Regarding the payment of annual membership fees for international organizations
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Ordinance on the Conclusion and Implementation of International Treaties of Vietnam dated October 17, 1989;
At the proposal of the Minister of Foreign Affairs and the Minister of Finance,
DECISION:
Article 1. The international organizations referred to in this Decision include: the United Nations, regional organizations, sub-regional organizations, and specialized international associations.
Article 2. Participation in international organizations in the name of the State, in the name of the Government, or in the name of sectoral agencies of Ministries, agencies at the level of Ministries, agencies under the Government, central agencies of political-social organizations, social organizations, and occupational social organizations (referred to as agencies) must be authorized by the competent authority and based on relevant international treaties signed or joined by Vietnam.
Article 3. Vietnamese agencies that have been authorized to join international organizations must fully perform their rights and obligations as members, including the responsibility to pay annual membership fees according to the regulations of the international organizations they join.
Article 4. The use of state budget funds to pay annual membership fees for international organizations shall only be considered and applied to Ministries, agencies at the level of Ministries, agencies under the Government, and political-social organizations joining non-commercial and service-oriented international organizations, with the contribution amount determined from the outset in the document requesting permission to join. During the process of participation and implementation of international treaties, if international organizations request an increase in the annual membership fee, participating agencies must notify and seek written opinions from the Ministry of Foreign Affairs and the Ministry of Finance, consolidate and submit to the Prime Minister for decision, except for international organizations where member contributions are made according to a coefficient.
Article 5. Agencies mentioned in Article 3 of this Decision joining specialized international organizations with commercial and service characteristics, and social and occupational social organizations joining international organizations shall bear the costs themselves (through voluntary contributions from members or revenue from production and business activities after fulfilling tax obligations to the state budget of enterprises benefiting from the participation of these organizations) to pay annual membership fees for those international organizations. In special cases where the participation of these organizations is linked to state tasks, part of the funding may be provided by the state budget, but this must be approved by the Prime Minister based on the recommendation of the participating agency and written opinions from the Ministry of Foreign Affairs and the Ministry of Finance.
Article 6. Agencies eligible to use state budget funds to pay annual membership fees for international organizations must include such expenses in their annual budget estimates and submit them for approval according to regulations.
Article 7. The Ministry of Finance shall take the lead and coordinate with agencies using state budget funds to pay annual membership fees for international organizations to prepare budgets by sector, balance them into the general budget, and submit them to the Government for submission to the National Assembly for approval.
Article 8. Annually, agencies participating in international organizations must report to the Prime Minister on their participation in international organizations and the implementation of signed international treaties, while also notifying the Ministry of Foreign Affairs and the Ministry of Finance for monitoring.
Article 9. The Ministry of Foreign Affairs is the focal agency assisting the Government in managing the implementation of international treaties and participation in international organizations by Vietnamese agencies; it will cooperate with the Ministry of Finance and relevant ministries and sectors to inspect compliance with committed obligations and evaluate the effectiveness of participation in international organizations by participating agencies. For international organizations where Vietnamese agencies' participation is ineffective, the Ministry of Foreign Affairs, together with the Ministry of Finance, will review and recommend to the Prime Minister to terminate the participation of these agencies.
Article 10. This Decision takes effect fifteen days after its issuance. All previous provisions contrary to this Decision are hereby abolished. Ministers, heads of agencies at the level of Ministries, heads of agencies under the Government, and leaders of central agencies of mass organizations are responsible for implementing this Decision.
