DECISION
Regarding the delegation of authority to approve budgets and tender plans, and the results of consulting bids for the Forest Protection and Rural Development Project
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government on the issuance of regulations on investment management and construction;
Pursuant to Decree No. 88/1999/NĐ-CP dated September 1, 1999 of the Government on the issuance of bidding regulations;
Pursuant to Decision No. 71/1999/QĐ/BNN-TCCB dated May 3, 1999 of the Minister of Agriculture and Rural Development on the issuance of regulations on the implementation of the Forest Protection and Rural Development Project;
Pursuant to Decision No. 179/1999/QĐ/BNN-TCCB dated December 27, 1999 of the Minister of Agriculture and Rural Development on the delegation of authority to approve project budgets for Forest Protection and Rural Development;
Considering the proposal of the Director of the Forestry Project Management Board at Circular No. 743 CV/DALN-WB1 dated September 22, 2000;
In accordance with the proposals of the Heads of the Personnel and Organization Department, the Basic Construction Investment Department, and the Finance and Accounting Department.
DECISION:
Article 1- Delegating authority to the People's Committees of provinces where projects are located:
1. To approve budgets, tender plans, bid evaluation results, and service contracts regarding land use planning and allocation, forest protection, and agricultural and forestry extension services based on current cost standards of the General Land Administration and guidance documents of the Ministry of Agriculture and Rural Development for field activities.
2. To approve budgets, tender plans, bid evaluation results, and service contracts for other construction works valued up to VND 1 billion and procurement of goods valued up to VND 500 million based on plans approved by the Ministry of Agriculture and Rural Development.
3. To approve contracts between the provincial project management board and mass organizations in project areas for construction and repair of Class IV buildings; technical roads grade 20, valued not exceeding VND 100 million based on plans approved by the Ministry of Agriculture and Rural Development.
4. To approve village action plans in project areas within the scope of project activities, after obtaining comments from the World Bank and the Central Project Management Board.
Article 2- Before submitting to the Provincial People's Committee for decision, the provincial project management boards must review and compare with signed agreements, World Bank regulations, state regulations, and written opinions of the Central Project Management Board.
Article 3.- THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
Article 4.- The Head of the Ministry's Office, Heads of the Personnel and Organization Department, Finance and Accounting Department, Basic Construction Investment Department, Heads of related units, Directors of the Forestry Project Management Board, and Central and local Project Management Boards for Forest Protection and Rural Development are responsible for implementing this decision./.
