DECREE
ON INTERNATIONAL EXCHANGE OF CLIMATE CHANGE MITIGATION RESULTS AND CARBON CREDITS
BASED ON THE ORGANIZATION LAW OF THE GOVERNMENT No. 63/2025/QH15;
AND THE ENVIRONMENT PROTECTION LAW No. 72/2020/QH14, AMENDED AND ENHANCED BY LAWS Nos. 11/2022/QH15, 16/2023/QH15, 18/2023/QH15, 47/2024/QH15, 54/2024/QH15, AND 146/2025/QH15;
IN ACCORDANCE WITH THE MINISTER OF AGRICULTURE AND ENVIRONMENTAL PROTECTION;
THE GOVERNMENT ISSUES THIS DECREE ON INTERNATIONAL EXCHANGE OF CLIMATE CHANGE MITIGATION RESULTS AND CARBON CREDITS.
CHAPTER I
GENERAL PROVISIONS
Article 1. Scope of Application
This Decree regulates the international exchange of climate change mitigation results and carbon credits with international partners to implement the Paris Agreement under the United Nations Framework Convention on Climate Change, supporting the achievement of national greenhouse gas emission reduction targets and other climate change mitigation targets.Article 2. Applicability
This Decree applies to agencies and organizations implementing international exchanges of climate change mitigation results and carbon credits.
Article 3. Interpretation of Terms
In this Decree, the following terms are interpreted as follows:
1. International exchange of climate change mitigation results and carbon credits refers to activities involving the exchange of climate change mitigation results and carbon credits between Vietnam and international partners within the framework of a cooperation agreement under Article 6.2 of the Paris Agreement (hereinafter referred to as Article 6.2 Agreement) or according to the mechanism specified in Article 6.4 of the Paris Agreement (hereinafter referred to as Article 6.4 Mechanism), or outside the framework of the Article 6.2 Agreement and the Article 6.4 Mechanism.
2. The Paris Agreement is an international treaty within the framework of the United Nations Framework Convention on Climate Change (hereinafter abbreviated as UNFCCC) effective from 2021, which stipulates the responsibilities of member states in adapting to and mitigating greenhouse gas emissions through Nationally Determined Contributions (hereinafter abbreviated as NDC).
3. The Article 6.2 Agreement is an international agreement or arrangement entered into between the Government of the Socialist Republic of Vietnam and a participating party of the Paris Agreement or an international organization to achieve greenhouse gas emission reduction targets in the NDC or other greenhouse gas emission reduction targets, allowing:
a) Transfer of climate change mitigation results and carbon credits from Vietnam to international partners through issuance of Vietnam's international transfer approval document;
b) Transfer of climate change mitigation results and carbon credits from international partners to Vietnam through issuance of the host country's international transfer approval document.
4. The Article 6.4 Mechanism is a mechanism for exchange and offsetting of carbon credits as specified in Article 6.4 of the Paris Agreement, allowing participating agencies and organizations to implement international transfer programs or projects that result in climate change mitigation results and carbon credits to achieve greenhouse gas emission reduction targets in the NDC or other greenhouse gas emission reduction targets.
5. Other greenhouse gas emission reduction targets as provided for in this Decree are greenhouse gas emission reduction targets under international commitments or international treaties outside the greenhouse gas emission reduction targets in the NDC (hereinafter referred to as greenhouse gas emission reduction targets under international treaties and international commitments) or voluntary greenhouse gas emission reduction targets of agencies and organizations.
6. International partners refer to countries, international organizations, foreign organizations, or entities authorized by a country, international organization, or foreign organization that cooperate or exchange climate change mitigation results and carbon credits with Vietnam as provided for in this Decree.
7. Program or project refers to programs or projects that reduce greenhouse gas emissions and generate climate change mitigation results and carbon credits according to carbon standards.
8. Carbon standard is a set of principles, requirements, procedures, processes, and methodologies for generating carbon credits from activities that mitigate greenhouse gas emissions; established and managed by domestic or international agencies or organizations.
9. Article 6.4 Mechanism Oversight Body is an entity established within the framework of UNFCCC to operate the Article 6.4 Mechanism, develop, approve carbon credit creation methodologies, register, approve programs, projects, and manage the Article 6.4 Mechanism's Registry System.
10. The Article 6.4 Mechanism Registry System is a digital database system operated by the Article 6.4 Mechanism Oversight Body to track and manage programs, projects, and carbon credits under the Article 6.4 Mechanism.
11. One unit of climate change mitigation result is a certification that represents the right to emit one ton of CO
or one ton of CO
equivalent, formed from activities that mitigate greenhouse gas emissions but not issued as carbon credits.212. Internationally Transferred Mitigation Outcome (ITMO) is a climate change mitigation result or carbon credit approved for international transfer by the host country's government and subject to corresponding adjustments in accordance with the Paris Agreement's provisions and guidelines.213. Host country refers to the country where the program or project is implemented.
14. Corresponding adjustment means that the host country shall add an equivalent amount of greenhouse gas emissions to its national emission inventory for each ITMO transferred internationally. Such ITMOs are only counted towards the host country's NDC or other climate change mitigation targets. The corresponding adjustments for ITMOs between Vietnam and international partners are carried out on behalf of the Government of the Socialist Republic of Vietnam by the Ministry of Agriculture and Environment Protection.
13. The host country is the country where the program or project is implemented.
14. Corresponding adjustment refers to the action by the host country of adding an equivalent amount of greenhouse gas emissions into the national inventory accounting for emissions reductions corresponding to the quantity of ITMOs transferred. Such quantity of ITMOs shall be counted towards the mitigation target under the NDC or other mitigation targets of the recipient of the transfer. The corresponding adjustment with respect to the quantity of ITMOs between Vietnam and international partners is carried out on behalf of the Government of the Socialist Republic of Vietnam by the Ministry of Agriculture and Environment.
15. The provisions and guidelines of the Paris Agreement include the provisions of the Paris Agreement and decisions and guidelines issued by the Conference of Parties to the Paris Agreement.
16. An international transfer approval document is a document issued by the host country to permit the use of greenhouse gas emission reduction results, carbon credit units obtained within its territory for the purpose of achieving greenhouse gas emission reduction targets in another country's Nationally Determined Contribution (NDC) or other greenhouse gas emission reduction targets. The international transfer approval document of the Government of the Socialist Republic of Vietnam is issued by the Ministry of Agriculture and Rural Development on behalf of the Government.
17. Additionality is a criterion used to evaluate programs and projects that are eligible for generating greenhouse gas emission reduction results, carbon credit units. A program or project is considered to have additionality if it meets all of the following conditions:
a) Demonstrates that the amount of greenhouse gas emissions reduced through the implementation of the program or project exceeds the level of emissions reductions required by current laws or mandatory requirements of the host country;
b) Demonstrates that the program or project applies advanced and superior greenhouse gas emission reduction technologies compared to commonly used technologies in the host country;
c) Demonstrates that the program or project would be difficult to implement or attract investment without technological, financial, or revenue support from the sale of greenhouse gas emission reduction results, carbon credit units.
18. Sustainability is a criterion used to evaluate programs and projects that are eligible for generating greenhouse gas emission reduction results or carbon credit units. A program or project is considered sustainable if it meets all of the following conditions:
a) Demonstrates that the program or project continues to generate greenhouse gas emission reduction results after the end of the carbon credit registration period;
b) Demonstrates that the program or project contributes to the sustainable development goals of the host country.
19. Double counting is the use of the same amount of greenhouse gas emission reduction results, carbon credit units more than once to achieve greenhouse gas emission reduction targets in a Nationally Determined Contribution (NDC) or other greenhouse gas emission reduction targets.
20. Independent carbon standard is a carbon standard established and managed by an international organization or an organization established under foreign law, allowing agencies and organizations to participate in the implementation of programs and projects that generate carbon credits for use and achievement of greenhouse gas emission reduction targets.
21. An independent carbon standards management organization is an international organization or an organization established under foreign law, operating independently; guiding, supervising, approving methods for generating carbon credits, approving programs and projects, issuing carbon credits in accordance with the provisions and procedures of such carbon standard.
Article 4. Principles of International Exchange of Greenhouse Gas Emission Reduction Results, Carbon Credit Units
1. International exchange of greenhouse gas emission reduction results, carbon credit units must ensure:
a) Compliance with the provisions of the Paris Agreement; support for development, technology transfer, enhancement of business competitiveness, and promotion of low-carbon economic development in Vietnam;
b) Prioritization of achieving greenhouse gas emission reduction targets in Vietnam's Nationally Determined Contribution (NDC) and other greenhouse gas emission reduction targets under international treaties and national commitments;
c) Protection of national interests and harmonization of the interests between parties involved, contributing to the sustainable development of the local community where programs or projects are implemented.
2. International exchange activities of greenhouse gas emission reduction results, carbon credit units between Vietnam and international partners must be recorded and published on Vietnam's National Registry System.
Article 5. International Transfer and Corresponding Adjustment Document
1. The Ministry of Agriculture and Environment shall issue an international transfer approval document for greenhouse gas emission reduction results and carbon credit certificates after such results and certificates have been issued.
2. Greenhouse gas emission reduction results and carbon credit certificates that have been revoked or expired may not be transferred internationally.
3. Corresponding adjustments to the quantity of ITMOs between Vietnam and international partners shall be carried out in accordance with the provisions of the Paris Agreement.
Article 6. International Transfer Ratio
1. In cases where there is a corresponding adjustment, the maximum transfer ratio for quantities of greenhouse gas emission reduction results and carbon credit certificates issued during the period of generating such results and certificates shall be as follows:
(a) 90% for programs and projects under measures and activities to reduce greenhouse gas emissions listed in Category No. 01 in Appendix I attached hereto;
(b) 50% for programs and projects under measures and activities to reduce greenhouse gas emissions listed in Category No. 02 in Appendix I attached hereto.
2. In cases where there is no corresponding adjustment, the maximum transfer ratio is 90% of the quantities of greenhouse gas emission reduction results and carbon credit certificates issued for a period during which such results and certificates are generated for all programs and projects.
3. The remaining quantities of greenhouse gas emission reduction results and carbon credit certificates after international transfer may be used for domestic exchanges.
4. Based on practical circumstances, the competent authority shall propose adjustments and supplements to the list of measures and activities to reduce greenhouse gas emissions for international transfer in Appendix I attached hereto, submit such proposals to the Ministry of Agriculture and Environment for consolidation, and report to the Prime Minister for examination and decision.
Article 7. Sale of Greenhouse Gas Emission Reduction Results and Carbon Credit Certificates from Public Investment Programs and Public-Private Partnership Projects
1. The managing authority of public investment programs shall decide on the sale of greenhouse gas emission reduction results and carbon credit certificates from such programs.
2. The sale of greenhouse gas emission reduction results and carbon credit certificates from public investment programs must obtain the opinions of the competent authority, the Ministry of Agriculture and Environment, the Ministry of Public Security, and relevant agencies or organizations. Such agencies or organizations shall respond in writing within fifteen working days from the date they receive the request for their opinion.
3. Revenue generated from the exchange of greenhouse gas emission reduction results and carbon credit certificates from public-private partnership (PPP) projects is recognized as revenue of the PPP project and managed according to the provisions of the law on investment in a public-private partnership. For PPP projects that have signed project contracts and/or financial schemes with a need for exchanging greenhouse gas emission reduction results and carbon credit certificates, the contracting authority and the investor shall adjust the project contract and/or financial scheme.
4. The funds received from the sale of greenhouse gas emission reduction results and carbon credit certificates from public investment programs are state budget revenues and shall be managed and utilized in accordance with the provisions of the law on the state budget.
Chapter II
EXCHANGE OF RESULTS OF REDUCTION AND MITIGATION OF GREENHOUSE GAS EMISSIONS, CARBON CREDITS IN THE FORMAT ACCORDING TO AGREEMENT 6.2
Article 8. Signing of Agreement 6.2
1. The Ministry of Agriculture and Environment shall take the lead in coordinating with the Ministry of Foreign Affairs, relevant sectoral ministries, and related agencies to organize negotiations and sign the Agreement 6.2 with international partners.
2. The Agreement shall include the following main contents:
a) Project registration;
b) Recognition of reduction and mitigation results of greenhouse gas emissions and issuance of carbon credits;
c) Carbon standards or methods for issuing carbon credits to be applied;
d) Financial obligations related to international exchange of reduction and mitigation results of greenhouse gas emissions, carbon credits;
e) Dispute resolution mechanism;
f) Recognition and announcement of verification units;
h) Information sharing mechanism;
i) Approval process for international transfer of reduction and mitigation results of greenhouse gas emissions, carbon credits in cases where Vietnam is the recipient.
Article 9. Registration of Projects under Agreement 6.2
1. An entity or organization desiring to register a project under Agreement 6.2 (hereinafter referred to as an "Agreement 6.2 Project") shall submit one copy of the registration application form for the project idea in one of the following forms: directly, through postal service, to the Ministry of Agriculture and Environment or online at the National E-Government Portal or the National Digital Identity Application.
2. The application package includes:
a) An application for registration of Agreement 6.2 project idea form in accordance with Model No. 01 attached as Appendix II to this Decree;
b) Copies of permits and relevant documents pertaining to the legal status, operations of the entity or organization according to requirements of the agreement and related laws and regulations;
c) Other documents as required by the agreement (if any).
Where documents referred to in paragraphs b and c of this Article are in a foreign language, they shall be accompanied by a certified translation into Vietnamese with an official stamp from the submitting entity or organization. The entity or organization submitting the application shall bear legal responsibility for the accuracy of the content of the translation.
Within two working days from receipt of the project idea registration application package, the Ministry of Agriculture and Environment shall notify in writing the entity or organization that submitted the application of one of the following: acceptance of a valid application; request for supplementation and completion if the application is not yet valid. The period for supplementation and completion is fifteen working days from the date of notification regarding the request for supplementation and completion.
3. The Ministry of Agriculture and Environment shall evaluate the project idea registration package according to the following contents: the suitability of the project idea with the list in Appendix I attached as part of this Decree and strategic development goals of the industry or region. During the evaluation process, the Ministry of Agriculture and Environment is responsible for sending the project idea registration application package to sectoral management authorities and relevant entities or organizations for comments. Within ten working days from receipt of the request for comments, the sectoral management authority and relevant entities or organizations shall respond in writing regarding the suitability of the project idea.
4. Within fifteen working days from receipt of a valid application package, the Ministry of Agriculture and Environment shall notify in writing the entity or organization that submitted the application according to Model No. 02 attached as Appendix II to this Decree of the evaluation results; if the registration is not approved, the reasons must be stated. Immediately after approving the project idea registration, the Ministry of Agriculture and Environment shall publish the project idea package on the National Registration System.
5. Within one year from the date the project idea was approved for registration, an entity or organization shall submit one copy of the application package requesting approval for project registration in one of the following forms: directly, through postal service, to the Ministry of Agriculture and Environment or online at the National E-Government Portal or the National Digital Identity Application.
6. The application package includes:
a) An application for approval of project registration according to Model No. 03 attached as Appendix II to this Decree, which shall include information about the organization representing the entities and organizations participating in the implementation of the project (hereinafter referred to as the "Representative Organization");
b) Project design documents in accordance with the carbon standards applicable under Agreement 6.2;
c) Project verification report in accordance with the carbon standards applicable under Agreement 6.2.
Where documents referred to in paragraphs b and c of this Article are in a foreign language, they shall be accompanied by a certified translation into Vietnamese with an official stamp from the submitting entity or organization. The entity or organization submitting the application shall bear legal responsibility for the accuracy of the content of the translation.
Within two working days from receipt of the project registration approval application package, the Ministry of Agriculture and Environment shall notify in writing the entity or organization that submitted the application of one of the following: acceptance of a valid application; request for supplementation and completion if the application is not yet valid. The period for supplementation and completion is fifteen working days from the date of notification regarding the request for supplementation and completion.
7. The Ministry of Agriculture and Environment shall evaluate the project registration approval application package according to the following contents: the additivity and sustainability of the project, the suitability of the carbon credit phase with the implementation of greenhouse gas emission reduction targets in Vietnam's NDC, and the contribution of the project to achieving greenhouse gas emission reduction targets in Vietnam's NDC. During the evaluation process of the project registration approval application package, the Ministry of Agriculture and Environment is responsible for sending the application package to sectoral management authorities and relevant entities or organizations for comments.
Within thirty days from the date of receipt of the application for comments, the agencies and organizations requested to provide comments are responsible for providing written comments on the contents within their scope of state management. The agency in charge of the sector is responsible for commenting on the project's compliance with the strategy, planning, development plan of the sector and field, as well as measures to reduce greenhouse gas emissions in Vietnam’s Nationally Determined Contribution (NDC). In case these agencies or organizations fail to provide comments within the aforementioned period, it shall be deemed that they agree with the content of the application for project registration approval.
8. Within forty-five days from the date of receipt of a valid application, the Ministry of Agriculture and Environment shall notify in writing the results of the evaluation to the agency or organization that submitted the application according to Form No. 04 in Appendix II attached hereto; if not approved, it must specify the reasons. Immediately after approving the project registration, the Ministry of Agriculture and Environment is responsible for publishing the project file on the National Registration System.
Article 10. Amend the scope of activities and change the participating agencies or organizations implementing the project Article 6.2
1. The agency or organization participating in the implementation of the project, after the registration application has been approved, may submit one copy of the application for amendment to the Ministry of Agriculture and Environment in one of the following forms: directly or through postal services, or online at the National Public Service Portal or the National Digital Identity Application.
2. The application shall include:
a) An application form according to Form No. 05 in Appendix II attached hereto;
b) Project design documents for amendment;
c) Project review report for amendment;
d) Copies of relevant permits and documents related to the amendment of the project's professional activities as prescribed by law;
d) Other documents submitted in accordance with the Agreement under Article 6.2 (if applicable).
Where any documents referred to in points b, c, and d of this paragraph are in a foreign language, they shall be accompanied by a certified translation into Vietnamese and stamped with the seal of the submitting agency or organization. The agency or organization submitting the application is responsible before the law for the accuracy of the content of the translation.
Within two working days from the date of receipt of the application for amendment to the project's scope, the Ministry of Agriculture and Environment shall notify in writing the representative entity on one of the following: acceptance of a valid application; request for supplementation or completion if the application is not yet valid. The period for supplementation or completion is fifteen working days from the date of notification requesting supplementation or completion.
3. The Ministry of Agriculture and Environment shall evaluate the application for amendment to the project's scope according to the contents proposed for amendment. During the evaluation process, the Ministry of Agriculture and Environment shall be responsible for sending the application for amendment to the project's scope to seek comments from the sector management agency and relevant agencies or organizations. Within fifteen working days from the date of receipt of the request for comments, the sector management agency and relevant agencies or organizations are responsible for responding in writing on contents within their scope of state management. In case these agencies or organizations fail to provide comments within the aforementioned period, it shall be deemed that they agree with the content of the application for amendment to the project's scope.
4. Within twenty-five working days from the date of receipt of a valid application, the Ministry of Agriculture and Environment shall notify in writing the representative entity on the results of the evaluation according to Form No. 06 in Appendix II attached hereto; if not approved, it must specify the reasons. Immediately after approving the amendment to the project's scope, the Ministry of Agriculture and Environment is responsible for publishing the amended project file on the National Registration System.
5. Where an agency or organization participating in the implementation of the project has a need to change the composition of participants after the registration application has been approved, the representative entity shall submit one copy of the application for amendment according to one of the following forms: directly or through postal services, or online at the National Public Service Portal or the National Digital Identity Application.
6. The application shall include:
a) An application form for project amendment according to Form No. 05 in Appendix II attached hereto;
b) A notification of termination of participation in the implementation of the project by an agency or organization (if applicable);
c) Other documents as prescribed by the Agreement under Article 6.2 (if applicable).
Where any documents referred to in points b and c of this paragraph are in a foreign language, they shall be accompanied by a certified translation into Vietnamese and stamped with the seal of the submitting agency or organization. The agency or organization submitting the application is responsible before the law for the accuracy of the content of the translation.
Within two working days from the date of receipt of the application for changing the participating agencies or organizations, the Ministry of Agriculture and Environment shall notify in writing the representative entity on one of the following: acceptance of a valid application; request for supplementation or completion if the application is not yet valid. The period for supplementation or completion is fifteen working days from the date of notification requesting supplementation or completion.
7. The Ministry of Agriculture and Environment shall organize an inspection and examination of the application for changing the participating agencies or organizations after receiving a valid application. During the process of inspection and examination, the Ministry of Agriculture and Environment shall be responsible for sending the application for changing the participating agencies or organizations to seek comments from relevant agencies or organizations. Within fifteen working days from the date of receipt of the request for comments, the relevant agencies or organizations are responsible for responding in writing on contents within their scope of state management. In case these agencies or organizations fail to provide comments within the aforementioned period, it shall be deemed that they agree with the content of the application for changing the participating agencies or organizations.
Within 25 working days from the date of receipt of a valid application, the Ministry of Agriculture and Environment shall examine and decide to approve any changes and notify the organization in accordance with Form No. 06 attached as Appendix II to this Decree; if not approved, the reasons must be clearly stated. Upon approval of the change by the relevant agency or organization, the Ministry of Agriculture and Environment is responsible for announcing it on the National Registration System.
Article 11. Measurement, Reporting, and Verification of Greenhouse Gas Emission Reduction Results for Projects under Paragraph 6.2
1. The agencies and organizations involved in implementing projects within the territory of Vietnam shall be responsible for measuring, reporting, and reducing greenhouse gas emissions from such projects according to the carbon standards applicable to the Agreement under Paragraph 6.2.
2. The reduction results of greenhouse gases from projects within the territory of Vietnam must be verified by an entity recognized by the agency or organization managing the carbon standards applicable to the Agreement under Paragraph 6.2, or another verification entity as specified in the said Agreement.
Article 12. Issuance and Recognition of Greenhouse Gas Emission Reduction Results and Carbon Credits from Projects under Paragraph 6.2
1. Agencies and organizations involved in implementing projects may request issuance and recognition of greenhouse gas emission reduction results and carbon credits from such projects. The organization representing the agency shall submit one copy of the application for issuance or recognition through either direct submission or postal service to the Ministry of Agriculture and Environment, or online via the National Public Service Portal or the National Digital Identity Application.
2. The application includes:
a) An application form for issuance and recognition of greenhouse gas emission reduction results and carbon credits according to Form No. 07 attached as Appendix II to this Decree;
b) A verification report on the reduction of greenhouse gas emissions from the project;
c) Documentation proving the issuance or recognition of greenhouse gas emission reduction results and carbon credits by the agency or organization managing the carbon standards applicable to the Agreement under Paragraph 6.2 (if applicable).
Where documents related to points b and c in this clause are in a foreign language, they must be accompanied by an authenticated translation into Vietnamese and stamped with the seal of the submitting agency or organization. The submitting agency or organization is responsible for the accuracy and correctness of the content of the translation under the law.
Within 2 working days from the date of receipt of the application for issuance or recognition of greenhouse gas emission reduction results and carbon credits, the Ministry of Agriculture and Environment shall notify the organization representing the agency in writing of one of the following: acceptance of a valid application; request for additional information if the application is not yet complete. The period to supplement or complete the application is 15 working days from the date of notification.
3. The Ministry of Agriculture and Environment shall evaluate the application for issuance or recognition of greenhouse gas emission reduction results and carbon credits after receiving a valid application. During the evaluation process, the Ministry must seek comments from the relevant management department. Within 20 working days from receipt of the request for comments, the relevant management department shall respond in writing on matters within its scope of national administrative control. If no response is received beyond this period, it is deemed to be in agreement with the content of the application.
4. Within 25 working days from the date of receipt of a valid application, the Ministry of Agriculture and Environment shall notify the organization representing the agency according to Form No. 08 attached as Appendix II to this Decree and record the quantity of greenhouse gas emission reduction results and carbon credits issued or recognized in the account of the implementing agency on the National Registration System; if not issued or recognized, the reasons must be clearly stated.
Article 13. Approval of International Transfer of Emission Reduction Results and Carbon Credits from Project under Article 6.2
1. An entity or organization participating in the implementation of a project that has a need to transfer internationally emission reduction results and carbon credits with corresponding adjustments (hereinafter referred to as "corresponding adjustment international transfer") from a project, an authorized representative shall submit an application for approval of such international transfer of emission reduction results and carbon credits according to Form No. 09 in Appendix II attached hereto, by one of the following means: directly or through postal service to the Ministry of Agriculture and Environment or online at the National E-Government Portal or the National Digital Identity Application.
2. The Ministry of Agriculture and Environment shall examine and issue a written approval for corresponding adjustment international transfer. During the examination process, the Ministry of Agriculture and Environment is responsible for seeking written opinions from the competent authority in charge of the relevant sector and other related entities or organizations. Within twenty (20) working days from the date of receipt of the request for opinion, the concerned entities or organizations shall provide written comments on matters within their scope of state management. If an entity or organization fails to provide comments within the aforementioned period, it is deemed to have agreed with the application for approval of corresponding adjustment international transfer.
Within twenty-five (25) working days from the date of receipt of the application for approval of corresponding adjustment international transfer, the Ministry of Agriculture and Environment shall notify the entity or organization that submitted the request according to Form No. 10 in Appendix II attached hereto; if not approved, the reasons must be clearly stated.
3. In case of an international transfer of emission reduction results and carbon credits without corresponding adjustments, the authorized representative shall notify the Ministry of Agriculture and Environment using Form No. 12 in Appendix II attached hereto within fifteen (15) working days from the completion of such international transfer.
Article 14. Revocation of Approval Registration Project under Article 6.2
1. The Ministry of Agriculture and Environment shall revoke the approval registration document for a project in the following circumstances:
a) The program or project activities are terminated pursuant to an investment management authority decision or a judgment, decision of the court;
b) Other cases as provided by law or under Article 6.2 Agreement.
2. Within five (5) working days from the date of revocation of approval registration, the Ministry of Agriculture and Environment shall be responsible for announcing on the National Registration System.
3. The revocation of the approval registration document does not affect the effectiveness of emission reduction results and carbon credits that have been approved for international transfer prior to the time when such approval document is revoked.
Article 15. International Transfer of Emission Reduction Results and Carbon Credits into Vietnam under Article 6.2 Agreement
1. When there is a need to use internationally transferred emission reduction results and carbon credits for implementing greenhouse gas emission reduction targets in accordance with international agreements and national commitments within the scope of management, the competent authority shall submit a proposal document to the Ministry of Agriculture and Environment for consolidation.
2. The proposal document for purchasing emission reduction results and carbon credits into Vietnam includes the following information:
a) International partner transferring emission reduction results and carbon credits;
b) Quantity and type of emission reduction results and carbon credits;
c) Entity or organization in Vietnam expected to purchase emission reduction results and carbon credits.
3. Based on the proposals from competent authorities, the Ministry of Agriculture and Environment shall take the lead, coordinate with the Ministry of Foreign Affairs, relevant competent authorities, and other related entities to negotiate and sign the Article 6.2 Agreement with the international partner.
4. Entities or organizations in Vietnam that purchase emission reduction results and carbon credits are responsible for implementing according to the provisions of the signed Article 6.2 Agreement between Vietnam and the international partner. Within fifteen (15) working days from the date of receipt of the international transfer approval document from the international partner, entities or organizations in Vietnam shall notify the Ministry of Agriculture and Environment in writing about the completion of the purchase of emission reduction results and carbon credits according to Form No. 11 in Appendix II attached hereto. The notification must be accompanied by the international transfer approval document and a certified translation into Vietnamese with an official seal.
5. The Ministry of Agriculture and Environment shall record the quantity of purchased emission reduction results and carbon credits on the National Registration System and adjust accordingly according to the provisions of the Paris Agreement.
Chapter III
INTERNATIONAL CARBON CREDIT SWAP PROGRAMS AND PROJECTS FROM PROGRAMS, PROJECTS ACCORDING TO MECHANISM ARTICLE 6.4
Article 16. Registration of Programs and Projects According to Mechanism Article 6.4
1. The registration of programs and projects according to the mechanism article 6.4 (hereinafter referred to as "Article 6.4 program or project") shall be carried out in accordance with the provisions and guidelines of the Paris Agreement.
2. An entity or organization desiring to register a program or project may submit one copy of the registration application package for programs and projects by either direct submission or through postal services to the Ministry of Agriculture and Environment, or online via the National E-Government Portal or the National Digital Identity Application.
3. The application package requesting approval for registration shall include:
a) An application form for approval of program or project registration in accordance with Form No. 03 attached as Appendix II to this Decree, which includes information on the organization representing the agencies and organizations participating in the implementation of the project (hereinafter referred to as "representative organization");
b) Design documents for programs and projects in accordance with the provisions of the mechanism article 6.4;
c) An assessment report for programs and projects in accordance with the provisions of the mechanism article 6.4.
Within two working days from the date of receipt of the application package requesting approval, the Ministry of Agriculture and Environment shall notify the entity or organization that submitted the package of one of the following: acceptance of a valid application; request for additional information if the application is not yet valid. The period to supplement or complete the application is fifteen working days from the date of receiving notification regarding the need to supplement or complete the application.
4. The Ministry of Agriculture and Environment shall organize an evaluation of the application package requesting approval according to the following contents: the added value and sustainability of the project, the compatibility of the carbon credit generation phase with the implementation of greenhouse gas reduction targets in Vietnam's NDC, and the contribution of the project to achieving the greenhouse gas reduction targets in Vietnam's NDC. During the evaluation process, the Ministry of Agriculture and Environment shall be responsible for sending the application package to seek opinions from sectoral management authorities and relevant organizations.
Within thirty days from the date of receipt of the request for comments, the entities or organizations receiving such requests are responsible for providing written comments on matters within their scope of national administrative management. The sectoral management authority is responsible for commenting on the compatibility of the project with the strategy, planning, and development plan of the industry, sector, and measures to reduce greenhouse gas emissions in Vietnam's NDC. If an entity or organization receiving such a request does not provide comments beyond the aforementioned period, it shall be deemed to have agreed to the content of the application package.
5. Within forty-five days from the date of receipt of a valid application, the Ministry of Agriculture and Environment shall notify in writing the results of the evaluation to the entity or organization that submitted the application and the UNFCCC Secretariat according to Form No. 04 attached as Appendix II to this Decree; if not approved, the reasons must be clearly stated.
6. After the program or project is approved for registration by the Article 6.4 Mechanism Supervisory Authority, the representative organization shall report on the implementation of the program or project annually before December 31 each year in accordance with Form No. 13 attached as Appendix II to this Decree.
7. In case entities and organizations participating in the implementation of the program or project have a need to cancel their registration, the representative organization shall carry out the cancellation procedures for the program or project in accordance with the provisions and guidelines of the Paris Agreement. The entity or organization is responsible for fulfilling its obligations already committed and ensuring that no new liabilities arise for the Socialist Republic of Vietnam after the cancellation.
Article 17. Amendment of Content of Activities and Change of Authorities or Organizations Participating in Implementation of Programmes, Projects under Article 6.4
1. The amendment of the content of activities of programmes, projects shall be carried out in accordance with the provisions and guidelines of the Paris Agreement.
2. Authorities or organizations participating in the implementation of programmes, projects that have a need to amend the content of their programme, project after the registration application has been approved shall submit one copy of the application for amendment in one of the following forms: directly or through postal services to the Ministry of Agriculture and Environment or online at the National E-Government Portal or the National Digital Identity Application.
3. The application includes:
a) A request form for amending the programme, project according to Model No. 05 in Appendix II attached hereto;
b) Design documents of the amended programme, project;
c) Review report on the amended programme, project;
d) Copies of relevant permits and documents related to the amendment of the professional activities of the programme, project as provided by law.
Where any of the documents referred to in points b, c, and d of this clause are in a foreign language, they shall be accompanied by a certified translation into Vietnamese with an official stamp from the submitting authority or organization. The authority or organization submitting the application shall bear legal responsibility for the accuracy of the content of the translation.
Within two working days from the receipt of the request to amend the content of the programme, project activities, the Ministry of Agriculture and Environment shall notify the representative organization in writing of one of the following: acceptance of a valid application; request for additional or improved documentation if the application is not yet valid. The period for submitting or improving the documentation is fifteen working days from the date of notification.
4. The Ministry of Agriculture and Environment shall evaluate the application to amend the content of the programme, project according to the proposed amendments. During the evaluation process, the Ministry of Agriculture and Environment shall be responsible for sending the application for amendment of the project activities to seek opinions from the competent authority and relevant organizations. Within fifteen working days from the receipt of the request for opinion, the competent authority and relevant organizations shall respond in writing on matters within their scope of state management. Where a relevant organization or entity fails to provide an opinion within the specified period, it is deemed to have agreed with the content of the application for amendment of the programme, project activities.
5. Within twenty-five working days from the receipt of a valid application, the Ministry of Agriculture and Environment shall notify the representative organization and UNFCCC Secretariat in writing of the evaluation results according to Model No. 06 in Appendix II attached hereto; if not approved, the reasons must be stated.
6. Where authorities or organizations participating in the implementation of programmes, projects have a need to change the composition of participants after the registration application has been approved, they shall submit one copy of the application for amendment in one of the following forms: directly or through postal services to the Ministry of Agriculture and Environment or online at the National E-Government Portal or the National Digital Identity Application.
7. The application includes:
a) A request form for amending the programme, project according to Model No. 05 in Appendix II attached hereto;
b) Notification of termination of participation in the programme, project by the authority or organization (if applicable).
Where this notification is in a foreign language, it shall be accompanied by a certified translation into Vietnamese with an official stamp from the submitting authority or organization. The authority or organization submitting the application shall bear legal responsibility for the accuracy of the content of the translation.
Within two working days from the receipt of the request to change the authorities or organizations participating in the implementation of the programme, project, the Ministry of Agriculture and Environment shall notify the representative organization in writing of one of the following: acceptance of a valid application; request for additional or improved documentation if the application is not yet valid. The period for submitting or improving the documentation is fifteen working days from the date of notification.
8. The Ministry of Agriculture and Environment shall review the application to change the authorities or organizations participating in the implementation of the programme, project after receiving a valid application. During the review process, the Ministry of Agriculture and Environment shall be responsible for sending the application for changing the participants to seek opinions from relevant organizations. Within fifteen working days from the receipt of the request for opinion, relevant organizations shall respond in writing on matters within their scope of state management. Where an organization or entity fails to provide an opinion within the specified period, it is deemed to have agreed with the content of the application for changing the authorities or organizations participating in the programme, project.
9. Within twenty-five working days from the receipt of a valid application, the Ministry of Agriculture and Environment shall examine and decide on the approval of the change and notify the representative organization and UNFCCC Secretariat according to Model No. 06 in Appendix II attached hereto; if not approved, the reasons must be stated.
Article 18. Issuance of Carbon Credits for Program and Project under Article 6.4
1. The issuance of carbon credits for programs and projects is carried out in accordance with the provisions and guidelines of the Paris Agreement.
2. After carbon credits from a program or project are issued by the Mechanism Supervision Agency under Article 6.4, the Ministry of Agriculture and Environment shall examine and issue an approval document for international transfer of carbon credits in accordance with the provisions of Article 19 of this Decree.
Article 19. Approval for International Transfer of Carbon Credits from Program and Project under Article 6.4
1. The agency or organization implementing a program or project that has a need to transfer internationally carbon credits shall adjust accordingly, submit one copy of the application document requesting approval for international transfer of adjusted carbon credits in any of the following forms: directly or through postal services to the Ministry of Agriculture and Environment, or online at the National Public Service Portal or the National Digital Identity Application.
2. The application includes:
a) An application form for approval of international transfer of carbon credits as specified in Form No. 09 in Appendix II issued along with this Decree;
b) A report on the assessment of greenhouse gas emission reduction results of the program or project;
c) An international transfer approval document from the foreign partner (if applicable).
In case documents specified at points b and c of paragraph 2 are in a foreign language, they shall be accompanied by an authenticated translation into Vietnamese. The agency or organization submitting the application is responsible for the accuracy and correctness of the content of the translation.
Within two working days from receipt of the application document requesting approval for international transfer of carbon credits from a program or project, the Ministry of Agriculture and Environment shall notify the implementing agency in writing of one of the following: acceptance of a valid application; request for additional completion if the application is not yet valid. The period for completing and perfecting the application is 15 working days from receipt of the notification requesting additional completion.
3. The approval for international transfer of carbon credits under Article 6.4 Mechanism shall be carried out in accordance with the procedures and formalities specified in Article 13 of this Decree.
4. In case of an international transfer of carbon credits without adjustment, the implementing agency shall notify the Ministry of Agriculture and Environment using Form No. 12 in Appendix II issued along with this Decree within 15 working days from completion of the international transfer.
Article 20. Revocation of Registration Approval Document for Program and Project under Article 6.4
1. The Ministry of Agriculture and Environment shall revoke the registration approval document for programs and projects in the following cases:
a) The investment certificate of the program or project has expired;
b) The activities of the program or project are terminated according to decisions by the state investment management authority or by a court judgment;
c) Within 12 months from the date of approval for registration by the Mechanism Supervision Agency under Article 6.4, the implementing agency fails to submit periodic reports as specified in paragraph 6 of Article 16 of this Decree.
2. Before revoking the registration approval document in cases specified at paragraph 1 of this article, the Ministry of Agriculture and Environment shall notify relevant agencies or organizations involved in the implementation of the program or project by written communication. After 60 days from sending such a notification to the agencies or organizations involved in the implementation of the program or project, the Ministry of Agriculture and Environment shall notify the UNFCCC Secretariat for cancellation of registration of the program or project.
3. The revocation of the registration approval document does not affect the validity of carbon credits that have been approved for international transfer prior to the time when the approval document is revoked.
Article 21. International Transfer of Carbon Credits from Programs and Projects under Article 6.4 to Vietnam
2. Within fifteen working days from the date of receipt of the host country's approval for the international transfer, agencies or organizations in Vietnam shall notify the Ministry of Agriculture and Environment in writing using Form No. 11 attached as Appendix II to this Decree. The notification must be accompanied by the host country's approval document for the international transfer and a certified translation into Vietnamese.
3. The Ministry of Agriculture and Environment shall record the transferred carbon credits on the National Registration System and make corresponding adjustments in accordance with the Paris Agreement provisions.
Chapter IV
EXCHANGE OF INTERNATIONAL RESULTS ON REDUCTION OF EMISSIONS OF GREENHOUSE GASES, CARBON CREDITS FROM PROGRAMS AND PROJECTS ACCORDING TO INDEPENDENT CARBON STANDARDS
Article 22. Recognition of Carbon Credit Generation Methods under Independent Carbon Standards
1. Independent carbon standards shall be considered for the recognition of carbon credit generation methods if they meet the minimum conditions below:
a) Possessing an open and transparent management system recognized internationally for project development, assessment, monitoring, and issuance of carbon credits;
b) Applying clear carbon credit generation methods that ensure additionality, sustainability, quantifiability, verifiability, and non-duplication;
c) Having a mechanism for information disclosure and receiving feedback from relevant parties;
d) Having a mechanism for connecting, sharing information, data, and technical cooperation with competent authorities of Vietnam.
2. The list of carbon credit generation methods for international transfer that are adjusted in accordance with independent carbon standards applicable in Vietnam includes:
a) Carbon credit generation methods under the carbon standard applicable to the Article 6.2 Agreements signed between Vietnam and its international partners;
b) Carbon credit generation methods under the independent carbon standards proposed by relevant ministries.
3. Relevant ministries shall be responsible for reviewing and summarizing the carbon credit generation methods that meet the independent carbon standard criteria, in line with the list in Appendix I attached to this Decree within their jurisdiction, and submit them to the Ministry of Agriculture and Environment to build a list of carbon credit generation methods for international transfer adjusted according to the applicable independent carbon standards.
4. The Ministry of Agriculture and Environment shall be responsible for publishing and updating the list of carbon credit generation methods for international transfer adjusted according to the applicable independent carbon standards on the ministry's official website.
Article 23. Registration of Independent Carbon Standard Programs and Projects
1. The registration of independent carbon standard programs and projects shall be carried out in accordance with the regulations and guidelines provided by the independent carbon management organization. Within fifteen working days from the date of receipt of the approval notification from the independent carbon management organization, the representative entity is responsible for reporting in writing to the relevant ministry and the Ministry of Agriculture and Environment about the successful registration of the project.
2. In case there are modifications to the activities, changes in the participating entities, or cancellation of the registration of an independent carbon standard program or project, the representative entity shall comply with the regulations and guidelines provided by the independent carbon management organization and report in writing to the relevant ministry and the Ministry of Agriculture and Environment along with the approval document from the independent carbon management organization.
3. After the independent carbon standard program or project is registered, the representative entity is responsible for reporting on the implementation status of the program or project annually by December 31st each year using Form No. 14 attached as Appendix II to this Decree.
4. The Ministry of Agriculture and Environment may request the independent carbon management organization to cancel the registration of an independent carbon standard program or project in the following circumstances:
a) The investment certificate for the program or project has expired;
b) The activities of the program or project have been terminated by a decision of the competent authority overseeing investment or by a judgment or decision of the court;
c) The representative entity fails to fulfill its regular reporting obligations under paragraph 3 within twelve months from the date of registration.
5. Before requesting the independent carbon management organization to cancel the registration of an independent carbon standard program or project, the Ministry of Agriculture and Environment shall notify in writing all participating agencies, organizations, and relevant ministries. After sixty days from the implementation of this notification, the Ministry of Agriculture and Environment will publish information on the cancellation of the program or project on the National Registration System and inform the independent carbon management organization to proceed with the cancellation.
5. Prior to requesting the independent carbon standards management organization to cancel the registration for a carbon standard project, the Ministry of Agriculture and Environment shall notify in writing the agencies and organizations involved in implementing the program or project as well as the sectoral manager. Sixty days after the implementation of this notification, the Ministry of Agriculture and Environment shall publish information on the cancellation of the project's registration on the National Registration System and inform the independent carbon standards management organization to proceed with the cancellation.
Article 24. Issuance of Carbon Credits for Independent Standard Carbon Projects
1. The issuance of carbon credits for independent standard carbon projects shall be carried out in accordance with the provisions and guidelines of the Independent Standard Carbon Management Organization.
2. After the carbon credits from the independent standard carbon project are issued, the representative organization shall notify the sector management department and the Ministry of Agriculture and Environment.
Article 25. Approval for International Transfer of Mitigation Results of Greenhouse Gas Emissions, Carbon Credits from Independent Standard Carbon Projects
1. An entity or organization participating in the implementation of an independent standard carbon project that has a need to transfer internationally the mitigation results of greenhouse gas emissions and carbon credits adjusted accordingly from such projects shall submit one copy of the application for approval of international transfer of mitigation results of greenhouse gas emissions, carbon credits adjusted accordingly by any of the following methods: directly or through postal services to the Ministry of Agriculture and Environment or online at the National Public Service Portal or the National Digital Identity Application.
2. The application shall include:
a) An application for approval of international transfer of mitigation results of greenhouse gas emissions, carbon credits in accordance with Form No. 09 attached as Appendix II to this Decree;
b) A report on the verification of the mitigation results of greenhouse gas emissions from the project;
c) A copy of the international transfer approval document from the foreign partner (if applicable).
Where documents referred to in points b and c of paragraph 2 of this Article are in a foreign language, they shall be accompanied by an authenticated translation into Vietnamese. The entity or organization submitting the application shall bear legal responsibility for the accuracy and correctness of the content of the translation.
Within two working days from the receipt of the application for approval of international transfer of mitigation results of greenhouse gas emissions, carbon credits from independent standard carbon projects, the Ministry of Agriculture and Environment shall notify the representative organization in writing of one of the following: acceptance of a valid application; request for additional or improved documentation if the application is not yet valid. The period for submitting or improving the documentation is fifteen working days from the date of notification requesting such submission or improvement.
3. Approval for international transfer of mitigation results of greenhouse gas emissions, carbon credits from independent standard carbon projects shall be carried out in accordance with the procedures and formalities specified in Article 13 of this Decree.
4. In case of an international transfer of mitigation results of greenhouse gas emissions, carbon credits without adjustment, the representative organization shall notify by Form No. 12 attached as Appendix II to this Decree to the Ministry of Agriculture and Environment within fifteen working days from the completion of the international transfer.
5. The Ministry of Agriculture and Environment shall only consider and approve the international transfer of mitigation results of greenhouse gas emissions, carbon credits adjusted accordingly for independent standard carbon projects applying a carbon credit creation method specified in paragraph 2 of Article 22 of this Decree.
Article 26. International Transfer of Carbon Credits from Standard Independent Programs to Vietnam
1. The international transfer of carbon credits from standard independent programs to Vietnam shall apply only to entities in Vietnam that are a party to the standard independent program abroad. When implementing the international transfer of carbon credits from standard independent programs, entities in Vietnam shall comply with the laws of the host country.
2. Within fifteen working days from the date of receipt of the host country's approval for the international transfer, the entity in Vietnam shall notify the Ministry of Agriculture and Environment Management in writing using Form No. 11 attached as Appendix II to this Decree. The notification must be accompanied by the host country's approval document for the international transfer and a certified translation into Vietnamese with an official seal.
3. The Ministry of Agriculture and Environment Management shall record the transferred carbon credits on the National Registration System and adjust accordingly in accordance with the Paris Agreement provisions.
Chapter V
INTERNATIONAL EXCHANGE OF REDUCTION OF EMISSIONS OF GREENHOUSE GASES, CARBON CREDITS TO IMPLEMENT THE GOAL OF REDUCING EMISSIONS OF GREENHOUSE GASES IN ACCORDANCE WITH INTERNATIONAL AGREEMENTS AND NATIONAL COMMITMENTS
Article 27. Reduction of greenhouse gas emissions and carbon credits transferred to implement the goal of reducing greenhouse gas emissions in accordance with international agreements and national commitments
1. The reduction of greenhouse gas emissions and carbon credits transferred to implement the goal of reducing greenhouse gas emissions in accordance with international agreements and national commitments include:
a) Carbon credits from programs and projects under Article 6.4;
b) Reductions of greenhouse gas emissions and carbon credits from programs and projects according to independent carbon standards recognized by international agreements and national commitments.
2. The entity in charge of implementing the international agreement or national commitment shall update the list of recognized independent carbon standards, publish it on the official website of the entity in charge of implementing the international agreement or national commitment.
Article 28. Approval for International Transfer of Reductions of Greenhouse Gas Emissions and Carbon Credits to Implement the Goal of Reducing Greenhouse Gas Emissions in Accordance with International Agreements and National Commitments
1. Entities participating in programs and projects that generate reductions of greenhouse gas emissions and carbon credits as specified under points a) and b) of paragraph 1 of Article 27 of this Decree, if they have the need to transfer internationally such reductions of greenhouse gas emissions and carbon credits with corresponding adjustments for implementing the goal of reducing greenhouse gas emissions in accordance with international agreements and national commitments, shall submit one copy of an application file requesting approval for the international transfer of reductions of greenhouse gas emissions and carbon credits with corresponding adjustments through either direct submission or postal service to the Ministry of Agriculture and Environment Management or online via the National Public Service Portal or the National Digital Identity Application.
2. The application file shall include:
a) An application for approval of international transfer of reductions of greenhouse gas emissions and carbon credits in accordance with Form No. 09 attached as Appendix II to this Decree;
b) A report on the verification of the reduction of greenhouse gas emissions from the program or project.
In case the verification report is in a foreign language, it shall be accompanied by an official certified translation into Vietnamese with an official seal. The entity submitting the application file shall bear legal responsibility for the accuracy and correctness of the content of the translation.
Within two working days from the date of receipt of the application file requesting approval for international transfer of reductions of greenhouse gas emissions and carbon credits to implement the goal of reducing greenhouse gas emissions in accordance with international agreements and national commitments, the Ministry of Agriculture and Environment Management shall notify the representative entity in writing regarding one of the following cases: acceptance of a valid application; request for additional or complete information if the application is not yet valid. The deadline for submitting or completing the application is fifteen working days from the date of receiving the notification requesting additional or complete information.
3. The Ministry of Agriculture and Environment Management shall examine and issue an approval document with corresponding adjustments. During the examination process, the Ministry shall seek written opinions from relevant authorities, entities in charge of implementing international agreements, and related organizations. Within ten working days from receiving the request for opinion, the relevant organizations must provide written comments on matters within their scope of national management. If no response is received beyond the specified period, it will be considered as agreement with the application file.
Within fifteen working days from the date of receipt of an application file with corresponding adjustments, the Ministry of Agriculture and Environment Management shall notify in writing to the entity that submitted the application, the recipient of the transfer, and the entity in charge of implementing international agreements or national commitments using Form No. 10 attached as Appendix II to this Decree; if not approved, the reasons must be clearly stated.
4. The provisions herein shall apply only to cases where the recipient is entities in Vietnam that are obligated to comply with and implement the goals of reducing greenhouse gas emissions in accordance with international agreements and national commitments.
Article 29. Transfer of international results of greenhouse gas emission reduction and carbon credit to Vietnam for the purpose of achieving national targets for greenhouse gas emission reduction in accordance with international agreements and international commitments
1. Entities and organizations within Vietnam have the obligation to achieve national targets for greenhouse gas emission reduction in accordance with international agreements and international commitments by purchasing results of greenhouse gas emission reduction and carbon credits specified at points a and b of Clause 1, Article 27 of this Decree from programs and projects implemented in other countries to achieve national targets for greenhouse gas emission reduction in accordance with international agreements and international commitments.
2. Within fifteen working days from the date of receipt of the international transfer approval document from the host country, entities and organizations within Vietnam shall notify in writing to the Ministry of Agriculture and Rural Development using Form No. 11 attached as Appendix II to this Decree. The notification must be accompanied by the international transfer approval document from the host country and a certified translation into Vietnamese stamped by the entity or organization.
3. The Ministry of Agriculture and Rural Development shall record the transferred results of greenhouse gas emission reduction and carbon credits in the National Registry System and make corresponding adjustments in accordance with the provisions of the Paris Agreement.
Chapter VI
ORGANIZATION AND CONDITIONS FOR IMPLEMENTATION
Article 30. Responsibilities of Ministries
In addition to the responsibilities stipulated in this Decree and other relevant legal documents, the Ministries of Agriculture and Rural Development, Industry and Trade, Construction, Finance shall have the following responsibilities:
1. The Ministry of Agriculture and Rural Development shall unify management of international exchange activities of greenhouse gas emission reduction results and carbon credits; take the lead in monitoring the implementation of this Decree.
2. The Ministry of Agriculture and Rural Development shall coordinate with the Ministry of Industry and Trade, the Ministry of Construction, the Ministry of Public Security, provincial people's committees to inspect compliance with laws related to international exchange activities of greenhouse gas emission reduction results and carbon credits.
3. The Ministry of Industry and Trade and the Ministry of Construction shall cooperate in providing technical expertise for content relevant to their functions and responsibilities during the implementation of this Decree.
4. The Ministry of Finance shall be responsible for developing financial regulations related to activities involving exchange of greenhouse gas emission reduction results and carbon credits.
Article 31. Responsibilities of Provincial People's Committees
1. Provide relevant information and data on programs and projects participating in international exchanges of greenhouse gas emission reduction results and carbon credits within their jurisdiction as requested by competent state authorities.
2. Coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, the Ministry of Construction to inspect activities involving international exchanges of greenhouse gas emission reduction results and carbon credits within their jurisdiction.
3. Direct departments and agencies to promote and guide residents and businesses on international exchanges of greenhouse gas emission reduction results and carbon credits within their jurisdiction.
4. Organize monitoring and inspection, as authorized, of the implementation of programs and projects participating in international exchanges of greenhouse gas emission reduction results and carbon credits within their jurisdiction.
Article 32. Enforceability
1. This Decree shall take effect from May 19, 2026.
2. The provisions numbered 2, 4, 5 and 6 of Article 20a of Decree No. 06/2022/NĐ-CP dated January 7, 2022 by the Government on reducing greenhouse gas emissions and protecting the ozone layer, as amended and supplemented by Decree No. 119/2025/NĐ-CP dated June 9, 2025, are hereby repealed.
3. The Ministers, Heads of agencies at the same level, Chairmen of People's Committees of provinces, and relevant organizations, entities, and individuals shall be responsible for implementing this Decree.
