JOINT CIRCULAR
Amending and supplementing Circular Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH dated September 27, 2007 guiding the content and expenditure levels for verification, reception, and support activities for women and children repatriated from abroad to reintegrate into society pursuant to Decision No. 17/2007/QĐ-TTg dated January 29, 2007 of the Government's Prime Minister.

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decision No. 17/2007/QĐ-TTg dated January 29, 2007 of the Government's Prime Minister approving the Regulation on receiving and supporting the reintegration into society of women and children repatriated from abroad.
The Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs amend and supplement Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH dated September 27, 2007 of the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs guiding the content and expenditure levels for verification, reception, and support activities for women and children repatriated from abroad to reintegrate into society as follows:
Article 1. Replace the content of point c, Clause 3, Section II of Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH with the following content:
c) Expenditure for counseling, psychological support, educational, health, and vocational guidance activities at support centers.
Article 2. Replace the content of Clause 2, Section III of Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH with the following content:
a) Victims, after being received at reception centers or support centers, shall be considered for a one-time allowance for clothing and essential personal items. The expenditure level shall be based on the actual prices in each locality but not exceeding 200,000 VND/person.
b) Women's hygiene expenses at a rate of 20,000 VND/person/month.
c) Food expenses at a rate of 20,000 VND/person/day.
d) During the stay at reception centers or support centers, if victims fall ill and require treatment to recover their health, they will be considered for assistance with medical examination and medication costs; in cases where they suffer from serious illnesses that exceed the treatment capacity of the center and need to be transferred to state hospitals for treatment, the costs of medical examination, medication, and hospitalization during the stay will be supported by the head of the reception center or support center. The maximum amount does not exceed 1,000,000 VND/person/treatment period.
e) In cases where victims die during their stay at reception centers or support centers, after obtaining conclusions from competent authorities, if relatives do not arrive within 24 hours or do not have the conditions for burial, the head of the reception center or support center shall be responsible for organizing the funeral. The funeral expense is 3,000,000 VND/person.
g) Allowance for food expenses during travel is 20,000 VND/person, with a maximum duration of up to 5 days.
h) The level of support for transportation costs is calculated based on the actual distance traveled and the fare for public transport vehicles. Reception centers and support centers are responsible for purchasing tickets for victims.
In cases where victims are children and there are no relatives to pick them up, support centers shall arrange staff to escort the children back to their place of residence or contact the labor, invalids, and social affairs authority in the child's place of residence to receive them.
i) The remuneration level for experts providing counseling and psychological support to victims is 50,000 VND/session, with a maximum of up to 20 sessions.
Article 3. Replace the content of point a and point b, Clause 4, Section III of Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH with the following content:
a) Victims who belong to poor households (according to poverty standards issued by the Government's Prime Minister at different times) or whose families are in particularly difficult circumstances (confirmed by the Chairman of the People's Committee at the commune level) shall be considered for initial hardship allowances with a minimum amount of 1,000,000 VND/person.
b) Victims who wish to learn a trade shall be considered for a one-time funding for vocational training with an amount of 1,000,000 VND/person/training course.
Article 4. Replace Clause 1, Section IV of Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH with the following content:
1. Procedures for disbursing support for victims to reintegrate into society:
To receive the support for reintegration into society as prescribed in Section III of Joint Circular No. 116/2007/TTLT-BTC-BLDTBXH and Article 2, Article 3 of this Joint Circular, victims or families with children who are victims must submit an application to the People's Committee at the commune level within 12 months (from the date the competent authority issues the Certificate of Return to Vietnam).
Based on the application, the People's Committee at the commune level shall establish a file requesting support for victims (model 02 attached to the Circular) and send it to the Department of Labor, Invalids, and Social Affairs at the district level.
The Department of Labor, Invalids, and Social Affairs at the district level shall consolidate and review the files and prepare a request letter (with attached files) to be sent to the Department of Labor, Invalids, and Social Affairs at the provincial level. Based on the application and the request file, the Department of Labor, Invalids, and Social Affairs at the provincial level shall consider and decide on the disbursement of support for victims according to the prescribed regulations.
Article 5. Effectiveness
This Circular takes effect 45 days from the date of signature.
During the implementation process, if there are difficulties, please promptly reflect them to the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs for research and amendment. /./
