DECREE

REGULATIONS ON THE FOUNDATION DAY, TRADITIONAL DAY, AND RESPONSE DAY OF MINISTRIES, SECTORS, AND LOCALITIES

Pursuant to the Law on Government Organization dated June 19, 2015;

At the proposal of the Minister of Culture, Sports and Tourism;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates:

a) Conditions, authority, and procedures for recognizing the traditional day of ministries, ministerial-level agencies, government agencies; sectors; provinces, centrally governed cities;

b) Organization of activities commemorating the foundation day and traditional day;

c) Conditions and requirements for organizing the response day.

2. For the traditional days of Party Committees and sectors already regulated in other legal documents, the conditions, authority, and recognition procedures set forth in this Decree shall not apply, but the regulations on organizing commemorative activities in this Decree must be implemented.

Article 2. Applicability

This Decree applies to:

1. Ministries, sectors, ministerial-level agencies, government agencies (hereinafter collectively referred to as the ministry level).

2. Provinces, centrally governed cities (hereinafter collectively referred to as the provincial level).

3. Organizations and individuals related to the matter.

Article 3. Explanation of Terms

In this Decree, the following terms shall be understood as follows:

1. The foundation day is the historical date marked by the establishment document issued by the competent authority.

2. The traditional day is the date marking a memorable event, the formation or development process recorded, with continuity and inheritance.

3. The response day is the specific time (day, hour) determined to focus on a particular theme to organize activities calling for community participation and support through actions.

4. The re-establishment day is the date marked by the establishment document issued by the competent authority following a separation, merger, or dissolution process.

5. A round year is a year ending in "0".

6. An odd year is a year ending in any other digits.

Article 4. Principles for organizing commemorative activities for the foundation day and traditional day

1. Commemorative activities must be solemn, safe, economical, and not ostentatious or formalistic.

2. Commemorative activities for the foundation day and traditional day can only be organized when there is an establishment document or a decision recognizing such days from the competent authority.

3. Only anniversary years may be chosen for commemoration. In cases where a ministry, sector, or province has both a foundation day, re-establishment day, and traditional day, only one of these days may be selected for commemoration.

4. No gifts or receptions may be organized during commemorative activities.

Chapter II

RECOGNITION OF TRADITIONAL DAYS

Article 5. Conditions and authority for recognizing traditional days

1. Conditions for recognizing traditional days

a) Historical documents showing a specific date marked by a memorable event;

b) The date of the memorable event must be at least 10 years prior to the request for recognition;

c) It must have educational value regarding historical traditions and significance for the ministry, sector, or locality.

2. The Prime Minister decides on the recognition of the traditional day of ministries, sectors, and provincial levels.

Article 6. Documents for requesting recognition of traditional days

1. Official letter requesting recognition of the traditional day.

2. Explanation of the necessity, educational value, and significance of recognizing the traditional day.

3. Copies of documents proving the establishment or the date of the memorable event.

4. Approval document from the approving agency.

5. Report explaining and incorporating comments from the review process.

Article 7. Authority for Review and Content of Review of Recognition Application for Traditional Day

1. The Ministry of Culture, Sports and Tourism is responsible for reviewing recognition application files for traditional days.

2. Content of review of application file

a) Completeness and legality of the file;

b) Accuracy of supporting documents;

c) Rationality and necessity of recognizing the traditional day.

Article 8. Procedure for Recognizing Traditional Days of Ministries, Sectors, and Provincial Levels

1. Ministries, sectors, and provincial levels shall directly submit or send via post or online one set of application file according to the provisions of Clauses 1, 2, and 3 of Article 6 of this Decree to the Ministry of Culture, Sports and Tourism for review.

2. In case the file is incomplete, within three working days from the date of receipt of the file, the Ministry of Culture, Sports and Tourism shall issue a notification requesting supplementary information. Upon receiving the notification, the authority applying for recognition shall supplement the file and send it to the reviewing authority.

3. In case the file is complete, within fifteen days from the date of receipt of the file, the Ministry of Culture, Sports and Tourism shall organize the review of the file and issue a review document, which shall be sent to the authority applying for recognition. If necessary, during the review process, the Ministry of Culture, Sports and Tourism may organize opinions from related agencies or units or request the authority applying for recognition to provide explanations.

4. The review document must clearly state the opinion on the content stipulated in Clause 2 of Article 7 of this Decree and conclude whether the file meets the conditions or not for submission to the Prime Minister for consideration and recognition.

5. After receiving the review document from the Ministry of Culture, Sports and Tourism, the authority applying for recognition has the responsibility to study and build a report with explanations, adopt the review opinions; supplement and perfect the file according to the provisions of Article 6 of this Decree for submission to the Prime Minister for consideration and decision.

Chapter III

ORGANIZATION OF ANNIVERSARY CELEBRATIONS AND REQUIREMENTS FOR ORGANIZING RESPONSE DAYS

Article 9. Organization of Anniversary Celebrations

1. Leap years

a) Ministries, sectors, and provincial levels organize anniversary celebrations and traditional day commemorations by developing plans for commemorative activities, specifying time, location, program, and participants of the celebration ceremony;

b) Approval of plans for organizing commemorative activities:

- The Minister or head of the central agency approves the plan for organizing commemorative activities of ministries and sectors;

- The Chairman of the People's Committee at the provincial level approves the plan for organizing commemorative activities at the provincial level and in localities.

c) The head of ministries, sectors, and provincial levels establishes a Steering Committee and Organizing Board for the anniversary and traditional day celebration ceremony according to the approved plan and is responsible for organizing the ceremony solemnly, practically, effectively, and economically.

2. Other years: Organize promotional, educational, competitive, seminar, discussion, and other practical activities to commemorate the anniversary and traditional day. Do not organize a celebration ceremony.

3. Funding for organizing the anniversary and traditional day is allocated in the annual regular budget estimate of agencies and localities in accordance with the State Budget Law.

Article 10. Celebration and decoration for commemorative ceremonies

1. Commemorative ceremonies shall be organized in conference halls or outdoors.

2. When organized in conference halls (viewed from below towards the stage):

a) The Party Flag and National Flag shall be hung on the left side of the stage; the Party Flag on the left and the National Flag on the right;

b) A bust of President Ho Chi Minh shall be placed on a high platform directly below between the Party Flag and the National Flag. In cases where flags are hung on flagpoles, the bust of President Ho Chi Minh shall be placed slightly to the front right of the flagpole;

c) The title of the ceremony shall be displayed in formal capital letters on a backdrop on the right side of the stage. The name of the place and the date of the commemorative ceremony shall be shown in regular slanted letters at the bottom of the ceremony title;

Where there is content related to awarding or receiving commendation titles or forms of reward, the highest commendation title or form of reward received must be fully recorded;

d) The speaking platform shall be placed at a position one-third of the width of the stage from the right to the left;

đ) Decorative flowers shall be placed below and in front of the bust of President Ho Chi Minh; flower baskets presented by leaders of the Party, State, and Vietnam Fatherland Front shall be placed in prominent positions; the placement of flower baskets and potted plants must be appropriate to the space of the stage, ensuring aesthetic appeal;

e) The slogan of the ceremony shall be hung in a prominent position suitable to the space of the conference hall. The content of the slogan shall be decided by the Organizing Committee;

g) Outside the conference hall, flags, banners, and slogans shall be decorated to create an appropriate atmosphere for the ceremony;

3. When organized outdoors:

a) Outdoor commemorative ceremonies shall be held in squares, stadiums, or other dignified locations as decided by the Organizing Committee;

b) The stage shall be designed securely and decorated similarly to indoor arrangements. If the area around the stage already has a bust or image of President Ho Chi Minh, the provisions of point b, Clause 1, Article 10 shall not apply. If there is a flagpole in front of the stage, the National Flag shall be hung on the flagpole and not on the stage.

Article 11. Attire of participants in commemorative ceremonies

1. The attire of members of the Organizing Committee, delegates, guests, and mass participants attending the ceremony shall be formal, appropriate, and in accordance with the regulations of the Organizing Committee;

2. Guests, delegates, and mass participants are encouraged to wear traditional costumes, religious ceremonial attire, or military uniforms;

3. Guests, delegates, and mass participants are encouraged to wear medals and orders;

Article 12. Delegates and guests attending commemorative ceremonies

1. Delegates and guests attending commemorative ceremonies shall be decided by the organizing unit; the number of guests shall be appropriate to the scale and conditions of organizing the ceremony;

2. In cases where the highest leaders of the Party and State are invited, the organizing unit shall invite no more than two out of four individuals: General Secretary, President, Prime Minister, and Chairman of the National Assembly;

3. Guests shall be seated according to their rank, from the center to both sides, and from the front to the back;

Article 13. Rituals of commemorative ceremonies

1. The rituals of organizing commemorative ceremonies shall be conducted in the following sequence:

a) Announcing the program of the commemorative ceremony;

b) Flag-raising ceremony and national anthem singing by the delegates;

c) Declaration of reasons and introduction of delegates and guests in the following order:

- Introducing the names of senior delegates attending the commemorative ceremony;

- Introducing representatives of the agencies, units, or groups of invited officials;

- Introducing the highest-ranking current position holder (head of the unit organizing the ceremony);

- When introduced, the delegate with the highest rank shall stand up and bow (the delegates attending the ceremony shall clap);

d) Commemorative speech;

đ) Announcement and presentation of commendation decisions (if applicable);

e) Speeches by senior delegates (if applicable);

g) Response speech by the head of the unit organizing the ceremony;

h) Declaration of the conclusion of the ceremony;

2. The conduct of the rituals specified in Clause 1 of this Article shall be carried out by the Organizing Committee of the commemorative ceremony.

Article 14. Conditions and scale for organizing response days

1. Agencies, organizations, units may organize response days if they meet one of the following conditions:

a) Vietnam's participation in international treaties or events called upon by the international community;

b) The theme of the response day is necessary and meets the requirements for economic and social stability and development of the country and locality.

2. The plan to organize the response day must clearly state the scale, time, location, form, and content of the program.

3. Authority to approve the plan to organize the response day

a) National-scale response days are approved by the ministry managing the relevant sector or field;

b) Provincial, district, commune-level response days are approved by the People's Committee of the province.

Article 15. Requirements for organizing response days

1. Ensure practicality, thriftiness, effectiveness, and utilize resources from socialized activities.

2. The overall program, content, and form of promotional messages must comply with ethical, cultural, traditional, and customary standards of the Vietnamese people.

3. Events such as rallies, parades, conferences, seminars, and other activities during the response day must be conducted in accordance with the law, ensuring security, public order, traffic safety, environmental protection, and social safety.

Chapter IV

IMPLEMENTING PROVISIONS

Article 16. Responsibility for Implementation

1. The Ministry of Culture, Sports and Tourism is responsible for assisting the Government in uniformly managing the recognition and organization of anniversary celebrations, traditional days, and response days.

2. Ministries, agencies at the ministerial level, government agencies, provincial People's Committees directly under the central government are responsible to the Government for organizing anniversary celebrations, traditional days, and response days of their respective units and localities.

3. The Ministry of Defense and the Ministry of Public Security are responsible for guiding special aspects related to rituals for organizing anniversary celebrations and traditional days of the people's armed forces.

Article 17. Transitional Provisions

For established anniversary days and traditional days that have been recognized or decided by competent authorities before this Decree takes effect, there is no need to go through the procedures and formalities for re-recognition.

Article 18. Effective Date

1. This Decree takes effect from October 15, 2018.

2. Abolish the provisions regarding the organization of anniversary celebrations and traditional days of ministries, provinces, and centrally-administered municipalities in Article 17, Chapter 4 of Decree No. 145/2013/NĐ-CP dated October 29, 2013 of the Government on the organization of commemorative days; the ritual of awarding and receiving commendations and titles; and foreign diplomatic ceremonies and reception of foreign guests.

3. Ministers, heads of agencies at the ministerial level, heads of government agencies, Chairmen of provincial and centrally-administered municipal People's Committees, and related agencies and organizations are responsible for implementing this Decree./.
