Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;
Pursuant to Decision No. 45/2007/QD-TTg dated April 3, 2007 of the Government Chairman on the management authority over cadres of Industrial Zone Management Boards, Export Processing Zone Management Boards, High-Tech Park Management Boards, Economic Zone Management Boards, and other Management Boards under the Ministry and People's Committees of provinces and centrally governed cities;
Considering the proposal of the Chairman of the People's Committee of Ha Giang Province at Report No. 123/TT-UBND dated July 9, 2008 and the Minister of Home Affairs at Report No. 2140/TT-BNV dated July 21, 2008,
DECISION:
Article 1. Establishing the Management Board for Industrial Zones in Ha Giang Province
1. The Management Board for Industrial Zones in Ha Giang Province (hereinafter referred to as the Management Board) is a state administrative agency directly subordinate to the People's Committee of Ha Giang Province, performing the function of direct state administration over industrial zones within the territory of Ha Giang Province in accordance with the provisions of Decree No. 29/2008/ND-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones and relevant laws; managing and organizing the provision of administrative public services and other supporting services related to investment and business operations for investors in industrial zones within the territory of Ha Giang Province.
2. The Management Board has legal personality, a bank account, office premises, and a seal with the national emblem; it is the budget planning focal point of the People's Committee of Ha Giang Province, and its basic construction capital from the state budget is balanced separately; it is subject to the direction and management of organization, staffing, programs, work plans, and operational funding by the People's Committee of Ha Giang Province.

The Management Board performs tasks and powers as prescribed in:
1. Article 81 of Decree No. 108/2006/ND-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law.
2. Article 37 of Decree No. 29/2008/ND-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones.
3. Other tasks and powers assigned by the People's Committee of Ha Giang Province.
The People's Committee of Ha Giang Province shall specify the functions, tasks, powers, and organizational structure of the Management Board for Industrial Zones in Ha Giang Province in accordance with the provisions of the law.
Article 3. Organizational structure and staffing of the Management Board
1. Organizational Structure:
a. The Management Board has a Director and two Deputy Directors appointed and relieved of their duties by the Chairman of the People's Committee of Ha Giang Province in accordance with the provisions of the law.
b. The Management Board has an assisting apparatus including: an office, specialized departments.
c. Affiliated service units.
Depending on the requirements of management and development of industrial zones in the province at each stage, the Director of the Management Board for Industrial Zones in Ha Giang Province shall submit to the Chairman of the People's Committee of Ha Giang Province for decision on the organizational structure of the Management Board.
2. Staffing:
The staffing of the Management Board shall be decided by the Chairman of the People's Committee of Ha Giang Province in accordance with the provisions of the law on the decentralization of administrative and service staffing management and the staffing management mechanism for state-owned service units.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision shall take effect from the date of issuance.
2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Ha Giang Province, and the Director of the Management Board for Industrial Zones in Ha Giang Province are responsible for implementing this Decision./.
