DECREE
Regulations on managing investment in the application of information technology using state budget funds
Decree No. 73/2019/ND-CP dated September 5, 2019, of the Government stipulates the management of investment in the application of information technology using state budget funds, effective from January 1, 2020, amended and supplemented by:
Decree No. 82/2024/ND-CP dated July 10, 2024, of the Government amending and supplementing certain articles of Decree No. 73/2019/ND-CP dated September 5, 2019, of the Government stipulating the management of investment in the application of information technology using state budget funds, effective from July 10, 2024.
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to the Law on Bidding dated June 23, 2023;
Pursuant to the Law on Public Investment dated June 13, 2019;
Pursuant to the Law on State Budget dated June 25, 2015;
At the proposal of the Minister of Information and Communications;
The Government promulgates this Decree stipulating the management of investment in the application of information technology using state budget funds.[1]
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation [2]
1. This Decree stipulates the management of the following activities applying information technology:
a) Investment projects applying information technology using development investment expenditure from state budget funds;
b) Activities applying information technology using regular expenditure from state budget funds.
2. Forinvestment projects applying information technology using mixed sources of funding where state budget funds account for 30% or more or are the largest portion of the total investment amount of the project, shall be implemented in accordance with the provisions of this Decree.
3. For activities applying information technology as stipulated in Clause 1 of this Article of agencies representing Vietnam abroad, shall be implemented according to specific regulations of the Government based on proposals and recommendations of the agencies involved, in line with the nature of the project and the laws of the host country.
4. For investment projects applying information technology invested under the public-private partnership model, shall be implemented in accordance with the laws on public-private partnerships.
Article 2. Applicability
This Decree applies to agencies, organizations, and individuals participating in or related to the activity managing investment in the application of information technology using state budget funds.
2. It is encouraged for organizations and individuals related to investment activities in the application of information technology using other sources of funding to apply the provisions of this Decree.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. Economic-technical report of an investment project applying information technology (hereinafter referred to as the economic-technical report) is the feasibility study report of the project applying information technology (hereinafter referred to as the feasibility study report) prepared in cases where the project is carried out under a single-step design scheme.
2. Database is a collection of information and data organized for access, exploitation, management, and updating through electronic means.
3.[3] Market-available information technology services are services provided immediately upon demand without having to place orders for design, construction, development, upgrade, or expansion; they have been described in terms of functions, features, technical specifications, and technology on the websites or pages of organizations or individuals or on other mass media.
4.[4] Information technology services not available on the market are services that provide meet specific requirements to address special needs of agencies or units. Accordingly, agencies or units hire organizations or individuals to build information systems, hardware, software, databases to meet their special needs; after completion of the system or part of the information technology system, the organizations or individuals lease the management and operation of the system to provide services to the hiring agencies or units for a specified period.
5.[5] An investment project applying information technology is a set of activities related to research and capital investment in purchasing hardware, software, databases; constructing, upgrading, and expanding information systems, hardware, software, database for developing, maintaining, improving product quality, operational efficiency within a specified period. At the preparation stage, the information technology application investment project is reflected through the preliminary feasibility study report, the proposal report on investment policy, the feasibility study report, or the economic-technical report.
6. Author supervision work involves checking, explaining, or handling issues, changes, and occurrences to ensure ensures the installation, setup, calibration of information technology materials, equipment, commercial software, or the construction, development, upgrade, expansion of internal software, databases according to detailed design specifications and ensuring copyright for these detailed designs as prescribed.
7. The completion project dossier is a collection of relevant documents related to the process of information technology application investment that needs to be stored when the product or project work item is put into operation and use.
8. Software testing is the verification of software compliance with technical requirements and user requirements using various techniques, means, and devices.
9. Software expansion is the modification of software to enhance its existing functions to meet additional user requirements, business requirements in the operating environment of the software.
10. Software upgrade It is the modification to increase performance, security, and confidentiality capabilities of existing software to optimize its ability to handle user requests and minimize risks in the operating environment of the software.
11.[6] Building and developing software is the production of software to meet organizational or user requirements or for commercial purposes on the market. Building and developing software takes place in a production environment, also known as a development environment.
12. Open-source software is software provided with source code, users do not have to pay licensing fees for the source code but must comply with international regulations on the use of open-source software.
13.[7] Internal software is software designed, built, developed, upgraded, expanded according to specific requirements of organizations or users to meet their special needs. The construction, development, upgrading, and expansion of internal software are activities of purchasing information technology equipment.
14.[8] Commercial software is ready-made, supplied immediately upon request without ordering for design, construction, development, upgrade, expansion; it has been described in terms of functionality and technical features on the electronic portal/information website of organizations or individuals or other mass media.
15. Information technology application investment quality management (referred to as quality management) is the management activity during the implementation of surveying; designing; deploying and supervising deployment work; testing or trial operation; acceptance and handover to ensure product and project quality requirements.
16. Information technology application investment cost management is the management of total investment amount, budget estimate, cost standards, unit prices for information technology application.
17. Review is the inspection and evaluation by the investment decision-maker, investor, specialized agency in information technology , other competent agenciesduring the preparation and implementation of the project to serve as a basis for examination and approval. 18. Verification is the inspection and evaluation from a professional perspective by organizations or individuals with the capacity and experience during the preparation and implementation of investment activities to serve as a basis for review.
20. Detailed design is documentation expressed through descriptions, diagrams, content descriptions, and other technical requirements to be met.
19.[9] Overall system design is the highest-level model of an information system. This model fully represents the architecture, layers/components of an information system such as: users, business processes, applications, data, IT infrastructure (including information security assurance), and relationships between them along with external systems interacting, integrating, connecting, sharing information with that system.
22. Logical system model is a detailed representation of the overall model. The logical model shows the processing procedures among components of the system or between the system and related systems to address technical requirements of the system to achieve desired results.
23. Physical system model is a detailed representation of the logical model. This model depicts the design of the information system based on the logical model and selected design solutions with information about solutions, technical parameters, and suitable equipment, tools (if any) in accordance with applied technical standards and norms.

Article 4. Implementing the provisions of the law on preferential investment policies for purchasing, leasing, and buying domestic information technology products and services, the law's provisions on special information technology products and services, digital technologies.
1. Information technology application activities within the scope regulated by this Decree must prioritize investment, leasing, and purchasing domestic information technology products and services, and implement according to the law's provisions on information technology products and services, special digital technologies.
2. The Ministry of Information and Communications shall issue detailed criteria to determine and publish a list of domestic information technology products and services prioritized for investment, leasing, and purchasing; a list of open-source software suitable for use in state agencies; a list of enterprises with products meeting the priority investment, leasing, and purchasing criteria. For specialized software products, the Ministry of Information and Communications shall coordinate and unify with the relevant ministry before issuing.
3. The Ministry of Information and Communications shall take the lead and coordinate with the Ministry of National Defense, the Ministry of Public Security, and related agencies to issue or submit to the competent authority for issuance detailed criteria and lists of special information technology products and services, digital technologies consistent with the laws on information technology, digital technologies, and related specialized laws..
Article 5. Compliance with the Government Electronic Architecture and Ensuring Connectivity, Interoperability, and Data Sharing
1. The construction, review, approval of investment orientation decisions, design, and implementation of information technology application investment projects[15] must comply with the Government Electronic Architecture Framework, Digital Government, or the departmental digital architecture framework, or provincial digital architecture framework.[16] currently in force.
2.[17] Building national databases, departmental databases central agencies, local databases must ensure connectivity, interoperability, and data sharing as prescribed.
Article 5a. Publication of Lists of Popular Software
1. Central agencies have the responsibility to review, establish, and publish lists and basic functions, technical features of popular software in sectors, specialties, fields.2. Chapter II. PROJECT MANAGEMENT FOR INFORMATION TECHNOLOGY APPLICATION INVESTMENTS[19]
Section 1. GENERAL PROVISIONS
Article 6. Management of information technology application investment projects in accordance with their nature and funding sources[20]
1. For information technology application investment projects funded by state budget development capital, they shall be implemented in accordance with laws on public investment and the provisions of this Decree.
2. Testing products not yet available on the market
a) In cases where the project involves products not yet available on the market, if necessary, the investor shall consider and report to the competent authority to select organizations and individuals to research, propose technical solutions and technological plans; build and test products. The aforementioned organizations and individuals shall bear all incidental costs (if any). After successful testing and determining the technical solution, technology, and cost, the investor shall proceed with investment procedures as prescribed;
b) The competent authority referred to in point a of this clause is the authority deciding on investment projects according to the laws on public investment;
c) The testing process includes at least the following steps: Identifying products not yet available on the market; Reporting to the competent authority referred to in point b of this clause for permission to select organizations and individuals to conduct testing; Selecting organizations and individuals to conduct testing (The investor directly sends participation requests to organizations and individuals capable of conducting testing or publicly announces the need to find organizations and individuals to participate in research, construction, and testing on their own electronic portal/information website or that of the managing agency so that interested organizations and individuals can know and propose participation; Based on the list of organizations and individuals proposing to participate, the investor reviews and selects one or more organizations and individuals to participate in product testing); Organizations and individuals researching, proposing technical solutions and technological plans; building and testing products; Reporting the testing results.
3. For information technology application investment projects involving telecommunication works, construction works, and other fields, the management of costs and quality of those investment items shall be carried out in accordance with laws on telecommunications works, construction, and related specialized fields.
For projects in other fields involving information technology application investment items, the management of costs and quality of those information technology application investment items shall be carried out in accordance with the provisions of this Decree.
4. In cases where a project consists of multiple component projects or sub-projects, if each component project or sub-project can operate independently, be exploited, or be implemented according to phased investment as recorded in the investment orientation, each component project or sub-project shall be immediately implemented from the investment preparation stage (excluding the establishment, review, and decision-making on investment orientation) as an independent information technology application project. a) For PPP projects, the tenderer shall post the selection results of investors and attach the approval decision on the System no later than ten days from the date the document is issued in accordance with point b of Clause 2, Article 4 of Decree No. 35/2021/NĐ-CP. 5. Component projects or sub-projects belonging to a certain group shall have their project establishment, review, and approval procedures carried out according to the procedures and formalities of projects in that group.
Article 7. Classification of Projects
Based on the level of importance and scale, projects are classified into national key projects, Group A projects, Group B projects, and Group C projects according to the criteria stipulated in the Law
on Public Investment đpublic investment.
Article 8. Investor
1. The investor is the agency or organization directly managing the information technology application investment project.[21]as follows:
a) The unit managing and using the products of the project or the specialized unit on information technology acts as the investor;
b) Ministries, central agencies, People's Committees at all levels act as investors simultaneously;
c) The Project Management Board established by ministries, central agencies, People's Committees at all levels acts as the investor if such Project Management Board has legal personality and meets the conditions to organize and implement the project.
2. For mixed capital projects, the investor is appointed by the contributing members through agreement or represents the party with the highest contribution ratio.
Article 8a. Establishment, Review, Approval of System Information Security Level
The procedures for establishing, reviewing, and approving the system information security level in information technology application investment projects shall be carried out in accordance with the laws on cybersecurity.
Section 2. MANAGEMENT OF INFORMATION TECHNOLOGY APPLICATION INVESTMENT PROJECTS
Subsection 1. INVESTMENT PROCEDURES AND INVESTMENT PREPARATION
Article 9. Investment Procedures for Information Technology Application Investment Projects
1. The investment procedures for information technology application investment projects include the following stages:
aa) Investment preparation;
b) Implementation of investment;
c) Completion of investment.
2. The works in the implementation stage and completion stage may be carried out sequentially or concurrently depending on the specific conditions of each project and determined by the competent authority authorized to make investment decisions.[23] Encouragement is given to the application of hybrid tender forms for projects involving construction, development, upgrading, and expansion of internal software, including component projects and sub-projects (if any). Depending on the nature and scale of the project, the competent authority authorized to make investment decisions is responsible for considering and deciding on the appropriate form of implementation and bearing responsibility under the law for the effectiveness of the project.
3.[24] In cases where a hybrid tender form is applied, the implementation of the project follows the agreement of the parties in the contract.
4. The selection of contractors, negotiation, and signing of contracts are carried out in accordance with the laws on bidding and related legal documents.
Article 10. Design Steps
1. The design process can be carried out in one or two steps:
a) One-step design is detailed design;
b) Two-step design includes basic design and detailed design.
2. One-step design is applicable to reserve procurement projects, replacement of existing hardware systems; procurement of equipment that does not require installation; procurement of commercial software; procurement of hardware, software, and databases not falling within the scope specified in
Clause 24, Article 3 of this Decree , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects.3. For projects investing in information systems, hardware, software, and databases as specified in

In the case of one-step design, the detailed design and economic-technical report budget are prepared during the investment preparation stage instead of the basic design and total investment cost of the feasibility study report.
In the case of two-step design, the detailed design must be consistent with the approved basic design regarding the overall model, logical model, physical model of the system or components of the system (if any).

Article 11. Investment Preparation
1. The contents of investment preparation work include:
a) Preparing, reviewing, and deciding on the investment orientation of the project;
b) Conducting surveys;
c) Preparing, reviewing, and deciding on the investment of the project.
2. The investor may carry out or hire organizations or individuals to prepare survey tasks, conduct surveys, and prepare feasibility study reports or economic-technical reports. A consulting organization or individual can simultaneously conduct surveys and prepare feasibility study reports or economic-technical reports.
3. The investment preparation phase ends when the competent authority decides to approve the project investment.[26] The investment decision approves the project.
Article 12. Preparing, Reviewing, and Deciding on the Investment Orientation of the Project
1. The procedures, formalities, and authorities for preparing, reviewing, and deciding on the investment orientation of the project shall be carried out in accordance with the provisions of the Public Investment Law.
The unit assigned to prepare the preliminary feasibility report or the proposal for the investment orientation of the project shall carry out or hire organizations or individuals to prepare the preliminary feasibility report or the proposal for the investment orientation of the project.
2.[27] The content of the preliminary feasibility report and the proposal for the investment orientation of the project shall be implemented according to the provisions of the Public Investment Law. The initial estimation of the total investment amount in the content of the preliminary feasibility report and the proposal for the investment orientation of the project shall be conducted using comparison methods, expert methods, or pricing, or a combination of these methods, or based on approved strategies, plans, programs, and projects.
The Minister of Information and Communications shall provide detailed guidance on the methods for initially estimating the total investment amount.
3In cases where the project involves information technology applications in other sectors, the content of the preliminary feasibility report and the proposal for the investment orientation of the information technology application project shall be implemented according to the provisions of Clause 2 of this Article.
Article 13. Preparing Survey Tasks and Organizing Survey Work
1. The survey task includes the following contents:
b) Scope of the survey;
c) Survey methods;
c) Types of survey works expected;
d) Expected time for conducting surveys.
2. The survey task must be approved by the investor in accordance with the requirements of each type of survey work and serve as the basis for conducting survey work.
Article 14. Survey Result Report

b) Characteristics and scale of investment;
c) Procedures, methods, and equipment (if any) used for surveys;
d) Actual survey data and results. For internal software, additional descriptions of user requirements should be included;
đ) Analysis of data and evaluation of survey results;
e) Technical-scientific solutions proposed (if any) to serve the preparation of basic design or detailed design (in cases of supplementary surveys or when the project prepares an economic-technical report);
g) Conclusions and recommendations;
h) Relevant appendices to illustrate the survey results obtained (if any).
2. The report on survey results must be inspected and accepted by the investor and serves as the basis for preparing the basic design or detailed design (when the project prepares an economic-technical report).

3. Organizations or individuals preparing survey tasks and conducting surveys shall be responsible before the investor and the law for the quality of the work undertaken; they must compensate for losses (if any) when failing to comply with the approved survey tasks and other violations causing damage.
Article 15. Acceptance of Survey Results
1. Basis for Accepting Survey Results
a) The survey contract (in cases where organizations or individuals are hired to conduct surveys);
b) Approved survey tasks;
c) Survey result reports.
2. Content of Acceptance
a) Evaluation of the quality of the survey work compared to the approved survey tasks;
b) Inspection of the format and quantity of the survey result report;
c) Acceptance of the volume of survey work according to the signed contract.
3. The acceptance results must be recorded in a protocol.
Article 16. Preparation of Feasibility Study Reports for Projects
1. Basic design is part of of the feasibility study report for the project.
2.[28] Contents of the feasibility study report for the project shall be carried out in accordance with the Public Investment Law, including for information technology application projects, the following contents must be clearly explained:
4. For investment projects specified in Clause 5, Article 38 of this Decree:Compliance assessment Government e-Government Architecture Framework, Digital Government Architecture Framework, or Ministry-level Digital Architecture Framework, or Provincial-level Digital Architecture Framework;
b) Analysis and selection of technical solutions, equipment, including analysis and selection of solutions ensuring connectivity, interoperability, and data sharing with related information systems, hardware, software, databases; requirements for IPv6 readiness or upgrade solutions ensuring IPv6 readiness if there are activities operating on the Internet environment; analysis and selection of technical solutions, equipment ensuring information security;
c) Basic design of the selected solution.
Article 17. Main Content of Basic Design
1. Requirements for Basic Design
a)[29] Must comply Government e-Government Architecture Framework, Digital Government Architecture Framework, or Ministry-level Digital Architecture Framework, or Provincial-level Digital Architecture Framework;
b)[30] Must comply with applicable technical standards and regulations; must ensure compliance with management, connection, and data sharing regulations within state agencies (if applicable);
c) Must reflect key parameters, main functions, and features;
d) Must ensure determination of total investment cost.
2.[31] Main Content of Basic Design
a) Description Section:
- Description of project requirements;
- List of applicable technical standards and regulations;
- Description of overall model, logical model, physical model of the system or components of the system (if applicable), presenting the main investment items of the project according to the chosen solution to demonstrate internal and external connections, transmission routes (if applicable) of the system and basic technical parameter calculations, number of devices;
- Preliminary quantities of construction works, equipment, and technical requirements; preliminary quantities of training, guidance, operation, and other related works; - Description of technical requirements that internal software must meet as stipulated in
Article 18 of this Decree - Description of information security requirements for the project.;
b) Preliminary Diagram Section:
- Documents on current technical infrastructure and other conditions; preliminary construction and installation diagrams (for network construction, IT equipment installation, and accessories);
- Preliminary diagram showing connections and interoperability with related information systems, hardware, software, databases.
c) Main content of basic design for procurement items or projects for spare parts replacement, equipment replacement belonging to existing information systems; procurement of equipment without installation; procurement of commercial software;
procurement of hardware, software, databases not included in the activities specified in - List of commercial hardware, software, and technical requirements for equipment; , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects.including:
- Statistics on quantities of commercial hardware, software.
- Statistics on the quantity of hardware and commercial software equipment.
Article 18. Description of technical requirements that internal software must meet
The description of technical requirements that internal software must meet must ensure sufficient conditions to determine the costs for building, developing, upgrading, and expanding internal software, including the following main contents:
1. Name of the software.
2. Main parameters:
a) Business processes that need to be computerized (organization and operation of the process, products of business operations, transaction processing activities of the business process);
b) Participants in the business process and their relationships (people, resources, equipment for business process handling, other supporting factors);
c) List of user requirements.
3. Non-functional requirements:
a) Requirements for the database;
b) Information security requirements;
c) Requirements for processing time and complexity of the software;
d) Requirements for installation, infrastructure, transmission lines, operational safety, exploitation, and use;
đ) Constraints on the system including environmental constraints and dependence on platform systems;
e) Requirements for IPv6 compatibility (if operating in an Internet environment);
g) Other non-functional requirements.
Article 19. Total investment amount of the project
1. The total investment amount of the project is the entire anticipated cost recorded in the investment decision, serving as the basis for the investor to develop plans and manage capital when implementing the project.
2. The total investment includes:
a) Construction costs:
- Costs for purchasing and installing networks, network accessories, and other costs related to network installation;
- Other direct construction costs related to the project.
b)[32] Equipment costs:
- Costs for purchasing information technology equipment: equipment requiring installation and setup, equipment not requiring installation and setup, auxiliary equipment, peripheral equipment, commercial software and accompanying support services (as required by the manufacturer), internal software, and other equipment; transportation and insurance costs for equipment; taxes and related fees;
- Costs for establishing databases; standardization and conversion services for data entry and database creation; implementation of data entry for the database;
- Costs for installing equipment; software installation; testing, adjusting equipment and software;
- Training costs for usage guidance; training costs for system management and operation staff (if applicable);
- Deployment, support, management, and operation costs of the project's product or work component before final acceptance and handover (if applicable).
c) Project management costs: including costs for organizing and implementing project management from the investment preparation stage to completion, acceptance, and handover, putting the project's product into operation and use, and monitoring and evaluating project investment;
d)[33] Investment consulting costs: survey costs; preparation of pre-feasibility study reports, investment proposal reports, feasibility study reports, or economic-technical reports; investigation and research services for preparing pre-feasibility study reports, investment proposal reports, feasibility study reports, or economic-technical reports, solution selection; review of pre-feasibility study reports, investment proposal reports, feasibility study reports, or economic-technical reports; detailed design preparation, adjustment, and supplementation; budget preparation; budget adjustment; detailed design and budget review; overall plan preparation for selecting contractors for the project, tender request documents, invitation to bid documents, and evaluation costs for tender submission documents, prequalification submission documents, and bidding documents for contractor selection; standard setting and unit price preparation; material and equipment quality inspection; product quality assessment; investment capital conversion; supervision of implementation work; performance of other consulting tasks;
đ)[34] Other costs: fees and charges; insurance (excluding equipment insurance costs specified in point b of this clause); testing or trial operation; auditing; budget verification and approval; installation and rental of transmission lines; costs for renting information technology services to serve activities during the project implementation process; cost appraisal and other costs;
e)[35] Contingency costs: Cost contingency for inflation during the project implementation period, cost contingency for volume changes, and cost contingency for provisional sums (if applicable).
In cases where the project is implemented across multiple locations or abroad, the costs specified in points a, b, c, d, and đ of this clause shall include additional costs for equipment and labor force relocation.
If the costs specified in points a, b, c, d, and đ of this clause have no established norms or cannot be immediately calculated, they may be temporarily estimated and included in the total investment amount.
3. The total investment amount is calculated and determined during the feasibility study report preparation phase, consistent with the content of the feasibility study report and the basic design.
In cases where the project is implemented under the economic-technical report format[36], the budget is prepared instead of the total investment amount. The budget is calculated based on the quantity from detailed design and the provisions at Article 28 of this Decree.
4.[37] The total investment amount shall be determined according to one of the following methods:
a) Calculating based on the basic design of the feasibility study report, wherein: Construction costs are calculated based on the main quantities from the basic design, other quantities are estimated, and material, equipment, and service prices are determined based on market conditions; equipment costs are calculated based on the quantity and type of equipment suitable for the information technology application solution, market equipment prices, and other related factors (if any); internal software development, enhancement, upgrade, and expansion costs are determined using the comparison method, expert method, cost calculation method, or pricing, a combination of these methods; project management costs, investment consulting costs, and other costs are determined by preparing a budget estimate or provisional estimate at a percentage (%) of the total construction costs and equipment costs; contingency costs are determined in accordance with Clause 5 of this Article.
For software that has been modified, supplemented, or developed, enhanced, upgraded, and expanded based on commercial software, open-source software, digital platforms, framework, ..., or developed based on artificial intelligence (AI), blockchain, virtual reality/augmented reality (VR/AR), ..., modification, supplementation, or software development, enhancement, upgrade, and expansion costs are determined using the comparison method, expert method, cost calculation method, quotation, or a combination of these methods. Commercial software, digital platform, framework, ... costs are determined according to the equipment cost determination method specified in Point from state budget funds under its management. Appropriate disciplinary measures shall be taken against individuals and units seriously violating the implementation of management, payment, and use of project management costs.
b) Calculating based on data from similar economic-technical indicator projects that have been implemented. When applying this method, it is necessary to convert the data of the similar project to the time of preparing the feasibility study report and adjust the undetermined cost items in the total investment amount accordingly;
c) Combining the methods prescribed in Points a and b of this Clause;
d) The Minister of Information and Communications shall provide detailed guidance on the methods for determining the total investment amount.
5. Contingency costs for additional work volumes are calculated based on the total costs stipulated in Points a, b, c, d, and đ of Clause 2 of this Article. Contingency costs for price escalation factors are calculated based on the duration of the project's implementation period, taking into account domestic and international price fluctuations.
Article 19a. Competence, procedure, documentation, content of review, and investment decision for information technology application investment projects
1. Competence, procedure, documentation, content of review, and investment decision for information technology application investment projects, including information technology application investment projects implemented under the economic-technical report form, shall comply with the provisions of the public investment law.
2. In cases where the investor hires organizations or individuals with competence and experience to review the feasibility study report or the economic-technical report,the review content includes part or all of the project review content as prescribed by the public investment law and the content stipulated in Clause 3 of Article 21 or Clause 3 of Article 22 of this Decree.
For national key projects, the review of the feasibility study report shall be carried out in accordance with the provisions of the law on national key projects.
Article 20. Competence and Procedure for Reviewing the Basic Design of Projects
1. The Ministry of Information and Communications shall review the basic design for national key projects, Group A projects, except for projects to purchase spare equipment hardware within the existing information system; to purchase equipment that does not require installation; purchase to purchase commercial software.
2. Professional units under provincial People's Committees specializing in information technology shall review the basic design for projects decided to be invested in by the Chairpersons of People's Committees at all levels, except for projects whose basic design falls within the competence of the Ministry of Information and Communications to review.
3. Professional units specializing in information technology under the level with the authority to decide on investment shall review the basic design, except for projects whose basic design falls within the competence of the Ministry of Information and Communications to review or within the competence defined in Clause 2 of this Article.
4. In cases where the unit reviewing the basic design is also the investor, the unit reviewing the basic design shall establish a review board to review the basic design or ||| have the authority to decide on investment entrust another specialized unit to review the basic design.
5. The review board or the specialized agency managing investment shall be responsible for reviewing the project according to the provisions of the Public Investment Law (hereinafter referred to collectively as the organizing body for review), including:
a) Sending the basic design dossier to seek opinions or submitting it to the competent authority to decide on investment to seek opinions from the units authorized to review the basic design as stipulated in Clauses 1, 2, and 3 of this Article (except in cases where the investor is simultaneously the unit reviewing the basic design);
b) Seeking opinions or submitting them to the competent authority to decide on investment to seek opinions from related agencies and units to review the project (if necessary).
6. Units authorized to review the basic design as stipulated in Clauses 1, 2, 3, and 4 of this Article shall be responsible for sending their opinions on the basic design to the organizing body for review to compile opinions when conducting the project review.
Article 21. Dossier and Content of Reviewing the Basic Design
1. The dossier sent by the organizing body for review to seek opinions on the basic design includes:
a) Report on survey results;
b) Basic design;
c) Legal documents and other relevant materials.
The number of dossiers is one set.
2. The time limit for reviewing the basic design starts from the date of receiving complete valid dossiers as follows: Not exceeding 20 days for national key projects, Group A projects; not exceeding 15 days for Group B projects; not exceeding 10 days for Group C projects.
3. Content of reviewing the basic design:
a) Compliance of the components and specifications of the basic design with legal regulations, including: basic design description, basic design diagrams, survey documents, and other documents as prescribed by law;
b) Compliance with the Government Electronic Architecture Framework, Digital Government Framework, or departmental digital architecture framework, or provincial digital architecture framework;
c) Appropriateness of the selection of technical solutions, technologies, and equipment;
d) Compliance of the basic design with technical standards and basic requirements for functions and technical performance;
đ) Appropriateness of the basic design in terms of connectivity, interoperability, and data sharing with related information systems, hardware, software, and databases;
e) Other contents in the basic design.
Article 22. Competence, procedure, and content of detailed design review for information technology application investment projects implemented in the form of economic-technical reports.
1. The main contents of the economic-technical report include:
a) - Office of the President of the StateCompliance assessment Government e-Government Architecture Framework, Digital Government Architecture Framework, or Ministry-level Digital Architecture Framework, or Provincial-level Digital Architecture Framework;
b) Analysis and selection of technical solutions, equipment, including analysis and selection of solutions ensuring connectivity, interoperability, and data sharing with related information systems, hardware, software, databases; requirements for IPv6 readiness or upgrade solutions ensuring IPv6 readiness if there are activities operating on the Internet environment; analysis and selection of technical solutions, equipment ensuring information security;
c) Detailed design documents and budget estimates as prescribed in Articles 27 and 28 of this Decree;
d) Other contents of the economic-technical report according to the feasibility study report content prescribed in the Public Investment Law.
2. Competence, procedure for reviewing detailed designs of information technology application investment projects implemented in the form of economic-technical reports
a) The Review Board or the specialized management agency on investment shall be responsible for reviewing the project in accordance with the Public Investment Law (hereinafter referred to as the organization responsible for review), including sending detailed design documents for comments or submitting them to the competent authority for investment decision-making to seek comments from the competent units specified in points b, c, d, đ of this clause; seeking opinions from relevant agencies and units to review the project (if necessary);
b) The Ministry of Information and Communications shall review detailed designs for Class A projects, except for projects investing in spare parts procurement, replacement of hardware equipment belonging to the system of individuals registered in accordance with the law continues to be updated into the information Balance; procurement of equipment that does not require installation; procurement of commercial software;
c) Specialized units on information technologyunder the provincial People's Committee shall review detailed designs for projects decided on investment by the Chairmen of all levels of People's Committees, except for projects whose detailed designs fall within the competence of the Ministry of Information and Communications to review; d) Specialized units on information technology under the competent authority deciding on investment shall review detailed designs, except for projects whose detailed designs fall within the competence of the Ministry of Information and Communications to review or within the competence prescribed in point c of this clause;
đ) In cases where the unit reviewing detailed designs is also the investor, the unit reviewing detailed designs shall establish a review board to conduct the review or the competent authority deciding on investment shall entrust another specialized unit to review detailed designs;
e) Units reviewing detailed designs as stipulated in points b, c, d, and đ of this clause shall be responsible for sending their detailed design review comments to the organization responsible for review for consolidation when conducting the project review.
3. Content of detailed design and budget estimate review:
a) Suitability of the selected technical and technological solutions, equipment;
a) b) Suitability of detailed design in terms of connection, interoperability, and data sharing with related information systems, hardware, software, and databases;
c) Other detailed design review contents as prescribed in
Clause 1 of Article 29 of this Decree d) Budget estimate review content as prescribed in;
Clause 2 of Article 29 of this Decree Article 23. Project Adjustment.
The adjustment of information technology application investment projects using development investment funds from the state budget shall be carried out in accordance with the laws on public investment.
Subsection 2. IMPLEMENTATION OF INVESTMENT
Article 24. Contents of work during the implementation phase
The contents of work during the implementation phase include:
1. Conducting supplementary surveys (if necessary).
2. Agreeing on the use of frequency and national digital resources (if required by relevant laws to agree on the use of frequencies and digital resources).
3. Preparing, reviewing, and approving detailed design documents, except for projects implementing economic-technical reports.
4. Organizing the selection of contractors and implementing contracts.
5. Inspecting and supervising the implementation of contracts.
6. Managing the implementation of the project.
7. Testing or trial operation.
8. Handing over products or project works.
9. Training on usage, deployment, support, management, operation, and exploitation.
10. Acceptance and handover of the project.
11. Preparing completion files and storing project files in accordance with regulations.
11. Completing and archiving project files according to regulations.
Article 25. Supplementary Survey
1. The investor shall be responsible for examining and deciding on supplementary surveys.
2. The tasks of supplementary surveys shall be established according to the contents specified in Clause 1 of Article 13 of this Decree. 3. The content of the report on the results of supplementary surveys, and the content of the acceptance of the results of supplementary surveys shall be carried out in accordance with the provisions of Article 14 and Clause 2 of Article 15 of this Decree..
4. The report on the results of supplementary surveys must be inspected and accepted by the investor and serve as the basis for implementing detailed design preparation or changes, adjustments, and supplements to the detailed design or the basic design of the feasibility study report. Article 26. Preparation of Detailed Design.
1. The investor shall carry out or hire organizations or individuals to prepare detailed designs and budgets. During the design process, typical designs may be used for similar information technology application models.
2. Documents serving as the basis for preparing detailed designs
a) Decision approving the project and the approved feasibility study report, except in cases where the project is implemented in the form of an economic-technical report;
b) List of technical standards and information technology standards to be applied;
c) Government e-Government architecture, digital government architecture, or ministry-level digital architecture, provincial-level digital architecture;
d) Report on survey results;
đ) Report on supplementary survey results (if any) and other requirements (if necessary).[42];
3. Organizations or individuals preparing detailed designs must implement author supervision throughout the implementation and acceptance of project products when requested by the investor.
Organizations or individuals preparing detailed designs shall not use the names of other organizations or individuals preparing detailed designs under any form.
4. Organizations or individuals preparing detailed designs and budgets must hand over to the investor sufficient design documentation to ensure management of investment activities and storage.
5. Approved detailed design documentation must be stored in accordance with the laws on archives.
Requirements for detailed design
a) Must comply with the Government e-Government architecture, digital government architecture, or ministry-level digital architecture, provincial-level digital architecture;
6.[43] b) Must comply with applicable technical standards and standards; must ensure compliance with regulations on data management, connection, and sharing within state agencies (if applicable);
c) Must be consistent with the approved basic design, except in cases where the project is implemented in the form of an economic-technical report; d) Must reflect technical parameters, functions, and features;;
đ) Must ensure the determination of the budget estimate.
Article 27. Main Content of Detailed Design Documentation
1. Main content of detailed design
a) For network installation, installation of information technology equipment and accessories: Technical criteria applied during installation, setup, testing, and calibration of equipment; Equipment installation, setup list, and technical specifications of equipment; Statistics of construction and installation work volume, equipment of main and auxiliary investment items; training and guidance usage, management, operation volumes, and other related works;
Implementation methods (for complex implementation cases); Operation safety measures, fire prevention, explosion prevention (if applicable); Existing site plan; Network design solution diagram and detailed explanation, transmission route, technical infrastructure, information security, power supply, lightning protection, cooling system, transmission bandwidth calculation; IP network address planning diagram and detailed explanation; Equipment installation diagram: location, distance, height of installation (if applicable); connection points; statistics of materials and supplies for equipment installation; Network construction diagram: wiring, cable tray installation, lightning surge protection installation, network installation material and supply usage, interconnection between network subsystems and external systems with main dimensions and materials; For linear network construction projects (if applicable): route scheme, directional change angle, installation height and coordinates, major intersections along the route, protected corridor width along the route with main dimensions and materials.
For reserve procurement items or replacement hardware devices of existing information systems, procurement of equipment that does not require installation;
the main content of detailed design includes: c) For internal software:- Description of technical requirements that need to be met by internal software during the investment preparation phase;
b)[44] - Analysis and description of software functions; purchase of commercial software; in the activities specified in - List of commercial hardware, software, and technical requirements for equipment; , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects.- Requirements for fault tolerance regarding syntax errors, logical errors in data processing, and input data correctness control errors;
- Statistics on quantities of commercial hardware, software.
- Statistics on the quantity of hardware and commercial software equipment.
- Requirements for readiness with IPv6 or upgrade solutions ensuring readiness with IPv6 if operating on the Internet environment; in non-Internet connected environments, compatibility support for IPv6 or upgrade solutions ensuring readiness with IPv6 is encouraged;
- Requirements for aesthetics and technical achievements of program interfaces;
- Requirements for the capabilities of staff involved in building, developing, upgrading, and expanding software;
- Other non-functional requirements.
d) Detailed requirements for training and guidance on use; deployment, support, management, and operation of project products or work items before final acceptance (if applicable); warranty and maintenance requirements.

2. Budget estimates are prepared in accordance with the provisions at

2. The budget is prepared in accordance with the provisions at Article 28 of this Decree.
Article 28. Budget Estimate
1. The budget estimate is the total cost of implementing the project determined at the investment implementation stage for each specific project in accordance with the feasibility study report, detailed design, and other work requirements to be carried out.
a)[46] The budget estimate is part of the detailed design dossier; the approved detailed item budget estimate serves as the basis for determining the tender package budget estimate for cases of direct assignment or self-execution and works carried out without contracts.
b) For mixed tender packages, the tender package budget estimate is determined based on the signed contract price.
c) In cases where typical designs are used, the budget estimate is determined based on the budget estimate of the typical design specified in Clause 1 of Article 26 of this Decree.
2.[47] The contents of the budget estimate include costs: construction and installation costs, equipment costs, project management costs, investment consulting costs, other costs, and contingency costs.
a) Construction costs:
Construction and installation costs are determined by preparing a budget estimate based on norms and methods of establishing norms as guided by the Ministry of Information and Communications and relevant regulations.
b) Equipment costs are determined based on the quantity and type of equipment needed to purchase and market equipment prices. Costs for building, developing, upgrading, and expanding internal software are determined using comparison methods, expert methods, cost calculation methods, pricing, or a combination of these methods. Installation and setup costs for equipment, database creation, training and usage guidance, management, operation; transportation and insurance costs for equipment; deployment, support, management, and operation costs for products or project tasks before final acceptance handover (if applicable) and other related costs (if applicable) are determined by preparing a budget estimate.
For software that has been modified, supplemented, or built, developed, upgraded, and expanded based on commercial software, open-source software, digital platforms, frameworks,... or built and developed based on artificial intelligence (AI), blockchain, virtual reality/augmented reality (VR/AR),..., modification, supplementation, or software development, upgrade, and expansion costs are determined using comparison methods, expert methods, cost calculation methods, or quotations or a combination of these methods. Commercial software, digital platform, framework,... costsare determined according to the equipment cost determination method specified herein;
c) Project management costs and investment consulting costs are determined based on cost norms as a percentage or by preparing a budget estimate;
d) Other costs include costs not specified in points a, b, and c of this clause and are determined by preparing a budget estimate or according to cost norms as a percentage;
đ) Contingency costs for additional work volumes are calculated as a percentage (%) of the total costs specified in points a, b, c, and d of this clause. Contingency costs for price escalation factors are calculated based on the length of the investment period of the project.
3.[48] The application of methods for determining budget estimates, establishing norms, unit prices during each period, and managing costs shall be implemented according to announcements and guidelines issued by the Ministry of Information and Communications.
4.[49] The Minister of Information and Communications shall guide the determination of labor unit prices in investment cost management for information technology applications based on market labor prices.

Article 29. Organization for detailed design review and budget approval
1. Content of detailed design review
a) The conformity of the components and specifications of the detailed design with legal provisions, including: the main contents of the detailed design, survey documents, and other documents as prescribed by law;
b) The conformity with the basic design in the feasibility study report approved and relevant legal provisions, except in cases where the project implements an economic-technical report;
c) The conformity with applicable technical standards and regulations;
d) Compliance with Government e-Government Architecture Framework, Digital Government Architecture Framework, or Ministry-level Digital Architecture Framework, or Provincial-level Digital Architecture Framework[51];
đ) The rationality of solutions and equipment (if any);
e) The suitability of operational safety measures, fire prevention, and explosion protection (if any).
g)[52] Other contents in the detailed design.
2. Content of budget review
a) The conformity between the quantity of the detailed design and the budget estimate;
b) The conformity of applying economic-technical norms, expenditure levels, unit prices; the application of norms, unit prices, calculation methods, related systems, policies, and cost items in the budget estimate as prescribed.
3. The investor organizes the review and is permitted to hire organizations or individuals with capability and experience to conduct detailed design and budget verification to serve as the basis for reviewing the tasks they undertake, except in cases where the project implements an economic-technical report.
4. Authority to approve detailed design and budget
a) The investor approves the detailed design and budget estimate for two-step design cases;
b) The approval of detailed design and budget estimate is carried out simultaneously, without separating the detailed design from the budget estimate.
The approved detailed design documents serve as the basis for the investor to manage the quality, progress, and implementation measures of the project.
6. Organizations and individuals conducting reviews, verifications, and approvals of detailed design and budget estimates must bear legal responsibility for the results of their reviews, verifications, and approvals.
7. In cases where the project adjustment leads to adjustments in the detailed design and budget estimate, the adjusted contents must be organized by the investor for review and re-approval according to the provisions of this Article.
Article 30. Adjustment of Detailed Design
1. The approved detailed design may only be adjusted in the following cases:
a) When the project is adjusted according to Article 23 of this Decree and there is a requirement to adjust the design;
b) During the implementation process, if unreasonable factors are discovered that, if not changed, will affect the investment quality of the project, progress, implementation measures, and investment effectiveness.
2. If the detailed design adjustment does not change the technical solution or technology; does not alter the scale or investment objectives and does not exceed the total investment amount already approved, the investor is permitted to self-adjust the detailed design. For all other cases, the investor must submit to the competent authority[53] for investment decision to review and re-approve the adjusted content.
3.[54] For projects implemented under the economic-technical report format, if the detailed design adjustment does not change the scale or investment objectives and does not exceed the approved budget estimate, the investor is permitted to self-adjust the detailed design; for all other cases, the investor must submit to the competent authority for investment decision to review and re-approve the adjusted content.
4. Depending on the specific conditions of the project, the investor may hire organizations or individuals to implement the adjustment of detailed design, basic design.
Article 31. Cases for Adjusting the Budget Estimate
1. The project investor shall organize the preparation of the adjusted budget estimate in the cases prescribed in Article 23 and Clause 1 of Article 30 of this Decree. 2. In the case of changing the cost structure in the budget estimate (including contingency costs), but not exceeding the total investment ceiling or the budget estimate (for projects implementing economic-technical reports) that have been approved, the project investor may independently adjust the budget estimates of the project's investment items..
3. Depending on the specific conditions of the project, the project investor may engage organizations or individuals to prepare the adjusted budget estimate.
4. The contents of the adjusted budget estimate shall be decided by the project investor or the competent authority authorized to decide on investment.
Article 32. Implementation Work and Supervision of Implementation Work[55] 1. The project investor shall either implement themselves or engage organizations or individuals to purchase information technology equipment; construct, upgrade, expand information systems, hardware, software, databases; implementation work for installation, construction, installation of information systems, hardware, software installation, material adjustment, equipment calibration.
2. The contractor implementing the work shall be responsible for establishing a quality management system suitable to the scale if requested by the project investor; establish a work implementation logbook.
3. For projects during the implementation and installation of information systems, hardware, commercial software installation, material adjustment, equipment calibration, supervision of implementation work must be carried out.
4. The project investor shall either supervise the implementation work themselves or engage organizations or individuals to supervise the implementation work.
5. The Minister of Information and Communications shall stipulate the contents of implementation work, supervision of implementation work, and acceptance.
Article 33. Management of Implementation Progress
1. Before implementation, the project must prepare an implementation schedule. The implementation schedule must be consistent with the overall progress of the project that has been approved.
2. For large-scale projects with implementation periods exceeding one year, the implementation schedule must be prepared for each phase, quarter, and year.
3. The contractor is obligated to prepare a detailed implementation schedule, interweaving and combining necessary tasks while ensuring consistency with the overall progress of the project that has been approved.
4. The project investor, the unit supervising the implementation work (if any), and related parties are responsible for monitoring and adjusting the progress when the progress in certain phases is delayed, without affecting the overall progress of the project.
5. Accelerating the implementation progress of the project based on ensuring investment quality is encouraged.
Article 34. Testing or Trial Operation
1. The project products must undergo testing or trial operation at least one beneficiary unit before final acceptance.
2. In the case of conducting testing, depending on specific conditions, the project investor may choose one of the following forms:
a) Self-testing;
b) Engaging independent organizations or individuals with sufficient capacity, means, and conditions to conduct testing.
3. The results of testing or trial operation must be documented and called the testing or trial operation result report.
The testing or trial operation result report serves as the basis for the participating parties to consider during final acceptance or for the project investor to request the contractor to continue making corrections, supplements, and improvements.
4. After the contractor makes supplementary and perfecting adjustments, the project investor shall organize retesting or trial operation. This process will only conclude when the product meets the quality requirements.
The test or trial operation report is the basis for the parties involved in the acceptance to consider during the acceptance process or for the investor to request the contractor to continue making adjustments, supplements, and improvements.
4. After the contractor has supplemented and improved the project's products, the investor must organize retesting or trial operation. This process only ends when the product meets quality requirements.
Article 35. Acceptance and Handover of Project Products
1. The project products or works can only be handed over to the investor after they have been accepted and meet quality requirements. The investor shall organize the acceptance and handover of project products or works with the participation of consulting organizations and individuals, equipment suppliers, implementers, and related agencies or units (if applicable).
2. Depending on the specific conditions of each project, the contractor may hand over individual completed products, works, component projects, or the entire completed project to the investor for operation and use.
Simultaneously, the contractor must hand over the following documents: completion files, user manuals, management, operation, and maintenance documents (if applicable) for completed products or works; technical documents for connection as prescribed (for projects involving data sharing between central ministries and local authorities). These documents must be clearly defined in the contract and form part of the project's completion files.
3.[57] The investor must submit to the competent unit as specified in point b of this clause a report on the completion of project products or works along with the list of completion files for project products or works for monitoring purposes.
a) Time limit: within ten days (for projects with basic design not subject to review by the Ministry of Information and Communications) or within twenty days (for projects with basic design subject to review by the Ministry of Information and Communications) from the date of acceptance and handover, putting the project products or works into operation and use, meeting requirements and being approved by all parties involved in the acceptance, signing the acceptance certificate;
b) The competent unit is specifically defined as follows:
- For projects with basic design subject to review by the Ministry of Information and Communications, the investor submits to the Ministry of Information and Communications;
- For projects decided upon by the Chairman of the People's Committee at various levels for investment, the investor submits to the specialized unit under the provincial People's Committee responsible for information technology, except for projects with basic design subject to review by the Ministry of Information and Communications;
- For other projects, the investor submits to the specialized unit authorized to review basic design as stipulated in Clause 3, Article 20 of this Decree, except for projects with basic design subject to review by the Ministry of Information and Communications.
4. In the case of internal software development, construction, upgrading, or expansion, the contractor is responsible for handing over:
5. All project-related files and documents must be stored by the investor in accordance with legal regulations on archiving.
6. In cases where the project is discontinued due to force majeure or a decision by the competent authority deciding on investment, the investor shall organize the acceptance of the work already performed with the participation of consulting organizations, designers, and related agencies or units (if applicable).
c) Source code of the program (if applicable);
d) User guides, management, and operation manuals; training materials for users, managers, and operators; maintenance procedure documentation (if applicable); technical guidelines and standards (if applicable);
đ) Technical documents for connection as prescribed (for projects involving data sharing between central agencies and localities).
5. All project-related documents must be stored by the investor in accordance with legal regulations on record keeping.
6. In cases where the project cannot continue due to force majeure or a decision by the competent authority[58] the investment decision, the investor shall organize the acceptance of the work already completed with the participation of consulting organizations, designers, and related agencies (if applicable).
Article 36. Establishment and Storage of Completion Documents for Products or Works of the Project
1. Completion documents for products or works of the project must be fully established by the investor before the products or works of the project are put into operation and use.
2. If all products or works of the project are simultaneously put into operation and use, completion documents shall be established once for the entire project. In cases where products or works of the project are put into operation and use at different times, completion documents may be established separately for each product or work.
3. The investor is responsible for organizing the establishment of completion documents. Contractors are responsible for establishing completion documents for the products or works they undertake. The number of completion documents is determined by the investor based on agreements with contractors and relevant parties.
4. Storage of completion documents shall be carried out in accordance with the provisions of the law on archiving.
Subsection 3. CONCLUSION OF INVESTMENT, PUTTING PRODUCTS OF THE PROJECT INTO OPERATION AND USE
Article 37. Conclusion of Investment, Putting Products of the Project into Operation and Use
The tasks to be performed during this phase include:
1. Warranty for products of the project.
2. Final settlement of investment capital and approval of final settlement.
Article 38. Warranty for Products of the Project
1. The minimum warranty period for products of the project is calculated from the date the investor signs the acceptance and handover certificate, putting the products or works of the project into operation and use, and is stipulated as follows:
a) A 24-month warranty for national key projects and group A projects;
b) A 12-month warranty for group B and C projects.
c)[59] The warranty period specified in points a and b of this clause does not include the manufacturer's or supplier's warranty period for individual information technology equipment, nor the extended warranty period for such equipment (if applicable).
2. The minimum warranty amount is calculated as a percentage (%) of the value of the project's products and is stipulated as follows:
a) For products with a 24-month warranty period, it is 03%;
b) For products with a 12-month warranty period, it is 05%.
The contractor is responsible for submitting a bank guarantee equivalent in value to the investor or other forms of guarantee accepted by the investor.
The contractor can only have the guarantee refunded after the warranty period has ended and the investor confirms that the warranty work has been completed.
3. Responsibilities of the Parties Regarding Warranty
a) The investor, management agency, and user unit of the project's products are responsible for inspecting and identifying defects to request the contractor to repair, rectify, or replace them. If the contractor fails to meet the warranty requirements, the investor and management/user units have the right to hire another contractor to perform the work. The cost of hiring is taken from the warranty amount of the project's products; Supervising and accepting the rectification, repair, and replacement work of the contractor; Confirming the completion of the warranty for the project's products to the contractor;
b) The contractor is responsible for immediately organizing repairs, replacements upon the investor's or management/user unit's request and must bear all costs of rectification, repair, and replacement; Refusing warranty in cases where damage is not caused by the contractor's fault, the investor violates state management regulations and is ordered by competent authorities to remove or improperly operate the project's products;
c) The contractor must compensate for losses caused by their own fault leading to damage, incidents, or defects of the project's products, even after the warranty period, and may face further legal penalties depending on the severity of the violation.
Article 39. Handling Assets at the End of the Project
The handling of assets resulting from the project and assets serving the project's operations shall be carried out in accordance with the provisions of the law.
Article 40. Management, Operation, and Maintenance of Project Products [60]
1. Project products must be managed, operated, and maintained regularly and continuously immediately after handover and commencement of use.
2. Responsibilities of the agency or unit entrusted with managing and using project products:
a) Organize the management, operation, and maintenance of project products;
b) Determine the costs of management, operation, and maintenance by preparing a budget or based on quotations from service providers;;
c) Bear legal responsibility for the deterioration or malfunction of project products due to failure to manage, operate, and maintain them in accordance with regulations;
d) Submit to competent authorities for balancing and allocating funds for the management, operation, and maintenance of project products;
đ) Fulfill other responsibilities and obligations as prescribed by laws governing the management and use of public assets and other relevant laws;
3. Article 24Management, operation, and maintenance of systems that are project products investing in information systems, hardware, software, databases as stipulated in , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects. is a special task guaranteed from the regular expenditure of the state budget.
4. The Minister of Information and Communications shall guide the content and methods for determining management, operation, and maintenance costs.
Article 41. Settlement and Finalization of Projects
The settlement and finalization of projects shall be carried out in accordance with the provisions of the law. The project sponsor or its lawful representative shall bear legal responsibility for the accuracy and legality of unit prices, quantities, and values proposed for payment in the settlement documents.
Subsection 4. PROJECT MANAGEMENT ORGANIZATION FOR INFORMATION TECHNOLOGY APPLICATION INVESTMENTS
Article 42. Forms of Project Management
1. Competent authority[61] decides to invest and selects one of the following forms of project management:
a) Directly managing the project when the project sponsor has the necessary conditions and capacity;
b) Hiring a consulting organization to manage the project.
2. In cases where the project sponsor directly manages the project, the project sponsor shall establish a Project Management Board to assist the project sponsor in managing the project.
For projects with a total investment amount of up to fifteen billion dong, the project sponsor may not establish a Project Management Board but instead use their own specialized machinery to manage and direct the project or hire professionals with experience to support project management.
Article 43. Responsibilities of the Project Sponsor in Managing the Project
1. The project sponsor is responsible for managing and implementing the project, performing tasks and exercising powers from the investment preparation stage through implementation until completion, acceptance, and handover of project products for exploitation and use, ensuring the effectiveness and feasibility of the project and compliance with legal provisions, including tasks assigned to the Project Management Board or hired consulting organizations.
2. Reporting on monitoring and evaluating the project and updating project information on the Investment Program Monitoring and Evaluation Information System using state budget funds as prescribed.
3. In cases where the project sponsor directly manages the project without establishing a Project Management Board, the project sponsor uses their own legal entity to directly manage and implement the project. The project sponsor must issue a decision appointing personnel to participate in project management and assign specific tasks, including a person directly responsible for project management tasks. Personnel appointed to participate in project management work on a part-time or full-time basis.
4. In cases where the project sponsor directly manages the project and establishes a Project Management Board, the project sponsor is responsible for:
a) Assigning tasks and granting authority to the Project Management Board according to the principle: suitability with the actual conditions of the project sponsor, requirements of the project; clearly defining the responsibilities of the project sponsor and the Project Management Board; delegating strong authority to the Project Management Board in the spirit of matching tasks with authority to minimize administrative procedures between the project sponsor and the Project Management Board.
The assignment of tasks and delegation of authority to the Project Management Board must be reflected in the decision to establish the Project Management Board and related documents assigning tasks and delegating authority issued by the project sponsor.
b) May entrust a single Project Management Board to manage multiple projects if it has the necessary conditions and capacity.
5. In cases where the project sponsor hires a consulting organization to manage the project, the project sponsor is responsible for:
a) Appointing at least one leader of the agency or unit to oversee the management and implementation of the project and assigning tasks to specialized units within the agency or unit's machinery to advise and assist the leadership in performing the project sponsor's duties and monitor the execution of the management consulting organization's contract to ensure the project is implemented correctly in terms of content, progress, quality, and effectiveness;
b) Organizing the selection and signing contracts with management consulting organizations suitable for the tasks they undertake to help the project sponsor manage and implement the project.
6. Bear the responsibility other responsibilities as prescribed by relevant laws concerning information technology application investment management.
Article 44. Tasks and Authorities of the Project Management Board and Project Management Consulting Organizations
1. In cases where the investor establishes a Project Management Board, the Project Management Board shall have the following tasks and authorities:
a) Implement tasks assigned by the investor and exercise powers delegated by the investor. The Project Management Board shall be responsible to the investor and the law for the tasks assigned and powers delegated;
b) The Project Management Board shall not establish subordinate Project Management Boards or subordinate public service units to manage projects;
c) When the Project Management Board manages multiple projects, each project must be managed, monitored, recorded separately, and settled promptly upon completion of the project in accordance with regulations;
d) If necessary, the Project Management Board may hire organizations or individuals with competence and experience to participate in managing and supervising certain tasks that the Project Management Board lacks the conditions or professional capacity to perform, but such hiring must be approved by the investor;
đ) The Project Management Board may sign contracts to hire foreign consulting organizations or individuals with experience and competence to manage tasks that domestic consultants lack the capacity to perform or when there are special requirements. Hiring foreign consultants in this case must be permitted by the competent authority issuing the investment decision;[62] e) Carry out project management tasks as prescribed in
Article 45 of this Decree; g) Be subject to other provisions of laws related to information technology investment management;;
bears the responsibility other as prescribed by relevant laws concerning the management of information technology application investments.
2. In cases where the investor hires a project management consulting organization, the project management consulting organization shall have the following tasks and authorities:
a) The project management consulting organization shall implement project management contents according to the contract signed with the investor. The contract for hiring a project management consultant must clearly specify the scope of work and management content; the powers and responsibilities of the consultant and the investor;
b) The project management consulting organization shall be responsible for organizing its organizational structure and appointing personnel to directly carry out project management tasks according to the contract signed with the investor. The project management consultant must notify the investor about the responsibilities and organizational structure of the personnel appointed to directly manage the project, and inform other contractors and relevant organizations or individuals;
c) The project management consulting organization may hire organizations or individuals with competence and experience to perform certain parts of project management tasks, but such hiring must be approved by the investor and be consistent with the tasks and authorities stipulated in the contract signed with the investor;
d) Carry out project management tasks as prescribed in g) Be subject to other provisions of laws related to information technology investment management; and other commitments made in the contract; compensate for losses caused by their own fault during project management; be subject to the responsibility other responsibilities as prescribed by relevant laws concerning information technology application investment management;
đ) bears the responsibility other as prescribed by relevant laws concerning the management of information technology application investments.
Article 45. Contents of Project Management Work
The contents of project management work for information technology application investment include:
1. Implement procedures and works serving the implementation of the project.
2. Organize detailed design documentation preparation.
3. Organize the preparation of request documents, tender documents; organize contractor selection.
4. Negotiate and sign contracts with contractors according to the investor's requirements.
5. Manage quality, quantity, progress, deployment costs, fire prevention and explosion safety, operational safety, and industrial hygiene at the site.
6.[63] Supervise project implementation activities and other advisory works as prescribed.
7. Organize project acceptance, handover of project products; settle accounts, finalize contracts signed according to the investor's requirements.
8. Prepare final settlement reports when the project is completed and put into operation.
9. Perform the task other as prescribed by relevant laws concerning the management of information technology application investments.

Chapter III. MANAGEMENT OF ACTIVITIES APPLYING INFORMATION TECHNOLOGY USING REGULAR EXPENSE FUNDS FROM THE STATE BUDGET
Article 51. Management and implementation of activities applying information technology using regular expense funds from the state budget[70]
1. For activities applying information technology using the following regular expense funds, after being allocated according to the provisions of Clause 5 of this Article, procurement and use of funds shall be carried out in accordance with the laws on the state budget, laws on bidding, laws on management and use of public assets, and relevant laws:
a) Procurement for spare parts and replacement of hardware equipment belonging to existing information systems; procurement of equipment that does not require installation; procurement of commercial software (including updates of commercial software licenses);
b) Extension of warranty (extended warranty); maintenance, repair of information systems, hardware, software; management, operation, outsourcing management, technical support for information systems; network security services; cybersecurity services;
c) Establishment of databases; standardization, conversion to facilitate data entry and database establishment; implementation of data entry for databases; maintenance of database systems; ensuring continuous provision of information and online public services on the internet;
d) Hiring of available information technology services on the market. The rental price (based on the unit price of each service used or the unit price of the output product of the service) is determined based on the quotation of the service provider or manufacturer at the time of service rental;
đ) Activities applying information technology using regular expense funds to immediately address or promptly handle consequences caused by natural disasters, fires, or to fulfill tasks to resolve incidents as required by the National Assembly, Government, Prime Minister, or as stipulated in regulatory legal documents;
e) Other activities applying information technology using regular expense funds that are not covered by the activities specified in , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects..
2. For investment activities in information systems, hardware, software, and databases specified in , except when the competent authority authorized to make investment decisions deems it necessary and requires a two-step design, and excluding national key projects. using regular expense funds (hereinafter referred to as projects), after being allocated according to the provisions of Clause 5 of this Article, shall be implemented in accordance with Article 51a of this Decree.
3. For activities hiring information technology services not available on the market, after being allocated according to the provisions of Clause 5 of this Article, shall be implemented in accordance with Article 52 of this Decree.
4. Authority to decide on investment and procurement of activities applying information technology specified in Clauses 2 and 3 of this Article
a) The Minister, Head of central agencies decides or specifies the authority to decide on investment and procurement of activities applying information technology using regular expense funds from the state budget within the scope of management of the ministry or central agency;b) The People's Council of the province decides or specifies the authority to decide on investment and procurement of activities applying information technology using regular expense funds from the state budget within the scope of management of the locality.
5. Procedures and formalities for preparing budgets, allocating budget funds, and settling accounts for implementing activities applying information technology specified in Clauses 1, 2, and 3 of this Article shall be carried out in accordance with the laws on the state budget regarding
preparation of regular expense budgets from the state budget, laws on payment and settlement of regular expense budgets from the state budget and relevant laws. 6. Selection of contractors, negotiation, and signing of contracts in activities applying information technology specified in Clauses 1, 2, and 3 of this Article shall be carried out in accordance with the laws on bidding and relevant laws.
6. The selection of contractors, negotiation, and signing of contracts in information technology application activities stipulated in Clauses 1, 2, and 3 of this Article shall be carried out in accordance with the bidding laws and related laws.
Article 51a. Management and implementation of activities for investing in information systems, hardware, software, and databases using regular budget funds
1. Projects shall be classified according to the provisions set forth in Article 7 of this Decree.
2. The investor shall be determined according to the provisions set forth in Clause 1, Article 8 of this Decree.
3. The procedures and formalities for investment, cost management, and quality control shall be carried out in accordance with the provisions set forth in Clause 2, 3, Article 6, Article 8a and Section 2 Chapter II of this Decree, except for the following contents:
a) Not required to prepare, review, and approve the investment proposal as stipulated in Point a, Clause 1, Article 11 and Article 12 of this Decree;
b) The investor shall consider and decide on conducting surveys. In cases where surveys are conducted, the organization implementing the survey shall comply with the provisions set forth in Chapter II of this Decree;
c) Investment decision-making authority, project review authority, and procedures as stipulated in Clause 4 of this Article;
d) Main contents of the basic design as stipulated in Clause 6 of this Article;
đ) Main contents of the detailed design as stipulated in Clause 7 of this Article.
4. Investment decision-making authority, review authority, and procedures for reviewing projects
a) Investment decision-making authority shall be implemented in accordance with the provisions set forth in Clause 4, Article 51 of this Decree.
The competent authority deciding on investment shall establish a Review Board or entrust a specialized agency under the competent authority to organize the review of the project (hereinafter referred to collectively as the organizing body for review);

5. Authority to review the basic design, detailed design (in cases implemented in the form of an economic and technical report)
The Ministry of Information and Communications shall review the basic design for national key projects; the basic design and detailed design for Group A projects;
a) b) The specialized unit on information technology directly under the People's Committee at the provincial level shall review the basic design and detailed design for projects decided on investment by the Chairmen of the People's Committees at all levels, excluding projects whose basic design and detailed design fall within the review authority of the Ministry of Information and Communications;
c) The specialized unit on information technology directly under the competent authority deciding on investment shall review the basic design and detailed design, excluding projects whose basic design and detailed design fall within the review authority of the Ministry of Information and Communications or within the review authority prescribed in point b of this clause;
In cases where the unit reviewing the basic design
d) is simultaneously the investor, the unit reviewing the basic design, detailed design shall establish a review board to review the basic design, detailed design the competent authority deciding on investment shall entrust another specialized unit to review the basic design, detailed design send a text message ||| 6. Article 52. Management of Implementation of Activities to Hire Information Technology Services Using Regular Expenditure Funds from State Budget[72]
1. For activities to hire existing information technology services on the market, shall be implemented in accordance with the provisions set out in point d, Clause 1, Article 51 of this Decree.
2. For activities to hire information technology services not available on the market (hereinafter referred to as customized services), the planning and implementation of hiring information technology services shall be carried out in accordance with the provisions set out in Articles 53, 54, 55, 56, 57, 58 of this Decree.
3. Testing of information technology services not yet available on the market
a) In cases where information technology services are not yet available on the market, if necessary, the agency or unit hiring the service shall consider and report to the competent authority for approval to select organizations or individuals to research, propose technical solutions and technological plans; build and test the service. The organizations and individuals mentioned above shall bear all incidental costs (if any). After successful testing, once the technical solution, technology, and cost have been determined, the agency or unit hiring the service shall proceed with the procedures to hire the information technology service information technology a) Receive and manage IDP data updated from Departments of Transport to synchronize with the IDP management information system;
b) The competent authority referred to in point a of this clause is the authority that decides investment and procurement in accordance with the provisions at Clause 4, Article 51 of this Decree.
c) The testing process includes at least the following steps: Identifying services not available on the market; Reporting to the competent authority referred to in point b of this clause for permission to select organizations or individuals to conduct testing; Selecting organizations or individuals to conduct testing (The agency or unit hiring the service directly sends requests for participation to organizations or individuals capable of conducting testing or publicly announces the need to find organizations or individuals interested in participating in research, construction, and testing on its own electronic portal/information website or that of the quan supervising body so that organizations and individuals interested can be informed and propose to participate; d.1. Amount of taxable income in Vietnam:based on the list of organizations and individuals proposing to participate, The agency or unit hiring the service considers and selects one or more organizations or individuals to participate in testing information technology services); Organizations or individuals researching, proposing technical solutions and technological plans; building, testing the service; Reporting the results of testing.
4. Information and data formed during the hiring of information technology services belong to the agency or unit hiring the service. The service provider is responsible for ensuring information security and transferring all information and data to the agency or unit hiring the service upon completion of the information technology service hiring contract.
5. Contracts for hiring information technology services shall be implemented in accordance with the laws on bidding and related laws.
The Minister of Information and Communications shall guide the specific contents of contracts for hiring customized information technology services.
6. Hiring activities for information technology services must be explained in terms of selecting the form of hiring information technology services or investment and procurement as the basis for ||| authority deciding on investment and procurement deciding to implement. The criteria including:
a) Procedures and formalities for implementation (procedures and formalities for hiring information technology services; investment and procurement);
b) Scope and scale of implementation;
c) Resources including financial plan effectiveness assessment, capital allocation capability, sources of funds; human resources for implementation;
d) Degree of technological change, functional and non-functional requirements of the system;
đ) System integration, connection, and interoperability capabilities;
e) System upgrade and expansion capabilities;
g) Maintenance, management, and operation capabilities;
h) Implementation time (time for hiring information technology services; time for implementing investment and procurement, including project preparation, review, and approval activities, procurement activities, and service hiring plans);
i) Ownership rights after the end of the hiring period (assets, information, data, etc.).
Agencies and units may supplement additional criteria suitable for their information technology service hiring activities (if any).
7. The procedures for establishing, reviewing, and approving the level of information system security in hiring information technology services shall be carried out in accordance with the laws on cybersecurity.
Article 53. Competence to Review and Approve Service Procurement Plans According to Specific Requirements[73]
1. The competence to approve service procurement plans according to specific requirements (hereinafter referred to as procurement plans) is the authority that decides on investment and procurement as prescribed in Clause 4, Article 51 of this Decree.
2. Procurement plans must be reviewed before approval.
a) The approving authority establishes a Review Board or assigns a specialized financial and state budget management agency under its jurisdiction to conduct a review of the procurement plan before approval (hereinafter referred to as the reviewing entity);
b) The reviewing entity is responsible for soliciting opinions or submitting to the approving authority for soliciting opinions from units with expertise in information technology regarding the appropriateness of the provisions set forth in point c, Clause 2, Article 54 of this Decree;
c) In cases where the budget-using unit entrusted with the task of procuring services (hereinafter referred to as the main procuring entity) hires organizations or individuals with capability and experience to review the procurement plan, the content of the review includes part or all of the provisions set forth in Clause 3, Article 56 of this Decree.
Article 54. Preparing Procurement Plans
1. The main procuring entity shall prepare the procurement plan itself or hire organizations or individuals to prepare it in accordance with the contents prescribed in Clause 2 of this Article.
2. Main contents of the procurement plan
a) Current status and necessity of service procurement;
b) Major items to be procured; objectives, contents, scale, scope, location, and agencies or units using the services;
c) Determining quality requirements for information technology services; technical and technological compliance requirements to meet quality standards; requirements and conditions for connectivity and interoperability with other information applications and systems; description of internal software requirements to be met; requirements for information security, data security, and other requirements;
d) Determining and clarifying ownership of information and data formed during the provision of services and plans for management and transfer to the procuring party;
đ)[74] Duration of procurement and progress schedule, construction and development time of the service. The procurement period must be sufficiently long (at least one year but not more than eight years) to ensure stability, continuity, and effectiveness in the exploitation and use of the service; cases with a procurement period less than one year must be approved by the competent authority approving the procurement plan;
e) Requirements for occurrences during the exploitation and use of the service;
g) Budget for service procurement as prescribed in Article 55 of this Decree.
3.[75] ||| Article 2. General provisions regarding foreign non-governmental organizations operating in Vietnam (as stipulated from Article 5 to Article 15 of the Decree): The Ministry of Information and Communications shall provide guidance on determining quality requirements for information technology services.
Article 55. Budget for Service Procurement According to Specific Requirements
1. Budget structure:
a) Service procurement costs;
b) Management costs: Including necessary costs as prescribed for the main procuring entity to organize management implementation;
c) Consulting costs: Costs for surveying, preparing procurement plans; reviewing procurement plans; consulting bidding; supervising implementation (if applicable); performing other consulting tasks;
d) Other costs: Auditing costs; valuation costs; testing or trial operation costs; other special costs;
đ) Contingency costs.
2. Methods of determination
a)[76] Service procurement costs are determined by one of the following methods: Comparative method; expert method; quotation method; cost calculation method; combination of methods.
b) Management costs, consulting costs, and other costs are determined by preparing a budget or according to cost norms at a ratio.
The main procuring entity bases on the nature of the service procurement activities to select appropriate methods for determining service procurement costs and is responsible for its selection.
of)[77] The Minister of Information and Communications shall provide detailed guidance on the methods for determining service procurement costs according to specific requirements.
Article 56. Review and Approval of Leasing Plans[78]
1. Documents for review:
a) Request for leasing plan review;
b) Leasing plan;
c) Other related documents.
The number of documents is three sets.
2. Time for reviewing leasing plans
a) The time for reviewing leasing plans shall not exceed thirty days from the date when the review authority receives all valid documents and does not include the time for supplementing and completing the documents. The review period includes the time for the review authority to seek opinions according to point b, Clause 2, Article 53 of this Decree and Clause 4 of this Article. The time for the unit with expertise in information technology to provide opinions according to point b, Clause 2, Article 53 of this Decree shall not exceed fifteen days.
b) In cases where additional information or explanations about the contents of the leasing plan are required, within three working days from the date of receipt of the documents, the review authority shall issue a document requesting the main lessee to supplement or explain.
3. Contents of leasing plan review
a) The appropriateness of the contents of the leasing plan prescribed in Article 54 of this Decree;
b) The completeness, reasonableness, and suitability with actual requirements of the cost items in the leasing service budget estimate.
4. During the review process, depending on the complexity of each task and the nature of the expenses, the review authority may seek opinions or submit the leasing plan for approval by the competent authority through written consultation or organize advisory meetings to seek opinions from relevant agencies, and obtain expert opinions from organizations and individuals with expertise.
5. The review result document serves as the basis for the examination and approval of the leasing plan.
6. Documents submitted by the review authority to the competent authority for approval of the leasing plan include:
a) Request for approval of the leasing plan;
b) Draft Decision on approval of the leasing plan;
c) The completed leasing plan according to the review comments;
d) Document on the results of the leasing plan review;
đ) Opinions of relevant agencies and units (if any);
e) Legal documents and other related documents.
7. The time for approving the leasing plan shall not exceed ten days from the date when the competent authority approves the leasing plan receives all valid documents.
Article 57. Adjustment of Leasing Plans
1. Approved leasing plans shall be reviewed for adjustment in the following cases:
a)[79] When there is a requirement for changes in the quality or quantity of services to be leased; changes in the leasing period;
b) The appearance of factors that bring higher efficiency to leasing activities;
c) The occurrence of unforeseen factors: natural disasters, fires, or other unforeseen events directly affecting leasing activities;
d)[80] When planning, strategy, program, plan, project adjustments or changes by the competent authority affect the scope, content, scale, and objectives of the leasing plan as stipulated in legal normative documents..
2. When adjusting the leasing plan does not change the objectives or scale and does not exceed the approved budget, the main lessee is permitted to organize the review and approval of the adjustment themselves.
In cases where the adjustment of the leasing plan changes the objectives and scale or exceeds the approved budget, the main lessee must submit it to the competent authority for examination and decision. The changed contents must be reviewed before making a decision. The procedures, documents, and time for submitting the adjusted leasing plan for review and approval shall be carried out as the steps for reviewing and approving the leasing plan.
3. The person deciding to adjust the leasing plan bears legal responsibility for their decision.
Article 58. Testing and Trial Operation Organization
1. Services according to specific requirements must be tested or trial operated before being officially put into use to ensure compliance with the leasing plan's requirements.
2. In cases where testing is conducted, depending on specific conditions, the leasing organizer may choose one of the following forms:
3. The results of testing or trial operation must be documented and called the testing or trial operation result report.
The testing or trial operation result report serves as the basis for the participating parties to consider during final acceptance or for the project investor to request the contractor to continue making corrections, supplements, and improvements.
4. After the contractor makes supplementary and perfecting adjustments, the project investor shall organize retesting or trial operation. This process will only conclude when the product meets the quality requirements.
The test result report or trial operation report serves as the basis for the participating parties to consider during acceptance, when putting the service into use, or it can serve as the basis for the leasing organizer to request the contractor to continue making corrections, additions, and improvements. The service lease period is calculated from the date of acceptance and putting the service into use.
4. Services according to specific requirements after being provided with supplementary and completion services by the contractor must be organized for re-testing or trial operation by the leasing organizer. This process will only end when the service according to specific requirements meets the quality service requirements and technical requirements that need to be met.
Chapter IV. TASKS AND RESPONSIBILITIES OF ORGANIZATIONS, ENTITIES, AND INDIVIDUALS IN INFORMATION TECHNOLOGY APPLICATION ACTIVITIES USING FUNDS STATE BUDGET[81]
Article 59. Responsibilities of the Ministry of Information and Communications
1. Issuing and guiding legal normative documents within its authority regarding investment management application information technology use of state budget funds.
2. Monitoring, inspecting, promptly resolving difficulties and obstacles during the implementation of information technology service leasing activities by agencies and units; summarizing and reporting to the Prime Minister issues exceeding the Ministry of Information and Communications' administrative management authority.
3. Monitoring and inspecting the implementation programs, plan information technology applications, ensuring focused investment, meeting objectives, and achieving effectiveness. Organizing inspections according to plans and spot checks for compliance with regulations set forth in
4. this Decree 5. Requesting and urging provincial People's Committees to implement monitoring and inspecting the implementation of programs and plans for information technology applications, ensuring focused investment, meeting objectives, and achieving effectiveness; inspecting compliance with regulations set forth in this Decree and related laws concerning projects within their management scope..
6. Reviewing systems of norms within its management authority; timely amending, supplementing, and issuing norms in accordance with practical situations, scientific and technological progress, ensuring economy and preventing waste.
Taking the lead and coordinating with relevant agencies to issue technical standards, economic-technical norms for information technology applications.

3. Inspect compliance with the provisions of this Decree by organizations and individuals participating in managing investment in the application of information technology using state budget funds within their scope of management.
4. Bear other responsibilities as prescribed by relevant laws concerning the management of investment in the application of information technology using state budget funds.
5.[87] Issue, guide, inspect, and supervise the implementation of technical standards, technical norms, economic-technical quotas, and special unit prices for the application of information technology specific to industries and localities under the management of ministries, central agencies, and local authorities.
6.[88] Allocate and ensure regular funding from the state budget to implement activities related to the application of information technology in accordance with the provisions of Article 40 2. Taking the lead in submitting to competent authorities for issuance or issuing guidance within its authority regarding payment and settlement of information technology application activities using regular budget expenditures.
Article 61. Responsibilities of Specialized Units on Information Technology Subordinate to Provincial People's Committees and District People's Committees
1. Responsibilities of specialized units on information technology subordinate to provincial people's committees
a) Submit to the Chairman of the provincial people's committee for issuance of guiding documents to implement legal normative documents on managing investment in the application of information technology using state budget funds at the local level;
b) Guide district people's committees, organizations, and individuals participating in managing investment in the application of information technology using state budget funds at the local level;
c) Assist the provincial people's committee in monitoring and inspecting the implementation of programs and plans for the application of information technology at the local level to ensure focused investment, in accordance with objectives, and with effectiveness;
d) Assist the provincial people's committee in inspecting compliance with the provisions of this Decree and relevant laws concerning investment in the application of information technology using state budget funds at the local level;
đ) Review the basic design in accordance with Clause 2, Article 20 of this Decree;
e) Review the detailed design in accordance with Point c, Clause 2, Article 22 of this Decree;
g) Report to the provincial people's committee on the implementation of programs and plans for the application of information technology, compliance with the provisions of this Decree, and relevant laws concerning investment in the application of information technology using state budget funds at the local level.
2. The district people's committee shall be responsible
a) Guide commune people's committees, organizations, and individuals participating in managing investment in the application of information technology using state budget funds within their scope of management;
b) Inspect compliance with the provisions of this Decree and relevant laws concerning investment in the application of information technology using state budget funds within their scope of management;
c) Coordinate with specialized units on information technology subordinate to the provincial people's committee to inspect activities related to investment in the application of information technology using state budget funds when requested.
Article 61a. Responsibilities of agencies, units, and appraisal boards [89]
1. Conduct independent and objective activities when conducting appraisals.
2. Request the project owner and the unit submitting for appraisal to provide complete files and documents related to the matters being appraised and to explain about the contents submitted for appraisal (if necessary).
3. Maintain confidentiality of information and documents related during the appraisal process.
4. Provide information and documents related upon request from competent authorities, inspection bodies, auditing bodies, and other state management bodies as prescribed.
5. Be responsible under the law and before competent authorities for the results of the appraisal and the tasks assigned according to this Article.
6. Fulfill other responsibilities as prescribed in this Decree and other relevant laws.
Article 61b. Responsibilities of organizations and individuals participating in investment activities applying information technology [90]
1. Request the project owner and the tenderer to provide information and documents related to the performance of tasks within the scope of the contract signed between the parties.
2. Perform tasks to ensure quality and quantity according to the contract signed between the parties and relevant legal regulations.
3. Be responsible for the results of their participation in investment activities applying information technology according to the provisions of the law.
Chapter V. IMPLEMENTING PROVISIONS[91]
Article 62. Effect of enforcement
1. This Decree shall take effect from January 1, 2020.
2. This Decree replaces Government Decree No. 102/2009/NĐ-CP dated November 6, 2009 on the management of investment in the application of information technology using state budget funds and abolishes Decision No. 80/2014/QĐ-TTg dated December 30, 2014 of the Prime Minister on pilot leasing of information technology services in state agencies.
Article 63. Transitional Provisions
1. Information technology projects approved before the effective date of this Decree and currently underway shall be implemented according to the management regulations for investment and leasing of information technology services at the time of approval.
In cases where it is necessary to apply the provisions of this Decree, the authorized person shall consider and decide to ensure that the work is not interrupted.
2. Information technology projects approved before the effective date of this Decree but not yet commenced or have been prepared and appraised but not yet approved before the effective date of this Decree, subsequent steps shall be carried out according to the provisions of this Decree.
Article 64. Responsibility for Implementation
1. The Minister, Head of a ministry-level agency, Head of a government agency, Head of another central agency, Chairman of the People's Committee of provinces and centrally governed cities are responsible for implementing this Decree.
2. During the implementation of the contents of this Decree, if there are difficulties or obstacles, agencies, organizations, and individuals need to promptly reflect them to the Ministry of Information and Communications for consideration and guidance or to compile reports for competent authorities.
3. The Ministry of Information and Communications shall take the lead and coordinate with relevant ministries, central agencies to assume responsibility for guiding and organizing the implementation of this Decree./.

[1] Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước có căn cứ ban hành như sau:

Căn cứ Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;
Căn cứ Luật Công nghệ thông tin ngày 29 tháng 6 năm 2006;
Căn cứ Luật Giao dịch điện tử ngày 22 tháng 6 năm 2023;
Căn cứ Luật Đấu thầu ngày 23 tháng 6 năm 2023;
Căn cứ Luật Đầu tư công ngày 13 tháng 6 năm 2019;
Căn cứ Luật Ngân sách nhà nước ngày 25 tháng 6 năm 2015;

[2] Điều này được sửa đổi, bổ sung theo quy định tại khoản 1 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[3] Khoản này được sửa đổi, bổ sung theo quy định tại điểm a khoản 2 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[4] Khoản này được sửa đổi, bổ sung theo quy định tại điểm b khoản 2 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[5] Khoản này được sửa đổi, bổ sung theo quy định tại điểm c khoản 2 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.

[15] Cụm từ “Dự án ứng dụng công nghệ thông tin” được thay thế, bãi bỏ bằng cụm từ “Dự án đầu tư ứng dụng công nghệ thông tin” theo quy định tại điểm a khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[16] Cụm từ “Khung Kiến trúc Chính phủ điện tử Việt Nam, Kiến trúc Chính phủ điện tử cấp bộ hoặc Kiến trúc Chính quyền điện tử cấp tỉnh” được thay thế, bãi bỏ bằng cụm từ “Khung kiến trúc Chính phủ điện tử, Chính phủ số hoặc khung kiến trúc số cấp bộ hoặc khung kiến trúc số cấp tỉnh” theo quy định tại điểm b khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[17] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 4 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[18] Điều này được bổ sung theo quy định tại khoản 5 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[19] Cụm từ “Dự án ứng dụng công nghệ thông tin” được thay thế, bãi bỏ bằng cụm từ “Dự án đầu tư ứng dụng công nghệ thông tin” theo quy định tại điểm a khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024
[20] Điều này được sửa đổi, bổ sung theo quy định tại khoản 6 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.

[23] Cụm từ “người có thẩm quyền” được thay thế, bãi bỏ bằng cụm từ “cấp có thẩm quyền” theo quy định tại điểm c khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[24] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 8 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.

[42] Cụm từ “Khung Kiến trúc Chính phủ điện tử Việt Nam, Kiến trúc Chính phủ điện tử cấp bộ hoặc Kiến trúc Chính quyền điện tử cấp tỉnh” được thay thế, bãi bỏ bằng cụm từ “Khung kiến trúc Chính phủ điện tử, Chính phủ số hoặc khung kiến trúc số cấp bộ hoặc khung kiến trúc số cấp tỉnh” theo quy định tại điểm b khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[43] Khoản này được bổ sung theo quy định tại khoản 18 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.

[67] Điều này được bãi bỏ theo quy định tại điểm b khoản 2 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.

[70] Điều này được sửa đổi, bổ sung theo quy định tại khoản 28 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[71] Điều này được bổ sung theo quy định tại khoản 29 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[72] Điều này được sửa đổi, bổ sung theo quy định tại khoản 30 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[73] Điều này được sửa đổi, bổ sung theo quy định tại khoản 31 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[74] Điểm này được sửa đổi, bổ sung theo quy định tại điểm a khoản 32 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[75] Khoản này được bổ sung theo quy định tại điểm b khoản 32 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[76] Điểm này được sửa đổi theo quy định tại điểm a khoản 33 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[77] Điểm này được sửa đổi theo quy định tại điểm b khoản 33 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[78] Điều này được sửa đổi, bổ sung theo quy định tại khoản 34 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[79] Điểm này được sửa đổi, bổ sung theo quy định tại điểm a khoản 35 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[80] Điểm này được sửa đổi, bổ sung theo quy định tại điểm b khoản 35 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[81] Tên Chương này được sửa đổi, bổ sung theo quy định tại khoản 36 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[82] Khoản này được sửa đổi, bổ sung theo quy định tại điểm a khoản 37 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[83] Khoản này được bổ sung theo quy định tại điểm b khoản 37 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[84] Khoản này được bổ sung theo quy định tại điểm c khoản 37 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[85] Khoản này được bổ sung theo quy định tại điểm d khoản 37 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[86] Điều này được bổ sung theo quy định tại khoản 38 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[87] Khoản này được bổ sung theo quy định tại điểm a khoản 39 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[88] Khoản này được bổ sung theo quy định tại điểm b khoản 39 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[89] Điều này được bổ sung theo quy định tại khoản 40 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[90] Điều này được bổ sung theo quy định tại khoản 41 Điều 1 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[91] Điều 3 và Điều 4 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024 quy định như sau:
“Điều 3. Hiệu lực thi hành và quy định chuyển tiếp
1. Hiệu lực thi hành
a) Nghị định này có hiệu lực thi hành từ ngày ký ban hành;
b) Quy định tại khoản 3 Điều 5a Nghị định này có hiệu lực thi hành khi bộ, cơ quan trung ương công bố danh mục và chức năng, tính năng kỹ thuật cơ bản của phần mềm phổ biến quốc gia, phần mềm phổ biến ngành, chuyên ngành, lĩnh vực;
c) Đối với các quy định yêu cầu tuân thủ Khung kiến trúc Chính phủ điện tử, Chính phủ số hoặc khung kiến trúc số cấp bộ hoặc khung kiến trúc số cấp tỉnh tại Nghị định này, trường hợp tại thời điểm có hiệu lực thi hành của Nghị định này mà Chính phủ chưa ban hành quy định về Khung kiến trúc tổng thể quốc gia số thì các cơ quan, đơn vị có dự án đầu tư ứng dụng công nghệ thông tin, hoạt động ứng dụng công nghệ thông tin tiếp tục thực hiện tuân thủ theo Khung Kiến trúc Chính phủ điện tử Việt Nam, Kiến trúc Chính phủ điện tử cấp bộ hoặc Kiến trúc Chính quyền điện tử cấp tỉnh.”
Khoản 2 Điều 3 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024 quy định như sau:
“2. Quy định chuyển tiếp
Dự án đầu tư ứng dụng công nghệ thông tin, các hoạt động ứng dụng công nghệ thông tin được phê duyệt trước ngày Nghị định này có hiệu lực thi hành thì các bước tiếp theo thực hiện theo các quy định về quản lý đầu tư ứng dụng công nghệ thông tin tại thời điểm phê duyệt.”
Điều 4. Trách nhiệm tổ chức thực hiện
1. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Thủ trưởng cơ quan khác ở trung ương, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương có trách nhiệm thi hành Nghị định này.
2. Trong quá trình thực hiện các nội dung của Nghị định này, nếu có khó khăn, vướng mắc, các cơ quan, tổ chức, cá nhân cần phản ánh kịp thời về Bộ Thông tin và Truyền thông để xem xét hướng dẫn hoặc tổng hợp báo cáo cấp có thẩm quyền.”
[92] Cụm từ “chi phí thiết bị” được thay thế, bãi bỏ bằng cụm từ “chi phí trang thiết bị” theo quy định tại điểm đ khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[93] Phụ lục này được bổ sung theo quy định tại điểm a khoản 42 Điều 1 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[94] Phụ lục này được bổ sung theo quy định tại điểm b khoản 42 Điều 1 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[95] Phụ lục này được bổ sung theo quy định tại điểm c khoản 42 Điều 1 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[96] Cụm từ “chi phí thiết bị” được thay thế, bãi bỏ bằng cụm từ “chi phí trang thiết bị” theo quy định tại điểm đ khoản 1 Điều 2 Nghị định số 82/2024/NĐ-CP ngày 10 tháng 7 năm 2024 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
[97] Phụ lục này được bổ sung theo quy định tại điểm d khoản 42 Điều 1 Nghị định số 82/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 73/2019/NĐ-CP ngày 05 tháng 9 năm 2019 của Chính phủ quy định quản lý đầu tư ứng dụng công nghệ thông tin sử dụng nguồn vốn ngân sách nhà nước, có hiệu lực kể từ ngày 10 tháng 7 năm 2024.
