Decision No. 1107/QD-TTg Approving the Master Plan for the Development of Industrial Zones in Vietnam until 2015 and Orientations until 2020

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Considering the proposal of the Minister of Planning and Investment.

DECISION:

Article 1. Approve the Master Plan for the Development of Industrial Zones in Vietnam until 2015 and orientations until 2020 with the main contents as follows:

1. Objectives:

a) General Objective:

The goal of developing industrial zones in Vietnam until 2015 and orientations until 2020 is to form a system of leading industrial zones playing a guiding role in national industrial development, while forming industrial zones of reasonable scale to create conditions for industrial development, thereby shifting the economic structure in localities where the proportion of industry in GDP is low.

Increase the contribution rate of industrial zones to total industrial production value from over 24% currently to about 39-40% in 2010 and above 60% in the subsequent period. Raise the export ratio of industrial products from industrial zones from 19.2% of the country's total export value currently to about 40% in 2010 and higher in subsequent periods.

b) Specific Objectives:

- Period until 2010:

+ Strive to basically fill existing industrial zones by 2010; establish new industrial zones selectively with an additional area of approximately 15,000 ha - 20,000 ha, bringing the total area of industrial zones to about 45,000 ha - 50,000 ha by 2010.

+ Invest comprehensively to complete infrastructure projects in existing industrial zones, particularly wastewater treatment facilities and ensure green space areas in industrial zones according to approved construction plans to protect the environment and promote sustainable development.

- Period until 2015:

+ Invest comprehensively to complete existing industrial zones, establish new industrial zones selectively with an additional total area of approximately 20,000 ha - 25,000 ha; bring the total area of industrial zones to about 65,000 ha - 70,000 ha by 2015. Strive to achieve an average occupancy rate of over 60% across the country.

+ Implement measures and policies to adjust the industrial sector structure in existing and under-construction industrial zones towards modernization suitable for the characteristics and specific features of territorial areas.

+ Construct large-scale centralized industrial waste disposal facilities in regions with concentrated industrial zones in key economic zones.

+ Continue to improve mechanisms and policies to encourage investment in industrial zones, striving to attract an additional 6,500 - 6,800 projects with registered total investment capital of approximately 36 - 39 billion USD, of which actual investment is about 50%.

- Period until 2020:

+ Manage well and reasonably plan the land reserve area for building industrial zones.

+ Complete the basic network of industrial zones across the entire territory with a total area of industrial zones reaching about 80,000 ha by 2020.

+ Manage and adjust the investment development structure of established industrial zones towards synchronization.

2. The formation of industrial zones in territorial areas must meet the following conditions and criteria:

- Consistent with planning, plans, and economic and social development situations; land use planning and plans of each locality.

- Possess favorable conditions or have the ability to build technical infrastructure and social infrastructure systems, implement comprehensively and closely integrate the development planning of industrial zones and export processing zones with urban development planning, population distribution, housing, and social facilities serving workers in industrial zones and export processing zones.

- Have land reserves for development and conditions to link into clusters of industrial zones; specifically, for purely agricultural localities, when developing industrial zones to achieve economic restructuring goals, it is necessary to conduct phased investments strictly to ensure effective land use.

- Have the ability to attract domestic and foreign investors' capital.

- Have the ability to provide and meet labor demand.

- Ensure requirements for security and defense.

- For localities that have developed industrial zones, establishing new industrial zones can only be carried out when at least 60% of the total industrial land area of existing industrial zones has been leased.

- Expanding existing industrial zones can only be carried out when at least 60% of the total industrial land area of that industrial zone has been leased and centralized wastewater treatment facilities have been completed.

- For industrial zones with an area exceeding 500 ha and multiple investors participating in the construction and operation of infrastructure, a general construction plan for the industrial zone must be prepared in accordance with the guidelines of the Ministry of Construction before preparing detailed plans for the industrial zone to ensure the consistency and synchronization of the technical infrastructure system of the industrial zone.

- In industrial zones and export processing zones, there shall be no residential areas. In industrial zones, there may be export processing zones and export-oriented enterprises.

3. Attach to this Decision the List of 115 Priority New Industrial Zones to be Established Until 2015 (Annex I) and the List of 27 Industrial Zones to be Expanded (Annex II). These lists do not include industrial zones within economic zones approved by the Prime Minister for overall planning.

Article 2. Implementation

1. Publicize the master plan:

Announce publicly the Master Plan for the Development of Industrial Zones in Vietnam until 2015 and orientations until 2020 after its approval.

2. Supplement and adjust the master plan:

On the basis of the conditions and criteria for establishing new and expanding industrial zones as stipulated in this Decision and based on the proposals of the People's Committees of provinces and centrally governed cities, the Ministry of Planning and Investment shall take the lead, coordinate with the Ministry of Construction and relevant ministries and sectors to examine and submit to the Prime Minister for consideration and decision on supplementing the establishment of new and expansion of industrial zones into the overall planning for the development of industrial zones.

3. Allocation of responsibilities:

- The Ministry of Planning and Investment shall be responsible for monitoring, urging, implementing, and reporting to the Prime Minister on the supplementation and adjustment of the planning when necessary.

- Ministries and sectors shall cooperate with the Ministry of Planning and Investment according to their functions, tasks, and authorities to direct localities to implement the planning.

- The People's Committees of provinces and centrally governed cities shall be responsible for announcing the list of industrial zones within their territorial jurisdiction that have been approved by the Prime Minister and directing the implementation of subsequent steps in accordance with current regulations.

- Relevant ministries and sectors and the People's Committees of provinces and centrally governed cities shall be responsible for planning and constructing technical infrastructure and social infrastructure outside the boundaries of industrial zones in synchronization with the construction of industrial zones.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 4. Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for enforcing this Decision.
