverbank in accordance with the provisions set forth in point a of this clause.
3. After completing the marking as stipulated in Clause 2 of this Article, organizations and individuals authorized to engage in mineral activities must notify in writing the Department of Natural Resources and Environment, which will coordinate with the People's Committee of the district and commune where the mineral resources are being exploited to hand over the markers on-site. In cases where the exploitation permit is issued by the Ministry of Natural Resources and Environment, representatives from the Vietnam General Directorate of Geology and Minerals must also be present.
4. Organizations and individuals authorized to engage in mineral activities have the responsibility to organize management and protection to prevent unauthorized mineral exploitation within the permitted mineral activity area. Upon discovering unauthorized mineral exploitation outside the boundaries of the permitted mineral activity area, they must immediately report it to the People's Committee of the district or commune for handling.
5. Organizations and individuals authorized to exploit mineral resources have the responsibility to retain and protect extracted minerals that have not yet been utilized; minerals at waste disposal sites or accompanying minerals that have not been recovered during the exploitation process.
6. Prior to exploiting accompanying minerals as specified in Clause 2 of Article 2 of this Decree,organizations and individuals engaged in mineral exploitation must submit a written notification to the agency responsible for receiving applications as stipulated in Clause 1 and Clause 3 of Article 47 of this Decree.Within no more than 15 working days, the agency must complete on-site inspections, review relevant files and documents, and submit to the competent authority issuing the Exploitation Permit for Minerals to make a decision regarding the exploitation of accompanying minerals so that organizations and individuals can fulfill their other obligations as prescribed.
Chapter IV. MINERAL AREAS AND REGULATIONS ON MINERAL ACTIVITIES
Section 1. MINERAL AREAS
Article 21. Delimitation of Areas with Dispersed and Small-Scale Mineral Resources
1. An area containing mineral resources (excluding ordinary construction materials, mud coal, harmful minerals, mineral water, and natural hot water) shall be delimited as an area with dispersed and small-scale mineral resources if it meets all of the following criteria:
a) It does not fall within areas prohibited from mineral activities, temporarily prohibited from mineral activities, or national mineral reserve areas;
b) The discovered mineral resources are independently distributed with small reserves or estimated resources; remaining minerals in areas where mines have been officially closed according to Clause 2 of Article 73 of the Law on Minerals or areas that have exceeded their exploitation period before the Law on Minerals took effect, with remaining small-scale reserves or estimated resources as defined in the Appendix attached to this Decree.
2. Based on the provisions of Clause 1 of this Article, the Ministry of Natural Resources and Environment is responsible for delimiting and announcing areas with dispersed and small-scale mineral resources.
3. Based on local realities and in compliance with the criteria set forth in Clause 1 of this Article, the People's Committee of the province may propose to the Ministry of Natural Resources and Environment to delimit and announce areas with dispersed and small-scale mineral resources. The Ministry of Natural Resources and Environment decides on the evaluation of mineral resources in areas that have been surveyed and evaluated but lack data on estimated resources.
Article 22. Designation of Areas Not Subject to Auction for Mineral Exploitation Rights
1. The area containing minerals designated as an area not subject to auction for mineral exploitation rights as stipulated in Clause 1, Article 78 of the Minerals Law shall meet one of the following criteria:
a) Area containing minerals: Coal, uranium, thorium;
b) Area of limestone, clay used as raw materials for cement production or minerals serving as additives for cement that have been identified as sources of raw materials for cement plant projects; areas with minerals that have been identified as sources of raw materials for deep processing mineral projects included in the approved mineral planning by the Prime Minister; areas with mineral water, natural hot water associated with investment projects using mineral water which have been granted investment certificates or investment approval decisions by competent authorities;
c) Areas within the national border zone, strategic areas concerning national defense and security;
d) Areas with construction projects as prescribed in Clause 2, Article 64 and Point b, Clause 1, Article 65 of the Minerals Law;
đ) Areas with common building material minerals planned for exploitation to provide raw materials for public works funded by state budget (infrastructure development; irrigation and hydropower projects); disaster relief and enemy prevention projects; areas with minerals used as fill materials for infrastructure transportation projects and welfare projects under the new rural construction program;
e) Areas where mineral exploration and exploitation activities are restricted according to Point a, Clause 2, Article 26 of the Minerals Law;
g) Areas where mineral exploration and exploitation activities have been granted mineral exploration permits and mineral exploitation permits by competent state management agencies.
2. Based on the provisions of Clause 1 of this Article and the authority to issue mineral activity permits as stipulated in Article 82 of the Minerals Law, the Ministry of Natural Resources and Environment, provincial Departments of Natural Resources and Environment, and centrally-administered city Departments of Natural Resources and Environment shall designate areas not subject to auction for mineral exploitation rights and submit them for approval by the competent authority as prescribed in Clause 3 and Clause 4, Article 78 of the Minerals Law. The Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Industry and Trade or the Ministry of Construction to determine certain areas with resource assessment results from areas surveyed and assessed with funds from organizations and individuals, and other cases to be submitted to the Prime Minister for decision.
3. Within seven days from the date the competent authority approves the areas not subject to auction for mineral exploitation rights, the Ministry of Natural Resources and Environment and the provincial People's Committees shall publicly announce the list of such areas on their respective websites.
Article 23. Soliciting Opinions on the Results of Designating Prohibited Mining Activity Areas and Temporary Prohibited Mining Activity Areas
1. Before submitting to the Prime Minister for approval of the results of designating prohibited mining activity areas and temporary prohibited mining activity areas within their jurisdiction, the provincial People's Committees and centrally-administered city People's Committees shall send documents to solicit opinions from the following Ministries: Ministry of Natural Resources and Environment, Ministry of Construction, Ministry of Industry and Trade, Ministry of National Defense, Ministry of Public Security, Ministry of Agriculture and Rural Development, Ministry of Transport, Ministry of Planning and Investment, Ministry of Culture, Sports and Tourism, Ministry of Information and Communications.
2. The documents for soliciting opinions as prescribed in Clause 1 of this Article include:
a) Letters from the provincial People's Committees and centrally-administered city People's Committees;
b) A detailed explanation including the main contents: Legal basis and documents serving as the foundation for designation; principles and methods of designation; results of designation by sector and a consolidated list of prohibited mining activity areas and temporary prohibited mining activity areas. Each area must have a table of coordinates of corner points according to the VN-2000 coordinate system, except for prohibited and temporarily prohibited mining activity areas due to national defense and security reasons. An attached detailed appendix provides information about each designated prohibited mining activity area and temporarily prohibited mining activity area;
c) Maps showing the prohibited mining activity areas and temporarily prohibited mining activity areas on a topographic base map according to the VN-2000 coordinate system at scales ranging from 1/200,000 to 1/100,000, including protective and safety zones for the designated areas (if applicable). For complex areas, they should be shown on detailed maps at scales ranging from 1/25,000 to 1/10,000 or larger.
3. Within thirty working days from the date of receipt of the documents for soliciting opinions on the results of designating prohibited mining activity areas and temporarily prohibited mining activity areas, the agencies solicited for opinions must respond in writing regarding the content within their administrative management authority. After the aforementioned period, if the solicited agency does not provide a written response, it will be deemed to have agreed.
Article 24. Approval Procedures for Prohibited Mining Areas and Temporary Prohibited Mining Areas
1. After completing according to the comments of the ministries as stipulated in Clause 1, Article 23 of this Decree, |||the People's Committee of the province or city shall submit the dossier to the Prime Minister for approval of prohibited mining areas and temporary prohibited mining areas to the Vietnam Geological and Mineral Resources General Department.
2. The dossier for requesting approval of prohibited mining areas and temporary prohibited mining areas includes:
a) A proposal to the Prime Minister from the People's Committee of the province or city;
b) A summary table of comments received and explanations provided by the ministries;
c) An explanatory report and accompanying drawings as prescribed in Point b and Point c, Clause 2, Article 23 of this Decree. points b and c, Clause 2, Article 23 of this Decree.
3. Within no more than 20 working days from the date of receipt of the dossier as stipulated in Clause 2 of this Article, the Vietnam Geological and Mineral Resources General Department shall complete the examination and review of the documents in the dossier and submit them to the Ministry of Natural Resources and Environment for issuance of a document to be sent to the Prime Minister along with the draft Decision on approval by the Prime Minister.
Section 2. MINERAL PROSPECTING
Article 25. Selection of Organizations and Individuals for Issuance of Prospecting Licenses in Areas Not Subject to Auctions for Mining Rights
The selection of organizations and individuals for issuance of prospecting licenses in areas not subject to auctions for mining rights as stipulated in Clause 1, Article 36 of the Minerals Law shall be carried out as follows:
1. In cases where, after the announcement period as stipulated in Point a, Clause 1, Article 58 of this Decree, only one organization or individual submits a prospecting application, that organization or individual will be selected for issuance of a prospecting license.
2. In cases where, after the announcement period as stipulated in Point a, Clause 1, Article 58 of this Decree, Point a, Clause 1, Article 58 of this Decree,
two or more organizations or individuals submit prospecting applications, the organization or individual selected for issuance of a prospecting license must meet the highest number of priority conditions in the following order:
a) Being an organization or individual who has participated in contributing capital for basic geological surveys about minerals in the area intended for prospecting licensing;
b) Having a minimum registered capital equal to 50% of the total budget of the prospecting project in the proposed prospecting area;
c) Being an organization or individual who has been and is using advanced and modern mining technology and equipment to maximize mineral recovery; complying well with environmental protection responsibilities and financial obligations regarding minerals;
d) Committing to exploit and utilize minerals for domestic production needs in accordance with approved mineral planning after successful prospecting.
3. In cases where all organizations and individuals applying for prospecting licenses meet the same conditions as stipulated in Clause 2 of this Article, the organization or individual submitting the earliest application, as recorded in the receipt slip, will be selected for issuance of a prospecting license.
Article 26. Conditions for a business household to be eligible for prospecting ordinary construction materials minerals
1. A business household as stipulated in Clause 2, Article 34 of the Minerals Law shall be granted a Prospecting Permit for ordinary construction materials minerals when meeting the following conditions:
a) Selected by the People's Committee of the province in accordance with Article 25 of this Decree ; having a contract with an organization that meets the conditions for mineral prospecting practice as prescribed in Clause 1, Article 35 of the Minerals Law to implement the prospecting project;b) Having a prospecting project for ordinary construction materials minerals in accordance with Clause 2 of this Article and consistent with the provincial or centrally-administered city’s prospecting, exploitation, and utilization plan for minerals where the minerals are located;
c) The area of the proposed prospecting zone does not exceed 01 hectare.
2. The technical content of the Prospecting Project for ordinary construction materials minerals must meet the requirements regarding: Reserve grade and prospecting network; prospecting work techniques; quality research work; level of research and block delineation for reserve calculation and reserve calculation work as prescribed by the Ministry of Natural Resources and Environment.
3. The Ministry of Natural Resources and Environment shall prescribe the content of mineral prospecting work for ordinary construction materials; guide the management of river sand and gravel.
Article 27. Transfer of Prospecting Rights for Mineral Resources
1. Conditions for transferring prospecting rights:
a) The organization or individual receiving the transfer must meet the conditions as prescribed in Clause 1, Article 34 of the Minerals Law; if they do not have the conditions for mineral prospecting practice, they must have a contract with an organization that meets the conditions for mineral prospecting practice as prescribed in Clause 1, Article 35 of the Minerals Law to continue implementing the prospecting project;
b) As of the date of transfer, the transferring organization or individual has fulfilled all obligations as prescribed in Points b, c, d, and e, Clause 2, Article 42; Clause 3, Article 43 of the Minerals Law and the provisions in the Prospecting Permit;
c) At the time of transfer, there is no dispute over rights and obligations related to the prospecting activity;
d) The organization or individual proposing the transfer has submitted the complete transfer application documents to the receiving authority when the Prospecting Permit remains valid for at least 90 days.
2. The content of the transfer of prospecting rights is reflected in a contract between the transferring party and the receiving party. The content of the transfer contract must clearly state the quantity and volume of items of work, exploration costs already carried out up to the date of transfer; the value of the transfer and the responsibilities of each party when performing tasks and fulfilling obligations after the transfer.
3. The maximum processing time for the transfer application documents is 45 days from the date the receiving authority issues the receipt of the documents.
In case the transfer request is not approved by the competent authority issuing the permit, the transferring organization or individual may continue to implement the Prospecting Permit or return the Prospecting Permit.
4. The transferring and receiving organizations or individuals of prospecting rights must fulfill financial obligations in cases of income generation as prescribed by law.
4. Organizations and individuals transferring and receiving the transfer of mineral exploration rights must fulfill financial obligations in cases where income arises according to the provisions of the law.
Article 28. Exploration to Upgrade Reserves within Mining Areas
1. Organizations and individuals permitted to extract minerals may conduct exploration to upgrade mineral reserves from a lower confidence level to a higher confidence level within the permitted mining area; if upgrading from resource level to reserve level, they are not required to submit an application for a Mineral Exploration Permit.
2. Prior to conducting exploration to upgrade reserves as stipulated in Clause 1 of this Article, organizations and individuals must send a notification letter to the competent authority issuing the relevant mining permit, along with the following documents:
a) An exploration upgrade plan specifying the purpose, volume, method, time frame, and progress of the exploration;
b) A map indicating the location of the construction works for exploration upgrade and a statistical report on the volume involved.
3. Within no more than twenty working days from the date of receipt of the notification letter and the documents specified in Clause 2 of this Article, the competent authority issuing the mining permit must provide a written opinion on the exploration upgrade. If there is no response from the competent authority within the aforementioned period, the organization or individual permitted to extract minerals may proceed with the exploration upgrade according to the planned exploration upgrade program.
4. In cases where organizations and individuals permitted to extract minerals do not meet the conditions for practicing geological exploration, they must contract with organizations and individuals meeting the conditions prescribed in Clause 1 of Article 35 of the Minerals Law and government regulations to carry out the exploration upgrade work.
5. Upon completion of the exploration upgrade, organizations and individuals permitted to extract minerals must submit the exploration results to the state agency authorized under Clause 1 of Article 49 of the Minerals Law for approval.
Article 29. Extension of Mineral Exploration Permits
1. Organizations and individuals requesting an extension of a Mineral Exploration Permit will be considered for extension when they satisfy the following conditions:
a) They have submitted all necessary documents for the extension of the Mineral Exploration Permit to the receiving agency at least forty-five days before the expiration of the current permit, providing clear reasons for the extension request;
b) At the time of requesting the extension, they have not completed all project components as outlined in the approved Mineral Exploration Plan and Permit, or there has been a change in geological structure or exploration methods compared to the approved exploration plan;
c) By the time of requesting the extension, the organization or individual holding the exploration permit has fulfilled their obligations as stipulated in Points b, c, d, đ, and e of Clause 2 of Article 42 of the Minerals Law.
2. In cases where the Mineral Exploration Permit has expired but the extension application is still being reviewed by the competent state agency, the organization or individual conducting the exploration must temporarily halt operations while ensuring management, protection of assets and exploration works, and preservation of unextracted minerals until the extension is granted or a decision denying the extension is received.
Article 30. Supervision of Construction Projects for Mineral Exploration Plans
1. The basis for supervising construction projects for mineral exploration plans includes:
a) The Mineral Exploration Permit; the approved Mineral Exploration Plan by the competent authority issuing the exploration permit;
b) Technical standards, norms, and economic-technical quotas in the field of geology and minerals.
2. Principles of supervision of construction projects for mineral exploration plans include:
a) Ensuring the scope and content of supervision;
b) Not hindering the activities of organizations and individuals conducting mineral exploration;
c) Information serving supervision must be complete, timely, accurate, truthful, and transparent;
d) Supervision results and evaluations must be processed and stored comprehensively.
3. Supervision of construction projects for mineral exploration can be carried out directly or indirectly, focusing on the following main aspects:
a) The capacity, workforce, and equipment of the construction unit;
b) The sequence and progress of construction of project components based on the approved Mineral Exploration Plan;
c) Procedures and volumes of construction work based on current technical standards, norms, and quotas.
4. The construction tasks subject to supervision during the execution of the exploration plan include:
a) Field surveying and construction procedures;
b) Construction works such as pits, trenches, wells, tunnels, drilling;
c) Sampling procedures; sampling within construction works; sample processing (for samples processed on-site);
d) Other construction tasks approved in the plan that are not subject to direct supervision.
5. The supervision costs for construction projects for mineral exploration are determined in the budget of the mineral exploration plan. The supervision cost rate is 20% of the total cost, calculated based on the direct cost budgets of each construction component.
6. The Ministry of Natural Resources and Environment shall specify the detailed contents of the supervision work for construction projects for mineral exploration plans.
Article 31. Changing Exploration Methods and Exploration Volumes
1. In cases where there is a change in exploration methods or an increase or decrease in exploration volumes with costs exceeding 10% of the approved exploration project budget, the organization or individual permitted to explore minerals must submit a report explaining the reasons for the change to the Department of Natural Resources and Environment where the mineral exploration activities take place if the Mineral Exploration Permit is within the authority of the provincial People's Committee; to the Vietnam Geological and Mineral Resource General Department if the Mineral Exploration Permit is within the authority of the Ministry of Natural Resources and Environment.
2. Within a period not exceeding twenty working days from the date of receipt of the report from the organization or individual specified in Clause 1 of this Article, the Department of Natural Resources and Environment, or the Vietnam Geological and Mineral Resource General Department, according to their respective authorities, shall be responsible for reviewing relevant files and documents, including on-site inspections, and submitting to the competent state agency a document approving the change in exploration methods or exploration volumes. If no response is received within the aforementioned period, it shall be deemed as approval.
Article 32. On-Site Surveying and Surface Sampling for Selection of Areas to Develop Mineral Exploration Projects3
1. Organizations or individuals wishing to conduct on-site surveys and surface sampling for selection of areas to develop mineral exploration projects must submit a document according to the model attached as Appendix III to this Decree and a survey plan and sampling plan to the provincial People's Committee where the mineral exploration is expected to take place, either directly, through postal service, or via online public services to the One-stop Service Center (or the Registration and Result Delivery Section of the Department of Natural Resources and Environment).
2. Surface samples include heavy sand, metal quantity, petrographic, mineralogical, and trench samples taken from outcrops, including trench samples from outcrops and previous exploration works (if any). The number of each type of sample shall not exceed fifty samples; the weight of one trench sample shall not exceed fifteen kilograms (for stone veneer samples, the volume shall not exceed 0.4 cubic meters).33. Within a period not exceeding ten working days from the date of receipt of the request document from the organization or individual mentioned in Clause 1 of this Article, the provincial People's Committee must issue a notification of approval or disapproval of the request through direct result delivery, postal service, or online public services. In case of disapproval, a reply document with detailed reasons must be issued.
Section 3. MINERAL RESERVE APPRAISAL AND APPROVAL
Article 33. Organization, Functions, Tasks, and Activities of the National Mineral Reserve Evaluation Council
1. The National Mineral Reserve Evaluation Council stipulated at point a, Clause 1, Article 49 of the Law on Minerals shall be established by the Prime Minister. The Council shall have a Chairman who is the Minister of Natural Resources and Environment; one Vice-Chairman who is a Deputy Minister of Natural Resources and Environment; members representing the Ministries of Industry and Trade, Construction, Planning and Investment, Science and Technology, and other members proposed by the Minister of Natural Resources and Environment.
The Secretariat of the National Mineral Reserve Evaluation Council shall be located at the Ministry of Natural Resources and Environment. The functions, tasks, powers, and organizational structure of the Secretariat of the National Mineral Reserve Evaluation Council shall be regulated by the Chairman of the Council.
2. The National Mineral Reserve Evaluation Council shall be tasked with appraising, approving, or recognizing mineral reserves and resources in exploration results reports and upgraded reserve exploration results; confirming mineral reserves that are allowed to be included in mining design; developing and submitting to the competent authority for issuance regulations on reserve classification; and compiling statistics on approved reserves within its jurisdiction.
3. The National Mineral Reserve Evaluation Council shall operate through meetings convened by the Chairman of the National Mineral Reserve Evaluation Council. Members of the National Mineral Reserve Evaluation Council shall work on a part-time basis and in accordance with the Council's operational regulations promulgated by the Chairman of the Council.

Article 34. Examination and Approval of Mineral Reserves within the Authority to Issue Licenses by Provincial People's Committees
1. Provincial People's Committees shall be responsible for:
a) Examine, approve, and recognize mineral reserves and resources in exploration result reports within their authority;
b) Confirm the mineral reserves permitted to be included in exploitation design plans within the licensing authority.
2. The Department of Natural Resources and Environment shall take the lead and coordinate with relevant state management agencies to examine exploration result reports, submit to the provincial people's committee for approval and recognition of mineral reserves in exploration result reports; confirm the mineral reserves permitted to be included in exploitation design plans as stipulated in Clause 1 of this Article.
3. In cases where necessary, the provincial people's committee may decide to establish a technical advisory board consisting of representatives from relevant state management agencies and experts with specialized knowledge in mineral exploration to examine exploration result reports before submitting for approval of mineral reserves within the licensing authority.
Article 35. Contents of Examination of Exploration Result Reports and Approval of Mineral Reserves in Exploration Reports
The contents of examination of exploration result reports and approval of mineral reserves in exploration result reports by the National Mineral Reserve Evaluation Council and provincial people's committees shall be carried out according to the following provisions:
1. The contents of examination of exploration result reports include:
a) Legal basis and grounds for preparing the report;
b) Results of implementing exploration works; indicators for calculating reserves or feasibility studies of mining projects; methods of delineation and calculation of mineral reserves;
c) Reliability of reserves, quality, and technological characteristics of minerals;
d) Reliability of geological hydrogeological and engineering geological conditions related to feasibility studies of mining;
đ) Reliability of topographic and geophysical data related to area, coordinates, and results of mineral reserve calculations.
2. Contents of approval of mineral reserves in exploration result reports:
a) Name of mineral; location, area, coordinates of the exploration zone, zone approved or recognized for mineral reserves;
b) Reserves and resources of main minerals, associated minerals and useful components (if any); confirmation of mineral reserves permitted to be mobilized for exploitation design;
c) Scope of use of the exploration result report.
3. The Ministry of Natural Resources and Environment shall guide the format of the Exploration Result Report; the format of the decision on approval and recognition of mineral reserves in exploration result reports.
The Ministry of Finance shall guide the level of fees, collection, payment, management, and use of fees for examining and evaluating mineral reserves.
Section 4. MINERAL EXPLOITATION
Article 36. Conditions for Households Engaged in Mining Ordinary Construction Materials and Mining by Utilization
1. Households specified in Clause 2 of Article 51 of the Law on Minerals shall be granted a Mining License for ordinary construction materials and a Mining License for utilization when meeting the following conditions:
a) Having an economic and technical report on mining in areas that have been explored and approved reserves consistent with the provincial mineral exploration, exploitation, and utilization plan. The economic and technical report on mining must include a plan for using specialized human resources, equipment, technology, and mining methods;
b) Having an environmental protection plan accompanied by a document approving it from the competent authority in accordance with the law on environmental protection;
c) The scale of mining capacity does not exceed 3,000 m3 cubic meters of raw mineral products/year.
2. The Ministry of Industry and Trade shall guide the contents of the Economic and Technical Report on mining ordinary construction materials and mining by utilization for households.
Article 37. Transfer of Mineral Exploitation Rights
1. Conditions for transferring mineral exploitation rights:
a) The organization or individual receiving the transfer must meet the conditions stipulated in Clause 1 of Article 51 and Point c of Clause 2 of Article 53 of the Law on Minerals.
b) As of the transfer date, the organization or individual permitted to exploit minerals has completed the tasks specified in Clause 1 of Article 66 and the obligations stipulated at Points a, b, c, d, e, and g of Clause 2 of Article 55 of the Law on Minerals.
c) At the time of transfer, there is no dispute regarding the rights and obligations related to mineral exploitation activities.
d) The organization or individual proposing the transfer has submitted all required documents to the agency receiving applications at least 90 days before the expiration of the Mineral Exploitation Permit.
2. Contents of the transfer of mineral exploitation rights shall be reflected in a contract between the transferring party and the receiving party, including the following main contents:
a) The current quantity, volume, value of exploitation works and technical infrastructure already invested and constructed; the transfer value; the financial obligation fulfillment status of the transferring organization or individual up to the signing date of the transfer contract.
b) The responsibility of the organization or individual receiving the transfer to continue performing unfinished tasks and obligations of the transferring organization or individual up to the transfer date.
c) Other relevant rights and obligations of the transferring organization or individual and the receiving organization or individual as prescribed.
3. The maximum processing time for the transfer application of mineral exploitation rights is 45 days from the date the agency receiving applications issues the receipt.
In case the transfer proposal is not approved by the competent authority issuing the permit, the transferring organization or individual may continue to implement the Mineral Exploitation Permit or return the Mineral Exploitation Permit.
4. Organizations or individuals transferring and receiving mineral exploitation rights must fulfill their financial obligations if income arises according to the law.
Article 38. Validity Period of the Mineral Exploitation Permit
1. The validity period of the Mineral Exploitation Permit is the mining time determined in the Mineral Exploitation Investment Project as stipulated in Clause 2 of this Article but shall not exceed the period prescribed in Clause 2 of Article 54 of the Law on Minerals.
2. The mining time in the mineral exploitation investment project includes: basic construction time of the mine, including the expected time for compensation procedures, land clearance, and land lease for mining; mining time according to designed capacity; mining dredging time.
Article 39. Extension of the Mineral Exploitation Permit and the Mineral Exploitation Recovery Permit
1. Organizations or individuals exploiting minerals can extend the Mineral Exploitation Permit and the Mineral Exploitation Recovery Permit when meeting the following conditions:
a) They have submitted all required documents for extending the Mineral Exploitation Permit and the Mineral Exploitation Recovery Permit to the agency receiving applications when the Mineral Exploitation Permit is still valid for at least 45 days and the Mineral Exploitation Recovery Permit is still valid for at least 15 days; clearly explaining the reasons for requesting extension.
b) They have reported the results of mineral exploitation activities from the issuance of the exploitation permit to the date of requesting extension, proving that the remaining mineral reserves in the exploitation area have not been fully exploited according to the Mineral Exploitation Permit.
c) Up to the date of requesting extension, the organization or individual granted the exploitation permit has fulfilled all obligations stipulated in Points a, c, d, đ, e, and g of Clause 2 of Article 55 of the Law on Minerals for the Mineral Exploitation Permit; Points c, d, đ, e, and g of Clause 2 of Article 55, and Point a of Clause 2 of Article 69 of the Law on Minerals for the Mineral Exploitation Recovery Permit.
d) They have fully performed their obligations in environmental protection, land use, water use, and technical infrastructure in mineral activities according to the laws on minerals and related laws.
đ) At the time of requesting extension, the next mineral exploitation plan must comply with the approved mineral planning as stipulated in Point c or Point d of Clause 1 of Article 10 of the Law on Minerals.
2. Extending the Mineral Exploitation Permit and the Mineral Exploitation Recovery Permit means continuing the exploitation rights of organizations or individuals based on the remaining allowable mineral reserves at the extension date without changing the allowable exploitation capacity.
If they wish to increase the exploitation capacity, organizations or individuals exploiting minerals must establish an investment project for renovation or expansion; prepare and approve an Environmental Impact Assessment Report or an Environmental Protection Plan, a rehabilitation and recovery plan according to regulations. When extending the Mineral Exploitation Permit, the exploitation area may be adjusted to match the remaining mineral reserves, but it cannot exceed the scope of the previously authorized exploitation area.
3. In case the Mineral Exploitation Permit or the Mineral Exploitation Recovery Permit has expired but the extension application is still under review by the competent state agency, the mineral exploitation organization or individual must temporarily suspend exploitation and bear the responsibility for managing, protecting assets, exploitation facilities, safety facilities, the environment, and unexploited minerals until the extension is granted or a reply is received denying the extension.
Article 40. Permitted Mineral Reserves for Mining Design
1. The mineral reserves in the mining investment project permitted to be included in the mining design as stipulated in Article 52 of the Law on Minerals shall include the entire or part of the mineral reserves approved by the competent state agency, not located in areas prohibited or temporarily prohibited from mineral activities, and consistent with the approved related mineral planning.
2. In cases where the entire approved mineral reserves or those already licensed cannot be fully mobilized due to consumption needs, mining duration, or social factors, the mobilized reserves for the mining design must not be less than 50% of the total approved mineral reserves for solid minerals; not less than 35% of the total flow rate approved by the competent state agency for mineral water and natural hot water, and confirmed by the competent authority regarding the mineral reserves specified in Article 49 of the Law on Minerals.
Article 41. Books, Documents, and Materials to Determine Actual Mineral Production
1. Depending on different types or groups of minerals, the actual mineral production is determined based on one of the types of books, documents, or technical or financial materials as prescribed in Clause 2 and Clause 3 of this Article.
2. Technical books, documents, and materials serving as the basis to determine actual mineral production include:
a) Records tracking and statistics of raw mineral volumes and waste rock volumes (if any), blasting passports, industrial explosives storage release forms;
b) Acceptance records of each technological process volume, including: Rock preparation, excavation, transportation, waste disposal;
c) Current status maps, cross-sections of the current status of the mineral extraction area;
d) Results of measurements and calculations of mineral losses and dilution.
3. Financial books, documents, and materials serving as the basis to determine actual mineral production include:
a) Purchase invoices/raw material storage release forms for the supply of raw materials and fuels to the technological processes mentioned in point b of Clause 2 of this Article;
b) Sales invoices/mineral raw material storage release forms transported out of the mineral extraction area;
c) Contracts for the sale of raw minerals or minerals that have been crushed, screened, or washed; acceptance records of quantities; contracts terminating mineral sales.
Article 42. Determination of Actual Mineral Production
1. The determination of actual mineral production is based on information and data from the books, documents, and materials prescribed in Clause 2 and Clause 3 of Article 41 of this Decree which is the sum of the following volumes:
a) Raw minerals consumed or processed through crushing, screening, or other enrichment activities;
b) Raw minerals stored in warehouses but not yet consumed or transported out of the extraction area.
2. Organizations and individuals engaged in mineral extraction, except for individual households, must install weighing stations at the points where raw minerals are removed from the extraction area; install surveillance cameras in storage warehouses to record relevant information and data.
3. On a monthly basis, organizations and individuals engaged in mineral extraction must compile, calculate, and update data in the books and materials prescribed in Article 41 of this Decree is to declare the taxable production volume of mineral resources and determine the annual production volume for periodic mineral resource exploitation reports to be submitted to tax authorities in accordance with the law on taxation.
4. The Ministry of Natural Resources and Environment shall guide the procedures, methods for determining, and statistical forms for actual mineral production volumes.
Article 43. Responsibilities for managing, storing, and using data on mineral production volumes
1. Organizations and individuals exploiting minerals must retain certificates, documents as prescribed from Article 41 of this Decree when commencing basic mine construction until the end of mining operations and closure of the mine, and they must bear legal responsibility before the state management agency regarding the accuracy of information and data.
In cases where organizations and individuals exploiting minerals do not establish ledgers, certificates, documents or establish them but incompletely; establish but not retain them fully or data and information are inaccurate leading to loss of state budget funds, they will be handled according to the law.
2. Ledgers, certificates, documents to determine actual mineral production volumes must be retained one set at the mining site and one set (a copy) at the headquarters of the organization or individual exploiting minerals.
3. The retention period for ledgers, certificates, documents as prescribed in Clause 2 and Clause 3 of Article 41 of this Decree shall be implemented in accordance with the law on record keeping. For ledgers, certificates used to determine annual mineral production volumes; information and data in digital form must be stored until the end of mining operations and closure of the mineral mine.
4. When the competent state authority or inspection teams established by the competent authority request, organizations and individuals exploiting minerals have the responsibility to provide complete ledgers, certificates, documents as prescribed in Clause 2 and Clause 3 of Article 41 of this Decree. In case of incomplete provision or false declaration, organizations and individuals exploiting minerals will be handled according to the law.
Section 5. ADJUSTMENT OF ENVIRONMENTAL REHABILITATION AND RESTORATION PLANS; MINERAL MINE CLOSURE
Article 44. Adjustment of environmental rehabilitation and restoration plans
1. Adjustments and supplements to the volume, budget estimate, and total deposit amount for environmental rehabilitation and restoration in approved environmental rehabilitation and restoration plans must be carried out in the following cases:
a) After approving the mine design, if there are changes in the volume of mining works or new items arise leading to the budget estimates for environmental rehabilitation and restoration works exceeding 15% of the total budget estimate in the approved environmental rehabilitation and restoration plan;
b) During implementation, if there are increases in the actual volume of works leading to an excess of 10% over the budget estimate for each item in the approved environmental rehabilitation and restoration plan.
2. Before carrying out environmental rehabilitation and restoration work on areas that have been completely mined, organizations and individuals exploiting minerals must submit a notification letter to the file receiving agency as prescribed in Clause 1, Clause 3 of Article 47 of this Decree.. Within no more than 15 working days, the file receiving agency must complete on-site inspections, review related files and documents and report to the competent state authority issuing the mineral exploitation permit to issue a notification letter to the organization or individual exploiting minerals.
If wishing to close the mine to return the area that has been completely mined, organizations and individuals exploiting minerals must prepare a mine closure project, submit it to the competent state authority issuing the mineral exploitation permit for approval to implement, while reporting to the competent authority to adjust the environmental rehabilitation and restoration plan.
Article 45. Review of Mine Closure Plans for Mineral Deposits
1. The Ministry of Natural Resources and Environment and the People's Committee of the province shall organize the review of mine closure plans before deciding to close the mine, in accordance with the authority stipulated in Clause 1 and Clause 2 of Article 82 of the Law on Minerals.
2. The review of mine closure plans shall be conducted through a Mine Closure Plan Review Board established by the Minister of Natural Resources and Environment or the People's Committee of the province where the mineral deposit is located, in accordance with their respective authorities. The operational regulations of the Mine Closure Plan Review Board shall be prescribed by the Ministry of Natural Resources and Environment.
The time limit for reviewing the mine closure plan shall not exceed sixty days from the date of receipt of complete and valid documents.
3. The contents of the review of the mine closure plan include:
a) Reasons for closing the mine;
b) Current status, quantity, volume, and safety level of mine structures and auxiliary facilities serving mining operations; environmental protection works and environmental restoration works already implemented, including waste dumps at the time of mine closure;
c) Actual volume of minerals extracted, remaining reserves within the permitted mining area compared to the permitted reserves stated in the Mining Permit at the time of mine closure;
d) Volume of work and methods for closing the mine, measures to protect unextracted minerals; solutions to ensure safety for the mining site and auxiliary facilities after mine closure; volume of environmental restoration works; time required for stability and safety of waste dumps; measures to restore land and environment during the implementation of the Mine Closure Plan and directions for land use after mine closure;
e) Volume, progress of implementing tasks under the plan, and completion time for each component of the mine closure plan.
44. (Repealed)
Article 46. Implementation and Acceptance of Mine Closure Plans
1. When the Mining Permit ceases to be effective or when the Mining Permit is returned or part of the mining area is returned, the organization or individual exploiting minerals must prepare a Mine Closure Plan to submit to the competent state agency for approval and implement it.
2. In cases where the organization or individual exploiting minerals is dissolved or declared bankrupt, the competent state management agency issuing the permit shall select a unit with sufficient capacity to prepare and implement the mine closure plan through a bidding process. If it is not possible to select through a bidding process, the competent agency issuing the permit shall designate the unit to carry out the task.
In cases where the approved mine closure plan has been mobilized with the maximum available capital, equipment, and technology but cannot be implemented or fully completed, the approving agency shall select a unit according to the aforementioned method to carry out the task.
3. The funds for preparing and implementing the mine closure plan as stipulated in Clause 2 of this Article shall be sourced from the advance deposit for environmental rehabilitation of the organization or individual permitted to exploit minerals up to the time of preparing the Mine Closure Plan. If there is insufficient funding to implement according to the budget estimate, the People's Committee of the province where the minerals are exploited shall supplement the budget expenditure proposal for approval by the same-level People's Council.
4. The results of implementing the Mine Closure Plan must be accepted by the agency receiving the application as stipulated in Clause 1 and Clause 3 of Article 47 of this Decree. before submitting to the competent agency issuing the permit to issue a decision to close the mine in accordance with the regulations of the Ministry of Natural Resources and Environment.
The verification and confirmation of the full refund of the advance deposit for environmental rehabilitation during mineral exploitation shall be carried out simultaneously with the acceptance of the results of implementing the Mine Closure Plan for mineral deposits.
Chapter V. PROCEDURES FOR GRANTING MINERAL ACTIVITY PERMITS, APPROVING MINERAL RESERVES, AND CLOSING MINERAL DEPOSITS
Section 1. AUTHORITIES RECEIVING APPLICATIONS, FORMS OF RECEIVING AND RETURNING RESULTS
Article 47. Authorities Receiving Applications for Mineral Exploration Licenses, Reserves Approval Applications, and Mine Closure Applications5
The authorities receiving applications for mineral exploration licenses, reserves approval applications, and mine closure applications shall be as follows:
1. The Office of Application Reception and Result Delivery of the Ministry of Natural Resources and Environment shall be responsible for receiving and delivering results of administrative procedures within the licensing authority of the Ministry of Natural Resources and Environment.
2. The Provincial Public Service Center (or the Application Reception and Result Delivery Unit of the Department of Natural Resources and Environment) shall be the authority receiving applications for mineral exploration licenses; applications registering areas and volumes of ordinary construction material mining within project construction areas, including applications registering volumes of sand and gravel recovered from dredging and channel clearance projects; applications approving, recognizing, and confirming reserves in mineral exploration reports; applications for mine closure within the licensing authority of the provincial People's Committee.
Article 48. Forms of Receiving and Returning Results of Applications for Mineral Exploration Licenses, Reserves Approval Applications, and Mine Closure Applications
1. Applications for mineral exploration licenses and mine closure applications shall be submitted directly or sent via postal service to the authorities receiving applications as stipulated in Clause 1 and Clause 3 of Article 47 of this Decree. or carried out through online public services.
Applications for reserves approval shall be submitted directly to the authorities receiving applications as stipulated in Clause 2 and Clause 3 of Article 47 of this Decree..
2. The processing time for applications as stipulated in Clause 2 of Article 48; Clause 2 of Article 50; Clause 2 of Article 60 and Clause 2 of Article 71 of the Minerals Law shall be calculated from the date the receiving authority issues the application receipt.
36The delivery of the results of application processing shall be carried out as follows:
a) For applications for mineral exploration licenses, including applications registering areas and volumes of ordinary construction material mining within project construction areas, and applications registering volumes of sand recovered from dredging and channel clearance projects, these shall be processed directly at the receiving authority or sent via postal service or through the online public service system according to the request of organizations or individuals;
b) For applications approving, recognizing, and confirming reserves in mineral exploration reports; and mine closure applications, these shall be processed directly at the receiving authority or sent via postal service or through the online public service system according to the request of organizations or individuals.
Section 2. FORMS OF DOCUMENTS IN APPLICATIONS
Article 49. Applications for Issuance, Extension, Return of Licenses, Return of Part of Exploration Area, and Transfer of Exploration Rights
1. Documents in applications for mineral exploration licenses as stipulated in Clause 1 of Article 47 of the Minerals Law shall be prepared in one set, in the following form:
a) Original: Application for Mineral Exploration License; map of the exploration area; exploration plan;
b)7 Certified copy or copy with original for comparison or certified electronic copy from the original of the Decision on Establishment of Representative Office or Branch in Vietnam in case of foreign enterprises; documents proving capital ownership as prescribed at Article 9 of this Decree.
In the case of requesting to explore radioactive ores, the dossier shall also include a safety assessment document issued by the Radiation and Nuclear Safety Center under the Ministry of Science and Technology.
2. The documents in the application dossier for extending the Mineral Exploration Permit as stipulated in Clause 2, Article 47 of the Law on Minerals shall be established in one set, in the following form:
a) Original: Application for extension of the Mineral Exploration Permit; report on the results of mineral exploration activities carried out up to the time of application for extension and the subsequent exploration plan; map of the exploration area (after returning 30% of the previous exploration area).
b)8 Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Documents implementing obligations related to exploration activities up to the time of applying for extension of the Mineral Exploration Permit.
3. The documents in the application dossier for returning the Mineral Exploration Permit or returning part of the exploration area as stipulated in Clause 3, Article 47 of the Law on Minerals shall be established in one set, in the following form:
a) Original: Application for returning the Mineral Exploration Permit or returning part of the exploration area; Mineral Exploration Permit; report on the results of mineral exploration activities carried out up to the time of application for return; map of the exploration area, subsequent exploration plan in the case of returning part of the exploration area.
b)9 Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Documents implementing obligations related to exploration activities up to the time of applying for return.
4. The documents in the application dossier for transferring the right to explore minerals as stipulated in Clause 4, Article 47 of the Law on Minerals shall be established in one set, in the following form:
a) Original: Application for transferring the right to explore minerals; contract for transferring the right to explore minerals; report on the results of mineral exploration activities up to the time of application for transferring the right to explore minerals.
b)10Certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Business Registration Certificate or Enterprise Registration Certificate of the organization or individual receiving the transfer of the right to explore minerals; documents proving that the transferring organization or individual has fulfilled the obligations prescribed in Points b, c, d, and e of Clause 2, Article 42; Clause 3, Article 43 of the Law on Minerals.
Article 50. Dossier for requesting approval of mineral reserves
The documents in the dossier for requesting approval of mineral reserves as stipulated in Clause 1, Article 50 of the Law on Minerals shall be established in one set, in the following form:

Original: Application for approval of mineral reserves; report on the results of mineral exploration or report on the results of upgrading mineral reserves, appendices, drawings, and related primary documents; explanatory materials on reserve calculation criteria or feasibility study report of the mining project; acceptance record of quantity and quality of mineral exploration works carried out by organizations or individuals; report on monitoring construction of the mineral exploration program.

3. Data of the documents specified in Clause 1 of this Article shall be recorded on one CD set.
Article 51. Documents for Issuing, Extending, Returning Mining Exploitation Licenses, Returning Part of the Mining Area, and Transferring Mining Exploitation Rights
1. The documents in the application file for issuing mining exploitation licenses as stipulated in Clause 1, Article 59 of the Minerals Law shall be prepared in one set, in the following form:
a) Original: Application for issuance of a Mining Exploitation License; map of the mining area; investment project for mining exploitation accompanied by the approval decision;
b)12 Certified copy or copy with original for comparison or certified electronic copy from the original of the documents proving the capital ownership as prescribed in Article 9 of this Decree.
In case of applying for radioactive ore exploitation, the file shall also include a safety assessment document issued by the Radiation and Nuclear Safety Agency under the Ministry of Science and Technology.
2. The documents in the application file for extending a Mining Exploitation License as stipulated in Clause 2, Article 59 of the Minerals Law shall be prepared in one set, in the following form:
a) Original: Application for extension of a Mining Exploitation License; map of the current mining status at the time of application for extension; report on the results of mining activities up to the time of application for extension;
b)13 Original or certified copy or copy with original for comparison or certified electronic copy from the original: Documents proving the fulfillment of obligations as prescribed in Points a, b, c, d, e, and g, Clause 2, Article 55 of the Minerals Law up to the time of application for extension.
3. The documents in the application file for returning a Mining Exploitation License or returning part of the mining area as stipulated in Clause 3, Article 59 of the Minerals Law shall be prepared in one set, in the following form:
a) Original: Application for return of a Mining Exploitation License or return of part of the mining area; map of the current mining status at the time of application for return; Mining Exploitation License; report on the results of mining exploitation up to the time of application for return; mine closure plan or partial mining area closure plan, in case of returning part of the mining area;
b)14 Original or certified copy or copy with original for comparison or certified electronic copy from the original: Documents proving the fulfillment of obligations as prescribed in Points a, b, c, d, e, and g, Clause 2, Article 55 of the Minerals Law up to the time of application for return.
4. The documents in the application file for transferring mining exploitation rights as stipulated in Clause 4, Article 59 of the Minerals Law, including cases where the transfer is made to a subsidiary owned 100% by the entity or individual permitted to exploit, shall be prepared in one set, in the following form:
a) Original: Application for transfer of mining exploitation rights; mining exploitation right transfer contract, accompanied by a statement of the value of transferred assets; map of the current mining status at the time of application for transfer; report on the results of mining exploitation up to the time of application for transfer of mining exploitation rights;
b)15 Original or certified copy or copy with original for comparison or certified electronic copy from the original: Documents proving the fulfillment of obligations as prescribed in Points a, b, c, d, and g, Clause 2, Article 55 of the Minerals Law up to the time of transfer by the transferring entity or individual;
c)16 Certified copy or copy with original for comparison or certified electronic copy from the original of the Investment Registration Certificate or Investment Registration Certificate (in case the transferee is a foreign-invested enterprise).
Article 52. Documents for Issuance, Extension, and Return of Mineral Exploitation Permit
1. The documents in the application for issuance of mineral exploitation permit as stipulated in Clause 1, Article 70 of the Minerals Law shall be compiled into one set in the following form:
a) Original: Application for issuance of Mineral Exploitation Permit; map of the area for mineral exploitation; investment project for mineral exploitation accompanied by the approval decision;
b)17 (Repealed)
2. The documents in the application for extension of Mineral Exploitation Permit as stipulated in Clause 2, Article 70 of the Minerals Law shall be compiled into one set in the following form:
a) Original: Application for extension of Mineral Exploitation Permit; report on the results of mineral exploitation up to the time of requesting extension;
b)18 Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Documents proving the fulfillment of obligations as stipulated in Clause 2, Article 69 of the Minerals Law up to the time of requesting extension.
3. The documents in the application for return of Mineral Exploitation Permit as stipulated in Clause 3, Article 70 of the Minerals Law shall be compiled into one set in the following form:
a) Original: Application for return of Mineral Exploitation Permit; Mineral Exploitation Permit; report on the results of mineral exploitation up to the time of returning the permit; mine closure plan;
b)19 Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Documents proving the fulfillment of obligations as stipulated in Clause 2, Article 69 of the Minerals Law up to the time of requesting return.
Article 53. Documents for Registration of Area, Capacity, Volume, Method, Equipment, and Plan for Exploitation of Common Construction Materials in Project Area
1. The components and forms of documents in the registration of area, capacity, volume, method, equipment, and plan for exploitation of common construction materials within the project area as stipulated in Point a, Clause 2, Article 64 of the Minerals Law include:
a) Original: Registration of area, capacity, volume, method, equipment, and plan for exploitation of common construction materials;
b) Original or certified copy or copy accompanied by the original for comparison: Master plan drawing of the construction project area and the approval decision of the competent state agency; Environmental Impact Assessment Report of the project approved by the competent state agency.
2. In the case of registering the volume of sand recovered from dredging and channel clearance projects, the documents shall include:
a) Original: Application for recovery of sand and gravel, accompanied by drawings showing the location and scope of the dredging and channel clearance project; registration of volume, plan, method, and equipment for sand and gravel recovery;
b) Original or certified copy or copy accompanied by the original for comparison: Plan and schedule for implementation of the dredging and channel clearance project and the approval decision of the competent state agency; Environmental Impact Assessment Report of the project approved by the competent state agency; lease contract for sand storage facilities (if any).
Article 54. Documents for Application to Exploit Minerals in Areas with Construction Projects
The components and forms of documents in the application dossier for obtaining a Mineral Extraction Permit in areas with construction projects as stipulated in Clause 2, Article 65 of the Law on Minerals include:
1. Original: Application for a Mineral Extraction Permit; map of the mineral extraction area indicating the scope and area of the construction project; mineral extraction plan within the project area accompanied by the environmental remediation and restoration plan approved by the competent authority.
2.20Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Decision approving the construction project of the competent authority; overall planning map of the construction project area approved by the competent authority.
Article 55. Documents for Application to Amend a Mineral Extraction Permit
1. Cases for amending the content of a Mineral Extraction Permit:
a) The proven reserves of minerals after exploration increase beyond the level of reliability of the corresponding reserves previously approved by the state agency;
b) When organizations or individuals wish to increase the extraction capacity by more than 15% compared to the capacity recorded in the Mineral Extraction Permit;
c) When there is a change in the name of the organization or individual extracting minerals;
d) When there is a desire to change the mining method, mining technology, and the permitted reserves mobilized into the design already determined in the investment project or mine design.
2.21 The components and forms of documents in the application dossier for amending a Mineral Extraction Permit include:
a) Original: Application for amending the content of a Mineral Extraction Permit; adjusted investment project according to newly approved reserves or adjusted capacity, changed mining methods, and technologies, accompanied by the approval decision; report on the results of mineral extraction and obligations fulfilled up to the time of applying to amend the Mineral Extraction Permit and related approval decisions of the competent authority;
b) Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Explanation report, accompanying drawings, and decision approving the increased reserve exploration results of the state agency; relevant documents and materials concerning changes in name and organizational structure as provided in point c, Clause 1 of this Article.
3. The competent authority issuing the Mineral Extraction Permit is the authority to issue the decision to amend that Mineral Extraction Permit. The decision to amend the content of a Mineral Extraction Permit is a legal document inseparable from the previously issued Mineral Extraction Permit.
Article 56. Documents for Application to Approve a Mine Closure Plan
1. The components of the application dossier for approving a mine closure plan as stipulated in Article 73 of the Law on Minerals include:
a) Application for approval of a mine closure plan;
b) Mine closure plan;
c) Map of the current status of the mine closure area;
d) Documents proving the fulfillment of obligations related to mineral extraction up to the time of mine closure.
2. The documents in the application dossier for approving a mine closure plan as stipulated in Clause 1 of this Article shall be prepared in one set, in the following form:
a) Original: Application for approval of a mine closure plan; mine closure plan; map of the current status of the mineral extraction area at the time of requesting mine closure; report on the implementation of the environmental remediation and restoration plan up to the time of mine closure;
b)22 Original or certified copy or copy accompanied by the original for comparison or electronic copy certified from the original: Environmental remediation and restoration plan, accompanied by the approval decision; documents proving the fulfillment of obligations specified in points a, b, c, d, and g of Clause 2, Article 55 of the Minerals Law up to the time of requesting mine closure.
Article 57. Sample Documents in Mineral Exploration Permit Application Files, Mineral Reserve Approval Files, and Mine Closure Files
1. The documents in the application file for mineral exploration permit; registration of area, capacity, volume, method, equipment, and mining plan for ordinary construction materials within the construction project area; registration of sand and gravel recovery volume during dredging and channel clearance projects; approval files for mineral reserves, mine closure files; samples include: Mineral Exploration Permit, Mineral Extraction Permit, report on mineral exploration results, confirmation of registration for ordinary construction material extraction within the construction project area, confirmation of sand and gravel recovery volume during dredging and channel clearance, decision to approve and recognize mineral reserves; decision to approve the mine closure project and decision to close the mine are established according to a unified model throughout the country.
2. The Ministry of Natural Resources and Environment shall issue sample documents of the types specified in Clause 1 of this Article.
Section 3. PROCEDURE FOR IMPLEMENTATION
Article 58. Procedure for Implementing Mineral Exploration Permit Issuance Procedures
1. The procedure for receiving the application file for a Mineral Exploration Permit in areas not subject to auctioned mineral exploitation rights shall be carried out as follows:
a)23 Within no more than three working days from the date of receipt of the first organization or individual's application for mineral exploration, the agency receiving the file shall publicly announce the name of the organization or individual, the type of mineral, and the proposed exploration area at its office premises and on the website of the competent authority issuing the permit and the national bidding system, and the Bidding Newspaper.
The time for receiving and announcing the application files for mineral exploration from other organizations and individuals is thirty working days, starting from the date of receipt of the first organization or individual's application for mineral exploration.
b) Upon expiration of the period mentioned in point a of this clause, the agency will not accept further applications and will select organizations or individuals to issue the Mineral Exploration Permit in accordance with Clause 2 of Article 25 of this Decree. The selection process for organizations or individuals to obtain the Mineral Exploration Permit is five days, starting from the day the announcement period ends as stipulated in point a of this clause..
c) Upon expiration of the period specified in point b of this clause, if the selection of an application for the exploration permit is successful, the agency will issue a receipt for the application file and publicly announce the name of the selected organization or individual at its office premises and on the website of the competent authority issuing the permit.
For organizations and individuals who are not selected to obtain the Mineral Exploration Permit, the agency receiving the application file has the responsibility to notify them in writing about the reasons for non-selection.
2. The procedure for receiving the application file for mineral exploration from organizations or individuals winning the auction for mineral exploitation rights in unexplored areas shall be carried out as follows:
a) Organizations or individuals winning the auction for mineral exploitation rights submit the application file for mineral exploration to the agency receiving the file.
Within no more than three working days from the date of receipt of the first organization or individual's application for mineral exploration, the agency receiving the file is responsible for checking the documents in the file. If the documents comply with the provisions of Clause 1 of Article 47 of the Mineral Law and
b)24 Clause 1 of Article 49 of this Decree, then the agency will issue a receipt for the application file and publicly announce the name of the organization or individual, the type of mineral, and the proposed exploration area at its office premises and on the website of the competent authority issuing the permit and the National Bidding System, and the Bidding Newspaper. 3. In cases where the application file for mineral exploration does not contain complete documents as required or contains complete documents but their contents do not comply with legal regulations, the agency receiving the file will guide the organization or individual applying for mineral exploration to supplement and complete the file in writing. The guidance and request for supplementation and completion of the file by the agency receiving the file will only be carried out once.
4. Review of the application file for mineral exploration
Within no more than fifty-five days from the date of receipt of the application file receipt, the agency receiving the file is responsible for completing the following tasks:
a) Verify the coordinates and area of the proposed mineral exploration site, including on-site verification;
b) Send documents to relevant agencies regarding the proposed mineral exploration site as provided for in Clause 3 of Article 48 of the Mineral Law.
Within no more than twenty days from the date of receipt of the request for comments from the agency receiving the file, the agency providing comments is responsible for responding in writing to related issues. If there is no response within the above period, it is considered that the agency providing comments has agreed.
Within twenty days from the date of receipt of the document requesting comments, the agency receiving the dossier shall be responsible for replying in writing to the relevant issues. If there is no reply within the aforementioned period, it shall be deemed that the agency has agreed.
c) Organize the appraisal of the mineral exploration project before submitting the application for the Mineral Exploration Permit in accordance with the procedures prescribed at Article 59 of this Decree.
5. The submission of the application dossier for the Mineral Exploration Permit shall be carried out as follows:
a) Within twenty-one days from the date of completion of the tasks specified in Clause 4 of this Article, the agency receiving the dossier shall complete and submit the exploration permit application dossier to the competent state agency for issuance;
b) Within seven days from the date of receipt of the dossier from the agency receiving it, the competent state agency for issuance shall decide on issuing or not issuing the Mineral Exploration Permit. In case of not issuing the Mineral Exploration Permit, a written response with clear reasons must be provided.
6.25 Delivering the results of the Mineral Exploration Permit application dossier
Within three working days from the date of receipt of the Mineral Exploration Permit application dossier from the competent state agency for issuance, the agency receiving the dossier shall notify the organization or individual requesting the Mineral Exploration Permit to receive the result and fulfill related obligations as prescribed.
Article 59. Procedure for reviewing the mineral exploration project proposal
1. The procedure for reviewing the mineral exploration project proposal within the licensing authority of the Ministry of Natural Resources and Environment shall be implemented within the time limit prescribed in Clause 4 of Article 58 of this Decreeas follows:
a) Within thirty-five days from the date of receipt of the dossier acceptance form, the agency receiving the dossier shall send the exploration project proposal to seek opinions from some experts in specialized fields. The time for responding to the experts' opinions shall not exceed ten days from the date of receipt of the request from the agency receiving the dossier;
b) Within five days from the date of receipt of the opinions of the experts, the agency receiving the dossier shall be responsible for compiling the opinions and submitting them together with the exploration project proposal application dossier to the Chairman of the Mineral Exploration Project Review Council specified in Clause 3 of this Article (hereinafter referred to as the Review Council);
c) Within ten days from the date of receipt of the exploration project proposal application dossier together with the opinions of the experts as stipulated in Point b of this Clause, the Chairman of the Review Council shall decide to convene a meeting of the Review Council;
d) Within five days from the end of the meeting, the agency receiving the dossier shall complete the minutes of the Review Council meeting. In cases where supplementation, revision, or redrafting of the project proposal is required, the agency receiving the dossier shall send a notification letter clearly stating the reasons for not approving the project proposal or the contents that need to be supplemented or completed, along with the minutes of the Review Council meeting.
The time taken by organizations or individuals requesting the license to supplement, complete, or redraft the exploration project proposal shall not be counted towards the review period for the exploration project proposal.
2. The procedure for reviewing the mineral exploration project proposal within the licensing authority of the provincial People's Committee shall be implemented within the time limit prescribed in Clause 4 of Article 58 of this Decreeas follows:
a)26 Within thirty-eight working days from the date of receipt of the dossier acceptance form, the agency receiving the dossier shall send the mineral exploration project proposal to seek opinions from some experts in specialized fields and organize the review of the content of the mineral exploration project proposal. The time for responding to the experts' opinions shall not exceed ten working days from the date of receipt of the request from the agency receiving the dossier.
In cases where the content of the mineral exploration project proposal is complex, the agency receiving the dossier shall submit to the provincial People's Committee for the establishment of a Technical Council to review the project proposal. The time for deciding on the establishment and convening of the Technical Council shall be included in the time for organizing the review of the mineral exploration project proposal;
b) Within five days from the date of receipt of the opinions of the experts, the agency receiving the dossier shall be responsible for compiling the opinions and submitting them together with the exploration project proposal application dossier to the provincial People's Committee;
c) Within ten days from the date of receipt of the exploration project proposal application dossier together with the opinions of the experts, the provincial People's Committee shall decide on approving the content of the mineral exploration project proposal for issuance or establishing a Review Council if necessary.
In cases where supplementation or revision of the mineral exploration project proposal is required according to the opinions of the provincial People's Committee or the Review Council, the agency receiving the dossier shall send a notification letter clearly stating the reasons for not approving the project proposal or the contents that need to be supplemented or completed in the mineral exploration project proposal.
The time taken by organizations or individuals requesting the license to supplement, complete, or redraft the exploration project proposal shall not be counted towards the review period for the exploration project proposal.
3. The Ministry of Natural Resources and Environment shall specify the organization and operation of the Mineral Exploration Project Review Council.
Article 60. Procedures for Issuing Mining Exploitation Licenses
1. The submission of documents shall be carried out as follows:
a) Organizations and individuals applying for a Mining Exploitation License shall submit their exploitation application documents to the document receiving agency.
b)27Within no more than three working days, the document receiving agency shall be responsible for checking the documents and materials contained in the file. If the documents and materials in the file comply with the provisions of Clause 1, Article 59 of the Law on Minerals and Clause 1, Article 51 of this Decree, then the document receiving agency shall issue a receipt for the submitted documents. In cases where the mining exploitation application documents are incomplete or contain documents and materials that do not meet the legal requirements, the document receiving agency shall guide the organizations and individuals applying for the license in writing to supplement and complete the documents. The issuance of written guidance and requests for supplementation and completion of the documents by the document receiving agency shall only be done once.
2. Examination of the Mining Exploitation License Application Documents:
a) Within no more than twenty-five days from the date of receipt of the document receipt, the document receiving agency shall be responsible for completing the verification of the coordinates and area of the proposed mining exploitation site and conducting a field inspection;
b) Within no more than six days from the completion of the work specified in point a of this clause, the document receiving agency shall send a document seeking opinions to relevant agencies regarding the issuance of the Mining Exploitation License as stipulated in point c, Clause 2, Article 60 of the Law on Minerals.
Within no more than twenty days from the date of receipt of the opinion-seeking document from the document receiving agency, the agency sought for opinions shall be responsible for replying in writing about related issues. If there is no written reply within the specified period, it shall be deemed that the agency sought for opinions has agreed. The time taken to seek opinions from relevant agencies shall not be included in the examination period;
c)28 Within no more than thirty-eight working days, the document receiving agency must complete the examination of all relevant documents, files, and other matters related to mining exploitation and determine the fee for granting the right to exploit minerals.
3. Submission of the Mining Exploitation License Application Documents:
a) Within no more than five days from the completion of the work specified in Clause 2 of this Article, the document receiving agency shall be responsible for completing and submitting the licensing application documents to the competent state agency for approval;
b) Within no more than seven days from the date of receipt of the documents from the document receiving agency, the competent state agency for approval shall decide whether to grant or deny the Mining Exploitation License. In case of denial, a written response stating the reasons must be provided.
4.29 Notification and Delivery of Results of the Mining Exploitation License Application
Within no more than three working days from the date of receipt of the documents from the competent state agency for approval, the document receiving agency shall notify the organizations and individuals applying for the Mining Exploitation License to collect the results and fulfill related obligations as prescribed. The aforementioned period does not include the time taken by the organization or individual exploiting minerals to complete the initial payment procedures for the exploitation rights.
Article 61. Procedures for Amending the Mining Permit
1. The submission of documents shall be carried out as follows:
a) An organization or individual exploiting a certain type of mineral shall submit an application to amend the mining permit for that type of mineral to the agency receiving the application.
b) Within no more than five days, the agency receiving the application shall be responsible for checking the documents and materials in the application. In cases where the documents and materials in the application comply with the provisions of Clause 2, Article 55 of this Decree, the agency receiving the application shall issue a receipt for the application. If the application for exploitation of minerals is incomplete or does not meet the legal requirements, the agency receiving the application shall guide the organization or individual applying for exploitation of minerals to supplement and complete the application in writing. The issuance of guidance documents and requests for supplementation and completion of the application shall only be carried out once.
2. Examination of the Application to Amend the Mining Permit:
a) Within no more than twenty days from the date of receipt of the application receipt, the agency receiving the application shall be responsible for completing the examination and review of the documents in the application, including on-site inspections;
b) In cases where the amendment of the mining permit is due to changes in the amount of minerals allowed to be exploited and requires determination and adjustment of the fee for granting the right to exploit minerals, the time required to complete this work shall not be included in the processing time of the application.
3. Submission of the Application to Amend the Mining Permit:
a) Within no more than five days from the date of completion of the tasks specified in Clause 2 of this Article, the agency receiving the application shall be responsible for completing and submitting the application to the competent state authority issuing the permit;
b) Within no more than seven days from the date of receipt of the application from the agency receiving the application, the competent state authority issuing the permit shall decide whether to amend or not to amend the mining permit. In case of refusal, a written response must be provided with clear reasons.
4. Notification and Delivery of Results of the Application to Amend the Mining Permit
Within no more than three days from the date of receipt of the application from the competent authority issuing the permit, the agency receiving the application shall notify the organization or individual applying for the mining permit to receive the results and fulfill related obligations as prescribed.
Article 62. Procedures for Registering the Area, Capacity, Volume, Method, Equipment, and Plan for Exploiting Ordinary Construction Materials in the Project Area
1. The submission of documents shall be carried out as follows:
a) An organization or individual registering shall submit the application to the agency receiving the application;
b) Within no more than five days, the agency receiving the application shall be responsible for checking the documents and materials in the application. In cases where the documents and materials in the application comply with the provisions Article 53 of this Decree, the agency receiving the application shall issue a receipt for the application. If the application is incomplete or does not meet the legal requirements, the agency receiving the application shall guide the organization or individual applying for exploitation of minerals to supplement and complete the application in writing. The issuance of guidance documents and requests for supplementation and completion of the application of the agency receiving the application shall only be carried out once.
2. Examination of the Registration Application:
a) Within no more than ten days from the date of receipt of the application receipt, the agency receiving the application shall be responsible for completing the verification of the coordinates and area of the proposed mining site and on-site inspections;
b) Within no more than twenty-five days, the agency receiving the application must complete the examination of the documents and other relevant contents related to the exploitation of minerals and determine the fee for granting the right to exploit minerals.
3. Submission of the Registration Application for Exploitation of Minerals:
a) Within no more than five days from the date of completion of the tasks specified in Clause 2 of this Article, the agency receiving the application shall be responsible for completing and submitting the registration application to the People's Committee of the province or city where the construction project is located or where dredging and channel clearance projects are located;
b) Within no more than seven days from the date of receipt of the application, the People's Committee of the province or city shall complete the registration. In case of non-registration, a written response must be provided with clear reasons.
4. Notification and Delivery of Results of the Application for Issuance of the Mining Permit
Within no more than five days from the date of receipt of the application from the competent authority, the agency receiving the application shall notify the organization or individual applying for registration of the volume of exploitation of minerals to receive the results and fulfill related obligations as prescribed, notify the local authorities at the district and commune level to coordinate management and supervision. The time mentioned above does not include the time taken by organizations or individuals exploiting minerals to complete the procedures for payment of the fee for granting the right to exploit minerals.
Article 63. Procedure for Implementing the Application Process for Mining Permits in Areas with Investment Projects for Construction Works
1. The submission of documents shall be carried out as follows:
a) Organizations and individuals applying for a Mining Exploitation License shall submit their exploitation application documents to the document receiving agency.
b)30 Within no more than three working days, the agency receiving the application files shall be responsible for checking the documents and materials in the file. In cases where the documents and materials in the file comply with the provisions set out in Article 54 of this Decree the agency receiving the application shall issue a receipt for the application. If the application is incomplete or does not meet the legal requirements, the agency receiving the application shall guide the organization or individual applying for exploitation of minerals to supplement and complete the application in writing. The issuance of guidance documents and requests for supplementation and completion of the application of the agency receiving the application shall only be carried out once.
2. The review of the application file shall be conducted as follows:
a) Within no more than ten days from the date of receipt of the application receipt, the agency receiving the application shall be responsible for completing the verification of the coordinates and area of the proposed mining site and on-site inspections;
b) Within no more than thirty-five days, the agency receiving the application files must complete the examination of the documents and files and other relevant contents related to mining activities and determine the fee for granting the mining permit.
3.31The submission of the application for a mining permit shall be carried out as follows:
a) Within no more than three working days from the date of completion of the tasks specified in Clause 2 of this Article, the agency receiving the application files shall be responsible for completing and submitting the application for a mining permit to the competent authority issuing the permit;
b) Within no more than three working days from the date of receipt of the application file from the agency receiving the application files, the state agency with the authority to issue the permit shall decide on granting or not granting the Mining Permit. In case of non-granting of the permit, it must provide a written response stating the reasons.
4.32 Notification and Delivery of Results of the Mining Exploitation License Application
Within no more than three working days from the date of receipt of the application file from the competent authority, the agency receiving the application files shall notify the organization or individual applying for the mining permit to receive the result and perform related obligations as prescribed. The time mentioned above does not include the time taken by the organization or individual engaged in mining activities to complete the procedures for payment of the mining right fee.
Article 64. Procedure for Implementing the Application Process for Mining Permit for By-product Mining
1. The submission of documents shall be carried out as follows:
a) Organizations or individuals applying for a Mining Permit for By-product Mining submit the application file for mining to the agency receiving the application files;
b) Within no more than five days, the agency receiving the application files shall be responsible for checking the documents and materials in the file. In cases where the documents and materials comply with the provisions set out in Clause 1 of Article 70 of the Law on Minerals and Clause 1 of Article 52 of this Decree then the agency receiving the application files shall issue a receipt for the application file.
In cases where the application file for by-product mining does not contain all required documents and materials as prescribed or contains them but the contents of the documents and materials in the file do not comply with the legal provisions, the agency receiving the application files shall guide in writing the organization or individual to supplement and complete the file. The issuance of written guidance and requests for supplementation and completion of the file by the agency receiving the application files shall only be carried out once.
2. Examination of the application file for a Mining Permit for By-product Mining:
a) Within no more than five days from the date of receipt of the application file receipt, the agency receiving the application files shall be responsible for completing the verification of the coordinates and area of the proposed by-product mining site and conducting a field inspection;
b) Within no more than fifteen days, the agency receiving the application files must complete the examination of the documents and files and other relevant contents related to the proposed by-product mining site.
3. Submission of the application file for a Mining Permit for By-product Mining shall be carried out as follows:
a) Within no more than two days from the date of completion of the tasks specified in Clause 2 of this Article, the agency receiving the application files shall be responsible for completing and submitting the application for a permit to the state agency with the authority to issue the permit;
b) Within no more than five days from the date of receipt of the application file from the agency receiving the application files, the state agency with the authority to issue the permit shall decide on granting or not granting the Mining Permit for By-product Mining. In case of non-granting of the permit, it must provide a written response stating the reasons.
4. Notification of the results of the application for a Mining Permit for By-product Mining:
Within three days from the date of receipt of the by-product mining permit application file from the competent authority issuing the permit, the agency receiving the application files shall notify the organization or individual applying for the Mining Permit for By-product Mining to receive the result and perform related obligations as prescribed.
Article 65. Procedures for extending, transferring, returning part of the area, returning mineral exploration permits, mineral exploitation permits; extending, returning residual mineral exploitation permits
1. The submission of documents shall be carried out as follows:
a) Organizations and individuals proposing to extend, transfer, return part of the area, return mineral exploration permits, mineral exploitation permits; extend, return residual mineral exploitation permits shall submit the application dossier to the receiving agency.
b)33 Within no more than three working days, the receiving agency shall be responsible for checking the documents in the dossier. If the documents comply with the regulations, the receiving agency shall issue a receipt for the dossier.
2. The process of reviewing the dossier shall be carried out as follows:
a) Within no more than five days from the date of receipt of the dossier receipt, the receiving agency shall complete the verification of coordinates and area of the proposed extension, transfer, return of part of the area, return of mineral exploration permits, mineral exploitation permits; within no more than three days for the case of extending, returning residual mineral exploitation permits, including on-site inspection.
b)34 Within no more than thirty working days, the receiving agency must complete the review of all relevant documents, dossiers, and other related contents for extending, transferring, returning part of the area, returning mineral exploration permits, mineral exploitation permits; within no more than three working days for the case of extending, returning residual mineral exploitation permits.
3. Submitting the dossier to the competent authority issuing the permit:
a) Within no more than two days from the completion of the tasks stipulated in Clause 2 of this Article, the receiving agency shall be responsible for completing and submitting the dossier to the state agency with the authority to issue the permit.
b) Within no more than five days from the date of receipt of the dossier from the receiving agency, the state agency with the authority to issue the permit shall decide whether to approve or not to approve the extension, transfer, return of part of the area, return of mineral exploration permits, mineral exploitation permits; within no more than three days for the case of extending, returning residual mineral exploitation permits. In the case of non-approval, a written response must be provided with clear reasons.
4. Delivery of Resolution Results
Within no more than three days from the date of receipt of the dossier from the state agency with the authority to issue the permit, the receiving agency shall notify the organizations and individuals proposing to extend, transfer, return part of the area, return mineral exploration permits, mineral exploitation permits; within no more than two days for the case of extending, returning residual mineral exploitation permits to receive the results.
Article 66. Procedures for approving mineral reserves35
1. The submission of documents shall be carried out as follows:
a) Organizations and individuals permitted to explore minerals shall submit the application dossier for approval of mineral reserves directly, through postal service, or via the online public service system to the receiving agency.
b) Within no more than three working days, the receiving agency shall be responsible for examining and checking the dossier. If the documents comply with the provisions of Clause 1 of Article 50 of the Law on Minerals and Article 50 of this Decree the agency receiving the dossier shall notify organizations and individuals who have applied for approval to pay the assessment fee for mineral reserve evaluation according to the regulations. The agency receiving the dossier shall issue a receipt immediately after the organization or individual has fulfilled their obligation to pay the assessment fee for mineral reserve evaluation.
In cases where the dossier does not contain complete documents as required or the contents of the documents in the dossier do not comply with the provisions of the law, the agency receiving the dossier shall guide in writing for the organization or individual to supplement and complete the dossier. The guidance and request for supplementation and completion of the dossier by the agency receiving it shall only be carried out once.
2. The inspection of the mineral reserve report shall be conducted as follows:
a) Within a period not exceeding thirty working days from the date of issuance of the receipt, the agency receiving the dossier shall be responsible for inspecting all documents in the dossier; conducting on-site inspections of the mineral exploration area, core drilling samples, trenches, and wells if deemed necessary;
b) Within a period not exceeding sixty working days from the end of the work specified in point a of this clause, the agency receiving the dossier shall send the exploration results report to experts in relevant fields to seek opinions on the related contents in the mineral exploration report. The time for experts to respond shall not exceed twenty working days from the date they receive the request from the agency receiving the dossier;
c) Trong thời gian không quá 30 ngày làm việc, kể từ ngày kết thúc công việc quy định tại điểm b khoản này cơ quan tiếp nhận hồ sơ có trách nhiệm tổng hợp ý kiến của các chuyên gia và chuẩn bị hồ sơ, tài liệu để trình Hội đồng đánh giá trữ lượng khoáng sản quốc gia hoặc trình Ủy ban nhân dân cấp tỉnh xem xét, quyết định.
Trường hợp báo cáo không đạt yêu cầu để trình Hội đồng đánh giá trữ lượng khoáng sản quốc gia hoặc Ủy ban nhân dân cấp tỉnh phê duyệt, cơ quan tiếp nhận hồ sơ thông báo bằng văn bản, nêu rõ lý do để tổ chức, cá nhân đề nghị phê duyệt trữ lượng khoáng sản bổ sung, hoàn chỉnh báo cáo, kèm theo ý kiến nhận xét bằng văn bản của các chuyên gia.
Thời gian tổ chức, cá nhân đang hoàn chỉnh báo cáo trữ lượng khoáng sản không tính vào thời gian thẩm định báo cáo.
3. Việc thẩm định báo cáo kết quả thăm dò khoáng sản và phê duyệt trữ lượng khoáng sản trong báo cáo thăm dò được thực hiện như sau:
a) Trong thời gian không quá 30 ngày làm việc, kể từ ngày hoàn thành nội dung công việc quy định tại điểm c khoản 2 Điều này, Chủ tịch Hội đồng đánh giá trữ lượng khoáng sản quốc gia tổ chức phiên họp Hội đồng; Ủy ban nhân dân cấp tỉnh quyết định việc thành lập hoặc không thành lập Hội đồng tư vấn kỹ thuật quy định tại khoản 3 Điều 34 Nghị định này.
b) Trong thời gian không quá 10 ngày làm việc, kể từ ngày kết thúc phiên họp của Hội đồng đánh giá trữ lượng khoáng sản quốc gia, Hội đồng tư vấn kỹ thuật, cơ quan tiếp nhận hồ sơ phải hoàn thành biên bản họp Hội đồng. Trường hợp phải bổ sung, chỉnh sửa để hoàn thiện báo cáo thăm dò khoáng sản theo ý kiến Hội đồng đánh giá trữ lượng khoáng sản quốc gia, Hội đồng tư vấn kỹ thuật hoặc Ủy ban nhân dân cấp tỉnh, cơ quan tiếp nhận hồ sơ gửi văn bản thông báo nêu rõ nội dung cần bổ sung, hoàn thiện kèm theo biên bản họp Hội đồng.
Thời gian tổ chức, cá nhân đề nghị phê duyệt trữ lượng bổ sung, hoàn thiện báo cáo thăm dò khoáng sản không tính vào thời gian thẩm định báo cáo.
c) Trong thời gian không quá 15 ngày làm việc, kể từ ngày nhận được báo cáo kết quả thăm dò đã bổ sung, hoàn chỉnh của tổ chức, cá nhân đề nghị phê duyệt trữ lượng, cơ quan tiếp nhận hồ sơ trình cơ quan có thẩm quyền phê duyệt trữ lượng quy định tại khoản 1 Điều 49 Luật Khoáng sản.
d) Trong thời gian không quá 03 ngày làm việc, kể từ ngày nhận được hồ sơ trình phê duyệt trữ lượng khoáng sản của cơ quan tiếp nhận hồ sơ, cơ quan có thẩm quyền phê duyệt trữ lượng khoáng sản ban hành quyết định phê duyệt trữ lượng khoáng sản trong báo cáo kết quả thăm dò khoáng sản.
4. Trả kết quả phê duyệt trữ lượng khoáng sản
Trong thời gian không quá 03 ngày làm việc, kể từ ngày nhận được hồ sơ của cơ quan có thẩm quyền phê duyệt trữ lượng khoáng sản, cơ quan tiếp nhận hồ sơ thông báo cho tổ chức, cá nhân đề nghị phê duyệt trữ lượng nhận kết quả trực tiếp hoặc qua đường bưu điện hoặc thông qua hệ thống dịch vụ công trực tuyến và thực hiện các nghĩa vụ khác có liên quan.
Điều 67. Trách nhiệm của Ủy ban nhân dân cấp tỉnh trong việc phối hợp thẩm định cấp phép hoạt động khoáng sản
1. Trường hợp khu vực cấm hoạt động khoáng sản, khu vực tạm thời cấm hoạt động khoáng sản chưa được phê duyệt theo quy định, trước khi cấp phép hoạt động khoáng sản, Bộ Tài nguyên và Môi trường lấy ý kiến bằng văn bản của Ủy ban nhân dân cấp tỉnh nơi có khoáng sản về diện tích dự kiến cấp phép hoạt động khoáng sản có hoặc không có liên quan đến khu vực cấm hoạt động khoáng sản, khu vực tạm thời cấm hoạt động khoáng sản.
2. Chậm nhất là 30 ngày, kể từ ngày nhận được văn bản lấy ý kiến quy định tại khoản 1 Điều này, Ủy ban nhân dân cấp tỉnh có văn bản trả lời Bộ Tài nguyên và Môi trường.
Chương VI. SỬA ĐỔI, BỔ SUNG MỘT SỐ QUY ĐỊNH VỀ ĐẤU GIÁ QUYỀN KHAI THÁC KHOÁNG SẢN; TIỀN CẤP QUYỀN KHAI THÁC KHOÁNG SẢN
Điều 68. Sửa đổi một số điều của Nghị định số 22/2012/NĐ-CP ngày 26 tháng 3 năm 2012 của Chính phủ quy định về đấu giá quyền khai thác khoáng sản như sau:
1. Sửa đổi khoản 2 Điều 3 như sau:
“2. Phiên đấu giá quyền khai thác khoáng sản chỉ được tiến hành khi có ít nhất 02 tổ chức, cá nhân tham gia đấu giá.”
2. Sửa đổi khoản 1 Điều 6 như sau:
“1. Tiền đặt trước được hoàn trả cho tổ chức, cá nhân tham gia đấu giá trong thời hạn 02 ngày kể từ ngày kết thúc phiên đấu giá, trừ trường hợp quy định tại khoản 2 Điều này.”
3. Bổ sung khoản 4 vào Điều 15 như sau:
“4. Việc đánh giá hồ sơ tham gia đấu giá về tiêu chí vốn chủ sở hữu của tổ chức, cá nhân tham gia đấu giá quyền khai thác khoáng sản quy định tại điểm đ khoản 2 Điều 15 được thực hiện như sau:
a) Căn cứ suất đầu tư thực tế khi thăm dò loại khoáng sản dự kiến đấu giá ở khu vực chưa có kết quả thăm dò hoặc suất đầu tư thực tế khi khai thác loại khoáng sản dự kiến đấu giá ở khu vực đã có kết quả thăm dò trong điều kiện tương tự, Hội đồng đấu giá quyền khai thác khoáng sản của Bộ Tài nguyên và Môi trường, Ủy ban nhân dân cấp tỉnh quyết định dự toán Đề án thăm dò khoáng sản hoặc tổng vốn đầu tư Dự án đầu tư khai thác khoáng sản;
b) Dự toán Đề án thăm dò khoáng sản hoặc tổng vốn đầu tư Dự án đầu tư khai thác khoáng sản quy định tại điểm a khoản 4 Điều này là cơ sở để cơ quan tiếp nhận hồ sơ đánh giá về tiêu chí vốn chủ sở hữu của tổ chức, cá nhân đăng ký tham gia đấu giá quyền khai thác khoáng sản khi xét chọn hồ sơ tham gia đấu giá quyền khai thác khoáng sản quy định tại khoản 2 Điều 19 Nghị định này.”
4. Sửa đổi, bổ sung điểm b khoản 2 Điều 16 như sau:
"b) Bản chính hoặc bản sao có chứng thực hoặc bản sao có bản chính kèm theo để đối chiếu: Giấy chứng nhận đăng ký kinh doanh hoặc Giấy chứng nhận đăng ký doanh nghiệp; văn bản giới thiệu năng lực, kinh nghiệm trong thăm dò, khai thác và chế biến khoáng sản; giới thiệu năng lực tài chính và khả năng huy động tài chính.”
Điều 69. Sửa đổi, bổ sung một số điều của Nghị định số 203/2013/NĐ- CP ngày 28 tháng 11 năm 2013 của Chính phủ quy định về phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản như sau:36
1. Bổ sung khoản 3, khoản 4 vào Điều 2 như sau:
“3. Tổ chức, cá nhân khai thác khoáng sản làm vật liệu xây dựng thông thường không phải đề nghị cấp Giấy phép khai thác khoáng sản quy định tại điểm a khoản 2 Điều 64 Luật khoáng sản; tổ chức, cá nhân thu hồi cát từ các dự án nạo vét, khơi thông luồng lạch.
4. Tổ chức, cá nhân khai thác khoáng sản thu hồi khoáng sản đi kèm.”
2. Sửa đổi, bổ sung Điều 4 như sau:
“Mức thu tiền cấp quyền khai thác khoáng sản (R) được quy định theo nhóm, loại khoáng sản có giá trị từ 1% đến 5%, được thể hiện tại Phụ lục II kèm theo Nghị định này.”
3. Sửa đổi, bổ sung quy định về trữ lượng tính tiền cấp quyền khai thác khoáng sản tại khoản 2 Điều 3 và Điều 5 như sau:
"2. Trữ lượng tính tiền cấp quyền khai thác khoáng sản (Q) là trữ lượng quy định tại khoản 6 Điều 2 Nghị định quy định chi tiết thi hành một số điều của Luật khoáng sản."
“Q - Trữ lượng tính tiền cấp quyền khai thác khoáng sản được quy định cụ thể tại Điều 6 Nghị định này; đơn vị tính là m3, tấn, kg và các đơn vị khác theo quyết định của cơ quan có thẩm quyền phê duyệt trữ lượng khoáng sản.”
4. Sửa đổi, bổ sung khoản 3 Điều 6 như sau:
“3. Đối với các giấy phép được cơ quan nhà nước có thẩm quyền cho phép khai thác không bắt buộc phải tiến hành thăm dò, quy định tại Điều 65 Luật khoáng sản hoặc trường hợp không phải đề nghị cấp Giấy phép khai thác khoáng sản quy định tại điểm a khoản 2 Điều 64 Luật khoáng sản thì trữ lượng tính tiền cấp quyền khai thác khoáng sản áp dụng quy định tại điểm c khoản 1 Điều này.
Đối với trường hợp thu hồi, sử dụng khoáng sản đi kèm hoặc khoáng sản tại bãi thải của mỏ theo Giấy phép khai thác khoáng sản đang còn hiệu lực; thu hồi cát, sỏi từ các dự án nạo vét, khơi thông luồng lạch thì trữ lượng tính tiền cấp quyền được xác định theo khối lượng khoáng sản đã thu hồi, sử dụng thực tế hàng năm.”
5. Sửa đổi, bổ sung Điều 7 như sau:
“Giá tính tiền cấp quyền khai thác khoáng sản được xác định trên cơ sở quy đổi từ giá tính thuế tài nguyên theo quy định của pháp luật về thuế tài nguyên tại thời điểm tính tiền cấp quyền khai thác khoáng sản.
Bộ Tài nguyên và Môi trường hướng dẫn phương pháp quy đổi để tính tiền cấp quyền khai thác khoáng sản.”
Chương VII. ĐIỀU KHOẢN THI HÀNH37
Điều 70. Điều khoản chuyển tiếp
1. Quy hoạch điều tra cơ bản địa chất về khoáng sản; quy hoạch thăm dò, khai thác, chế biến và sử dụng khoáng sản đã được phê duyệt theo quy định trước ngày Luật khoáng sản có hiệu lực được thực hiện cho đến khi quy hoạch khoáng sản quy định tại khoản 1 Điều 10 và Điều 11 Nghị định này được cơ quan có thẩm quyền phê duyệt và công bố theo quy định.
2. Đối với các hồ sơ đề nghị cấp phép khai thác đã được tiếp nhận trước ngày Nghị định này có hiệu lực mà trữ lượng khoáng sản rắn huy động vào khai thác nhỏ hơn 50% tổng trữ lượng khoáng sản đã được cơ quan nhà nước có thẩm quyền phê duyệt thì trữ lượng tính tiền cấp quyền khai thác bằng 50% tổng trữ lượng khoáng sản đã phê duyệt. Đối với khai thác nước khoáng bằng 35% tổng lưu lượng đã được cơ quan nhà nước có thẩm quyền phê duyệt.
Điều 71. Hiệu lực thi hành
1. Hiệu lực thi hành:
a) Nghị định này có hiệu lực thi hành từ ngày 15 tháng 01 năm 2017;
b) Nghị định số 15/2012/NĐ-CP ngày 09 tháng 3 năm 2012 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật khoáng sản hết hiệu lực kể từ ngày Nghị định này có hiệu lực.
2. Chấm dứt hiệu lực các nội dung quy định liên quan tại: khoản 2 Điều 3, khoản 1 Điều 6, điểm b khoản 2 Điều 16 Nghị định số 22/2012/NĐ-CP ngày 26 tháng 3 năm 2012 của Chính phủ quy định về đấu giá quyền khai thác khoáng sản; khoản 2 Điều 3, Điều 4, khoản 3 Điều 6, Điều 7, điểm b khoản 2 Điều 15 Nghị định số 203/2013/NĐ-CP ngày 28 tháng 11 năm 2013 của Chính phủ quy định về phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản.
Điều 72. Trách nhiệm thi hành
1. Bộ Tài nguyên và Môi trường chịu trách nhiệm chủ trì, phối hợp với các bộ, ngành liên quan hướng dẫn thi hành Nghị định này.
2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh và tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.

1 1. Nghị định số 67/2019/NĐ-CP ngày 31 tháng 7 năm 2019 của Chính phủ quy định phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản có căn cứ ban hành như sau:
“Căn cứ Luật tổ chức Chính phủ ngày 19 tháng 6 năm 2015;
Căn cứ Luật khoáng sản ngày 17 tháng 11 năm 2010;
Căn cứ Luật ngân sách nhà nước ngày 25 tháng 6 năm 2015;
Căn cứ Luật quản lý thuế ngày 29 tháng 11 năm 2006 và Luật sửa đổi, bổ sung một số điều của Luật quản lý thuế ngày 20 tháng 11 năm 2012;
Theo đề nghị của Bộ trưởng Bộ Tài nguyên và Môi trường;
Chính phủ ban hành Nghị định quy định về phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản.”
2. Nghị định số 22/2023/NĐ-CP ngày 12 tháng 5 năm 2023 của Chính phủ sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường có căn cứ ban hành như sau:
“Căn cứ Luật Tài nguyên nước ngày 21 tháng 6 năm 2012;
Căn cứ Luật Khoáng sản ngày 17 tháng 11 năm 2010;
Căn cứ Luật Khí tượng thủy văn ngày 23 tháng 11 năm 2015;
Căn cứ Luật Đa dạng sinh học ngày 13 tháng 11 năm 2008;
Căn cứ Luật Đầu tư ngày 17 tháng 6 năm 2020;
Theo đề nghị của Bộ trưởng Bộ Tài nguyên và Môi trường;
Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường”
2 Khoản này bị chấm dứt theo quy định tại khoản 2 Điều 16 của Nghị định số 67/2019/NĐ-CP quy định phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản, có hiệu lực kể từ ngày 15 tháng 9 năm 2019.
3 Điều này được sửa đổi theo quy định tại khoản 1 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
4 Khoản này được bãi bỏ theo quy định tại khoản 2 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
5 Điều này được sửa đổi theo quy định tại khoản 3 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
6 Khoản này được sửa đổi theo quy định tại khoản 4 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
7 Điểm này được sửa đổi theo quy định tại khoản 5 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
8 Điểm này được sửa đổi theo quy định tại khoản 6 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
9 Điểm này được sửa đổi theo quy định tại khoản 7 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
10 Điểm này được sửa đổi theo quy định tại khoản 8 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
11 Khoản này được bãi bỏ theo quy định tại khoản 9 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
12 Điểm này được sửa đổi theo quy định tại khoản 10 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
13 Điểm này được sửa đổi theo quy định tại khoản 11 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
14 Điểm này được sửa đổi theo quy định tại khoản 12 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
15 Điểm này được sửa đổi theo quy định tại khoản 13 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
16 Điểm này được sửa đổi theo quy định tại khoản 14 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
17 Điểm này được bãi bỏ theo quy định tại khoản 15 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
18 Điểm này được sửa đổi theo quy định tại khoản 16 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
19 Điểm này được sửa đổi theo quy định tại khoản 17 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
20 Khoản này được sửa đổi theo quy định tại khoản 18 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
21 Khoản này được sửa đổi theo quy định tại khoản 19 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
22 Điểm này được sửa đổi theo quy định tại khoản 20 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
23 Điểm này được sửa đổi theo quy định tại khoản 21 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
24 Điểm này được sửa đổi theo quy định tại khoản 22 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
25 Khoản này được sửa đổi theo quy định tại khoản 23 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
26 Điểm này được sửa đổi theo quy định tại khoản 24 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
27 Điểm này được sửa đổi theo quy định tại khoản 25 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
28 Điểm này được sửa đổi theo quy định tại khoản 26 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
29 Khoản này được sửa đổi theo quy định tại khoản 27 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
30 Điểm này được sửa đổi theo quy định tại khoản 28 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
31 Khoản này được sửa đổi theo quy định tại khoản 29 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
32 Khoản này được sửa đổi theo quy định tại khoản 30 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
33 Điểm này được sửa đổi theo quy định tại khoản 31 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
34 Điểm này được sửa đổi theo quy định tại khoản 32 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
35 Điều này được sửa đổi theo quy định tại khoản 33 Điều 4 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh trong lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2023.
36 Điều này bị chấm dứt hiệu lực theo quy định tại khoản 2 Điều 16 của Nghị định số 67/2019/NĐ-CP quy định về phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản, có hiệu lực kể từ ngày 15 tháng 9 năm 2019.
37 1. Điều 15, Điều 16 và Điều 17 của Nghị định số 67/2019/NĐ-CP quy định về phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản, có hiệu lực kể từ ngày 15 tháng 9 năm 2019 quy định như sau:
“Điều 15. Điều khoản chuyển tiếp
1. Đối với Quyết định phê duyệt tiền cấp quyền khai thác khoáng sản đã ban hành trước ngày Nghị định này có hiệu lực sẽ tiếp tục thực hiện theo Quyết định đã được ban hành. Trường hợp có sự điều chỉnh Giấy phép khai thác thì Quyết định phê duyệt tiền cấp quyền khai thác khoáng sản được áp dụng theo quy định của Nghị định này.
2. Đối với các hồ sơ đề nghị cấp Giấy phép khai thác khoáng sản được cơ quan có thẩm quyền tiếp nhận trước ngày Nghị định này có hiệu lực thi hành nhưng tính đến thời điểm Nghị định này có hiệu lực chưa phê duyệt tiền cấp quyền thì việc tính tiền cấp quyền khai thác khoáng sản được thực hiện theo quy định của Nghị định này. Trường hợp các thông số tính tiền cấp quyền khai thác khoáng sản áp dụng theo quy định Nghị định này làm cho tổ chức, cá nhân phải nộp tiền cấp quyền khai thác khoáng sản cao hơn khi áp dụng theo Nghị định số 203/2013/NĐ-CP ngày 28 tháng 11 năm 2013 của Chính phủ thì tiếp tục thực hiện theo quy định của Nghị định số 203/2013/NĐ-CP.
3. Đối với những trường hợp đang tạm thu tiền cấp quyền khai thác khoáng sản, khi giá tính thuế tài nguyên do Ủy ban nhân dân cấp tỉnh ban hành đang có hiệu lực và đúng quy định về giá khoáng sản nguyên khai để tính tiền cấp quyền khai thác khoáng sản thì được áp dụng chính thức, thay thế giá tính tiền cấp quyền khai thác khoáng sản tạm thu trước đây.
Điều 16. Hiệu lực thi hành
1. Hiệu lực thi hành:
a) Nghị định này có hiệu lực thi hành từ ngày 15 tháng 9 năm 2019;
b) Nghị định số 203/2013/NĐ-CP ngày 28 tháng 11 năm 2013 của Chính phủ quy định phương pháp tính, mức thu tiền cấp quyền khai thác khoáng sản sẽ hết hiệu lực kể từ ngày Nghị định này có hiệu lực.
2. Chấm dứt hiệu lực các nội dung quy định liên quan tại: khoản 6 Điều 2 và Điều 69 Nghị định số 158/2016/NĐ- CP ngày 29 tháng 11 năm 2016 của Chính phủ quy định chi tiết thi hành một số điều của Luật khoáng sản.
Điều 17. Trách nhiệm thi hành
1. Bộ Tài nguyên và Môi trường chịu trách nhiệm chủ trì, phối hợp các bộ, ngành liên quan tổ chức thi hành Nghị định này.
2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh và tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./”
2. Điều 12 của Nghị định số 22/2023/NĐ-CP sửa đổi, bổ sung một số điều của các Nghị định liên quan đến hoạt động kinh doanh lĩnh vực tài nguyên và môi trường, có hiệu lực kể từ ngày 12 tháng 5 năm 2015 quy định như sau:
“Điều 12. Điều khoản thi hành
1. Nghị định này có hiệu lực thi hành kể từ ngày ký ban hành.
2. Quy định chuyển tiếp
Các yêu cầu điều kiện đầu tư kinh doanh, hồ sơ đã được tiếp nhận đầy đủ, hợp lệ trước ngày Nghị định này có hiệu lực thi hành thì xử lý theo quy định của các Nghị định hiện hành tại thời điểm tiếp nhận.
3. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.”
