RESOLUTION
ON STANDARDS AND CONDITIONS FOR THE ESTABLISHMENT OF ETHNIC MINORITY COMMITTEES OF PROVINCE, DISTRICT, CITY-DISTRICT, AND CITY-COUNTY PEOPLE'S COUNCILS

On the basis of the Constitution of the Socialist Republic of Vietnam;
WHEREAS, the Law on Local Administration No. 77/2015/QH13;
Considering the proposal of the Government at the Report No. 03/TTr-CP dated January 7, 2016,
RESOLUTION:
Article 1. Standards and conditions for the establishment of ethnic minority committees of provincial People's Councils
1. An ethnic minority committee of a provincial People's Council shall be established when two out of the three following standards and conditions are met:
a) The province has more than 20,000 ethnic minorities living together in village and hamlet communities;
b) The province has more than 5,000 ethnic minorities who need concentrated assistance and support from the State for development;
c) The province has ethnic minorities residing in areas critical to national security and defense; areas with intercropping and intermixed populations; border areas with a large number of ethnic minorities from both Vietnam and neighboring countries frequently crossing back and forth.
2. For provinces where ethnic minorities reside but do not meet the standards and conditions for establishing an ethnic minority committee as stipulated in Clause 1 of this Article, the Cultural-Social Committee of the provincial People's Council shall perform tasks related to ethnic affairs.
Article 2. Standards and conditions for the establishment of ethnic minority committees of district, city-district, and city-county People's Councils
1. An ethnic minority committee of a district, city-district, or city-county People's Council shall be established when one of the following two standards and conditions is met:
a) The district, city-district, or city-county has more than 5,000 ethnic minorities who need concentrated assistance and support from the State for development;
b) The district, city-district, or city-county has ethnic minorities residing in areas critical to national security and defense; areas with intercropping and intermixed populations; border areas with a large number of ethnic minorities from both Vietnam and neighboring countries frequently crossing back and forth.
2. For districts, city-districts, or city-counties where ethnic minorities reside but do not meet the standards and conditions for establishing an ethnic minority committee as stipulated in Clause 1 of this Article, the Economic-Social Committee of the district, city-district, or city-county People's Council shall perform tasks related to ethnic affairs.
Article 3. Effectiveness
1. This Resolution shall take effect from the date of signature.
The Government, People's Councils, People's Committees of provinces and centrally governed cities, and relevant agencies and organizations shall be responsible for implementing this Resolution.
