Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;
Pursuant to Decision No. 103/2008/QĐ-TTg dated July 21, 2008 of the Prime Minister approving the Project "Supporting Youth Vocational Training and Employment Creation for the 2008-2015 Period";
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Circular No. 4017/VPCP-TH dated June 11, 2010 of the Government Office on implementing the Project Supporting Youth Vocational Training and Employment Creation;
Considering the proposal of the Director of the Department of Administrative and Public Financial Affairs;
The Minister of Finance issues this Circular amending and supplementing certain provisions of Circular No. 101/2009/TT-BTC dated May 20, 2009 of the Ministry of Finance guiding management, use, and settlement of funds to ensure implementation of projects and programs under the Project "Supporting Youth Vocational Training and Employment Creation for the 2008-2015 Period".
Article 1. Amending and supplementing certain provisions of Circular No. 101/2009/TT-BTC dated May 20, 2009 of the Ministry of Finance guiding management, use, and settlement of funds to ensure implementation of projects and programs under the Project "Supporting Youth Vocational Training and Employment Creation for the 2008-2015 Period":
1. Clause 3 of Article 1 shall be amended and supplemented as follows:
"Article 1. General Provisions
3. Sources of funds:
a) Funds for implementing the project "Enhancing awareness among youth and society about vocational training and career establishment"; the project "Consulting and supporting youth to start businesses and establish careers"; the program "Monitoring and evaluating the implementation of state policies on vocational training and employment creation for youth";
- The central budget shall ensure funding for the implementation of the project and program for tasks carried out by the Central Committee of the Ho Chi Minh Communist Youth Union from the economic affairs expenditure allocated to the Central Committee of the Ho Chi Minh Communist Youth Union and other legitimate sources.
- The local budget shall ensure funding for the implementation of the project and program for tasks implemented at the local level.
b) Funds for implementing the project "Investment in building model vocational guidance, training, and youth employment introduction centers of the Youth Union";
- The central budget shall allocate funds from the National Target Program on Employment and Vocational Training to build model vocational guidance and youth employment introduction centers of the Youth Union through the Central Committee of the Ho Chi Minh Communist Youth Union according to feasible projects approved by competent authorities.
- Localities shall provide land for construction of the center and ensure regular operating funds for the center's staff from the local budget."
2. Clause 1 of Article 4 shall be amended and supplemented as follows:
"Article 4: Budget preparation, allocation, settlement, and reporting system:
1. Preparation of Budget Estimates:
Annually, based on the guidelines for preparing the state budget issued by the Ministry of Finance, the levels of the Ho Chi Minh Communist Youth Union shall assess the progress of each project and program (according to tasks and funding); based on the workload of each project and program in the annual plan, based on current spending regulations, the levels of the Ho Chi Minh Communist Youth Union shall prepare the budget for implementing the Project according to Decision No. 103/2008/QĐ-TTg dated July 21, 2008 of the Prime Minister, clearly identifying the work content to be implemented from other sources of mobilization and consolidating it into their own agency's budget to submit to the financial, planning, and investment agencies at the same level for consolidation and submission to the competent authority for approval in accordance with current regulations.
For funds for implementing the project "Investment in building model vocational guidance, training, and youth employment introduction centers of the Youth Union" from the National Target Program on Employment and Vocational Training, the Central Committee of the Ho Chi Minh Communist Youth Union shall prepare the budget for implementing the project and submit it to the Ministry of Labor, Invalids, and Social Affairs, which is the managing agency of the Program, for consolidation and submission to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and submission to the Prime Minister and the National Assembly for approval in accordance with regulations."
Article 2. Implementation
This Circular takes effect from September 1, 2012. Other provisions of Circular No. 101/2009/TT-BTC dated May 20, 2009 of the Ministry of Finance guiding management, use, and settlement of funds to ensure implementation of projects and programs under the Project "Supporting Youth Vocational Training and Employment Creation for the 2008-2015 Period" remain in effect.
2. During the implementation process, if there are any difficulties, it is recommended that agencies and units reflect them to the Ministry of Finance for study, amendment, and supplementation to be appropriate./.
